After much discussion the Commit4e voted unanimously to allow five children as the code now reads . Discussions included overcrow4 ng a three-bedroom home, traffic in and out of the property , h�urs of operation, and state (HRS) requirements . She keeps only five children which falls below the threshold necessary to classify her as a "Child Care Facility" by the definitions in the Zoning Code. Because she falls below the threshold number of children, she is not required to atain an occupational license . She proposes to expand her pperation to accommodate ten children which will then become a` "Child Care Facility" by definition. The RS-1 district does n )t list that type of use as either a Permitted Use or as a Use-by-Exception. The applicant applied for a Use- y-Exception as a Home Occupation which is a Use-by-Exceptio in the RS-1 district . 4 { RECOMMENDATION: k k E The RS districts do not permit Czild Care Facilities while the RG districts permit them as Uses- Dy-Exception . Both types of districts permit the operation of lome Occupations as Use-by-Exceptions ( separately from Child Care ) . This means that Child Care Facilities are intended to be treated differently than Home Occupations . k The Community Development Board unanimously voted to deny this request based upon the fact that the proposed use is not a listed Use-by-Exception in the RS-1 zoning district and is not a Home Occupation. James Jennings introduced himself to the board and explained that the variance was requested to allow the construction of an addition to the rear of the church to serve as as a pastor's study and prayer room. Contractor Robert Lawrence introduc d himself to the board and stated that a prior variance had bee granted for an addition to the old church building but durinconstruction it revealed extensive damage and it was necessaryto construct a new church. After discussion regarding alternative construction plans for which a variance would not be required, Mr, Frohwein moved to deny the variance. Mrs . Walker seconded the motion and the variance was denied by a vote of 5 - 1 . II . Application for Use-by-Exception filed by Sarah B. Jackson to operate a daycare business at propert located at 458 Sargo Road. E i f k The Chairman pointed out that a daycare business was not listed as a use by exception under the RS-1 zo ing district and therefore it was his opintion that the board coul4 not act upon the application. After discussion by the board and several members of the audience who use Mrs . Jackson's services, Mr. McGowan moved to recommend to the City Commission the the use by exception be denied due to the fact that a daycare center is not a listed use by exception in a RS-1 zoning district . Mrs . Gregg s conded the motion and it was unamimously approved. 7 III . The board discussed various additions or amendments to the Application for Variance form now being used. The general concensus of the board was that the applicant be informed of the intent of the ordinances under which the board could act upon. They also agreed that the section of the ordinance be shown on the application and that the ownerand/or applicant be listed separately when applicable. IV. The' Chairman called for electio of new officers . Thereupon, Don Wolflson and Robert Frohwein were elected to serve as Chairman and Vice Chairman respectively. Building setback shall mean the minimum horizontal distance between the front, rear or side lines of the lot and the front, rear or side lines of the building. When two(2)or more lots under one ownership are used, the exterior property Ilines so grouped shall be used in deter- mining building setback when the interior commo lot line is straddled by the principal structure. Bulkhead shall mean a structure separating land and water areas, primarily designed to resist earth pressures. Certificate of ownership shall mean an opinion "f title of a licensed attorney or title company certifying to the city commission, based upor an examination of an abstract of title of the Official Records of Duval County, stating that te applicant is the owner in fee simple to the tract submitted for subdivision.The certificates all also state the names and nature of all liens, mortgages and encumbrances against the titl to said tract, if any. Guest cottage shall mean living quarters within a detached accessory building located on the same lot or parcel of land as the main building, ased exclusively for housing members of the family occupying the main building and their nonpaying guests. Such quarters shall not be rented or otherwise used as a separate dwelling. Height of building shall mean the vertical distance from the established grade at the center or front of a building to its highest point of the roof or parapet. Home occupation shall mean any use conducted entirely within a dwelling and carried on by an occupant thereof, which use is clearly incidental and secondary to the use of the P� dwelling for dwelling purposes and does not change the character thereof. Service occupations including, but not e g limited to beauty salon/barber (limited to one op ator), carpenters, minor contractors doing remodeling or home repairs, wall papering, floor covering or tile work, cosmetic sales, pet grooming, repairmen (household appliances), travel agents, painters, window cleaners, and maid or lawn service,shall also be permitted,provJ ded no more than one vehicle is used in the business and the applicant can meet all other onditions provided herein. The following occupations shall not be permitted as home occupations: Escort/introduction service, massage i therapist, welding, vehicle repair, manufacturing such as cabinet making, or upholstering. Home occupations shall not be permitted in area3 which are restricted by deed when such documents are recorded in the public records of Du al County and on file with the city clerk of the City of Atlantic Beach. (2) No one other than immediate family m mbers residing on the premises shall be r involved in the occupation. There shall be a limit of one license per person, and no e more than two(2)licenses per household. home occupation shall be nontransferable. e (3) All business activities conducted on the licensed premises shall be conducted entirely within the dwelling. I purchased a residence in the royal palms neighborhood ton Yejws ago when first moving to the beaches area because it was affordable, and I thought it may have some long term gr#th potential.I strongly feel that allowing any commercial business In the neighborhood would eventually lead to further declining property values. I realize the need for child care and am sympathetic to Ms.J 's request,but I can't see how any one can effectively run a child care business in any of these homes. The homes in the neighborhood range from 1100 to 1350 sq.it I am not sure about the state and local requirements but s Ms.Jackson's residence conform with state or local guidelines? Is there adequate recreation equipment on sfte?Is there adequa�e room for 10-15 children to be Inside on a rainy day? Is there adequate kitchen facilities to feed these children? I feel if you allow this child care center to operate in a residential neighborhood you will be opening the flood gates throughout the city of Atlantic Beach for all kinds of requests to nwrate commercial business's from residential homes,Further more I ask would you consider this if it were y neighborhoods. I realize that Ms. Jackson is doinga fine job of caring for these children; however, I feel tha five ( 5) children should be the limit for any woman to carry V, or. I realize that she has violated the city ordinance regardi g the number of children allowed in her home in the past wit out reprimand; however, I feel that it should not be overlook d any longer. Enclosed is a picture taken from last week' s Be ches Leader - please note the number of little heads. Saveral residents spoke on her beha f, all of whom she provides day care services for; however these people do not live on the street or own property in the area. € I purchased a residence nine years ago at 439 Sargo Road and Ms. Jackson was providing day care services at that time. The traffic resulting from parents leaving and picking up thei children at all hours of the day and night was, and still is a nuisance. In closing, I feel that relaxation of this ban would be a real mistake.
