Mrs . Morrison applied for a Variance to keep the structure as built. The Board discussed the fact that no permit was pulled and that the violation could have been avoided had the normal process been followed . By a vote of 4-3 the Board moved to deny the request. RECOMMENDATION : All construction within the City of Atlantic Beach is governed by both the city Zoning Codes and the Standard Building Codes . The permitting process was established to provide the city with the opportunity to review proposed construction for compliance with those codes . Structures such as constructed by Ms. Hesketh must comply with both codes to be safe . As of yet, no plans for the already existing room addition have been reviewed by the Building Department. Such review may result in the requirement for structural changes to the room addition in order to bring it into compliance . Ford, Building Official RE : Lifetime Enclosures Incorporated Application for a Screened Enclosure at 1821 Tierra Verde Drive In the Commission meeting of January 25 , 1993 , the City Commission granted a variance to Mrs . Margaret Cresson at 1821 Tierra Verde Drive to construct a screened enclosure on the east side of her home . Lifetime Enclosures applied for a permit to construct the screened enclosure . After reviewing the permit application I have returned the information to Lifetime Enclosures for the following reasons : The plans as drawn do not meet the 1991 Standard Building Code in that the structure is not designed to withstand 110 mph winds . The builder was rather concerned as he was under the impression that the Commission had ordered us to award a permit . I have explained to the builder and also to Mrs . Cresson that the Commission granted them a variance to allow them to build closer than the existing setbacks permit . The Commission did not grant any variances to the building code and the structure will have to meet the building code just as any other structure in Atlantic Beach will have to meet the code. I bring this to your attention as there was quite a bit of discussion in the Commissions ' deliberations about this structure being built on an existing wooden deck. The main problem with the structure is that the wooden deck is not an allowable platform to build a structure on. In order for the enclosure to be built on the deck, the deck would have to have some sort of tie downs , footing or an equal structural platform to allow the aluminum frame to resist high winds . My concern with the granting of the variance for this particular property is that apparently the citizen, in the form of Mrs . Cresson, and the contractor were not made aware that their variance did not include any variances from the building code . Lifetime Enclosures is back to the drawing board now and having to redesign the entire structure to meet 110 mph winds whereas they were under the impression that they could start construction immediately after the variance was granted. Kim Leinbach February 2 , 1993 Page 2 I wonder if it would be possible to be sure we include in our wording, when we grant variances that all other codes and City ordinances must be complied with and be very specific about the variance being granted. Application for Variance filed by Margaret Cresson to enclose an existing wood deck which would encroache the rear yard setback requirements on property located at 1821 Tierra Verde Drive. Ms. Cresson introduced herself to the board and explained that the variance was requested to allow construction of a screened enclosure on an existing deck. After discussion of whether a hardship existed and the impact on Other properties, Ms. Gregg moved to approve the variance as requested. Mr. Howie seconded the motion. The motion failed by a vote of 2 - 5. II. Application for Variance filed by The Church of the Living God to construct an addition to the church which will encroach the setback requirements on property located at 390 Church Road. Mr. James Rivers introduced himself to the Board and explained that the Church was requesting a variance to add needed room for the congregation. After discussion, Ms. Pillmore moved to approve the variance. Ms. Gregg seconded the motion and it was unanimously approved. III. Application for Variance filed by _Clyde and Elizabeth Asbury to park a motor home in the front setback of property located at 545 Seaspray Avenue. Mr. and Mrs. Asbury introduced themselves to the Board and explained that the variance was requested to permit them to continue to park a motor home in violation of the front yard setback due to health problems. The Chairman presented a letter from a neighbor expressing approval of the variance request. Mr. Asbury stated that another 14 approvals were submitted with their application. After discussion, Ms. Pillmore moved to approve the variance on a temporary basis until such time as Mr. Asbury could no longer operate the motor home. Mr. Howie seconded the motion. The motion failed by a vote of 3 - 4. IV. Application for Variance filed by Gudron Morrison to retain a screened enclosure in violation of the rear yard setback on property 'located at 403 Sear-pray Avenue. Ms. Lori Hesketh, a friend of the applicant, introduced herself to the board and explained the reasons the variance was requested. Reasons included mosquito infestation and raccoons. She explained that the structure had already been constructed. After discussion, Mr. Wolfson moved to deny the variance. Mr. McGowan seconded the motion and it passed by a vote of 4 - 3. V. Application for Variance filed by Townsend and Virginia Hawkes to construct a garage apartment on a non-conforming lot located at 1771 Beach Avenue. Mr. and Mrs. Townsend Hawkes introduced themselves to the Board and explained that the variance was requested to allow them to construct a garage apartment on a 50 x 50 lot on the west side of Beach Avenue. Variances are needed for minimum lot size and rear yard setback. After discussion, Mr. Wolfson moved to deny the variance. Mr. Frohwein seconded the motion and the variance was denied by a vote of 5 - 2. VI. Application for Plat Review by William Morgan for property located on the north corner of 19th Street. Mr. William Morgan introduced himself to the Board and explained that he desired to replat the property into six separate lots for the purpose of selling them. After discussion, Mr. Wolfson moved to recommend the replatting to the City Commission and to encourage the proposed use of single family homes as well as one-way traffic on the street. RECOMMENDATION : The majority of the Board voted to deny this request due to the lack of hardship or special conditions peculiar to the property in question , except for those created by the actions of the owners . I was on the agenda of the Community Development Board on Tuesday, November 17, trying to get a variance for a screened porch. I was turned down by a vote of four "no ' s" and three "yes ' s" . One of the "no ' s" I question, as he asked me if I had been in the meeting earlier when they turned down an elderly lady for the same request. I nodded but stated that I thought each case was handled individually. He said they are, however, I question the merit of his question to me. Mr. G4lliford, I want to mention that a porch (which I did not know needed a building permit since it had an existing slab) was built this summer because of the extreme mosquito problem in the park (the house backs up to Howell Park) . I believe that because of the excessive rain this season and the lack of sun in the park which caused a lot of standing water, contributed to the unusually high infestation of mosquitos. However, the problem does persist and is not determined by the elements. I consider this a definite health hazard when rumors in the -past have contributed mosquitos as a carrier of the Aids virus. This may be just a rumor but I still have my anxieties. I had hoped for more sympathy and understanding from the board, but did not receive it. One board member dismissed the raccoon problem as one he also hasand basically not a big deal ' I do hope with a second chance to tell my story before your board that we can come to an understanding of what needs to be done other then "tearing down" a much needed addition. Application for Variance filed by Dorothy and Stan Jones to park a motor home in the front yard setback of property located at 2051 Seminole Road. Stan Jones introduced himself to the board and explained the reasons the original Variance was requested. He requested an extension of that original Variance until the certificate of occupancy was issued for his new home currently under construction. After discussion Ms. Gregg moved to approve an extension of six (6) months. Mr. Howie seconded the motion and it was approved by a vote of 4 - 1. II. Application for Variance filed by James Barrington Darby to construct a carport which will encroach the side yard setback on property located at 350 Ocean Boulevard. Mr. Darby introduced himself to the board and stated the reasons a variance was requested. After discussion, Mr. Howie moved to approve the variance with the condition that the structure be constructed with non- flammable materials. Ms. Gregg seconded the motion and it passed by a vote of 4 - 3. NEW BUSINESS: I. Application for Variance filed by Margaret Cresson to enclose an existing wood deck which would encroache the rear yard setback requirements on property located at 1821 Tierra Verde Drive. Ms. Cresson introduced herself to the board and explained that the variance was requested to allow construction of a screened enclosure on an existing deck. After discussion of whether a hardship existed and the impact on other properties, Ms. Gregg moved to approve the variance as requested. Mr. Howie seconded the motion. The motion failed by a vote of 2 - 5. II. Application for Variance filed by The Church of the Living God to construct an addition to the church which will encroach the setback requirements on property located at 390 Church Road. Mr. James Rivers introduced himself to the Board and explained that the Church was requesting a variance to add needed room for the congregation. After discussion, Ms. Pillmore moved to approve the variance. Ms. Gregg seconded the motion and it was unanimously approved. III. Application for Variance filed by _Clyde and Elizabeth Asbury to park a motor home in the front setback of property located at 545 Seaspray Avenue. Mr. and Mrs. Asbury introduced themselves to the Board and explained that the variance was requested to permit them to continue to park a motor home in violation of the front yard setback due to health problems. The Chairman presented a letter from a neighbor expressing approval of the variance request. Mr. Asbury stated that another 14 approvals were submitted with their application. After discussion, Ms. Pillmore moved to approve the variance on a temporary basis until such time as Mr. Asbury could no longer operate the motor home. Mr. Howie seconded the motion. The motion failed by a vote of 3 - 4. IV. Application for Variance filed by Gudron Morrison to retain a screened enclosure in violation of the rear yard setback on property 'located at 403 Seaspray Avenue. Ms. Lori Hesketh, a friend of the applicant, introduced herself to the board and explained the reasons the variance was requested. Reasons included mosquito infestation and raccoons. She explained that the structure had already been constructed. After discussion, Mr. Wolfson moved to deny the variance. Mr. McGowan seconded the motion and it passed by a vote of 4 - 3. V. Application for Variance filed by Townsend and Virginia Hawkes to construct a garage apartment on a non-conforming lot located at 1771 Beach Avenue. Mr. and Mrs. Townsend Hawkes introduced themselves to the Board and explained that the variance was requested to allow them to construct a garage apartment on a 50 x 50 lot on the west side of Beach Avenue. Variances are needed for minimum lot size and rear yard setback. After discussion, Mr. Wolfson moved to deny the variance. Mr. Frohwein seconded the motion and the variance was denied by a vote of 5 - 2. VI. Application for Plat Review by William Morgan for property located on the north corner of 19th Street. Mr. William Morgan introduced himself to the Board and explained that he desired to replat the property into six separate lots for the purpose of selling them. After discussion, Mr. Wolfson moved to recommend the replatting to the City Commission and to encourage the proposed use of single family homes as well as one-way traffic on the street. Ms. Pillmore seconded the motidn and it was unanimously passed. There being no further business to come before the board on motion made and seconded the meeting was adjourned. Such procedures shall include dead- lines for filing applications prior to regularly scheduled meetings to allow time for adequate review and the preparation of a written report and recommendation of each application. Section 1302.5(8) is hereby added as follows: "Foundation walls shall be continuous and piers shall not be permitted to support exterior bearing walls. All frame superstructure above the foundation wall shall. be provided with approved termite protection." Section 1404.2(c) is hereby amended by striking therefrom the figure "(6)," where the same appears in line 2 of such subsection,and substituting in lieu thereof the figure"(8)," and further by adding at the end of such section the following: "The uppermost eight (8) inches of any hollow concrete masonry wall, and the upper- most eight(8)inches of the wall of each story height,shall be reinforced concrete spandrel beam, or lintel block filled with 3,000# concrete. Two (2) one-half inch steel deformed reinforcing rods shall be used as minimum reinforcing. Reinforcing shall be increased at openings to provide necessary strength. All masonry shall be finished to provide a true and even surface for wooden structural members. Such structural members except floor joists shall be securely fastened to the concrete bearing surface with bolts(galvanized)not less than one-half inch in diameter, securely embedded in the concrete, and spaced not more than four(4)feet apart. Compliance with section 1408.2 of the code is intended; and in addition thereto, the wood plate or beam (bolted to the masonry lintel or spandrel beam) shall be fastened with hurricane clips to each joist, rafter or roof truss at every point of bearing." Section 1701.3 is hereby amended by adding the following additional subsections thereto: "(a) Foundation wall vents. Space under first floor joists except in such space as is occupied by a basement or cellar, shall be provided with openings to insure ventilation. Such ventilating openings shall be proportioned on the basis of not less than one and one-half(11/a) square feet net opening for each fifteen (15) lineal feet or major traction thereof of exterior wall.Vents shall be so placed as to provide ventilation at all points and prevent dead air pockets; they need not be placed in the front of the building. Such openings shall be screened with galvanized hardware cloth having an opening or ,mesh no greater than one-fourth inch square. "(b) Clearance. There shall be clearance of not less than eighteen (18) inches between the bottom of untreated wood framing and the ground beneath. "(c) Foundation sills. M S Y N Motion: Grant three variances Edwards x necessary to construct building on Fletcher 50' x 50' lot located at 1771 Beach Tucker x Avenue on the West side of Beach waters Gulliford Avenue Commissioner Waters felt it was unfair to allow the requested structure height of 27 feet on the substandard lot, as he felt it would be detrimental to the people living behind the proposed structure. It was explained the proposed structure would utilize the same plans as the house behind it. Commissioner Fletcher was concerned with the height of the structure as well as the precedent the structure would set. He added the City had a substandard zoning code for a reason and that was to limit the density in certain areas. Mayor Gulliford felt the Commission should be fair and even-handed. He added beach communities were dense by nature . Appeal of variance denial by Community Development board to keep a screened enclosure (Laurie Hesketh) George Worley reported Gudron Morrison, represented by Lori Hesketh, constructed a screened enclosure at the rear of her home at 403 Seaspray Avenue in violation of the required rear setback. Ms. Morrison applied for a variance to keep the structure as built. The Community Development Board discussed the fact that no permit was pulled and that the violation could have been avoided had the normal process been followed. She explained as a result of the standing water an abundance of mosquitoes made it impossible to sit on the porch. Thus, the owner decided to screen in the porch. She further explained that because the slab was already in existence, it was not realized by the owner that it would be necessary to obtain a permit. A discussion ensued and it was explained that because a permit was not obtained by the owner the enclosure was not inspected by the Building Department. Lori Hesketh was advised it would be necessary to obtain a permit and have the enclosure inspected by the Building Department. The question was called and the motion carried unanimously. 4 . Mrs . Morrison applied for a Variance to keep the structure as built. The Board discussed the fact that no permit was pulled and that the violation could have been avoided had the normal process been followed . By a vote of 4-3 the Board moved to deny the request. RECOMMENDATION : All construction within the City of Atlantic Beach is governed by both the city Zoning Codes and the Standard Building Codes . The permitting process was established to provide the city with the opportunity to review proposed construction for compliance with those codes . Structures such as constructed by Ms. Hesketh must comply with both codes to be safe . As of yet, no plans for the already existing room addition have been reviewed by the Building Department . Such review may result in the requirement for structural changes to the room addition in order to bring it into compliance .
