We inspected several vacant apartments and two occupied units. After a conversation with you we have determined the units we inspected are consistent with the condition of the entire complex. We have noted that the hot water heaters, plumbing, windows, doors, and roofs need replacing or repairs. No working smoke detectors were found. Current code requires smoke detectors in all sleeping rooms and hall ways. They must be hard wired. Battery powered smoke detectors do not meet the National Electrical Code for installation in apartments. We have noted there is mold in several units which indicates excessive moisture entering the units. -- Per this notice units addressed as 150B, 155B, 1551), 170A, 170D, 215C, 220B, 220C, 260B, 280B,285C, 295A,295C, 325C, 375A, and 380A shall not be occupied until being permitted and all code violations corrected and inspected by the City of Atlantic Beach Building Dept. These units must be secured immediately by boarding up or by installing permanent, secure doors and windows. The code used for this inspection is the 1997 Standard Housing Code. Do C. As you are already aware,the current condition of the buildings on the property have given rise to several complaints from the public. A successful renovation project will provide needed affordable housing for the community and improve the looks of the entrance to our City dramatically. City staff has discussed with me a number of issues related to the project. One is that site and landscaping plans have not been received as of this time. This includes a drawing showing how you plan to comply with the city's parking regulations of two parking places per unit and. We understand that your intent is to begin construction on some of the buildings in the near future before any site plan has been approved. While it is certainly better to start the construction sooner rather than later,this letter is to request that you provide a little more information on your overall plans. Please provide answers to the following questions; 1) What is your phasing plan and overall time schedule for completion of all phases of this work? 2) How many units do you expect to be working on before the site plan is submitted for city review? This ordinance is partially a result of the numerous complaints that the City has received about the partially demolished condition of the Palms Apartments on Mayport Road. It applies to construction or demolition jobs where no substantial work has been completed for a six month period. This ordinance will apply to your property going forward which means that you will need to get a building permit and accomplish substantial progress resulting in approval of major inspections within the next six months, or you will be in violation of the City Code. A copy of the adopted ordinance is attached for your information. Also attached is a copy of my letter of December 20, 2007. You may not have received it as we have not heard from you in response. Included shall be the requirement that The Palms perform the following: (a) Keep the property free from debris; (b) Keep the grass and any weeds maintained, keep the property free from tall grass,and mow the property at least twice per month; (c) Keep unauthorized people out of the buildings, keep the security plywood boarding in place,and otherwise keep the premises secured when any construction begins; (d) Keep armed security personnel on location twenty-four (24) hours a day, seven (7) days a week, who will aggressively patrol and inspect the buildings and keep unauthorized people out. They should call the police with any problems. (e) Keep the"No Trespassing"signs posted; (f) Keep secure fencing in place to keep unauthorized people out. Access for Atlantic Beach Police should be allowed; (g) Have a local contact person available at all times; (h) Keep the security lighting repaired and in working order; (i) Allow city personnel to inspect the property at any time,which may include gaining access to the buildings; and 0) Immediately fill the pool with sand and secure the fence around the pool. This shall remain in place until the pool is operational. 2. Provided that all of the aforesaid conditions and requirements are met and maintained by The Palms, the City shall not proceed with action to demolish the buildings located on the property. 3. The guard was parked in the north side of the complex and was awake. The guard reported tome that she observed three men in an apartment and pointed to a building and asked if I just saw the lights go out in the room. She said that she observed movement in two upstairs rooms where she saw the lights go out. I checked the building and it was completely sealed and I am positive no one was able to gain entry. After 1 explained to the guard that the building was secure she started telling me that she saw a man in a gray metal container with a door on the back of it standing by the wall of the apartment building I just left. The apartment was directly in front of me in plain sight. She pointed and told me that he was standing right there against the wall. I shined my light on the wall and she told me that was where the man in the gray container was standing however nobody was there. The owner of the security company, Ms. Printella Bankhead, arrived and said she was going to be working with the guard for the remainder of the night. The south and middle entrances were restricted with cable to prevent vehicles from entering, however it would not stop foot traffic. The north entrance was not roped off but the guards were parked there. All of the streetlights were on except for the one in the 300 block where the guards were parked. The buildings were boarded up and secure. This was the cleanest I have seen the Palms since I have been employed here. I informed Sgt. Hundley about the incident and he will also be checking the area. Additionally, I have advised Mr. Kololgi that, even though the earlier request of the Staff was to drain the swimming pool on the site (which he has done), the City would now prefer the pool be filled with sand. Mr. Kololgi is making arrangements for the pool to be filled with sand as well. As I stated to Mayor Wolfson, I am hopeful I can have an understanding as well as written confirmation of the City's expectations on "sight" issues over and above the health safety issues with which Mr. Kololgi has already dealt. I was shocked by Mr. Hanson's letter that I got at 10.30 am on 06/15/06,yesterday detailing all the problems with the property. I have been in almost constant contact with Jeff Klotz since then and he is working hard to get the men and materials (including dumpsters) so the problems are resolved as soon as possible. Some workers were there this morning and he is arranging more to work through this weekend. Dumpsters are being ordered for delivery ASAP so that the trash put in. The apartments will be reboarded with longer stronger nails. He plans to work on the grass and vegetation today (crew is there). The work started within 24 hours of my getting the letter. He will be intouch with Mr. Hanson to update him and listen to his suggestions. I told Jeff and he agreed that we need security people like off duty police officers to prevent people from breaking in. He has contacted people and agencies about the same. The concern of the security fence is that it should not prevent legal and government officers from getting in. Possibly, adequate security people may be an option. I will let Jeff decide this with Mr. Hanson. Jeff and I have been working on a written plan for resolving the problems. It is now in the third revision and we will refine it over the weekend and send it to Mr. Hanson by Monday,June 19th,2006. We will make it comprehensive for the present and future. I really would like to be a responsible citizen of the City of Atlantic Beach,till the property is sold. The site is adjacent to commercial and is not located within the CHHA. The existing multi-family use is consistent with the Zoning District classification and the Comprehensive Plan land use designation. I cannot verify that required parking is provided as I do not have current informtion related to the number of existing on-site parking spaces. Land Development Regulations require two spaces per Dwelling Unit at a dimension of 10-feet by 20- feet. The City of Atlantic Beach has no regulations related to condominiums or conversion to condominiums. City Land Development Regulations address only the use, which is multi- family, regardless of the form of ownership. Condominium formation, of course, will be regulated by applicable State law. The City of Atlantic Beach does regulate short-term rental of residential uses. Short-term rentals, which are periods of rental less than ninety (90) days in term, are considered to be a commercial activity, similar to hotel, motel, motor lodge, resort rental, bed and breakfast or tourist court uses. Such uses are permitted only within commercial Zoning Districts where Short-term rental uses are permitted. Such commercial activity would not be consistent with the Zoning District classification or the Comprehensive Plan land use designation of the subject property. Any period of rental exceeding ninety consecutive (90) days, however, is considered to be a residential use, and there is no limitation on the number of 90-day terms a unit may be leased within a calendar year. I cannot address whether there are any outstanding Building Code violations on this property, as the City Building Department has had no reason to conduct recent inspections on the property. I will advise that should there be any discrepancy in these land area amounts once applications for development permits are submitted, the allowable number of dwelling unit will need to be adjusted accordingly. The calculated number of units also assumes provision of all other development requirements, including parking, access, internal circulation„ utilities and stormwater management. As you have noted, the Atlantic Arms site is located partially within a Residential, High Density Land Use designation, which permits up to 20 Dwelling Units per acre, and partially within a Commercial land use designation, which permits up to 14 Dwelling Units per acre, where such land is adjacent to other commercial and not within the Coastal High Hazard Area (CHHA.) The site is adjacent to commercial and is not located within the CHHA. The Palms property is located fully within the within the Residential, High Density Land Use designation. The Zoning District designation of the larger portion of the combined land area for the two sites is Residential General, Multi-family (RG-3.) As you have also noted, a smaller 3.55-acre portion of the property, which fronts Mayport Road, is zoned Commerical Limited (CL.) In accordance with following Section 24-81 of the Land Development Regulations, the Residential General, Multi-family zoning designations may be extended to encompass both sites, provided that the properties are developed under unified ownership consistent with the Comprehensive Plan density limitations. Sec. 24-81. Rules for Determining Boundaries. (a) Where a Zoning District boundary line as appearing on the Zoning Map divides a Lot, which is in single ownership, the Zoning District classification of the larger portion may be extended to the remainder of the property subject to consistency with the Comprehensive Plan. Sec. 24-82. General Restrictions upon Land,Buildings and Structures. (a) Use. No Building or Structure shall be placed or erected, and no existing Building shall be moved, altered, added to or enlarged, nor shall any Land, Building, Structure or premises be used, designed or intended to be used for any purpose or in any manner other than a Use designated in this Chapter, as allowed in the Zoning District in which such Land, Building, Structure or premises are located. Further, no Land shall be used except in compliance with the Comprehensive Plan. (b) Number of Buildings allowed on a Single-family or Two-family (Duplex) Lot. The total number of Buildings on any Lot zoned only for Single-family or Two-family (Duplex) Use shall not exceed three(3) including the Principal Use Structure,detached garages and any other detached Building. (c) Height. No Structures or Building shall be erected, and no existing Building shall be moved, reconditioned or structurally altered so as to exceed the height limit specified in this Chapter for the Zoning District in which such Building or Structure is located. However, on Nonconforming Lots of Record, the Height of Buildings shall be restricted to a percentage of the area of the such Lot compared to the minimum requirements of the Zoning District and applying the same to the maximum Height of Building allowed in said Zoning District. (For example, if the Minimum Lot Area is 5,000 square foot, and the size of the Nonconforming Lot is 2,500 square feet, a percentage of 50 percent would be applied to the 35-foot height restrictions, resulting in an allowable Height of Building of seventeen and one-half(17.5)feet. All Development of Land and Parcels within the RG-2 and RG-3 Zoning Districts shall comply with the residential Density limitations as set forth within the adopted Comprehensive Plan for the City of Atlantic Beach, as may be amended. (b) Permitted Uses. The Uses permitted RG-2 and RG-3 Zoning Districts shall be as follows. (1) Single-family Dwellings. (2) Two-family(duplex)Dwellings. (3) Townhouses, subject to compliance with Article IV, Subdivision Regulations and Section 24-87. (4) Multi-family Dwellings, subject to the Density limitations as set forth in the Comprehensive Plan. (5) Accessory Uses as set forth in Section 24-151. (6) Government Buildings and facilities. (7) Family Day Care Homes and Group Care Homes. (c) Uses-by-Exception. Subject to the provisions of Section 24-63, the following Uses may be approved as a Use-by-Exception within the RG-2 and RG-3 Zoning Districts. (1) Churches. (2) Public and private recreation facilities not of a commercial nature and of a neighborhood scale intended to serve the surrounding residential neighborhood. (3) Child Care Centers. (4) Schools and Community Centers. (5) Home Occupations subject to the provisions of Section 24-159. (d) Minimum Lot Size. The minimum size for Lots within the RG-2 and RG-3 Zoning Districts which are created after the initial effective date of these Land Development Regulations, shall be as follows. (1) Lot or Site Area: i. Single-family Dwellings: 5,000 square feet. ii. Two-family Dwellings or Townhouse: Lands designated as Low Density by the Future Land Use Map: 14,500 square feet Lands designated as Medium Density by the Future Land Use Map: 6,200 square feet Lands designated as High Density by the Future Land Use Map: 5000 square feet iii. Multi-family Dwellings: Minimum 5000 square feet, with maximum number of Dwelling Units determined by the Density limitations as set forth in the Comprehensive Plan. Initial Effective Date: January 01,2002 Last amended April 11,2005 as adopted by Ordinance Number 90-01-173 as adopted by Ordinance 90-05-186 50 (2) Lot width in the RG-2 and RG-3 Zoning Districts: i. Single-family Dwellings: Fifty(50)feet. ii. Two-family Dwelling or Townhouse: Fifty(50)feet. iii. Multi-family Dwellings: Seventy-five(75)feet (3) Lot depth in the RG-2 and RG-3 Zoning Districts: One hundred(100) feet: Existing legally established Lots of Record may exist, which do not meet the above requirements, These Lots may be developed subject to all applicable Land Development Regulations; however, all Lots created after January 01, 2002 must comply with the Minimum Lot Size requirements in order to obtain Building Permits authorizing Development. (See Section 24-188 and Section 24-189.) (e) Minimum Yard Requirements. The minimum Yard Requirements in the RG-2 and RG-3 Zoning Districts shall be as follows. (1) Front Yard: Twenty(20)feet. (2) Rear Yard: Twenty(20)feet. (3) Side Yard: i. Single-family Dwellings: Combined fifteen (15) total feet and five (5) minimum feet on either side. In the case of an existing Nonconforming Structure that does not comply with Required Side Yards, any new Development shall provide for a combined total Side Yard of fifteen (15)total feet. For example, where an existing Structure is located three(3) feet from the side Lot Line, new Development on the opposite side Yard shall provide a minimum Required Side Yard of twelve (12) feet, thereby providing for a combined total side Yard of fifteen(15)feet. ii. Two-family(Duplex)Dwellings and Townhouse. Seven and one-half(7.5)each side. iii. Multi-family Dwellings: Fifteen (15)feet each side. (f) Building Restrictions. District shall mean Zoning District classifications as established by the official Zoning Map and as set forth within Division 5 of this Chapter. Duplex. See Dwelling,Two-family. Dwelling Unit shall mean a single unit providing complete independent living facilities for one Family as defined herein, including permanent provisions for living, sleeping, eating, cooking and sanitation. Dwelling, Multi-family shall mean a residential Building designed for or occupied exclusively by three (3) or more Families, with the number of Families in residence not exceeding the number of Dwelling Units provided. Dwelling, Single-family shall mean a Building containing one Dwelling Unit, and not attached to any other Dwelling Unit by any means, and occupied by one Family only. Dwelling, Two-family (Duplex) shall mean a residential Building containing two Dwelling Units designed for or occupied by two (2) Families, with the number of Families in residence not exceeding one Family per Dwelling Unit. Easement shall mean a grant from a property owner or public agency for the Use of Land for a specific purpose or purposes by the general public or a public agency,by a corporation or by certain person(s). Eaves and Cornices shall mean typical projections, overhangs or extensions from the roof Structure of a Building. Eaves and Cornices shall not project beyond forty-eight (48) inches into Required Front and Rear Yards. Eaves and Cornices shall not project into Required Side Yards beyond twenty-four (24) inches, or forty(40)percent of the established Required Side Yard Setback,whichever distance is less. Environmentally Sensitive Areas shall include lands, waters or areas within the City of Atlantic Beach which meet any of the following criteria: (a) Wetlands determined to be jurisdictional, and which are regulated by the Florida Department of Environmental Protection(FDEP)and the St.Johns River Water Management District(SJRWMD); (b) Estuaries or estuarine systems; (c) Outstanding Florida Waters and Natural Water Bodies; (d) Areas designated pursuant to the Federal Coastal Barrier Resource Act(PL97-348), and those beach and dune areas seaward of the Coastal Construction Control Line; (e) Areas designated as Conservation by the Future Land Use Map; (f) Essential Habitat to Listed Species as determined by approved methodologies of the Florida Fish and Wildlife Conservation Commission, the Department of Agriculture and Consumer Services, and the U.S. Fish& Wildlife Service. Exception, Use-by is a departure from the general Use provisions of these Land Development Regulations, which may be granted in accordance with the express provisions of Section 24-63 of this Chapter. They are preparing a Variance and a Use-by-Exception for several minor things. (The UBE is related to parking, but we still have that provision in Section 24-63 that requires a UBE for anything related to parking. Going to fix that first chance I can.) Variance request will be to reduce the 15-foot side setback along the Mayport Road. Rick Carper will present it to the Community Development Board. Its pretty straightforward per Code that Atlantic Boulevard is the Required Front Yard and Mayport Road is the Required Side Yard, since the narrowest side that abuts a street if the Atlantic Boulevard side, but still think it is best that you verify it rather than me. I don't think they need a letter if you will just note Front — Rear — Side on the Site Plan and sign or initial, that will be good enough. Think they are just trying to avoid any wasted time and discussion for non-issues during the meetings. He will be intouch with Mr. Hanson to update him and listen to his suggestions. I told Jeff and he agreed that we need security people like off duty police officers to prevent people from breaking in. He has contacted people and agencies about the same. The concern of the security fence is that it should not prevent legal and government officers from getting in. Possibly, adequate security people may be an option. I will let Jeff decide this with Mr. Hanson. Jeff and I have been working on a written plan for resolving the problems. It is now in the third revision and we will refine it over the weekend and send it to Mr. Hanson by Monday, June 19th,2006. We will make it comprehensive for the present and future. I will advise that should there be any discrepancy in these land area amounts once applications for development permits are submitted, the allowable number of dwelling unit will need to be adjusted accordingly. The calculated number of units also assumes provision of all other development requirements, including parking, access, internal circulation„ utilities and stormwater management. Demolition of Palms ordered Site to be cleared by April 13 FROM STAFF The owner of The Palms Apartments has a month to begin demolition of the vacant structures or the city of Atlantic Beach will negotiate bids to remove the 25 buildings. Owner Chris Hionides must be done with the work by April 13, the city said. The property at 3952 Mayport Road is a blight on nearby businesses and housing, City Manager Jim Hanson told the commission Monday night. "Removing walls would eliminate an eyesore and help with public safety," he said. Hanson read a letter sent to the city by Hionides. In the letter, Hionides said he wants to demolish the buildings himself and said the work would be done in six months. Hanson said he also wants to pursue a Planned Unit Development for the property. City building official Mike Griffin told commissioners that the property is open to vagrants and children, with evidence of occupancy. He recommended removal. In late August, the city sent the owner notice that the buildings violate city code and gave him 20 days to submit a building permit or appeal. Hanson said the request for an extension came after the deadline, prompting the staff recommendation to authorize demolition. The commission formally turned down the request for an extension and authorized the city to take bids for demolition, but give Hionides 30 days to begin demolition on his own. Hanson said the structures on the site have to be taken down, fences have to be removed and work done on a swimming pool on the property. "He [Hionides] has put the right foot forward offering to do this [demolition]," Hanson said. Mayor John Meserve said once the work begins, steady progress needs to be evident. City Commissioner John Fletcher said he thinks six months is too long a period for the demolition to be accomplished.
