Hubbard, applied to the Community Development Board for a Variance to permit the construction of a screened room addition to the rear of her residence which would encroach the rear setback requirement by four feet. At the hearing , the Board found that no hardship existed that justified the proposed encroachment . RECOMMENDATION: Staff recommends that this appeal be denied based upon the lack of apparent hardship, and that the granting of this variance would confer upon the applicant a special privilege denied by the Zoning Code to other lands in the same district, namely a sixteen foot rear setback where twenty feet is required. Applicant desires a Use-by-Exception to permit a neuromuscular therapy clinic at a location in a CG zoning district. This business is similar to a massage therapy clinic . The location has adequate ingress/egress and parkin-- . RECOMMENDATION : Considering the low traffic generation, the ingress/egress and parking , and considering that this use is similar to one approved approximately six months ago which has riot generated any complaints , Staff recommends approval'-- of this request. AGENDA ITEM: #3b Application for rezoning of 228;3 Mayport Road from CG to ILW for the operation of a Mini warehouse facility with outside storage of automobiles. The applicant; currently operates a mini storage facility in :a CG district along with the outside storage of automobiles on the same site . The storage business is permitted as a Use-by-Exception in the CG district, however, '.;he outside storage of automobiles is only permitted in the ILW district. The area surrounding Pan Am Mini Storage is all zoned CG- RECOMMENDATION: G.R.EC,OMMENDATION: Staff agrees that in all probability Pan Am will keep a clean and unobtrusive operation. Rezoning this location will legitimize the outside storage of automobiles . It will also allow as Permitted Uses bulk storage yards, manufacturing , contractors storage yards, vehicle repairs and similar uses. These would be located adjacent to Mayport. Road. Outside storage has the potential to become a collection point for disabled and abandoned automobiles. Maintenance of stich sites is difficult at best. Rezoning this CG property to II.,W could open the door to many more requests from the other storage businesses. In addition, this is a drastic step to take to permit outside storage which could lead to a downgrading of the adjacent areas . Because of the potentia]. for degrading the .area and because of the other permitted uses of ILW, Staff' recommends-Den..-.al . AGENDA ITEM: 3c . Application for rezoning of RG-1 lots at 310 Mayport Road to CG as part of a Mini Storage business. . Two of the lots are adjacent to the Mini Storage and two are across the road. The twoadjacent lots are fenced in as part of the mini storage use. ; The two lots on the south side of West Third contain existing mini storage buildings . The applicant requests that these 4 ots be rezoned to assure that he has the capability of expanding the existing buildings onto those lots. He has not expressed the intent to construct such an expansion at this time. RECOMMENDATION: Due to the adjacent CG uses on both sides of the street and the fact. that the applicant has common ownership of the adjacent Mini Storage business , Staff recommends approval. of this request with the _stipulation that the 'use of these lots be made in strict compliance. with the CG district regulations including no outside.._storage o_f__ vehicles . AGENDA ITEM: 3d . Application for Variance to rear yard setback at 251 Ocean Forest Drive for the construction of an enclosed porch. The addition will be 10 feet from the rear property line. The required setback is 20 feet. RECOMMENDATION: No hardship has been demonstrated by the applicant. Application for Variance to permit the placement and use of a mobile office trailer at 880 Mayport Road. Lowther introduced himself to the Board and explained why the variance was requested. After discussion . Mr . Wolfson moved to deny the application , Ms . Gregg seconded the motion and the application was denied by a unanimous vote. V . Application for Variance filed by William H. Dukes , Jr . , to allow a 10-foot x 36-foot trailer for office and storage space at property located at 880 Mayport Raod. Mr . Dukes introduced himsel"f to the Board and explained that the variance was requested for storage purposes at his property for 12-month period. After discussion, Ms . Gregg moved to grant the variance for a period of six months . The Chairman seconded the motion and it was granted by a vote of 3 - 1 .
