Re: Line of Sight Survey for the intersection of 12th St.and Ocean Blvd.
You requested I conduct a line of sight measurement and survey at the 4 way stop sign controlled
intersection of 12th St. and Ocean Blvd. where a 25mph St., Ocean Blvd. intersects with a 20mph St.,
12th St. The goal of a line of sight study is to ensure that a driver's actual sight distance is equal to or
greater than the minimum recommended sight distance. The minimum recommended sight distance
takes several things into consideration such as speed, stopping distances, decision making, and crash
data to name a few. When the sight distance cannot be achieved due to obstruction mitigation may be
required such as removal or modification of obstruction, reduction of speed limit, installation of traffic
control devices if warranted by MUTCD. Atlantic Beach Municipal Ordinance 19-5 provides examples
and sets the minimum sight distance for intersections in Atlantic Beach. According to ABMO 19-5 this
intersection is excluded from the sight distance requirements because all roads entering the
intersection are required to stop.
I reviewed the initial complaint from Mr. Hilliard, and spoke with him on the phone. Mr. Hilliard stated
he finds it difficult to see around the bushes at the southwest corner of 12th St. and Ocean Blvd., 220
12th St., and thinks it is dangerous for people to enter the intersection. Mr. Hilliard believes a vehicle
stopped at the intersection facing east on 12th St. has to move into the intersection to make sure
vehicles traveling northbound on Ocean Blvd. are going to stop at the stop sign. Mr. Hilliard thinks
northbound on Ocean Blvd. drivers might run the stop sign causing an accident. He also believes the
220 12th St.'s fence and bushes are in the right of way and were put in without a permit. Mr. Hilliard
has complained several times about the intersection and stated that the bushes were trimmed but the
trimming did not improve intersection visibility. I spoke with the resident at 1224 Ocean Blvd. and she
stated she has never had a visibility issue at the intersection. I spoke with the resident of 220 12t" St.
who stated she has lived in the house since 2009 and realizes the bushes have grown and has taken
steps to trim them back.
The 12th St and Ocean Blvd. intersection is a 4 way stop with stop signs at all four corners. The
intersection is currently under construction, water main replacement 12th St to 15th St on Ocean Blvd,.
and the stop bars are obscure or missing as is the case at the west stop sign on 12th St. I took line of
sight measurements, even though the intersection is exempted, and found clear line of sight at the
westbound approach to the intersection on 12th St. and the southbound approach to the intersection on
Ocean Blvd. when compared to the minimum sight distance requirements of ABMO 19-5 for 20mph
and 25mph roadways. The northbound approach to the stop sign on Ocean Blvd. and eastbound
approach to the intersection on 12th St. did not meet requirements due to the bushes at 220 12th St.
and a sign placed in the right of way, (the sign is a residential notice for the construction). I attempted
to review crash data for the intersection of Ocean Blvd. and 12th St. but was unable to find any crash
data associated with the intersection.
22012 th St. is a corner lot with a fence and Jasmine running along the northern property line on 12th
St. and turning south on Ocean Blvd. The Jasmine is approximately 8 feet in height and hinders a
southern view of Ocean Blvd. Under the Jasmine is an aluminum picket style fence with 1/4" square
aluminum slats with an approximate 4" gap between slats and is approximately 5 foot high. The lot is
built above the roadway and is approximately 12" above the road grade.
I found 2 permits for a fence at 220 12th St. permit #'s 06-33717 and #08-1181. 1 found an
application for the replacement and installation of new fencing. The fence permit application dated
2006 and associated permit# 06-33717 requested approval for a 48" fence and included a diagram.
The diagram shows the requested fence running the perimeter of the property line. The application
was approved and a Permit was granted 2006. 1 was unable to find a line of sight easement
associated with 220 12t St. or wording in the permit on fence restrictions. I found a variance for a pool
that was not built with no mention in the variance for a fence extension into right of way and the
variance has since expired. I found what appeared to be a property iron at the southeast corner of 220
12th St. lot and requested the right of way be marked by public works.
I recommend the notice of construction sign for the city water main improvements be removed from
the east side of Ocean Blvd. because it is blocking the view of the stop sign for northbound travelers.
The stop bar at all 4 stop signs should be repainted with a scheduled maintenance program put in
place as recommended from the Federal Highway Administration. ABMO 24.157 governing fences,
walls, and similar structures should be enforced.

Sec. 24-157. - Fences, walls and similar structures.
(a) Permit required. Issuance of a permit is required for any new or replacement fence or wall,
and all new or replacement fences and walls shall comply with the following provisions.
Nonconforming fences shall not be replaced with nonconforming fences. The term fence and
wall may be used interchangeably within this chapter, and shall mean as specifically defined
within section 24-17. Fences must be constructed out of materials that are customarily used
for fences.
(b) Height and location.
(1) Within required front yards, the maximum height of any fence shall be four (4) feet,
except that open ornamental aluminum, iron or vinyl or wood fences, similar to the
below examples, with vertical rails no more than two (2) inches in width and spacing
of at least four (4) inches may be constructed to a maximum height of five (5) feet
except in cases as described in following subsection ii. Within required side or rear
yards, the maximum height of any fence shall be six (6) feet.
(2) The height of fences shall be measured from the established grade at the fence
location to the horizontal top rail of the fence. The use of dirt, sand, rocks, timbers, or
similar materials to elevate the height of a fence on a mound or above the established
grade is prohibited.
(3) The maximum height of retaining walls on any Lot is four (4) feet. A minimum of forty
(40) feet shall separate retaining walls designed to add cumulative height or increase
site elevation. Signed and sealed construction and engineering plans for retaining
walls over thirty-six (36) inches in height shall be required.
(4) For nonoceanfront lots with uneven topography along a side lot line, the minimum
necessary rake of the fence, which is the ability for a fence to adjust to a slope, shall
be allowed for the purpose of maintaining a consistent horizontal line along the side of
the lot, provided that the height closest to the front of the lot does not exceed six (6)
feet.
(c) Corner lots. Fences, walls, similar structures and landscaping on corner lots may create
obstacles to clear vehicular, bicycle and pedestrian sight visibility resulting in a public safety
hazard. Notwithstanding the following provisions, clear sight visibility for fences, walls,
landscaping or any structure proposed along the street side of any corner lot shall be verified
by the designated public safety official prior to issuance of the permit required to construct,
place or replace any such feature. Sight triangles as defined within section 24-17 shall
remain free of visual obstruction.
(1) For corner lots located on rights-of-way that are fifty (50) feet or less in width, no
fence, wall or landscaping exceeding four (4) feet in height, shall be allowed within ten
(10) feet of any lot line which abuts a street.
(2) For corner lots located on rights-of-way that are wider than fifty (50) feet, fences may
be constructed within the side yard adjacent to the street at a maximum height of six

(6) feet provided that the fence is on the private property and shall not be located
closer than fifteen (15)feet from the edge of the street pavement or closer than five
(5) feet to any sidewalk or bike path.
(3) Similarly, hedges and landscaping on corner lots shall be maintained at a height that
does not interfere with clear vehicular, pedestrian or bicycle sight visibility or use of
the public sidewalk or bike path.
(d) Structures similar to fences. Vertical structures such as trellises, screens, partitions or walls,
that are intended primarily for the purpose of creating privacy for a back yard or an exterior
deck, as opposed to a fence which encloses or separates land, and constructed of any type
of material shall be limited to maximum length of twelve (12) feet and a height of eight (8)
feet above the deck or the established grade of the lot where such structure is placed,
provided that no such structure on a rooftop deck exceeds the maximum permitted height of
building. Except for oceanfront lots, where the ocean side is the designated front yard, any
such structure shall not be located within the required front yard of a lot and shall be subject
to the applicable required side yard setback.
(e) Maintenance of fences. Fences that have been allowed to deteriorate to an excessive
degree have a negative impact on property values and the quality of neighborhoods. Fences
that are in a state of neglect, damage or disrepair, shall be repaired, replaced or removed.
Unacceptable fences are identified as those containing any of the following characteristics that can
be easily observed from the street or by a neighboring property:
(1) Components of the fence are broken, bent, visibly rusted or corroded.
(2) Portions of the fence are no longer connected to support posts and rails.
(3) Any components are rotten, broken or missing.
(4) Weeds are overtaking the fence.

I have checked the property pins at 220 12th St. and have determined the fence at the corner of 12th and
Ocean Blvd. is in the right of way. I have heard there was a variance for a pool as a reason for allowing the
fence to be in the right of way with the bushes. I have checked permits for 220 12th St and have found an order
granting variance for a pool dated October 17, 2006 and on October 14 2008 the variance was extended to run
with the title of the property and does not expire. However, the pool variance does not address the fence. I
also found a permit for the fence at this location with a drawing showing the fence to be placed on the property
line. The original permit for the fence dated 8/21/2006 permit#06-00033717 with an renewal permit dated
8/27/2008 does not appear to grant a variance for the fence to be in the right of way or for a exemption of
ABMO 24.157. I have made copies of the above mentioned permits and variances for your review.

Dear Ms. White:
I received your Courtesy Notice of Violation advising me to move the fence on my property
bordering Ocean Boulevard.
I was surprised to receive the notice because:
• The previous owner states that a City of Atlantic Beach, ("City"), fence permit form with
an attached survey was submitted to the City for approval. A City Public Safety Officer
inspected the site and approved the fence. A pool permit was also approved at the time,
although a pool has not been installed.
• My understanding is that no appeals contesting the fence were submitted to the City.
• The fence has been in place for more than 4 years, dating to before we purchased the
property.
• The City has never been impeded by the fence, inclusive of replacing the water main last
year on Ocean Boulevard.
• Atlantic Beach Police have examined the intersection at least twice and found no safety
issue, especially given that the sightline is within City code even if it was not a four-way
stop. It is a four-way stop and the sightline regulations would not apply anyway.
• There have been no accidents at the intersection of 12th and Ocean Boulevard, to our
knowledge, since we have been in the home.
I feel we are being harassed at this point by an unidentified citizen, who upon failing to get
agreement from the City that there was a safety issue, has now decided to pursue a code
violation years after the period for appeal has passed. There is no serious threat to the public
health, safety or welfare.
Given that there is no safety issue, the fence has been in place for years, the City issued a
Certificate of Occupancy when we purchased the property and there has been no impediment to
City access to the right-of way, we fail to see the issue, nor the justification for the City forcing
us to incur the cost of moving the fence and possibly removing a mature palm tree as a result.
I would appreciate a meeting with you to better understand the City's position. Please respond
via e-mail with some potential dates and times you could be available to discuss the situation.

I have checked the property pins at 220 12`h St. and have determined the fence at the corner of 12`h and
Ocean Blvd. is in the right of way. I have heard there was a variance for a pool as a reason for allowing the
fence to be in the right of way with the bushes. I have checked permits for 220 12`h St and have found an order
granting variance for a pool dated October 17, 2006 and on October 14 2008 the variance was extended to run
with the title of the property and does not expire. However, the pool variance does not address the fence. I
also found a permit for the fence at this location with a drawing showing the fence to be placed on the property
line. The original permit for the fence dated 8/21/2006 permit#06-00033717 with an renewal permit dated
8/27/2008 does not appear to grant a variance for the fence to be in the right of way or for a exemption of
ABMO 24.157. I have made copies of the above mentioned permits and variances for your review.

Dear Ms. White:
I received your Courtesy Notice of Violation advising me to move the fence on my property
bordering Ocean Boulevard.
I was surprised to receive the notice because:
• The previous owner states that a City of Atlantic Beach, ("City"), fence permit form with
an attached survey was submitted to the City for approval. A City Public Safety Officer
inspected the site and approved the fence. A pool permit was also approved at the time,
although a pool has not been installed.
• My understanding is that no appeals contesting the fence were submitted to the City.
• The fence has been in place for more than 4 years, dating to before we purchased the
property.
• The City has never been impeded by the fence, inclusive of replacing the water main last
year on Ocean Boulevard.
• Atlantic Beach Police have examined the intersection at least twice and found no safety
issue, especially given that the sightline is within City code even if it was not a four-way
stop. It is a four-way stop and the sightline regulations would not apply anyway.
• There have been no accidents at the intersection of 12th and Ocean Boulevard, to our
knowledge, since we have been in the home.
feel we are being harassed at this point by an unidentified citizen, who upon failing to get
agreement from the City that there was a safety issue, has now decided to pursue a code
violation years after the period for appeal has passed. There is no serious threat to the public
health, safety or welfare.
Given that there is no safety issue, the fence has been in place for years, the City issued a
Certificate of Occupancy when we purchased the property and there has been no impediment to
City access to the right-of way, we fail to see the issue, nor the justification for the City forcing
us to incur the cost of moving the fence and possibly removing a mature palm tree as a result.
I would appreciate a meeting with you to better understand the City's position. Please respond
via e-mail with some potential dates and times you could be available to discuss the situation.
