That Thomas J.Streit is the owner of the property located at 94 Stanley Rd.,Atlantic Beach, Florida. 2. That notice was sent by certified mail and that Thomas J. Streit was present at the hearing. 3. That notification of the violations of City of Atlantic Beach International Property Maintenance Code Chapter 6,Section(6-16)were made and served on the resident as evidenced in this hearing.Violations of the International Property Maintenance Code were determined to exist as follows: Sec.302.1 Trash and junk in yard Sec.304.14 Window screens missing Sec.305.3 Interior walls not properly maintained Sec.305.6 Doors damaged on interior Sec. 506.1 Bathroom sink does not drain Sec.604.3 Air-conditioning electrical circuit is unsafe and not providing heating. CONCLUSIONS OF LAW THAT Thomas J. Streit is not in compliance and has failed to correct such violation as of this hearing. ORDER Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted in Chapter 162,Florida Statutes,and the Code of Ordinances of the City of Atlantic Beach,Florida it is Ordered: THAT the Respondent be found guilty for non-compliance,and must demonstrate compliance to the satisfaction of the Code Enforcement Board on or before November 27, 2009. Failure to comply may result in Administrative fees and fines of$250 for the first day and$250 for everyday thereafter until compliance is met. THAT failure to pay all accumulated fines will result in a lien being placed against the property of 94 Stanley Road for the total assessment plus costs incurred for the filing of the lien. All lien amounts are to be made payable at an interest rate of ten(10)percent per annum from date of certification until paid. This Order becomes self-executing upon an Affidavit of Non-Compliance being filed with the City Clerk's Office and a hearing shall not be necessary. DONE AND ORDERED THIS day November 10,2009. Inspection of the property on September 10, 2009 revealed the following violations of the property maintenance code: Section 304.14 window screens missing Section 305.6 and 305.3 interior walls and doors in poor condition. The inspection was made as a result of a complaint from the tenant. Notice of violation was delivered to the property owner September 16, 2009 In staff's opinion the violation substantially affect the health and safety of the occupants of the property because of the unsanitary condition created by the substandard plumbing drain, unsafe electrical and missing widow screens and inoperable heating source. As of this date the respondent has taken some action to correct the violations, replaced the smoke detection. The respondent has not been previously cited for violations of this nature.
