Please be advised,Atlantic Beach Code Enforcement has found the property referenced above to be in
violation of Chapter 12 Nuisance and Chapter 16 Solid Waste Definitions and Procedures,City of
Atlantic Beach, Code of Ordinances,to wit:
VIOLATIONS
Section 12-1 Nuisances—Enumeration
(b)It is hereby declared to be a nuisance,the enumerations of which are merely indications of the
nature and type of acts,occurrence and conditions,and shall not be deemed to be exclusive:
(2) For any person to throw,deposit or discharge into or suffer to be collected, deposited
or remain on or in any public or private property, house,building, sewer,or gutter, any
filth,or rubbish of any kind.
(7) For any person,either as the owner or occupant of a building, structure,or property
to utilize the premises of the property for the open storage of any abandoned or
inoperable motor vehicles,refrigerators or other appliances,household furniture,glass
building material,building rubbish or similar items.(building meterials,concrete
blocks,large blue plastic bins,shelving,etc.stored on property)
Section 16-3 Garbage and trash containers
(d) Dumpster required. All commercial units, other than commercial hand pick-up and
multifamily residential units shall be required to have a commercial dumpster for disposal of
garbage and trash. It shall be the duty of the Public Works Director to determine the size
dumpster required. Dumpsters shall not be filled past the maximum fill line. In cases where a
commercial or multifamily unit is routinely overfilling the dumpster,the Public Works Director
may direct an increase in either frequency of collection or container size. Appeals of his decision
may be made to the City Manager. The Public Works Director will approve requested from
commercial and multifamily residential units for mechanical compacting dumpster. Rates for

These services will be set by ordinance. Dumpster enclosures meeting design standards provided
by the Public Works Director are required for all new or redeveloped commercial and multifamily
residential units. Owners and resident with dumpsters are required to keep installed gates closed
at all times except when necessary for access. (loose trash and garbage t curb and in
unapproved plastic cans,property does not pay for any garbage service and will not be
picked up by city contractor)
This letter requests that the noted violations be corrected by removal of all garbage and trash
stored at the curb from the premises and remove all items described stored on the property within
ten (10)days from receipt of this notice.Please contact Carlene Matthews to apply for garbage
service as needed at(904)247-5812.
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this notice
must be in compliance on or before the date established by Atlantic Beach Code Enforcement. The Board
may impose fines up to two hundred fifty($250.00)per day for continuing violations.
It is our goal to enforce the codes and ordinances of the City of Atlantic Beach and protect the health,
safety and welfare of the City, and accordingly,your cooperation in this matter is greatly appreciated.
