An inspection of your property referenced reveals you are in violation of the City of Atlantic
Beach Code of Ordinances Section 24-68—Land Clearing and alteration of site grade or
topography and Chapter 6, Florida Building Code adopted to wit:

Sec. 24-68 Land Clearing and alteration of site grade or topography
No Lands shall be cleared, grubbed, filled, excavated, or topographically altered by any
means, and no vegetation on any development site disturbed, prior to the issuance of all required
approvals and development permits authorizing such clearing or alteration. Except as required to
meet coastal construction codes as set forth within a valid permit from Florida Department of
Environmental Protection; or as required to meet applicable flood zone or stormwater
regulations,the grade, elevation or topography of any parcel, development or redevelopment site
shall not be altered. (grade and elevation altered and retaining wall installed without permits
as required)
FLORIDA BUILDING CODE RESIDENTIAL
Section R404.4 Retaining Walls. Retaining walls that are not laterally supported at the top and
that retain in excess of 24 inches of unbalanced fill shall be designed to ensure stability against

overturning, sliding, excessive foundation pressure and water uplift. Retaining walls shall be
designed for a safety factor of 1.5 against lateral sliding and overturning. (engineering and an
approved building permit is required)
This letter requests that the noted violation be corrected by removing the recently installed
un-permitted retaining wall and returning property to the original grade or obtain the
required engineering from as State of Florida licensed engineer and make application and
obtain a building permit within ten (10) days of receipt of this notice.
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
Enforcement. The Board may impose fines up to two hundred fifty($250.00)per day for
continuing violations. Upon completing the corrective action(s) required, it is your responsibility
to contact Atlantic Beach Code Enforcement and arrange for an inspection to verify compliance.
It is our goal to enforce the codes and ordinances of the City of Atlantic Beach and protect the
health, safety and welfare of the City, and accordingly, your cooperation in this matter is greatly
