Dear Mr.McCoy:
Please be advised,Atlantic Beach Code Enforcement has found the property referenced above to
be in violation of City of Atlantic Beach, Code of Ordinances, Chapter 6, Building,Building
Regulations, Chapter 20, Taxation and Chapter 24, Land Development Regulations to wit:
VIOLATIONS
CITY OFATLANTIC BEACH CODE OF ORDINANCES
Section 24-163—Storage and parking of commercial vehicles and recreational vehicles and
equipment and repair of vehicles in residential zoning districts.
(a) The storage and parking of commercial vehicles greater than twelve thousand five
hundred(12500)pounds gross weight and dual rear wheel vehicles shall be prohibited
in residential zoning districts.
(1) No more than one(1)commercial vehicle of less than twelve thousand five
hundred(12500)pound shall be permitted on any residential lot, and such
commercial vehicle shall be parked a minimum of twenty(20)feet from the front
lot line. (trailer for handyman service stored in front yard and open hauling
trailer stored in the public right of way,exceeds maximum number of
vehicles allowed)

(b) Recreational vehicles stored or parked on any residential lot shall be subject to the
following provisions:
(1) Recreational vehicles,boats or boat trailers or other type of trailer shall not be
parked or stored closer than fifteen(15)feet from the front lot line and shall be
parked in a manner that is generally perpendicular to the front property line such
that length is not aligned in a manner that extends across the front of the lot, it
being the intent that recreational vehicles, boats and trailers that are parked
forward of the residence should not excessively dominate the front of the lot.

Sec.24-157.Fences,walls and similar structures.
(e) Maintenance of fences. Fences that have been allowed to deteriorate to an excessive
degree have a negative impact on property values and the quality of
neighborhoods. Fences that are in a state of neglect, damage or disrepair, shall be
repaired,replaced or removed.
(2) Any components are rotten,broken or missing. (dilapidated,collapsing fencing)

Section 6-16—Adoption of the Florida Building Code—Permits Required(no
evidence of any permits issued for the above ground swimming pool)
Chapter 24-151 Land Development Regulations.
Section 24-151 (2) c.Accessory Structures and Uses.
Unless otherwise specified within this section,accessory uses and structures shall not be
located in required front yards and shall not be closer than five (5)feet from any lot line. (Above
ground pool is an accessory structure and may not be located in the front yard)
Section 20-52. Business License Tax.—Levy.
(1) Any person who maintains a permanent business location or branch office within the
City, for the privilege of engaging in or managing any business within its jurisdiction
(Handyman Service advertised on hauling trailer,no business tax receipt since 2009
as required)

This letter requests that the noted violations be corrected by removal of the improperly
stored open hauling trailer currently loaded with construction debris from the public right-
of-way including the discarded pallets,remove the boat and commercial white hauling
trailer labeled"handyman services" stored and projecting into the front yard set-back,
repair or remove all dilapidated collapsing fencing,remove the above ground unpermitted
swimming pool installed in the front yard and contact the Atlantic Beach City Clerk's
office to renew and update your expired business tax receipt within thirty(30) days of the
receipt of this notice.
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
Enforcement. The Board may impose fines up to two hundred fifty dollars($250.00)per day for
continuing violations.
It is our goal to enforce the codes and ordinances of the City of Atlantic Beach and protect the
health, safety and welfare of the City, and accordingly,your cooperation in this matter is greatly
