My client is extremely concerned with the fill dirt that you have place on her property and the proposed drainage plan for your surface water runoff. You were aware that your chain link fence encroaches onto my client's property by approximately 18 inches. In addition, the fill dirt abuts the chain link fence and therefore encroaches by approximately 18 inches onto my client's property. The fill dirt is approximately 36 -48 inches higher than the elevation of my client's property. Accordingly, the fill dirt will cause serious flooding and drainage problems to my client's property. Since the fill was placed against the fence without a retaining wall, the fill dirt is washing through the fence onto my client's property. In addition, the fill dirt has covered numerous palm trees that are located on my client's property and have already or will cause these palm trees to die. According to the drainage plan that you submitted to the City of Atlantic Beach you intend for your surface water runoff of the northerly 2/3 of your property to flow to 5 Street and the surface water runoff of the southerly 1/3 of the property to flow to the southwest corner of your property. Evidently, you did not inform the City that you would be filling approximately 18 inches of my client's property. This drainage plan has already caused and will continue to create significant drainage problems for my client and possibly your neighbor to the south. All of the surface water runoff of your property should be maintained on your property and carried to 5 Street. Also, a retaining wall will need to be constructed to contain your surface water runoff on your property as well as to prevent your fill dirt from eroding onto my client's property. Furthermore, the chain link fence needs to be relocated to your property line or removed and the trees that you have covered with fill dirt need to be immediately uncovered so Ms. Allison Hall July 23, 2003 Page 2 that they will not die. Also the pitch of your roof will cause the water from the roof to dump directly onto my client's property unless a gutter system is installed on the entire westerly eave of your home. The gutter system should tie into a standard PVC pipe collection system to carry the runoff from the roof to 5 Street. My client would like to reach an amicable resolution of the drainage issues that will be caused by your fill dirt drainage plan, and construction. Accordingly, I suggest that you, your builder, my client and I meet at my office to discuss how you propose to remedy the drainage problems. Please note that this matter needs to be addressed now while you still have access to the areas that are affecting my client's property and before any further construction work is performed. If we are able to reach a mutually agreeable resolution to these drainage problems, then our agreement will need to be incorporated into a written document. I respectfully request that you and your builder arrange a time with my secretary, Tonya Wood for our meeting to discuss these drainage issues. In the event that you have not contacted my office and a meeting has not been scheduled to be held on or before August 1, then I will assume that you are not willing to amicably resolve this matter and my client would be left with no alternative to pursue all legal and equitable remedies available to her, which would include a suit for Trespass and a suit for Ejectment of the fence and the fill dirt. In addition, my client will seek an injunction to stop any further construction until these issues can be resolved by judicial order. Within all residential Zoning Districts, the maximum amount of Impervious Surface area allowed is fifty percent (50 %). Within all commercial and industrial Zoning Districts, the maximum amount of Impervious Surface area allowed is seventy percent (70%). The Zoning regulations define Impervious Surface as follows: • Impervious Surface shall mean those surfaces that prevent the entry of water into the soil.
