Dear Ms. Schell:
Our records indicate the site plan submitted with your fence permit application was not accurate
which creates a violation of City of Atlantic Beach, Code of Ordinances violation. The site plan
submitted indicated forty four(44') from the building to the front line, based on this site plan a
permit was issued to install the six and four foot tall sections of wood fencing. The property
actually is twenty nine (29') from the building to the front lot line, making the six (6')tall
section closes to the street being too tall and in violation to wit:
VIOLATION
City of Atlantic Beach, Code of Ordinances Section 24-157 Fences.
(b) Height and location.
(1) Within required front yards, the maximum height of any fence shall be four
(4) feet. (The required front yard set-back at this location is twenty(20')
Please have the six(6') tall section of wood fencing closest to the street lowered/modified to
four(4') feet tall and call to schedule an inspection when work is completed within twenty
(20) days of the receipt of this notice.
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
Enforcement. The Board may impose fines up to two hundred fifty($250.00)per day for
continuing violations.
