The entire latch has been removed, and the concrete paver that has been used to hold the gate shut has been left aside on two occasions. Each time, I've had to put it back in place for fear of their dogs escaping, and I'm afraid to tend my plants on that side of my house. Although the back yard has been cleared and much of the rotted wood removed, there are still loose boards and shredded screen on what used to be the enclosed porch, and it's very unsightly. According to my records, a fine should have been imposed over a week ago for failure to replace or reinforce the gate. Please reply if you would like to come back to re-inspect the back of my neighbor's house from my upper porch. Meanwhile, the rotted gate is easily visible from my driveway. Originally, I told you and the commissioners that my personal interest was in having the dogs declared dangerous and restrained. But having seen the photos of the dog that was attacked, and knowing that the dog owners have no intent of ever improving the situation, I now feel that the dogs pose a greater danger than I first realized and should be removed. Living directly south of Ms. Leviseur's property, I have a unique view of the home, patio and yard in the rear of the house from my upper porch. When the dogs aren't inside or on the balcony, they are allowed outside in back, where they deficate on the porch and on the grounds with no clean-up. The foliage in back is so over-grown, that the dogs have a hard time getting any real exercise. i There is always stagnant black water in the hot tub, but I never see fresh water for the dogs, and the gate is being held shut by some paver blocks that I originally put there to try keeping the dogs inside the fence. I had to install a strong board-on-board fence against the previous fence between our properties because it had rotted, the dogs were trying to break through, and Ms. Leviseur wouldn't share the cost of replacing it. The dogs have gotten so thin, and are so lacking in exercise, that my latest fear is about their possible abuse or neglect. Having re-read the complete city pet ordinance, I hope that the entire property can be inspected at some point. I know that, given the exterior condition of Ms. Leviseur's property, I could never sell my home for a fair price. If the dogs aren't removed and the condition of the property improved, I know that I will have to appeal to the mayor and city commissioners at some point regarding the loss of my property value. Since my neighbor's property is so lacking in maintenance, and Willi's behavior has become so intolerable, I may try contacting the property owner, Richard Babillis, who is Ms. Leviseur's husband and Willi's father, who lives in PA. I know "Rich" hasn't visited in years and doubt he knows anything about the current condition of the house or about the threat Willi's dogs are posing for his former neighbors. For purposes of this section, "habitually" means at least two (2) separate occurrences within a time period of no more than one (1)month; except that barking habitually or making other objectionable animal noises habitually means making the sound persistently or continuously for at least thirty (30) minutes occurring at least three (3) separate times within a period of no more than thirty (30) days. Specifically, the Nuisance Notice requires that Ms. Leviseur, within three (3) days from the date she receives the notification, make any corrections necessary to confine the animals on her property. Further, if they do not confine the animals securely on their property, the city may remedy the situation by immediately impounding the dogs. I would to remind everyone again that if the dog(s) get loose, please call the police department immediately so we can respond and investigate. If an immediate public safety hazard exists you should dial 911. Finally, I have indirectly received some emails, via the Clerk's office, that have circulated today regarding a possible court date on Monday for some of the citations. We do understand that a couple of witnesses would not be available to testify on that date. Please be advised that Animal Control has been working on this and we intend to have a motion filed for a continuance. We also intend to request the citations be transferred to criminal court to be heard by a judge in conjunction with the nuisance charge. The photos don't show the entire situation. Lindsay Cole plans to borrow my camera and take photos from her side of house, which she says is just as bad or worse, and I'm sure she will share them with you too. I explained to her the height of the rail, spacing and materials had to be according to the Florida Building Code and gave her the dimensions . She said she was going to replace the guardrails exactly as there were. I will inspect the property on Monday morning to verify compliance with installation of either a temporary or permanent rail has been installed and if not will get with our Building Official on next course of action. I have inspected 330 Magnolia Street and found that a portion of the guardrails on the 2nd story deck in front have been removed. . Regardless of any procedural mis-steps that may have occurred regarding the appeal of the dangerous dog designation hearing, we continue to remain scared to death of the dogs living next door. My fears about the condition of the balcony, and all of our complaints, has led to an even worse situation, as Willi Babillis has torn the railing and slats off half of the balcony and continues to leave the dogs on the unsecured half of the porch with an unsecure barricade. Even if she intends to fix the balcony herself or seek volunteer help from our city volunteers again to do the work, nothing will be fixed before school lets out today or Lindsay Cole arrives home from work. Please, PLEASE have an animal control or a police officer check out the situation and get Ms. Babillis to secure the dogs inside or in the back yard until the balcony is fixed properly. Regardless of any procedural mis-steps that may have occurred regarding the appeal of the dangerous dog designation hearing, we continue to remain scared to death of the dogs living next door. My fears about the condition of the balcony, and all of our complaints, has led to an even worse situation, as Willi Babillis has torn the railing and slats off half of the balcony and continues to leave the dogs on the unsecured half of the porch with an unsecure barricade. Even if she intends to fix the balcony herself or seek volunteer help from our city volunteers again to do the work, nothing will be fixed before school lets out today or Lindsay Cole arrives home from work. Please, PLEASE have an animal control or a police officer check out the situation and get Ms. Babillis to secure the dogs inside or in the back yard until the balcony is fixed properly.
