The Zoning Code Review Committee Meeting of February 16, 1994
discussed the possiblities of allowiig/disallowing the use of a
single family home as a daycare center for up to ten children.
After much discussion the Commit4e voted unanimously to allow
five children as the code now reads .
Discussions included overcrow4 ng a three-bedroom home,
traffic in and out of the property , h�urs of operation, and state
(HRS) requirements .

BACKGROUND:
The applicant currently operatesla child care service in
her home on Sargo Road ( RS-1 zoning district ) . She keeps only
five children which falls below the threshold necessary to
classify her as a "Child Care Facility" by the definitions in
the Zoning Code. Because she falls below the threshold number
of children, she is not required to atain an occupational
license . She proposes to expand her pperation to accommodate
ten children which will then become a` "Child Care Facility" by
definition. The RS-1 district does n )t list that type of use as
either a Permitted Use or as a Use-by-Exception.
The applicant applied for a Use- y-Exception as a Home
Occupation which is a Use-by-Exceptio in the RS-1 district .

The RS districts do not permit Czild Care Facilities while
the RG districts permit them as Uses- Dy-Exception . Both types
of districts permit the operation of lome Occupations as
Use-by-Exceptions ( separately from Child Care ) . This means that

Acting Chairman Robert Frohwein called the meeting to order
and asked for approval of the minutes from the meeting of December
21 , 199j . Upon motion duly made and seconded the minutes were
approved.
NEW BUSINESS:

I . Application for Variance filed by New Community Baptist Church
to construct an addition to the church that will encroach the rear
yard setbace of property located at E4 Lewis Street .
Rev. James Jennings introduced himself to the board and explained
that the variance was requested to allow the construction of an
addition to the rear of the church to serve as as a pastor's study
and prayer room.
Contractor Robert Lawrence introduc d himself to the board and
stated that a prior variance had bee granted for an addition to
the old church building but durinconstruction it revealed
extensive damage and it was necessaryto construct a new church.
After discussion regarding alternative construction plans for which
a variance would not be required, Mr, Frohwein moved to deny the
variance. Mrs . Walker seconded the motion and the variance was
denied by a vote of 5 - 1 .
II . Application for Use-by-Exception filed by Sarah B. Jackson to
operate a daycare business at propert located at 458 Sargo Road.

The Chairman pointed out that a daycare business was not listed as
a use by exception under the RS-1 zo ing district and therefore it
was his opintion that the board coul4 not act upon the application.
After discussion by the board and several members of the audience
who use Mrs . Jackson's services, Mr. McGowan moved to recommend to
the City Commission the the use by exception be denied due to the
fact that a daycare center is not a listed use by exception in a
RS-1 zoning district . Mrs . Gregg s conded the motion and it was
unamimously approved. 7
III . The board discussed various additions or amendments to the
Application for Variance form now being used. The general
concensus of the board was that the applicant be informed of the
intent of the ordinances under which the board could act upon.
They also agreed that the section of the ordinance be shown on the
application and that the ownerand/or applicant be listed
separately when applicable.
IV. The' Chairman called for electio of new officers . Thereupon,
Don Wolflson and Robert Frohwein were elected to serve as Chairman
and Vice Chairman respectively.
There being no further business to come before the board on motion
duly made the meeting was adjourned.

purpose of measuring,setbacks shall be determined b measuring from any vertical support of
a covered roof section to the nearest point to the lot line.
Building, principal shall mean a building in whi h is conducted the main or principal use
of the lot or parcel on which the building is situated.
Building setback shall mean the minimum horizontal distance between the front, rear or
side lines of the lot and the front, rear or side lines of the building. When two(2)or more lots
under one ownership are used, the exterior property Ilines so grouped shall be used in deter-
mining building setback when the interior commo lot line is straddled by the principal
structure.
Bulkhead shall mean a structure separating land and water areas, primarily designed to
resist earth pressures.
Car wash shall mean an area of land and/or a structure with machine or hand operated
facilities, used principally for the cleaning, washing, olishing or waxing of motor vehicles.
Cemetery shall mean land used or intended to bye used for the burial of the animal or
human dead and dedicated for cemetery purposes, including crematories, mausoleums and
mortuaries, if operated in connection with and within the boundaries of such cemetery.
Center line, street shall mean a line running parallel with the highway right-of-way,
which is half the distance between the extreme edges of the official right-of-way width.
Certificate of completion shall mean that certificate issued by the city subsequent to final
inspection that all improvements have been completed in conformity with the requirements of
this chapter and the approved construction plans and specifications.
Certificate of ownership shall mean an opinion "f title of a licensed attorney or title
company certifying to the city commission, based upor an examination of an abstract of title
of the Official Records of Duval County, stating that te applicant is the owner in fee simple
to the tract submitted for subdivision.The certificates all also state the names and nature of
all liens, mortgages and encumbrances against the titl to said tract, if any.
Certified survey shall mean a survey, sketch plan, map or other exhibit containing a
written statement regarding its accuracy or conformi y to specified standards certified and
signed by the registered surveyor under whose supervi 3ion said survey was prepared.
Change of occupancy shall mean discontinuance of an existing use and the substitution of
a different kind or class of use.
Child care center shall mean any establishment whch provides care for more than five(5)
children unrelated to the operator and which receives payment, fee or grant for any of the
children receiving care wherever operated and whether or not operated for profit. The term
child care center shall include day nurseries,day care rvices and day care agencies, but not
community-based residential facilities.
Church shall mean a building used for nonprofit purposes by a recognized or established
religion as its place of worship. Such building may include a residential area for the pastor or
minister of a sect. I
Clinic shall mean an establishment where patients, who are not lodged overnight, are
admitted for examination and treatment by one(1)persc n or a group of persons practicing any

governmental functions. Any lawful activity is permitted without restriction. Any lands used
by a government which is converted to private ownei ship shall comply with the requirements
of the zoning district.
Grade shall mean the finished elevation of a ite after all fill, land balancing or site
preparations have been completed.
Group care home shall mean any dwelling, building or other place, occupied by seven(7)
or more persons,including staff,whether operated for profit or not,which provides for a period
exceeding twenty-four(24)hours, one or more personal services for persons not related to the
owner or administrator by law, blood, marriage oi adoption, and not in foster care, who
require such services. The personal services, in addition to housing and food services, may
include but not be limited to personal assistance with bathing, dressing, housekeeping, adult
supervision,emotional security,and other related services but not including medical services.
Guest cottage shall mean living quarters within a detached accessory building located on
the same lot or parcel of land as the main building, ased exclusively for housing members of
the family occupying the main building and their nonpaying guests. Such quarters shall not
be rented or otherwise used as a separate dwelling.
Height of building shall mean the vertical distance from the established grade at the
center or front of a building to its highest point of the roof or parapet.
Home occupation shall mean any use conducted entirely within a dwelling and carried on
by an occupant thereof, which use is clearly incidental and secondary to the use of the

dwelling for dwelling purposes and does not change the character thereof.
Hospital shall mean any institution, including a sanitarium, which maintains and oper-
ates facilities for overnight care and treatment of two (2) or more unrelated persons as
patients suffering mental or physical ailments, but not including any dispensary or first-aid
j; treatment facilities maintained by a commercial or industrial plant, educational institution,
convent or convalescent home, as previously defined.
Hotel, motel, motor lodge or tourist court shall nan a building as licensed by the state
containing individual guest rooms for which daily or weekly lodging is provided as the more
or less transient residence of individuals, and ingress and egress to and from all rooms are
made through an inside lobby.
House trailer. See Mobile home.

Institutional use shall mean the structure and/or land occupied by a group, cooperative,
board, agency organization created for the

Junk shall mean inoperative,dilapidated,abandoned or wrecked materials,including but

(a) Intent. The RS-1 districts are intended for development of low density single-family
residential areas.

i, Intent. To recognize the need for people to cnduct small-scale home occupations, which
are incidental to the primary use of the residenc , while preserving the character of residen-
tial neighborhoods and minimizing traffic and no residential disturbances.
I (a) A home occupation that is solely used fo� the purpose of receiving phone calls and
t keeping business records in connection with anyl profession or occupation or any business
activity of a sedentary nature, as listed in (7) b low, shall be permitted in all residential
districts and shall require a "convenience licens ." Service occupations including, but not
e g
limited to beauty salon/barber (limited to one op ator), carpenters, minor contractors doing
remodeling or home repairs, wall papering, floor covering or tile work, cosmetic sales, pet
grooming, repairmen (household appliances), travel agents,
painters, window cleaners, and
maid or lawn service,shall also be permitted,provJ ded no more than one vehicle is used in the
business and the applicant can meet all other onditions provided herein. The following
occupations shall not be permitted as home occupations: Escort/introduction service, massage
i therapist, welding, vehicle repair, manufacturing such as cabinet making, or upholstering.
Home occupations shall not be permitted in area3 which are restricted by deed when such
documents are recorded in the public records of Du al County and on file with the city clerk of
the City of Atlantic Beach. All other business activities shall be restricted to the commercial
1, districts. The following regulations shall apply to home occupations:

(1) The address of the home occupation sh Il not appear in the telephone book, on
9 letterhead checks or any type of advertising.
(2) No one other than immediate family m mbers residing on the premises shall be
r involved in the occupation. There shall be a limit of one license per person, and no
e more than two(2)licenses per household. home occupation shall be nontransferable.

(3) All business activities conducted on the licensed premises shall be conducted entirely
within the dwelling. There shall be no outside storage or outside use of equipment or
is
materials.
,y (4) No more than one (1) room of the dwellin shall be used to conduct the occupation,
provided the area of that room does not a Geed twenty-five (25) percent of the total
11 living area of the dwelling.
(5) No external sign or evidence that the dwel ing is being used for the home occupation

shall be allowed.
k, (6) There shall be no pedestrian or vehicular taffic, noise, vibration, glare, fumes,odors
a or electrical interference as a result of the ome occupation.
ct (7) The following are typical occupations that are acceptable as home occupations: Ac-
'y countant, architect, artist, attorney, book eeper, consultant, auctioneer, seamstress
or tailor, insurance agent, music instructor, photographer, piano tuner, real estate
agent, secretarial services, telephone ans ering service, hobby/crafts (not involving
heavy equipment).

(8) If at any time there is a complaint of noncompliance of the above which is sustained,
the convenience license shall be revoked.
(b) Home occupations existing at the time this section is adopted will comply substan-
tially with the standards of this section on or before April 1, 1990.

Sec. 24161. Off-street parldng and loading.
(a) General. Minimum off-street vehicular parkinj spaces shall be provided at the time of
the construction of any main building for the uses dese ibed in this section.The facilities shall
be arranged for convenient access and safety of ped 'ans and vehicles; shall be paved,
adequately drained and maintained in a dustproof ndition; shall provide barriers when
located at the perimeter of the lot to prevent encroachment on to adjacent property;and when
lighted, lights shall be directed away from adjacent property. Parking areas and driveways
shall not obstruct storm water drainage swales,gutter'ng,etc.
(b) Plans required A plan shall be submitted wi the application for a building permit
for any building requiring off-street parking and loading with accurate dimensions for park-
ing and loading spaces, access aisles and driveways and location of parking and loading in
relationship to the buildings or uses to be served.
(c) Measurement Where floor area determines he amount of off-street parking and
loading required,the floor area of a building shall be I he sums of the gross horizontal area of
every floor of the building, using exterior wall dimensions. In places of public assembly in
which occupants utilize benches,pews or similar seating,each twenty-four(24)lineal inches of
such seating shall be considered one (1) seat. When c mputations result in requirement of a
fractional space, a fraction equal to or more than one-]ialf shall require a full space.
(d) Uses not specifically mentioned Requiremen for off-street parking and loading for
uses not specifically mentioned in this section shall be the same as required for the most
similar to the one sought, it being the intent of thiarticle to require all uses to provide
off-street parking and loading.
(e) Location: I
(1) Parking spaces for dwellings shall be located on the same property with main build-
ing to be served,where feasible.
(2) Parking spaces for other uses shall be provided on the same lot or not more than four
hundred(400)feet away.

After learning that you were considering granting approval of a day care center to be operated in my residential
neighborhood I felt the need to write and state my objections to I bix issue.
I purchased a residence in the royal palms neighborhood ton Yejws ago when first moving to the beaches area because
it was affordable, and I thought it may have some long term gr#th potential.I strongly feel that allowing any
commercial business In the neighborhood would eventually lead to further declining property values.
I realize the need for child care and am sympathetic to Ms.J 's request,but I can't see how any one can
effectively run a child care business in any of these homes. The homes in the neighborhood range from 1100 to 1350
sq.it I am not sure about the state and local requirements but s Ms.Jackson's residence conform with state or
local guidelines?
Is there adequate recreation equipment on sfte?Is there adequa�e room for 10-15 children to be Inside on a rainy day?
Is there adequate kitchen facilities to feed these children?
I feel if you allow this child care center to operate in a residential neighborhood you will be opening the flood gates
throughout the city of Atlantic Beach for all kinds of requests to nwrate commercial business's from residential
homes,Further more I ask would you consider this if it were y neighborhoods.
In dosing I would ask that this tetter be kept in confidence and i ot made public,my home has been burglarized twice
In the past ten years and I realize that my opinions of this mattei my not be popular,publkbdnng them would only
subject myself and my property to negative repercussion.

I am in receipt of your letter dated February 21 , 1994 . I
apologize for not responding to you sooner.
I can appreciate your concerns and views regarding Ms . Jackson
providing day care facilities at he� residence . However, based on
the research of Ms . Jackson and staff, the use of her home for
child care was grandfathered in as 'she was doing this long before
the enactment of the current zoning code restricted this activity.
In light of that , she will be permitted to continue the use of
her home for child care with restrictions on the number of children
and all requirements will be properLy supervised. We were assured
at the public hearing that the sup rvision would be adequate and
comply with all city, county and sate regulations .
Thank you for your letter and a ain I appreciate your concerns
and interest in this matter.

Dear Mr. Mayor and Fellow City Council Members;
After atending the last monthly meeting at CIty Hall,
I felt compelled to write and express my views and objections.
I realize that Ms. Jackson is doinga fine job of caring for
these children; however, I feel tha five ( 5) children should
be the limit for any woman to carry V, or. I realize that she has
violated the city ordinance regardi g the number of children
allowed in her home in the past wit out reprimand; however, I
feel that it should not be overlook d any longer. Enclosed is
a picture taken from last week' s Be ches Leader - please note
the number of little heads.
Saveral residents spoke on her beha f, all of whom she provides
day care services for; however these people do not live on the
street or own property in the area. € I purchased a residence
nine years ago at 439 Sargo Road and Ms. Jackson was providing
day care services at that time. The traffic resulting from
parents leaving and picking up thei children at all hours of
the day and night was, and still is a nuisance.
In closing, I feel that relaxation of this ban would be a real
mistake.
