McCue Jameson Builders, Inc., RG0007820 1701 Sixth Avenue North Jacksonville Beach, FL 32250 Re: Disciplinary Hearing/Order of the Construction Trades Qualifying Board Dear Mr. McCue: Pursuant to a notice sent to you via certified mail which notice included a copy of the Charge Sheet dated March 22, 1994, and various regulations and the hearing procedures, a hearing was held before the Board on May 4, 1994. At the hearing you appeared before the Board without legal counsel and prior to the presentation of any evidence you entered a plea of guilty. Exercising the option provided by Board rules, you chose not to make a statement of explanation regarding the violations of the City Code as set forth in the Charge Sheet. The Board then received a recommendation from the City as to an appropriate disciplinary action and reviewed your file as to any previous disciplinary matters. The City recommended a $100.00 fine and a letter of reprimand, and your file indicated no previous violations. Based upon the preceding, the Board found it appropriate to accept your plea and found YOU guilty of the charge set forth in the Charge Sheet. As appropriate disciplinary action the Board issued an order that a letter of reprimand be placed in your file and that you be required to pay a fine of $100.00 on or before July 5, 1994. Failure to pay the fine by the time stated shall result in assessment of interest and further action by the Board. This is to also remind you that you still have not complied with Municipal Ordinance 342.110(h)(7) and applied for a Duval County Certificate of Competency as a General Contractor. Failure to do so, will result in further charges being brought against you. Until this is accomplished your State registration is not valid in Duval County and you may be considered an unlicensed contractor. 231 E. Should you fail to appear at the hearing to be held on February 1, 1995, the Board intends to proceed with the hearing in absentia. It is suggested it would be in your best interest to attend. The Board will also review your Application for Contractor Certificate of Competency during its regular meeting on February 1, 1995. Your application, however, is incorrect and incomplete at this time, and the following information must be supplied prior to the meeting: (a) This Board can only certify you in the name that is on your State registration which is Jameson Builders, Inc. You cannot change from a corporation to an individual with this Board, until after you have made the status change with the Florida Construction Industry Licensing Board. Once you are certified by this Board, the process however works in reverse for future changes of status. The State board tells me you filed for a change of status on December 19, 1994, but failed to supply them with a credit report, therefore your application is "on hold" with them. (b) Passport size photograph was not attached to application. (c) You failed to answer "yes" on question (g), Form 10, which ask "Has any person named in (i) below ever been convicted of acting in the capacity of a contractor without a license, or, if licensed as a contractor in this or any other State, has any disciplinary action "(including probation, fine or reprimand) ever been taken against such license by a State, County or Municipality". McCue, RG0007820 1701 Sixth Avenue, N. Jax Beach, FL 32250 Re: Board's response to Respondent's Request for a Rehearing Dear Mr. McCue: As you are aware, a hearing was held on November 2, 1994, at the request of your attorney, Francis Jerome Shea, for the Board to consider a rehearing of your case. On July 6, 1994, the Board heard charges brought against you by John Thrush, Assistant Building Inspector, in absentia. The conclusion of the Board was to revoke your, James R. McCue's, permit pulling privileges effective July 6, 1994, and to recommend to the Florida Construction Industry Licensing Board that your registration be revoked. You had been reminded by letter of May 27, 1994, that you had not complied with Municipal Ordinance 342.110(h)(7) and that further charges could be brought against you. However, you still took no action to correct the situation. It was further discovered that your State Registration was incorrect in that it said you were licensed as Jameson Builders, Inc., which you testified ceased to exist approximately six years ago. You were also advised by myself that the first step to correct the situation was to apply with the Florida Construction Industry Licensing Board to change your registration to reflect your current business status, which you indicated was James L. McCue, Individual. Based on the testimony of your attorney, Mr. Shea, that you were in the process of correcting your state registration, the Board determined to put your rehearing in abeyance until you have corrected your paperwork with the state and presented your new state registration to this office. The Director will then notify the Board of your compliance, at which time the Board may set a date and time to rehear your case. The Board also reminded you that you are still considered a non-licensed contractor in Duval county and can not do any work as a Registered General Contractor. However, the Board did agree to notify Mr. Don Ford, Building Official at Atlantic Beach, at such time as you have corrected your state registration and applied for a Duval County Contractor Certificate of Competency. At that time, the Board feels Mr. Ford can use his wisdom as whether to allow you, for the customer's best interest, to complete the job you started, but no other jobs until the Board has made it's final decision to accept your application and/or revisit your previous penalty. w By ,.`copy of this letter to the Florida Construction Industry Licensing Board, the Construction 231 E. This is to also remind you that you still have not complied with Municipal Ordinance 342. 110(h)(7) and applied for a Duval County Certificate of Competency as a General Contractor. Failure to do so, will result in further charges being brought against you. Until this is accomplished your State registration is not valid in Duval County and you may be considered an unlicensed contractor. R L t 231 E. Roof loading uplift and structural supports for the new wind loads have to be verified and incorporated into scope of work and plans before I could ever figure the extra cost to construction. H. I hereby order my permit withdrawn by the City of Atlantic Beach Building Department. I. I as of this date officially shut job down because of owner's unwillingness to stay out of negotiations with contractors and she further continues to interfere with good construction practice. The problems brought about on this job are because she believes subcontractors and not the contractor. J• I have no choice but to let this case be handled by the attorney Mr. Shay and Misla Nelson's attorney. K. I will not be jerked around on this job any more. We have spent in time and motley well over what she has paid. She also has not dealt in good faith, as she knows there were other bidders for her project and the cost. There has been too much conversation with owner to sub-owner to supplier, and what was a private business transaction has been allowed to be a street gossip campaign. Now hear this- Bob McClure don't speak for me. The plumbing contractor don't speak for me. The cabinet man don't speak for me. Nor does anybody else except Mr. Shay with my permission. So as of this time we must please be allowed to withdraw until Misla Nelson understands who is in control and procedures for control b contract, chanceorders and completed plans showing total scope of workpins electrical drawings. structural re art and architectural drawings by a registered architect. I have no further responsibility to this job, the money has been spent as directed by Misla Nelson, and has been spent wisely by contractor so as to try and ensure a sound building. We have been mislead, lied to and about, what started to be a simple remodelling job has been allowed to become a nightmare by all concerned. The building inspector allowed a start to help owner. But owner never followed through with allowing plans as specs to be completed as regtjested by contractor. U1 1 if -'.J 1- ;4 ZCk_I r-O C;'.C!_U I !VC Dr-r-V 1I,_tn ,_d(Jr LO NO.033 903 In closing, I would only recommend that the following occur: That we complete electrical & plumbing enough so that Misla can ;et back into her house, then as she can see fit to allow the proper plans and permits to be done and complete and complete the work as she can fund it. • Mr. Shay, you Must advise that my permit has been, pulled because of default by her • Mr. Shay, you trust advise her that she must take an Owner's Permit to finish because I will not allow my license or permit to remain in a position of responsibility. Also, I have pulled my insurance form from the job. There will be no further work on this project unless there is a better set of plans specs and then only after price is agreed. Signed: . L. McCue III PS#1 Confidential to Shay: Misla Nelson is a licensed real estate holder. She knows what costs are cost of construction and how to milk the contractor. PS#2 Also Electrical McClure knows how to milk the customer, and has gone around the contractor, which I refused to allow him to do. And he did it anyway, causing problems uncorrectable. So they have all conspired against the contractor with the owner, a form of mutiny at will. L. McClure is proceeding with electrical work on December 22 and will coordinate his trimout work with cabinet installers . I do not agree to the $800 figure for interiors doors proposed by Mr. McCue as the plan called for new doors in 3 of the 4 locations installed. Mr. McCue and I discussed one of those doors, "Sarah' s room" , being French doors . If he upgraded the other 2 from luan to six-panel, there may be some slight increase in price, but the framing of three doors was anticipated in Plans . I therefore agree to only $200 . 00 for doors on the change order. Mr. McCue knows this to be a more real cost than his proposal of $1800 adjusted by him to $800 . Mr. McCue told me on Monday of this week that the ceilings have been sprayed-they have not . They must be complete for the cabinet installers to proceed on December 28 . Y have prepared a modified work order reflecting adjustments for cabinets, electric and doors . I have included an accounting of monies paid and due . This Board found you guilty on May 4, 1994 and fined you $100.00. On July 6, 1994, this Board revoked your permit pulling privileges which you failed to acknowledge on the form. (f) Payment of $75.00 must be attached to application. Please submit the above required information prior to the next Board meeting. Without it, the Board will not consider your application. A copy of this letter will be sent to your attorney, Mr. Shea. Thank you for your immediate attention to these matters. Respectfully yours, (::) 01'4 60 Donald W. McCue, RG0007820 e p;;-S AN 1701 Sixth Avenue, N. 1 Jax Beach, FL 32250 Re: Board's response to Respondent's Request for a Rehearing Dear Mr. You had been reminded by letter of May 27, 1994, that you had not complied with Municipal Ordinance 342.1 1,0(h)(7) and that further charges could be brought against you.
