The 3/4" hole is in the steel lining. The repair procedure would have to done based on
the UL 127 Testing requirements. Also the metal of the firebox does not fit flush against
the
vertical masonry wall and is also a concern. The manufacturers installation procedures
will tell us if the installation is correct. our files have no plans/installation
procedures of your residence.

I would like to solve this fireplace problem as soon as possible. In order
for me to have it done to Code, I would like to know if you can answer these
questions for me. The 3/4 inch hole-was that in the brick lining or in a
steel lining. If it is steel and the hole in the liner can be welded
shut (closed)-does that solve the problem.? As you can tell, I am nor sure
where the hole is and in what kind of material we are talking about.
The fireplace was never a gas fireplace that was converted to a wood burning
fireplace. From the very outset it was a wood burning fireplace. I don't
know if a copy of the plans for the unit regarding the installation is on
file with City indicating what manufacture product was use for the
installation. Are such plans on file with your office?

THE CODE SECTION THAT YOUR FIREPLACE VIOLATES IS SECTION 101.6 OF THE
STANDARD HOUSING
CODE. 1997 EDITION.
101.6 Maintenance
All buildings or structures, both existing and new, and all parts
thereof, shall be maintained in a safe and sanitary
condition. All devices or safe guards which are required by this code
in a building when erected,altered,or repaired,
shall be maintained in good working order. The owner or his designated

agent, shall be responsible for the
maintenance of building, structures and premises.
THE DEFECT THAT IS OF CONCERN IS THAT THE FIREPLACE IS A GAS LOG
INSTALLATION, WHICH HAS BEEN DISMANTLED AND IS SET UP FOR USE AS A WOOD
BURNING FIREPLACE. THERE IS A 3/411 HOLE IN THE FIREBOX THAT WILL ALLOW
FLAMES TO PASS THROUGH TO SUPPORT FRAMING.
IF YOU HAVE A COPY OF THE MANUFACTURERS INSTALLATION INSTRUCTIONS THAT
OVERRIDE THIS WE
WILL CONSIDER IT.
