alter, repair, remove, convert or replace any

T141S CAUSE came for public hearing before the Code Enforcement Board on January 8,2013 and the Board
having heard testimony under oath,received evidence,and heard arguments respective to all appropriate matters,and
thereupon issues the Findings of Fact,Conclusions of Law and Order as follows:
FINDINGS OF FACT
1. That the Respondent Cemetery Professionals,LLC owns the property located at 1500 Main Street,
Atlantic Beach,Florida.
2. That notice was sent by certified mail and was signed on December 7,2012 and that Respondent's
representative was present at the hearing
3. That notification of the violations of the City of Atlantic Beach,Code of Ordinances,Section 6-]6
Florida Building Code Adopted,FBC Section 105.1 Pen it Required were made and served on the
Respondent as evidenced in this hearing.
4. The exterior of the aforementioned property shall be corrected by obtaining permits for construction of
the addition and walkway/patios by State of Florida licensed contractors with signed applications,signed
and sealed architectural plans,engineering,energy calculations,site plan,affidavit from State of Florida
licensed engineer certifying the existing foundation system is adequate,and other documents as required
and obtain permits and approval from the Fire Department or remove the structure and concrete
walkway/patios installed without permits.
CONCL JSIONS OF LAW
THAT Cemetery Professionals,LLC is not in compliance and has failed to correct such violation as of this hearing
date.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted in Chapter
162,Florida Statutes,and the Code of Ordinances of the City of Atlantic Beach,Florida it is Ordered:
THAT the Respondent is found in violation for non-compliance and must obtain compliance on or before
March 8,2013. Failure to comply will result in fines of$100.00 for the first day and$100.00 for every day thereafter
while the violation continues to exist. In addition,any fine shall also include the administrative costs to the City
incurred in prosecuting this case.
THAT the Respondent is responsible for contacting the City of Atlantic Beach Code Enforcement Officer and
obtaining an inspection of compliance.
THAT failure to pay all accumulated fines will result in a lien being placed against the property at 1500 Main
Street for the total assessment plus costs incurred for the filing of the lien. All lien amounts are to be made payable
at an interest rate of ten(10)percent per annum from date of certification until paid.
This Order becomes self-executing upon an Affidavit of Non-Cornpliance being filed with the City Clerk's Office.

Please be advised that if you wish to request a rehearing of the attached Order, such request must be
submitted in writing to the Atlantic Beach City Clerk's Office, 800 Seminole Road, Atlantic Beach,
Florida no later than ten(10) days from the execution of the order to be appealed. The request must
be based on the following grounds:
a. That there exists new and material evidence which, if introduced at the hearing,would
probably have changed the code enforcement board decision and could not with reasonable

plans, engineering, energy calculations, site plan, affidavit from State of Florida licensed engineer certifying the
existing foundation system is adequate, and other documents as required. Obtain permits and approval from the Fire
Dept..
RECOMMENDATION: Staff recommends the Board find the property owner in violation and order that
compliance be achieved within thirty(30) days of execution date on the order or a fine of$100.00 be imposed
for the first day and $100.00 for every day thereafter the violation continues to exist. In addition, any fine shall
also include the administrative costs to the City incurred in prosecuting this case.The property owner is
responsible for contacting the City Code Enforcement Officer and obtaining an inspection of compliance.

You are requested to obtain the services of a State of Florida,licensed engineer to submit
drawings to the City of Atlantic Beach for construction added to the rear of your office building
and obtain the services of a State of Florida licensed general contractor to obtain a building
permit and obtain all approvals including approval from the Fire Marshal or remove the structure
all concrete added without permits within fourteen(14)days of the receipt of this notice.

THIS CAUSE came for public hearing before the Code Enforcement Board on January 8,2013 and the Board
having heard testimony under oath,received evidence,and heard arguments respective to all appropriate matters, and
thereupon issues the Findings of Fact, Conclusions of Law and Order as follows:
FINDINGS OF FACT
1. That the Respondent Cemetery Professionals,LLC owns the property located at 1500 Main Street,
Atlantic Beach,Florida.
2. That notice was sent by certified mail and was signed on December 7,2012 and that Respondent's
representative was present at the hearing
3. That notification of the violations of the City of Atlantic Beach,Code of Ordinances, Section 6-16
Florida Building Code Adopted,FBC Section 105.1 Permit Required were made and served on the
Respondent as evidenced in this hearing.
4. The exterior of the aforementioned property shall be corrected by obtaining permits for construction of
the addition and walkway/patios by State of Florida licensed contractors with signed applications, signed
and sealed architectural plans, engineering,energy calculations, site plan,affidavit from State of Florida
licensed engineer certifying the existing foundation system is adequate,and other documents as required
and obtain permits and approval from the Fire Department or remove the structure and concrete
walkway/patios installed without permits.
CONCLUSIONS OF LAW
THAT Cemetery Professionals,LLC is not in compliance and has failed to correct such violation as of this hearing
date.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted in Chapter
162,Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach,Florida it is Ordered:
THAT the Respondent is found in violation for non-compliance and must obtain compliance on or before
March 8, 2013. Failure to comply will result in fines of$100.00 for the first day and$100.00 for every day thereafter
while the violation continues to exist. In addition, any fine shall also include the administrative costs to the City
incurred in prosecuting this case.
THAT the Respondent is responsible for contacting the City of Atlantic Beach Code Enforcement Officer and
obtaining an inspection of compliance.
THAT failure to pay all accumulated fines will result in a lien being placed against the property at 1500 Main
Street for the total assessment plus costs incurred for the filing of the lien. All lien amounts are to be made payable
at an interest rate of ten(10)percent per annum from date of certification until paid.
This Order becomes self-executing upon an Affidavit of Non-Compliance being filed with the Citv Clerk's Office.

This firm has the honor of representing Ms. Amanda Rayan, owner and
Cemetery Professionals LLC. We acknowledge receipt of your letter dated
August 31, 2012 in the referenced matter and look forward to resolving this
matter consistent with the dictates of the City of Atlantic Beach. Ms. Rayan
wanted me to extend her apologies to the City for any inconvenience this has
caused as her only intentions were to improve the quality and extent of the
services that she will be able to provide to citizens of Atlantic Beach and
Northeast Florida.
My first request is that you hold any daily fines in abeyance as Cemetery
Professionals LLC follows your instructions to retain a licensed engineer and
submit the appropriate drawings to the City. Ms. Rayan is already taking those
steps. We ask for a thirty (30) day extension to make certain that the correct
engineer is retained and so that that engineer has the necessary time to
complete the professional analysis.
Again, thank you for bringing this issue to my client's attention. She looks
forward to bringing her property and structures into full compliance. We
welcome any visits by authorities associated with the City at Beaches Memorial
Gardens at any time. By a copy of this letter, I am forward an invitation to the
Fire Marshal of the City of Atlantic Beach to visit the property at issue and to
make whatever inspections the Marshal deems to be necessary.

This letter is written to advise that you are currently in violation of the Florida Building Code as
adopted by the City of Atlantic Beach, Code of Ordinances Section 6-16 as indicated below. A
stop work order was issued on August 19, 2012 for the addition to the rear of your business
being constructed without the required building permit and/or approvals.

Section 105 PERMITS
105.1 Required. Any owner or authorized agent who intends to construct, enlarge, alter, repair,
move, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge,
alter,repair, remove, convert or replace any required impact resistant coverings, electrical, gas,
mechanical or plumbing system, the installation of which is regulated by this code, or to cause
any such work to be done, shall first make application to the building official and obtain the
required permit. (Addition added to rear of commercial building without a permit and
approx. 725 SF of concrete)
You are requested to obtain the services of a State of Florida, licensed engineer to submit
drawings to the City of Atlantic Beach for construction added to the rear of your office building
and obtain the services of a State of Florida licensed general contractor to obtain a building
permit and obtain all approvals including approval from the Fire Marshal or remove the structure
all concrete added without permits within fourteen(14) days of the receipt of this notice.

To avoid having this case be referred to the Code Enforcement Board, all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
Enforcement. The Board may impose fines up to two hundred fifty ($250.00)per day for
continuing violations.
