I am aware of section 302 of the IPMC, which if enforced against all vacant land that is overgrown in Atlantic Beach, including 1 vacant and unimproved City property, would not make common sense. Many jurisdictions have amended section 302 of the IPMC to include a boundary designation such as the 20 ft. perimeter to make section 302 IPMC practical and enforceable. We will ask Ash Properties to cut the lot due to problems arising from the adjacent residential community, however taking Ash Properties to the code board may be problematic in that we do not ask other undeveloped property owners, including the City,to clear unimproved property. Also,we will look into amending the IPMC to address unimproved property adjacent to improved residential/commercial property so that enforcement can stand a legal challenge. Thanks Mike G. From: Classey, Michael Sent: Tuesday, July 24, 2012 4:15 PM To: Griffin, Michael Cc: Hanson, Jim; White, Debbie Subject: RE: Lot clearing Mike, Below is from section 302 of the International Property Maintenance Code which, of course is adopted in Municipal Ordinance 6-120. This may provide some authority, but it does exclude shrubs. However, I also recall that if a property owner clears an undeveloped lot, then they are required to keep it clear, but I was unable to find this requirement in our ordinance. The city has dealt with this property owner before and they have cleared the lot on multiple occasions. Fyi...one of the COPs Officers spoke with the property owner last week and advised them that they needed to clear it again. 302.4 Weeds. All premises and exterior property shall be maintained free from weeds or plant growth in excess of[JURISDICTION TO INSERT HEIGHT IN INCHES].All noxious weeds shall be prohibited. Weeds shall be defined as all grasses,annual plants and vegetation, other than trees or shrubs provided; however, this term shall not include cultivated flowers and gardens. Upon failure of the owner or agent having charge of a property to cut and destroy weeds after service of a notice of violation,they shall be subject to prosecution in accordance with Section 106.3 and as prescribed by the authority having jurisdiction. Upon failure to comply with the notice of violation, any duly authorized employee of the jurisdiction or contractor hired by the jurisdiction shall be authorized to enter upon the property in violation and cut and destroy the weeds growing thereon, and the costs of such removal shall be paid by the owner or agent responsible for the property.
