Re: Property of the Dagley Family
Dear Sonya:
This letter is a formal request to seek formal recognition of a previous
agreement in 1986 between the City of Atlantic Beach and the Dagley family.
I represent the Dagley family in this matter.
By way of background, the Dagley family has operated a salvage junkyard
in the City of Atlantic Beach for quite sometime.
In 1986, . a SP special use district was established for their property
pursuant to Ordinance 00-86-100. This special use district is reflected today as
Section 24 -113.
During the passage of that Ordinance, an agreement was made between
the City of Atlantic Beach and the Dagleys, as to the use of certain streets. It
was agreed upon and the parties have used the property that way since 1986.
Specifically, the City of Atlantic Beach and the Dagleys agreed that the
City would close Begonia Street from West 6 Street, South and Tulip Street
from West 6 Street, North. In exchange, the Dagley's agreed to restrict the use
of their operation to that property.
There has become an interest in formalizing this agreement after recent
right of way issues and zoning issues which the zoning department can address.
The bottom line is to request formal recognition of the 1986 agreement
that no right of way would be operated on Begonia Street to the South and Tulip
Street to the North.
Please inform me when I may address the City of Atlantic Beach on this
issue. I would prefer the date of October 27, 2003, if possible.
