Crabtree, plans for your home on the captioned lot were submitted by the contractor, Altore Inc. and approved. No changes or deletions in the exterior elevations, placement on the lot, fences or anything else can be made to the residence as originally approved, without additional submissions to the Special Advisory Planning Board for approval or disapproval, as the case maybe, after which the building department of the City of Atlantic Beach must also approve. It has come to my attention, and I have personally visited the site, that there has been a fence erected on the south side of the house, and partially erected on the north side of the house, both fences being contrary to, and in violation of, the covenants and restrictions and both not in compliance with the submitted and approved plans. Further investigation reveals that no building permit was taken out by you for the separate construction of these fences, and, therefore, it is presumed that you are doing it under the con- struction permit of the general contractor, Altore, Inc. Mr. Jim Pastore of Altore Inc. upon enquiry stated to me to-day that the fences called for on the plans were deleted from his contract and he allowed you a credit therefor, and the fence con- struction was undertaken individually and separately by you, not- withstanding his expressed and explicit caution that it was continued. The purpose of this letter is to advise you to forthwith remove the violation and reconstruct the fences in compliance with the plans and the covenants and restrictions. If substantial progress of these corrective measures is not achieved by Thursday July 30, 1977, this matter will be handed to my attorney, who will seek remedy in the Circuit Court. This residence was designed pnd constructed by my company, Al Tore, Inc. , In the design phase of this house the owner was made aware of the fence height , limitation as per recorded restrictions. The house was designed with a proper fence. As the house approached completition, the owners informed me that they wanted to build the fence higher than four feet. I told them that I would not build the fence in that mannor and I would rebate the cost of the fence in my contract and they could build it after a final closing with my company.
