Dear Building Inspector:- The architectural plans of the subject structure have been reviewed by myself for compliance with section 1606 of the 2001- FBC for three second gust wind speeds of 120 mph and concluded that the building structure will satisfy the wind loading requirements of section 1606 of the 2001- FBC as long as sheets #S-1 through #S-5 of the architectural drawings are satisfied. It shall be noted that the following criteria were assumed throughout the review and analysis:- a) that the lateral diaphragm of roof and floor sheathing/trusses system is of the flexible type, b) that the shear walls segments will interact in unison due to their attachment to the above mentioned lateral diaphragm, c) that the entire roof uplift forces will be transferred to the footings through the use of metal strapping ;thus, the uplift resistance of the deli plated ahead- walls sheathing will be neglected, d) that the shear wall segments will distribute the designated shear forces based upon their rigidities, e) that I have no knowledge of any subsurface soil condition report ; thus, all footings were designed asstnmig an allowable soil bearing pressure of 2000 psf. If contractor found any differing cow through sod removal or soil report that will affect the above mentioned assumption, then I shall be notified and possible footing design revisions may need to be implemented prior to commencing with footings Please let me know, if further help is needed. SUBMITTED BY: Rick Carper, P.E., Public Works Director Sonya Doerr, AICP, Community Development Director DATE: December 30, 2005 BACKGROUND: On November 28, 2005, the Commission took action to deny a request for a Waiver from the Land Development Regulations related Section 24-66(b), which requires on-site storage of stormwater runoff such that there is no increase in the rate or volume of flow to off-site, for a property at 1718 Selva Marina Drive. Since that action, the property owner, Joseph Fitzgerald, has advised Staff that it was not his intention to go forward with the waiver request at that time and stated that he had not been notified that the request had been scheduled for consideration by the Commission. Mr. Fitzgerald, however, had been in discussions with both Planning and Public Works Staff regarding available Commission agenda dates and had submitted a written waiver request in October for the purpose of being heard by the Commission. (See attached chronology.) While Staff's recommendation related to this matter remains unchanged, Mr. Fitzgerald, upon written request to the City, may submit a new or amended, waiver request if he chooses to do so. Unlike Rezonings, Zoning Variances and Use-by-Exceptions, there is no 365-day time limit to re-apply following a denial. RECOMMENDATION: As previously provided, Staff continues to recommend disapproval of the waiver request. LDR Section 24-66(b) gives the Director of Public Works authority to waive on-site retention "if storage is determined to be unnecessary or unattainable". In this case, Staff feels it is both necessary and attainable, and that to grant the waiver would set a dangerous precedent for the City. AGENDA ITEM#4E JANUARY 9,2006 AGENDA ITEM ND NOVEMBER 14.2005 CITY OF ATLANTIC BEACH CITY COMMISSION MEETING STAFF REPORT AGENDA ITEM: Request for a Waiver from Land Development Regulations Requirement for On- Site Retention for a lot located at 1718 Serve Marina Drive SUBMITTED BY: Rick Carper, P.E., Public Works Director DATE: October 26, 2005 BACKGROUND: Land Development Regulations(LDR) Section 24-66(b) requires on- site storage of stormwater runoff such that there is no increase in the rate or volume of flow to off-site, from every developed or redeveloped Parcel" (emphasis added). The property owner is requesting a waiver from on-site retention requirements by saying the LDR should not be applied to a new home within an already existing subdivision, stating the regulation "applies only to subdivisions and not to individual lots". As noted, Section 24-66(b)specifically applies to both development and redevelopment at the Parcel (lot) level. Although the Selva Marina Subdivision is nearly built out, the lot in question was undeveloped at the time of the permit request. The intent of LDR Section 24-66(b) is to ensure the capacity of existing stormwater collection systems is not exceeded because of the increase in stormwater runoff caused by the increased impervious areas resulting from both development(new construction) and from redevelopment(tear downs). That the property is being built to less than 50% impervious simply means it is complying with another section of the City's LDR (Section 24-104 (f)), unrelated to on-site retention. Public Works approved the Building permit request for property at 1718 Selva Marina Drive on May 27, 2005. At that time, Public Works had conducted several plan reviews with the Builder (Gamel Construction) to obtain a plan for on-site retention that met the spirit of the City's Land Development Regulations. Because the lot has natural Type 8 drainage (splits front and rear), Staff agreed that the portion of the lot draining directly to the lagoon would not be considered in the retention calculations. The front half of the lot drains to Selva Marina Drive, with an existing City catch basin at the curb. This curb inlet is piped directly to Selva Lagoon along Mr. Fitzgerald's northern property line. Combined with flow from the inlets immediately across Selva Marine Drive, this 18" pipe carries runoff from approximately 700 linear feet of Selva Marina Drive, over 900 AGENDA ITEM#4E JANUARY 9,2006 AGENDA ITEM#8D NOVEMBER 14,2005 feet of Live Oak Lane and 500 feet of the north side of Palmwood Drive and all the properties adjacent to these roads. As a result of an Administrative oversight, Staff is unable to find the permitted drainage plan and approved on-site retention calculations for this property. Staff requested a copy from the Builder who stated he did not have them either. However,the portion of the lot draining directly to the lagoon was taken into account when the amount of on- site storage required was calculated. RECOMMENDATION: Staff recommends disapproval of the waiver request. Present Situation: Upon applying for a building permit for my new home,Mr. Rick Carper,P.E.Public Works Director used section 24-66(b)of the above regulation to calculate the volume of run off and storage requirements for my individual lot at 1718 Selva Marina Dr.The results from the calculation required 3,740 cu. ft. of storage. After discussion with my builder, Mr. Frank Gamel,Mr.Carper reduced the requirement to 2,500 cu.ft.between the house and the road(see attached sheet A).Upon additional discussion with Mr. Gamel. he agreed to a 6"birm to be constructed in the front of the property to retain the water.Then the building permit was approved. Waiver Request: I request that the Regulation of Atlantic Beach,Subdivision and Land Development.Section 24-66(b) not be applied to my property on 1718 Selva Marina Dr. Reasons: I do not believe that an individual lot, within an established community should be required to comply with a regulation that has as its intent to cover a Subdivision and Land Development situation. Selva Marina was developed in the 1960's and constructed the water management system for the subdivision for all the homes at that time. If the present thinking of the requirement for a 25 year and 24 hour rainfall (9.3 inches) has changed since then, applying this regulation to the two remaining properties on the street,which do not have homes on them,(2 homes out of 40—5%)would have a small impact on the water management situation.Certainly,there would not be enough impact to correct the situation if the system is now defined to be unable to handle the situation in its present condition. I don't believe the regulation is being applied to homes which are being rebuilt or under going renovations. Reasoning: The last 40 feet of my property is located in the canal which is used as the water management system for the subdivision.Therefore, 16% of the total property is being used for the system presently, (150 ft.X 250 ft.=37,500 sq.ft. &40 ft, X 150 ft. =6000 sq. ft.)Also, on the North East corner of the lot, which is in the street, there is a storm water drain which collects the water in to a buried 3 ft. corrugated steel pipe draining under the property into the canal in the rear of the home. I feel that I am already contributing to the water management of the community. Reasoning(cont.): The front of the property(home to property line is 75 ft X 150 ft.) is 11,250 sq.ft.If the initial calculation of a storage requirement(3,740 cu, ft.)were to AGENDA ITEM#4E JANUARY 9,2006 AGENDA ITEM#81) NOVEMBER 14,2005 apply and the depth were '/x ft. then two thirds of the front yard would be a holding pond. Also I followed the regulation regarding the tree retention regulations and to follow this water retention approach the trees in the holding pond area would be affected negatively. Summary: The existing regulation,(section 24-66 b) applies only to subdivisions and not to individual lots. Our building plans and specs do not in any way violate the impervious surface area limit of 50% which was established in November of 2001. In addition,the last 40 feet of our lot is in the canal,part of the existing storm water management system.Therefore we already have a storm water management system on our lot. The fact that Mr.Carper reduced the requirement indicates that he also believes that the resulting calculation is too much for an individual lot. Mr. Frank Gamel, my construction manager, and an active builder for the last 25 years at the beaches, has also indicated that he has never seen this kind of approach to an individual lot. Section 24-46(d)permits the commission to authorize limited waivers on a case by case basis, from specific provisions of the land development regulations when it is demonstrated that compliance with such provision would be unreasonable,in conflict with the public interest,or a practical impossibility. Stormwater, Drainage, Storage and Treatment Requirements. (Emphasis added) (a) Topography and Grading. All Lots and Development sites shall be constructed and graded in such a manner so that the stormwater drains to the adjacent Street, an existing natural element used to convey stormwater(See section 22-303, definitions: Stormwater Management System), or a City drainage structure after meeting on-site storage requirements, as listed within this Section. The City shall be provided with a pre-construction topographical survey prior to the issuance of a Development Permit and a post-construction topographical survey prior to the issuance of a Certificate of Occupancy. Said surveys shall be prepared by a licensed Florida surveyor, and the requirement for either or both surveys may be waived by the Director of Public Works if determined to be unnecessary. (b)On-Site Storage: The Applicant shall be required to provide on-site storage, such that there is no increase in the rate or volume of flow to off-site. from every developed or redeveloped Parcel, and provide documentations and calculations to demonstrate compliance. Development Projects previously permitted by the St. Johns River Water Management District (SJRWMD), which have an in-compliance retention or detention system that collects and controls run-off, are exempt. The requirement for on-site storage may be waived by the Director of Public Works if storage is determined to be unnecessary or unattainable. Volume calculations for Lots that require on-site storage should be based on the difference in run-off volume generated by the new impervious area("delta volume") and would be calculated by: V AR/12,where V=volume of storage in cubic feet, A=area of the lot in square feet, R-25 year and 24 hour rainfall depth(9.3 inches) over the lot area, and C = run-of coefficient, which is 0.6 for the 50%maximum imperviousness, 0.4 for 25%imperviousness,and 0.2 for 0%imperviousness. This delta volume (post V minus pre V in cubic feet) must be stored at least 1 foot above the wet season water table and below the overflow point to off-site(in many cases this may be the adjacent road elevation). As an option, and as approved by the Director of Public Works, the owner of the parcel to be developed or redeveloped may implement, at the applicant's cost, off-site storage and necessary conveyance to control existing flood stages off-site. (c) Flood Plain Storage: There shall be no net loss of storage for areas in the 100-year floodplain, where a floodplain elevation has been defined by either the Federal Emergency Management Agency (FEMA) on Flood Insurance Rate Maps (FIRMs), the 1995 Stormwater Master Plan, the Core City project, or the 2002 Stormwater Master Plan Update(e.g., Hopkins Creek). Site grading shall create storage on-site to mitigate for filling of volume on-site. This storage is in addition to the storage required for the increase in Impervious Surface Area. AGENDA ITEM#4E • JANUARY 9,2006 AGENDA ITEM#8D NOVEMBER 14,2005 (d) Stormwater Treatment: Stormwater treatment shall be provided for a volume equivalent to either retention or detention with filtration, of the run-off from the first one(1)inch of rainfall; or as an option, for facilities with a drainage area of less than one hundred (100) acres, the first one-half(1/2) inch of run-off pursuant to Chapter 62-25, Florida Administrative Code (FAC). No discharge from any stormwater facility shall cause or contribute to a violation of water quality standards as provided in Section 62.302 of the Florida Administrative Code. This treatment volume can be included as part of the on-site storage requirement in item d(2)of this Section. (e) NPDES Requirements: All construction activities shall be in conformance with the City's National Pollutant Discharge Elimination Systems (NPDES) permit, in addition to the requirements of the Water Management District and the Florida Department of Environmental Protection. NPDES requirements include use of Best Management Practices (BMPs) prior to discharge into natural or artificial drainage systems. Beginning May 1, 2003, all construction projects of one acre or more will require a NPDES permit. (f) Enforcement: Subsequent to approval of a property owner's final grading. including on-site and/or flood plain storage and stormwater treatment, the improvements shall be maintained by the property owner. Failure to maintain the improvements will require restoration upon notification by the Director of Public Works, within a stipulated time frame, If restoration is not timely completed, the City shall have the right to complete the restoration, and the City's actual cost incurred, together with a charge of 100% of said costs to cover the City's administrative expenses, shall be charged to the owner. Landscaping shall mean any of the following or combination thereof: living materials, such as but not limited to, grass, ground covers, shrubs, vines, hedges, trees or palms; and nonliving durable materials commonly used in Landscaping, such as but not limited to, rocks, pebbles, sand, walls, fences, berms, sculptures and fountains,but excluding paving. Laundromat, Self-service shall mean a business that provides noncommercial clothes washing and drying or ironing machines to be used by customers on the premises. Live Entertainment includes, but is not limited to, singers, pianists, musicians, musical groups, bands, vocal or instrumental dancers, theatrical shows, magicians, performers, comedians and all fashions, forms and media of entertainment carried on and conducted in the presence of and for the entertainment and amusement of others and as distinguished from records, tapes, pictures and other forms of reproduced or transmitted entertainment. Live Entertainment, as used within these Land Development Regulations, shall not include adult entertainment establishments as defined by Chapter 847.001 (2),Florida Statutes. Loading Space shall mean a space within the main Building or on the same property, providing for the standing, loading or unloading of trucks or other motor vehicles, constructed consistent with the requirements of this Chapter. Lot shall mean a parcel of Land occupied or intended for occupancy by a Use permitted within this Chapter and having its required frontage upon a Street Right-of-way or permanent Easement, and as may be defined in Chapter 177,Florida Statutes. Lot Area shall mean the area formed by the horizontal plane within the Lot Lines. Lot, Corner shall mean a Lot abutting two (2) or more Streets,or at a Street intersection or at a Street corner having an interior angle not greater than one hundred thirty-five (135) degrees. The exterior Lot Line of the narrowest side of the Lot adjoining the Street shall be considered the front of the Lot. The exterior Lot Line of the longest side of the Lot abutting the Street shall be considered as a side of the Lot and shall have a minimum Required Side Yard of fifteen(15)feet. The opposite side Yard and the rear Yard shall conform to the minimum Yard requirements of the Zoning District in which the property is located. Lot Coverage shall mean the area of the Lot covered by all Impervious Surfaces. Lot Depth shall mean the distance measured from the middle point of the front Lot Line to the middle point of the opposite rear Lot Line. Lot Line shall mean the legal boundary of a Lot as established by a certified land survey. Marina shall mean an establishment with a waterfront location for the purpose of storing water craft and pleasure boats on Land, in Buildings, in slips or on boat lifts, and including accessory facilities for purposes such as refueling, minor repair and launching. Mean High Water shall mean the average height of the high waters over a nineteen (19) year period or for shorter periods of observations; the average height of the high waters after corrections are applied to eliminate known variations and to reduce the result to the equivalent of a mean nineteen (19)year value, as defined in Chapter 253,Florida Statutes. Mini-warehouses shall include all those businesses commonly known as mini-warehouses, which shall be utilized for the sole purpose of storage of tangible personal property. No business activity shall be conducted within Mini-warehouses. Mobile Home shall mean a Structure, transportable in one or more sections, which is eight(8) feet or more in width and which is built on an integral chassis and designed to be used as a Dwelling when connected to the required utilities including plumbing,heating, air-conditioning, and electrical systems. Nonconforming Lot of Record shall mean a Lot of Record containing less than the minimum site area, site dimensions or other site requirements of the applicable Zoning District, or which is not in compliance with the provisions of other currently effective Land Development Regulations, as may be lawfully amended, but which was legally recorded and documented prior to the effective date of such Land Development Regulations. 'Nonconforming Structure shall mean a Structure or Building or portion thereof, which does not conform with the Land Development Regulations applicable to the Zoning District in which the Structure is located, but which was legally established prior to the effective date of such Land Development Regulations. If that were the case where are all the other holding ponds in the development? I believe that the present water management system, which received a grade of"8"out of 10 for compliance with the regulations of the FEMA Flood Control,would not have been awarded if the subdivision of Selva Marina had not been in compliance. Is there a study or evidence that indicates the development is not in compliance? In my efforts,to understand the reasons behind this approach to retaining water on residential property, I spoke to the Compliance Manager of the St John River Water Management District and I explained that I am being asked to construct a retention pond in my front yard to control the water run-off. His response was "I haven't heard of holding ponds being used in individual residential situations,but rather they are used for commercial applications." In reviewing the chapter 40C-42, F.A.C. of their regulation of storm water management systems,the paragraph 40C-42.029 requires that the operation and maintenance entity to provide for periodic inspections of the storm water management system to insure that the system is functioning as designed and permitted. The regulation goes on further state that this inspection is to be done every two years and with the reports being submitted to the District. Have any of these reports indicated that the development of Selva Marina is out of compliance?(See attachment A) If there or only two homes yet to be built on the street,then what impact would there be to adding holding ponds on both properties?Curiously,the water retention fences on the property(which was approved prior to construction) during construction are in place to prevent water run-off to both sides of our property and are not in position to prevent run-off into the street. I have been at the property when it has been raining, and there hasn't been any run-off to the street. Mr. Carper further states that the retention is necessary to ensure that the capacity of the existing system is not exceeded. How close are we to exceeding the capacity of the system? I think that is a reasonable question that needs to be answered. The need to store water on our front yard doesn't appear to be necessary for the protection of the sewer system. In fact, almost all of the lot would drain to the rear of the lot. If fact there are homes across the street from our lot that have greater slope in their front yards and are not required to have holding ponds. Secondly, Mr. Carper has altered the definition of the"Area of the lot" in the formula concerning the calculation of the volume of required on-site storage. In the definition section of the regulations there isn't any definition of the term"type of lot". The section containing the formula does not refer to any other document or section within the regulations which would contain this definition or the authority to alter the formula. (See attachment B)All of the definitions of term"lot" in the definition section of the regulations include the entire property. Mr. Carper altered the formula of the area of the lot to include only one half of the lot because of the drainage into the canal. This calculation resulted in showing that water storage was required. If you follow the formula correctly and include the entire lot the impervious surface calculation is under the 25% level. (See attachment C—where the calculation shows the result to be 18.44%coverage) Therefore the coefficient is .02 and this then equals the pre construction volume and consequently does not require any water storage or retention. My builder, Frank Gamel had received a calculation from Mr. Carper on the volume of storage required indicating a 2500 cu. ft. requirement which is different than the one showing a requirement of 5402 cu. ft. which was presented at the commission meeting. (Included in attachment C) This paragraph in the regulations on the calculation of the volume to retain a volume of water does not allow Mr. Carper to make changes or alter a formula without the proper authority. The tree regulators requested that the surveyor return and place a stake on the rear of the lot indicating where the boundary of the property was. The property actually extends half way into the canal. I complied with the tree retention regulations and that board accepted the boundaries of our lot. Furthermore, we wanted a circular driveway in the front yard of our home (similar to several homes to the south of our property on the street). And because of the trees which we had to retain, we complied. We now unable to construct the circular driveway and will now have to construct a pull-off next to the driveway. If the entire lot was used for the tree regulation then the entire lot should be used for the water retention calculation. If you were to follow Mr. Carper logic that the back half of the lot drains into the canal, why did he stop at the center of the house and not consider the highest point on the lot?This point is at the front of the building restriction boundary(see Attachment D). Also,Mr. Gamel,my builder, agreed to slope the driveway near the garage to the rear of the property and redirect the water from the home to around the corner of the house and into the backyard, negating the water run-off from the structure. This would leave about 5,625 sq. feet in the front yard with a slope of one foot towards the road. The only impervious surface would be the 12 ft. wide driveway inside that area. The driveway equates to 11.7%coverage of impervious surface,therefore under the 25 %impervious coverage level which does not require on-site storage of water. The recommendation by Mr. Carper from the commission meeting on Nov 14th was "that to grant the waiver would set a dangerous precedent for the City". With only one other open lot on the street,how dangerous can this be? What I do on our lot certainly does not impact other drainage systems in other parts of the city. There may be problems in other sections where most of the homes cover over the 50%of the impervious surface criteria,but that is not certainly the case on our property. Reasons why our property isn't required to retain water on-site would be: - there is only 18%of impervious surface covered on the lot - proper management of the water coming off the house, (sloped driveway and directing of water to the rear of the home by controlling the gutter run-off and by proper grading where possible without damaging trees) - the fact that our property has over 10,000 cu. ft. of water storage already as part of the canal which is part of the community water management system. This storage of the water should have some impact in our favor in these decisions. For the above reasons, all I would like the requirement to be removed for the retaining berm in the front of our home and for the installation of drains to connect to the pipe which carries water to the canal,be removed. The driveway run-off in the front of our home would just run into the road and immediately(15 ft)enter the grate at the corner of our property which is the entry point of the pipe. The surrounding neighbors operate in the same manner on the same drainage system. The foundation has been in place for over 6 months and even with a rainy fall season,there has not been any significant water run-off problems that I or my builder is aware of. I would like to be a member of good standing in the community. And if I thought that my building of our home was creating a problem for our neighbors, I would not be asking for this waiver. When Mr. Carper stated"that to grant us a waiver would be a dangerous precedent for the city" what did he actually mean? Is there another problem somewhere in the city that is creating this issue for us? I have heard that the city is concerned about people trying to subdivide existing lots and building large home on these subdivided parcels,this is certainly not an issue with our property. At the meeting with Mr. Carper, I showed him the picture of the rusted condition(see attachment E)of the sewer pipe and the washout situation created by the pipe which runs under our property and into the canal. I pointed out that it probably would be less expensive for the city to repair/maintain the pipe at this time before we landscaped the yard or poured the driveway. His immediate response was that he did not have the money in his budget to fix the problem. Maybe this decision could be revisited and the repairs made in a timely and less costly manner. A final comment,the process which I have gone through was not exactly clear and straight forward. I might suggest that a section of the regulations be written and added to the ordinance defining the objective that Mr. Carper is trying to achieve and how to accomplish it. Most home owners if they understood the problem and the magnitude of the situation,they would be supportive of some practical solutions. Offsite parking plan in compliance with subsection (e)(4) and the following: 1. A single access with dimensions; • 2. Buffering for adjacent waterways and streets, as approved by the building official; 3. A temporary fence location, height and type of fence with screening; (4) Fencing plan, showing location, height and type of fence with screening or evidence that proposed construction does not warrant a construction fence in compliance with subsection (g) (6) as determined by the building official, (5) Location of construction trailer(s), loading/unloading area and material storage area. (6) Location of chemical toilet(s). I (7) Location of dumpster. (8) Traffic control plan, showing access with dimensions, area to be stabilized, narrative on phasing of construction with provision of adequate parking and delivery of materials. (9) Other activities, where special conditions are identified by the building official. • (c) Approval/waivers. The building official shall review, approve or deny the construction site management plan. The building official is hereby authorized to grant waivers from submittal requirements and corresponding standards: (1) If the requirement is unrelated to proposed development, or (2) If the impact of the proposed development is negligible in the that submittal requirement area. Contractor shall provide for parking on the project site and abutting right-of-way to the greatest degree possible. Alternative parking sites may include adjacent vacant lot or offsite parking lots in the immediate area as approved in the site management plan. (2) Access. Use of the public right-of-way for access to and from the project site as shown on the construction site management plan shall be strictly managed by the contractor. Contractor shall maintain the public street adjacent to the project site free of dirt, sand or any other debris resulting from construction activities. The public right-of-way adjacent to the project site shall be broom swept on a regular basis keeping it free of dirt, sand and other debris. Failure to remove said material on the day of occurrence is a violation. (3) Temporary graveled or stabilized area for construction access and parking. Contractor shall provide a graveled or stabilized area as shown in the construction site management plan. The stabilized area shall be located at points where vehicles enter and exit the construction site and the parking location. When a right-of-way area is used for parking, the contractor shall provide a graveled or stabilized area on the right-of-way. Upon completion of the project, the contractor shall restore the right-of way to its original condition or better. The purpose of the graveled or stabilized area at the entrance to the project site is to eliminate and reduce tracking or flow of sand, mud, concrete wash or other related material onto the right-of-way. (4) Offsite parking. If the construction site management plan illustrates proposed parking in the right-of-way, the application shall be accompanied by a city right-of-way permit. The building official may temporarily permit offsite parking on vacant lots other than the project site with the written permission of the owner of the lot where the vehicles are to be parked and in compliance with the following standards: a. Compliance with the construction site management plan. b. There shall be no storage of materials, trailers or construction equipment. d. There shall be no loading and unloading of materials or machinery. e. Parking within the right-of-way abutting the off-site parking lot may be approved by the building official. Sufficient ingress and egress to the vacant lot must be maintained. f. A temporary six-foot fence with fabric or screen or other materials as approved by the building official shall be located at the front, side, and rear lot line of the temporary parking area except where a lot line is located on the water. Where a lot line is along the water, the fence shall be placed no closer to the water than the yard setback line and shall not exceed three feet in height The fence gate shall remain locked during non- working hours. The fencing shall remain on-site until the off-site parking is no longer needed to complete the project site and shall be removed prior to issuance of a certificate of occupancy for the project site. g. The offsite parking shall occur no earlier than 7:00 a.m. and no later than 6:30 p.m. Loitering is prohibited. h. The offsite parking lot shall be restored to its original condition prior to issuance of a certificate of occupancy for the project site and shall include proper grading, replacement of trees, planting of grass and other landscape material as approved by the property owner. I (e) Material storage. Material associated with the project site including equipment shall be neatly stored on the site (within the fenced area when applicable). The storage of material shall not obstruct access to the structure under construction or create a public safety hazard. All loading or unloading of materials and/or equipment is limited to the construction site and adjacent right-of-way. (t) Construction fencing. A project site that meets the following standards is required to install a construction fence which means a temporary six-foot chain link fence with fabric, or other screening material. A construction fence is required where clearing, grading, stockpiling of soil or demolition is proposed as follows: a. A lot located in the residential or commercial zoning districts shall install a fence on the front, side, and rear lot fines prior to commencement of clearing, grading or demolition. Fencing may be removed upon final electrical inspection. b. All other lots shall install a fence on the side and rear lot lines. Fencing may be removed upon final electrical inspection. (2) Major remodeling shall mean an increase in the building volume of 10,000 cubic feet or more; or an increase in the building footprint of 1,000 square feet or more; or new construction with a building footprint of 1,000 square feet or more. A construction fence is required for major remodeling as follows: a. A lot located in the residential or commercial zoning districts shall install a fence on the front, side and rear lot lines. Fencing may be removed upon final electrical inspection; b. All other lots shall install a fence on the side and rear lot lines. Fencing may be removed upon final electrical inspection; (3) Major alteration shall mean where 50 percent or more of the gross square footage of an existing structure is proposed for reconstruction, rehabilitation, removal of wall(s), alteration or other improvement excluding replacement of the roof:A construction fence is required for major alteration as follows: a. A lot located in the residential or commercial zoning districts shall install a fence on the front, side and rear lot lines. Fencing may be removed upon final electrical inspection. b. All other lots shall install a fence on the side and rear lot lines. Fencing may be removed upon final electrical inspection. (4) Exception from six-foot height requirement. a. Where a construction fence is required and the property line is located on the water in any zoning district, that portion of the construction fence along the water shall be located no closer than the yard setback line at a height no higher than three feet. In a zoning on a waterfront facing the rear yard lot, the side lot line fence shall be lowered to three feet for that portion which is the greater of. 1. 30 feet from the mean highwater line; or 2. 30 feet from the platted waterfront building line (5) Alternative to fence. An existing hedge or visual barrier of at least six feet in height along any lot line may be considered an equivalent of the construction fence. The contractor shall make this request in writing to the building official. (6) Exception to installation of construction fence. Where a construction fence would be required for a residential lot pursuant to subsection (1)b., (2)b, or(3)b. and contractor obtains a construction fence waiver from the adjacent property owner or tenant that abuts the project site, the building official may waive the requirement for all or a portion of the construction fence. (7) Installation. Installation of a construction fence shall occur prior to any construction activity or material deliveries. The fence shall not be placed so as to create a public safety hazard. Where the project site is enclosed by a fence, the fence gate shall be locked during non-working hours. (g) Signs. A 12"X 18" sign shall be posted by the contractor on the project site in the location approved on the construction site management plan which is readable from the street. The sign shall contain the street address of the • property, phone number for the City of Atlantic Beach and the name and phone number of the general contractor. The sign is exempt from Chapter 17. This sign shall be maintained in a readable condition until completion of construction. (h) Site cleanliness. Contractor shall have the entire construction site cleaned by Friday of each week. Cleaning for purposes of this section means, without limitation, removal and placement into a dumpster of scrap lumber, concrete remnants and roof tile from the project site. The project site shall be free of all loose debris such as cans, metal, plastic and paper. When a temporary trailer is proposed and a construction fence is required, it shall be located on the project site within the fence at the location shown on the construction site management plan. 0) Chemical toilets. Chemical toilets shall be located inside the project fence and accessible for servicing. Where a fence is not required, the contractor shall locate the chemical toilet facing towards the rear of the project site and no further than 15 feet from the structure under construction except where another location has been authorized by the building official due to the size of the lot and ease of access to the chemical toilet. (k) Landscaping. Damage to any landscaping on an abutting or adjacent property as a result of the construction shall be replaced and restored at the contractors expense to its original condition. Failure to replace and repair is a violation. (I) Dumpster. Construction site dumpster shall be located inside the fence. Where a fence is not required, it shall be located on the project site. The dumpster shall be emptied in a timely fashion so there is no overflow of debris or litter. All dumpsters will have tarp covers or rigid covers during windy days. Prior to a certificate of occupancy being issued, the dumpster shall be removed from the site. f (m) Limitation of certain construction activities. Pile driving and steel erection activity shall be limited to Monday through Friday, excluding federal holidays, during the hours between 7:00- 8:00 a.m. in the morning until 480 5:00 p.m. in the evening. Demolition activity shall be limited to Monday through Friday, excluding federal holidays, during scheduled work hours between 7400 8:00 a.m. in the morning and 6:38 5:00 p.m. in the evening. (n) Construction related traffic control. A contractor, owner, vehicle operator or any persons associated with the project site who impedes or obstructs the public right-of-way shall be in violation of this Code. Parking, loading, unloading or any related activity on the public right-of-way is prohibited unless consistent with section. (o) Weather emergency. It is the responsibility of the contractor to remove construction materials from the project site or secure construction materials at the project site commencing with issuance of a tropical storm or hurricane warning announcement until the time set forth in Subsection (4). When the National Weather Service, National Hurricane Center or appropriate weather agency declare a tropical storm warning or a hurricane warning for any portion of Duval County, Florida, all construction materials, including roof tiles, on all project sites within the city shall be secured and stored onsite in a safe manner or removed so that no material can become a safety hazard with hurricane or tropical storm force winds. (2) Notice. Media broadcasts or notices issued by the National Weather Service or National Hurricane Center of a tropical storm warning or a hurricane warning is hereby deemed notice to the contractor. The contractor is responsible for the project site by securing onsite or removing from the site any construction materials or debris to protect against the effect of hurricane or tropical storm force winds. By holding a building permit during hurricane season, contractor shall monitor the National Weather Service and the National Hurricane Center for weather emergencies. (3) Materials. Materials stockpiled on top of any structure under construction shall be handled as follows: a. Band construction material together and fasten them to the top of the structure in such a manner to prevent the material from becoming airborne during a tropical storm or hurricane; or b. Remove construction materials from the top of the structure and secure them to the ground; or c. Remove construction materials from the project site; or d. Store construction materials inside a structure if said structure is secure from tropical or hurricane force wind loads. (p) Nuisance. A nuisance maintained on a project site is a violation of this Code. This ordinance shall become effective immediately upon its final passage and adoption.
