Ladies & Gentlemen:
Atlantic Geotechnical & Environmental Services (AGES) has completed a geotechnical
exploration of the subsurface conditions beneath the referenced residential structure. The purpose
of the geotechnical study was to verify a permitted construction plan requirement that a minimum
bearing capacity of 2,500 psf could be obtained by the subsurface soils below the constructed
foundation modifications.
The geotechnical exploration, which was conducted on 03/28/03, consisted of two(2) 20-foot
penetration test borings adjacent to the existing building foundations. The field test locations were
established by our personnel using paced and taped measurements from the existing site features and
building corners. The boring locations, as shown on the Field Exploration Plan, should be considered
approximate. The attached Test Boring Records present the descriptions of the subsurface soils
encountered, the groundwater levels encountered, and the penetration resistances recorded when
drilling and sampling the test borings. The stratification lines and depth designations on the boring
records represent the approximate boundary between the various soils encountered, as determined
in the field by our drillers, and the transition from one strata to the next should be considered
approximate.
It is our opinion that the site and subsurface conditions are favorable and that the existing one
story wood frame residential structure is founded on a reconstructed stem wall shallow foundation
system with subsurface soil conditions providing the required 2,500 psf allowable bearing pressure.
We estimate that total structural settlement due to fill and structural loads will probably be on the order
of one inch or less. In addition, post construction differential settlements should be within tolerabli-,
magnitudes. The total and differential settlement should occur concurrently with construction due to
the generally sandy nature of the soils encountered.

FIELD EXPLORATION PROCEDURES
Penetration Borlinas
The penetration borings were made in general accordance with ASTM D 1586-67,"Penetration Test and
Split-Barrel Sampling of Soils". The borings were advanced to the water table by augering and,after encountering
the groundwater table,further advanced by"wash-and-chop"drilling techniques using a circulating bentonite fluid
for borehole flushing and stability. At two-foot intervals within the upper 10 feet and at five-foot intervals thereafter,
the drilling tools were removed from the borehole and a split-barrel sampler inserted to the borehole bottom and
driven 18 inches into the material using a 140-pound SPT hammer falling,on the average,30 inches per hammer
blow. The number of hammer blows for the final 12 inches of penetration is termed the"penetration resistance,
blow count,or N-value". This value is an index to several in-place geotechnical properties of the material tested,
such as relative density and Young's Modulus.
After driving the sampler 18 inches (or less, if in hard rock or rock-like material)at each test interval,the
sampler was retrieved from the borehole and a representative sample of the material within the split-barrel was
placed in a glass jar and sealed. After completing the drilling operations, the samples for the boring were
transported to our laboratory where they were examined by our engineer in order to verify the driller's field
classifications. The samples will be kept in our laboratory for a period of two months after submittal of formal
written report, unless otherwise directed by the client.

Fasteners
All fasteners must be driven flush with the shingle surface and penetrate at least—"into the wood deck.Where the
deck is less than—"thick the fastener should be long enough to penetrate fully and extend at least 1/8"through
the roof deck.
Owens Coming recommends the use of nails as the preferred method of attaching shingles to
wood decking or other nailable substrates. If staples are used they must be,corrosion resistant,zinc-
coated, 16-gauge minimum with minimum 15/16"crown width. Staples must be long enough to

penetrate at least—' into solid decking,or extend a minimum of 1/8"through the APA-rated sheathing.

Portable storage structures may be used within the City of Atlantic Beach following submittal of this completed
form to the Building and Zoning Department. Within all residential Zoning Districts, these may be used only for
the temporary storage of personal household belongings of occupants of the property and may be placed on the
property for a period not to exceed four (4) days or ninety-six (96) hours. Registration is required each time that a
temporary storage structure is placed on the property. In the event of damage to a residence by fire, storm, flood, or
other such property loss, this period of time may be extended to ten (10) days upon request to and written approval
of the City Manager. Within all non-residential Zoning Districts, enclosed portable storage structures may be used

Dear Mrs. Kilcullen:
After reviewing your Variance application and discussing the matter with your architect,
I am returning your application for a Variance. (I have initiated the process for a refund
of your application fees.) There is not a Variance procedure by which a non-conforming
structure can be deemed conforming for the purpose of permitting construction upon an
adjacent tot. -1
After talking a bit more with your architect, I want to try and clarify a few issues related
to your property. Your property consists of two legally created Lots of Record, Lots 14
and 16, within Block 7 of Atlantic Beach subdivision "A." These continue to be two
sepatate lots, although they have been treated as a single development parcel with respect
to required setbacks. Your residence on Lot 16 is a non-conforming structure in that only
a 4.8-foot setback is provided on the west side of the lot and only a 7.5-foot setback is
provided on the east side.
If it is your desire to sell Lot 14 as a separate lot, there is not a prohibition against doing
this provided that a ten-foot setback must be provided along the east side of Lot 16. In
other words, a portion of the existing house must be demolished so that it is located at
least 10-feet from the lot line that divides Lots 16 and Lot 14, or alternatively a 7.5-foot
setback could be created on the west side. (The 4.8 setbacks on the west side of Lot 16 is
not an issue, since this minor deficit in setback and is within the allowed 5% percent
administrative waiver.) Further, any new construction on Lot 16 must comply with
current setbacks. A Variance could be sought in conjunction with future construction on
Lot 16, but I must frankly advise, I think it is unlikely that a Variance would be
approved, in that your lot is a regularly-shaped lot and substantially deeper that the 100-
foot deep lot typical of the area.

Variance, Zoning. A Zoning Variance shall mean a relaxation in the terms of this Chapter where such
Variance shall not be contrary to the public interest, and where because of exceptional narrowness,
shallowness, irregular shape of a specific piece of property, or because of exceptional topographic
conditions, or other unusual circumstances particular to a specific property, the literal enforcement of
certain requirements of this Chapter would result in an undue Hardship to carry out the purpose and intent
of this Chapter, or would be contrary to the purpose and intent of this Chapter. A Zoning Variance shall
not reduce Minimum Lot Area, Lot Width or increase Maximum Building Height as established for the
various Zoning Districts, and a Zoning Variance shall not be used to modify the Use terms of property. A
Zoning Variance shall be approved only in accordance with the provisions as set forth in Section 24-64 of
this Chapter.
Vehicular Use Area (VUA) means those areas of a site to be used for Off-Street Parking, employee
parking, service drives, Loading Spaces and access drives within property located in the Commercial and
Industrial Zoning Districts.
Vested Development shall mean a proposed Development project or an existing Structure or Use, which
in accordance with applicable Florida law or the specific terms of this Chapter, is exempt from certain
requirements of these Land Development Regulations and/or the Comprehensive Plan.
Veterinary Clinic shall mean any Building or portion thereof designed or used for the veterinary care,
surgical procedures or treatment of animals, but shall not include the boarding of well animals.
Wetlands means those areas that are inundated or saturated by surface water or ground water at a
frequency and a duration sufficient to support vegetation typically adapted for life in saturated soils.
Florida Wetlands generally include swamps, marshes, bayheads, bogs, cypress domes and strands,
sloughs, wet prairies, riverine swamps and marshes, hydric seepage slopes, tidal marshes, mangrove
swamps and other similar areas. The delineation of actual Wetland boundaries may be made by
professionally accepted methodology consistent with the t'ype of Wetlands being delineated but shall be
consistent with any unified statewide methodology for the delineation of Wetlands.
Yard means a required Open Space on the same Lot with a Building, unoccupied and unobstructed from
the ground upward, except by trees or shrubbery, landscape elements and uncovered steps, decks,
balconies or porches not exceeding thirty (30) inches in height, or as otherwise provided within this
Chapter.
Yard, Required Front means the required Yard extending across the full width of the Lot, extending
from the front Lot Line to the front Building Setback Line as established by the Zoning District
designation. (See definitions for Eaves and Cornices and Building Setback,)
Yard, Required Rear means a required Yard extending across the full width of the Lot, extending
between the rear Lot Line and the Rear Building Setback Line as established by the Zoning District
designation. (See definitions for Eaves and Cornices and Building Setback.)
Yard, Required Side means a required Yard extending between a side Lot Line and the Side Building
Setback Line as established by the Zoning District designation. (See definitions for Eaves and Cornices
and Building Setback.)
Zoning Map shall mean the official record of the City of Atlantic Beach depicting the Zoning District
classifications on property within the municipal limits of the City of Atlantic Beach.

existing and proposed construction,as well as other significant features existing on the Lot.
(b) The signature of the owner, or the signature of the owner's authorized agent and written authorization
by the Owner for the agent to act on the behalf of the property owner.
(c) The Community Development Director shall refer the request to the Community Development Board.
In considering applications for Variances to provisions of this Chapter, the Community Development
Board shall, before making any finding of fact in a specific case, first determine that the proposed
Variance shall not constitute any change in the Zoning Districts shown on the Zoning Map and shall
not impair an adequate supply of light and air to adjacent property; materially increase the congestion
in Streets; increase the public danger of fire and safety; materially diminish or impair established
property values within the surrounding area; create adverse impacts to Environmentally Sensitive
Areas,or in any other respect impair the public health, safety,morals and general welfare.
(d) The Community Development Board, shall within a reasonable period of time hold a public hearing
with due public notice to consider applications for any Variance.
(e) At the public hearing, any party may appear in person or be represented by an agent.
(f) In order to approve an application for a Variance, the Community Development Board must find that
request complies with the definition of a Variance and that all of the following conditions apply:
(1) Special conditions and circumstances exist which are peculiar to the Land, Structure or Building
involved and which are not applicable to other Lands, Structures or Buildings in the same Zoning
District;
(2) The special conditions and circumstances do not re�ult from the actions of the Applicant;
(3) The Variance granted is the minimum Variance that will make possible the reasonable Use of the
Land, Building or Structure;
(4j The granting of the Variance will be in harmony with the general intent and purpose of this
Chapter and the Variance will not be injurious to the area involved or otherwise detrimental to the
public welfare.
(g) No Nonconforming Use of neighboring Lands, Structures or Buildings in the same Zoning District
and no permitted Use of Lands, Structures or Buildings in other Zoning Districts shall be considered
grounds for approval of a Variance.
(h) If an application for a Variance is denied by the Community Development Board, no further action on
another application for substantially the same request on the same property shall be taken for 365
days from the date of denial.
(i) When a Variance is approved by the Community Development Board, the work to be performed
pursuant to the Variance shall commence within 365 days from the date of approval unless otherwise
authorized by the Community Development Board, or the Variance shall become null and void.
A Variance, which involves the Development of Land, shall be transferable and shall run with the
title to the Property unless otherwise stipulated by the Community Development Board.

(b) Townhouses and residential Dwellings held in Fee-Simple Ownership. Townhouses and Two-family
Dwellings,when divided in ownership, shall not constitute a division of Lands requiring approval of
a Final Subdivision Plat or a Replat, provided that such Dwellings are otherwise in compliance with
these Land Development Regulations and the Comprehensive Plan.
See. 24-190. Multiple Lots and Parcels treated as a single Development Parcel.
In the case where more than one Parcel, Platted Lot or Lot of Record has been combined and developed
as a single Development Parcel, such Lots shall not later be developed as a single Lot, unless all
requirements for Development as a single Lot shall be met, including but not limited to Impervious
Surface Area limitations and provision of all Required Yards for all Structures.
See. 24-191. Waiver.
(a) General. Where the City Commission finds that undue hardship due to unreasonable practical
difficulties may result from strict compliance with this Article, the City Commission may approve a
waiver to the requirements of this Article if the waiver serves the public interest.
(b) Conditions of waiver. An Applicant seeking a waiver shall submit to the City Commission a written
request for the waiver stating the reasons for the waivef and the facts, which support the waiver. The
City Commission shall not approve a waiver unless it diAermines as follows.
(1) The particular physical conditions, shape or topography of the specific property involved causes
an undue hardship to the Applicant if the strict letter of the Article is carried out.
(2) The granting of the waiver will not be injurious to the other adjacent property.
(3) The conditions, upon which a request for waiver are based, are peculiar to the property for which
the waiver is sought, are not generally applicable to other property and do not result from actions
of the Applicant.
(4) The waiver is consistent with the intent and purpose of this Chapter, the Comprehensive Plan and
the requirements of this Article. If the City Commission approves a waiver, the City Commission
may attach such conditions to the waiver as will ensure that the waiver will comply with the
intent and purpose of this Article.
Sec. 24-192. Vacation of Previously Recorded Subdivision Plats.
An Applicant may apply for the vacation of a recorded Plat, or a portion of a Plat by written application to
which a copy of the Plat shall be attached requesting the same to be vacated. Vacation of Plats shall
require approval by resolution of the City Commission, and such vacation shall be approved only in
accordance with Chapter 177.10 1, Florida Statutes.
