Upon motion duly made and seconded the minutes were approved . OLD BUSINESS : I . Application for Variance filed by Robert and Leona Lowther to enclose a porch which encroaches the rear yard setback at property located at 251 Ocean Forest Drive North. This application was remanded back to the -Board by the City Commission after an appeal of the previous denial by the Board in April . Mr . Lowther introduced himself and stated that his wife had an arthritic condition and the proposed construction would allow Ili: wife better mobility around the house . After discussion , Mrs . Pillmore moved to deny the application . The motion was seconded by Mr . Frohwein and the variance was unanimously denied. II . Application for Use-by-Exception filed by Pan Am Mini Storage . Inc . toiallow outside , on-site storage of vehicles at property located ,at 2383 Mayport Road. Terence p . Kane introduced himself to the board and explainer that the City' Commission suggested he file an application for a use-by- j eMcepti.can instead of change in zoning which wa originally requested . After discussion, Mrs . Creag moved to defer .the application until the next meeting to allow the board time to review further documentation. The motion was seconded by the Chairman and passed unanimously . NEW BUSINESS I . Application for Variance filed by Annabelle P . Wallace to construct an aluminum carport which will encroach the side yard setback ! at property located at 221 Seminole Road. 1 The applicant ' s contractor , Floyd Cardin, introduced himself to the boa> d and presented pictures to the board showing the residence • in which the variance was applied for- and the residence next door which h .d previously been granted a similar variance . He stated that Mr . Wallace had consented to the variance . ' After dlscus:oion , Mr . Frohwein moved to deny the apply"ation , Mrs . Walker seconded the motion and the variance was denied by a vote of 3 - 2 . II . Application for. Variance filed by Jerry Dorsch t -2 construc` an addition to the Tappin Book Store which is a non-conf orc:inc structure located at 705 Seminole Road . Mr . Dorsch introduced himself to the Board and explained that the variance was needed to enlarge the storage and indexing section c_ the bookstore . After discussion , Mr . Frohwein moved to grant the variance . The motion was seconded by the Chairman and unanimously passed . III . Application for Use-by-Exception filed by Ted Barrett tc allow a , home occupation license at his property located at 377 7th Street . Mi_ . ADDENDUM TO BUILDING PLAN 1. Building locationg 221 Seminole 2 . The attached plan for the above building is approved subject to meeting the following applicable construction require- ments: a. Footings shall be continuous monolithic concrete under exterior walls, reinforced with two 5/8" deformed reinforcing rods for one-story buildings and three 5/8" deformed reinforcing rods for two- story buildings. Reinforcing rods shall be placed in the lower one-third of the footings, properly placed and fastened on metal saddles with wire. Footings shall be six inches wider on each side than the wall above, shall be at least eight inches thick and shall rest on firm soil at least twelve inches below undisturbed soil. b. In hollow masonry unit construction, each unit cell shall be reinforced with at least one No. 5 bar at all corners; poured and tamped with concrete; such reinforcing shall be properly tied into the footing and spandrel beam. c. All wood truss rafters (roof construction) shall be securely fastened to the exterior walls with approved hurricane anchors or clips. d. Construction of nearby one-family dwellings, which are duplicates or intensely similar, shall be avoided. Such similarity considers the external configuration and appearance (i.e. , roof, outer wall materials, window size and design, and other like characteristics) of structures. In accord with the foregoing, similar or duplicate homes shall not be constructed within close proximity of each other, and shall be at least 500 feet apart if any one similar dwelling is visible from any other similar dwelling . Upon motion duly made and seconded the minutes were approved . OLD BUSINESS : I . Application for Variance filed by Robert and Leona Lowther to enclose a porch which encroaches the rear yard setback at property located at 251 Ocean Forest Drive North. This application was remanded back to the Board by the City Commission after an appeal of the previous denial by the Board in April . Mr . Lowther introduced himself and stated that his wife had an arthritic condition and the proposed construction would allow hi wife better mobility around the house . After discussion , Mrs . Pillmore moved to deny the application . The motion was seconded by Mr . Frohwein and the variance was unanimously denied . II . Application for Use-by-Exception filed by Pan Am Mini Storage . Inc . to allow outside , on-site storage of vehicles at property located ,at 2383 Mayport Road. . Terence ;P . Kane introduced himself to the board and explained that the City Commission suggested he file an application for a use-by- exceptign instead of change in zoning which wa.= originally requestejd. After discussion, Mrs . Gregg moved to defer the application until the next meeting to allow the board time to review further documentation . The motion was seconded by the Chairman and passed unanimously . NEW BUSINESS I . Application for Variance filed by Annabelle P . Wallace to construct an aluminum carport which will encroach the side yard setbacklat property located at 221 Seminole Road . The applicant ' s contractor , Floyd Cardin, introduced himself to the board and presented pictures to the board showing the residence in which the variance was applied for. and the residence next door which h ..d previously been granted a similar variance . He stater? that Mr . Wallace had consented to the variance . After discussion , Mr . Frohwein moved to deny the application , Mrs . Walker seconded the motion and the variance was denied by a vote of 3 - 2 . II . Application for. Variance filed by Jerry Dorsch to construct an addition to the Tappin Book Store which is a non-conforming structure located at 705 Seminole Road. Mr . Dorsch introduced himself to the Board and explained that the variance was needed to enlarge the storage and indexing section of the bookstore . After discussion , Mr . Frohwein moved to grant the variance . The motion was seconded by the Chairman and unanimously passed . III . Application for Use-by-Exception filed by Ted Barrett to allow a . home occupation license at his property located at 377 7th Street . Mir. Barrett introduced himself to the Board and explained that the use-by-exception was requested to allow him .to conduct hid. contracting business at his residence and stated that there would be no outside storage or parking of equipment or supplies . Wallace was heard and acted upon. Mrs . Wallace requested a Variance to the side yard setback requirement for the construction of a carport to within three feet of that side property line. At the Community Development Board meeting the board found that insufficient grounds existed to grant the Variance. Mrs . Wallace appealed to the City Commission. At the meeting of the City Commission, Mrs . Wallace explained her desire for the carport including her reasons. The code requirements as well as the physical relationships of the existing and proposed structures was explained by staff. Upon conclusion of deliberations, the City Commission found that Mrs. Wallace did have sufficient grounds to obtain a Variance to the side yard setback requirement and granted her a Variance to permit the construction of an aluminum carport to a point three feet from the north side property line. No future enclosure of this carport is to be permitted, including screen or solid walls. This Variance is to run with the land and is transferable with the title to the property.
