THIS CAUSE came for public hearing before the Code Enforcement Board on November 11,
2009,and the Board having heard testimony under oath,received evidence,and heard arguments respective
to all appropriate matters,and thereupon issues the Findings of Fact,Conclusions of Law and Order as
follows:
FINDINGS OF FACT
1. That Thomas J.Streit is the owner of the property located at 94 Stanley Rd.,Atlantic Beach,
Florida.
2. That notice was sent by certified mail and that Thomas J. Streit was present at the hearing.
3. That notification of the violations of City of Atlantic Beach International Property
Maintenance Code Chapter 6,Section(6-16)were made and served on the resident as
evidenced in this hearing.Violations of the International Property Maintenance Code were
determined to exist as follows:
Sec.302.1 Trash and junk in yard
Sec.304.14 Window screens missing
Sec.305.3 Interior walls not properly maintained
Sec.305.6 Doors damaged on interior
Sec. 506.1 Bathroom sink does not drain
Sec.604.3 Air-conditioning electrical circuit is unsafe and not providing heating.
CONCLUSIONS OF LAW
THAT Thomas J. Streit is not in compliance and has failed to correct such violation as of
this hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the
authority granted in Chapter 162,Florida Statutes,and the Code of Ordinances of the City of
Atlantic Beach,Florida it is Ordered:
THAT the Respondent be found guilty for non-compliance,and must demonstrate
compliance to the satisfaction of the Code Enforcement Board on or before November 27,
2009. Failure to comply may result in Administrative fees and fines of$250 for the first day
and$250 for everyday thereafter until compliance is met.
THAT failure to pay all accumulated fines will result in a lien being placed against the
property of 94 Stanley Road for the total assessment plus costs incurred for the filing of the
lien. All lien amounts are to be made payable at an interest rate of ten(10)percent per annum
from date of certification until paid.
This Order becomes self-executing upon an Affidavit of Non-Compliance being filed
with the City Clerk's Office and a hearing shall not be necessary.
DONE AND ORDERED THIS day November 10,2009.

The Code Enforcement Board of the City of Atlantic Beach was created pursuant to
Florida Statutes and exists for the purpose of facilitating the enforcement of the Code of
Ordinances. It is comprised of seven citizens, residents of Atlantic Beach,who meet regularly to
hear allegations of code violations.
You are hereby notified and ordered to appear at the next public hearing of the Code
Enforcement Board on Tuesday, the 10th day of November, 2009, AT 7:00 P. M. at Atlantic
Beach City Hall, 800 Seminole Road, to answer and be heard to the alleged violations of the
following Section(s) of the Code of the City

The Code Enforcement Board has the power to levy fines up to $250.00 per day for the
first offense and $500.00 for the second offense against the property, if a violation is found to

inspector, the case could be presented to th e enforcement boa

Consider this an Official Notification of Violation, that on September 10, 2009 the Building Official for the City of
Atlantic Beach conducted an inspection of Apartment#2 at the aforementioned property. This inspection was the
result of a complaint by the tenant residing there. Based on this inspection the following violations were identified.
International Maintenance Code as Adopted:
a. 302.1 Trash and junk in the yard.
b. 304.14.Window Screens missing.
c. 305.3 Interior walls not properly maintained.
d. 305.6 Interior doors in poor condition.
e. 506.1 Bathroom sink does not drain.
f. 604.3 A/C receptacle not properly covered and arcs when used.
g. 704.2 No smoke detector
In an effort to eliminate any undue hardship, I am granting you up to 21 days from receipt of this notice to correct items
a, b, c, and d. Items e,f, and g must be corrected within 48 hours of receipt of this notification. You can bring your
property into compliance by:
a. Remove and properly dispose of trash and junk from yard.
b. Replace missing window screens.
c. Repair and paint interior walls.
d. Repair/replace all interior doors and associated hardware as necessary.
e. Unplug clogged bathroom sink.

1. September 9, 2009, City code staff responded to fire investigation and relocation of tenants at
the above address to the downstairs apartment. Housing code violations were noted and
correction was requested.
2. September 10, 2009, inspection made at above subject address revealing violations of
International Property Maintenance Code was not made as requested.
3. September 11, 2009, sent certified letter to property owner requesting corrections be made.
4. October 15, 2009, corrections not made, sent letter to appear before the Code Enforcement
Board.

Code Officer Statement
This is Code Enforcement Case 104309 at 94 Stanley Road regarding violation of
the City of Atlantic Beach Property Maintenance Code.
Inspection of the property on September 10, 2009 revealed the following
violations of the property maintenance code:
Section 304.14 window screens missing
Section 305.6 and 305.3 interior walls and doors in poor condition.
Section 506.1 Bathroom sink does not drain properly.

Section 604.3 A/C electrical not properly operating and unsafe. �� Y (*f
Section 302.1 Trash and debris in yard.
The inspection was made as a result of a complaint from the tenant.
Notice of violation was delivered to the property owner September 16, 2009
In staff's opinion the violation substantially affect the health and safety of the
occupants of the property because of the unsanitary condition created by the
substandard plumbing drain, unsafe electrical and missing widow screens and
inoperable heating source.
As of this date the respondent has taken some action to correct the violations,
replaced the smoke detection. The respondent has not been previously cited for
violations of this nature. Staff recommended the board find the respondent in
violation of sections 302.1,304.14,305.3,305.6,506.1,604.3 and order the
violations to be corrected within 15 days which is on or before November 26,
2009 or a fine of $250 for first day and $250 for everyday thereafter the violation
continues be imposed.
