The Code Enforcement Board of the City of Atlantic Beach was created pursuant to Florida
Statutes and exists for the purpose of facilitating the enforcement of the Code of Ordinances. It is
comprised of seven citizens of Atlantic Beach who meet regularly to hear allegations of code
violations.
You are hereby notified and ordered to appear at the next public hearing of the Code
Enforcement Board on Tuesday, the 14th day of November,2012, at 6:00 pm at Atlantic Beach City
Hall, Commission Chamber, 800 Seminole Road, to answer and be heard to the following alleged
violations on the property known as 60 Ocean Blvd , Lots 5,6,N 37FT, Lot 7 Blk 35, RE#170227-
0000:
City Code of Ordinances
Section 17-61. Permit Required. It shall be unlawful for any person to install, erect,
place, alter or relocate any sign without first obtaining a sign permit with permit with
payment of the required fee to the city.Sign permits shall be required for any sign
requiring a permit under the provisions of Section 3108.1.3., Florida Building Code. A
sign permit shall not be issued prior to issuance of the appropriate occupational license
as required for the activity on the property for which the sign permit is sought, except as
set forth in Section 17-29(c) of this chapter. (wall signs have been added "PIZZA"
painted on exterior wall, several other wall signs, reader boards,wall bracket signs
have been altered using unapproved materials and adding additional signage to
bottom of the permitted existing signs etc.) .
Section 19-1. Obstructing free passage prohibited; exception. No person shall obstruct the
free passage of person or vehicles over any street, sidewalk or other public way by any means
whatsoever, except pursuant to a permit issued by the city manager, and only in accordance
with the terms of the permit and any conditions attached thereto.
The Code Enforcement Board may levy fines up to $250.00 per day for the first offense and
$500.00 for the second offense against the property, if a violation is found to exist beyond the date set
by the Board for compliance. If the violation is corrected and then recurs or if the violation is not
corrected by the time specified for correction by the Code Enforcement Officer, the case could be
presented to the Code Enforcement Board even if the violation has been corrected prior to the Board
hearing. Upon completing the corrective action required, it is your responsibility to contact Atlantic
Beach Code Enforcement and arrange for an inspection to verify compliance at(904) 247-5855.

behalf. If you desire to have witnesses subpoenaed or if you have questions regarding the procedure,
please contact Dayna Williams, Secretary of the Code Enforcement Board within five days of the
receipt of this notice at 247-5810. Please note the presence of a court reporter for the purpose of
insuring a verbatim record in the event an appeal should be secured at your expense.

Please be advised, Atlantic Beach Code Enforcement has found your property referenced above
to be in violation of the City of Atlantic Beach, Code of Ordinances, Chapter 17, Signs, Section
17-61 Permit Required and Chapter 19, Streets Sidewalks and Other Public Places, Section 17-1.

Section 19-1. Obstructing free passage prohibited; exception.
No person shall obstruct the free passage of person or vehicles over any street, sidewalk
or other public way by any means whatsoever, except pursuant to a permit issued by the city
manager, and only in accordance with the terms of the permit and any conditions attached
thereto.
This letter requests that the applications be submitted for the signs installed and/or altered
without the required permits within ten (10) days of the receipt of this notice or remove all
these signs within 24 hours of receipt of this notice. In addition, all merchandise, bicycles
or other items be removed from the public right of way upon receipt of this notice and
cease any future storage of items in the right of way/sidewalk.
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
Enforcement. The Board may impose fines up to two hundred fifty ($250.00) per day for
continuing violations. Upon completing the corrective action(s) required, it is your responsibility
to contact Atlantic Beach Code Enforcement and arrange for an inspection to verify compliance.
It is our goal to enforce the codes and ordinances of the City of Atlantic Beach and protect the
health, safety and welfare of the City, and accordingly, your cooperation in this matter is greatly
