CONCLUSIONS OF LAW: After considering the merits of the proposal and any written objections from affected persons, the Department finds that upon compliance with the permit conditions, the activities indicated in the project description of this permit are of such a nature that they will result in no significant adverse impacts to the beach/dune areas or to adjacent properties; that the work is not expected to adversely impact nesting sea turtles,their hatchlings, or their habitat; that the work is expendable in nature and%or is appropriately designed in accordance with Section 6213-33.005, Florida Administrative Codc; and that it is an activity or type of construction which the designee of the Department has authority to approve or deny pursuant to Delegation of Authority, DEP Directive 137, effective May 14, 2001. A 6-foot high masonry privacy wall with a landward gate is to be located along the north, south and landward peripheries of the property to approximately 70 feet seaward of the control line. All rubble, debris, wood, and damaged or broken concrete on the site resulting from this demolition and construction shall be removed and relocated landward of the coastal construction control line. 4. All excavated sand material shall be maintained on site seaward of the coastal construction control line. 5. All imported fill material shall be obtained from a source landward of the control line. All fill material placed seaward of the control line shall consist of sand that is similar to the native sand of the placement site in both coloration and grain size and be free of construction debris, metal, vegetation, organic soils, rocks, clay, or other foreign matter. A sample of the sand shall be provided to the staff representative of the Department during the preconstruction conference. 6. All plantings shall conform to the approved landscape plan. Plantings shall not include invasive nuisance plant species such as listed in the Florida Exotic Pest Plant Council's List of Invasive Species, Categories I and II. If the Department determines that this requirement is not being met, positive control measures,such as temporary fencing,designated access roads,adjustment of construction sequence,or other requirements,shall be provided by the permittee at the direction of the Department.Temporary construction fencing shall not be sited within marine turtle nesting habitats. g) The permittee shall not disturb existing beach and dune topography and vegetation except as expressly authorized in the permit. Before the project is considered complete,any disturbed topography or vegetation shall be restored as prescribed in the permit with suitable fill material or revegetated with appropriate beach and dune vegetation. h) All fill material placed seaward of the control line shall be sand which is similar to that already existing on the site in both coloration and grain size. All such fill material shall be free of construction debris,rocks,clay,or other foreign matter; shall be obtained from a source landward of the coastal construction control line;and shall be free of coarse gravel or cobbles. i) If surplus sand fill results from any approved excavation seaward of the control line,such material shall be distributed seaward of i the control line on the site,as directed by the Department,unless otherwise specifically authorized by the permit. j) Any native salt-tolerant vegetation destroyed during construction shall be replaced with plants of the same species or, by authorization of the Department, with other native salt-tolerant vegetation suitable for beach and dune stabilization. Unless otherwise specifically authorized by the Department,all plants installed in beach and coastal areas—whether to replace vegetation displaced;damaged,or destroyed during construction or otherwise—shall be of species indigenous to Florida beaches and dunes, such as sea oats,sea grape,saw palmetto,panic grass,saltmeadow hay cordgrass,seashore saltgrass,and railroad vine,and grown from stock indigenous to the region in which the project is located. k) All topographic restoration and revegetation work is subject to approval by the Department, and the status of restoration shall be reported as part of the final certification of the actual work performed. 1) If not specifically authorized elsewhere in the permit, no operation, transportation, or storage of equipment or materials is authorized seaward of the dune crest or rigid coastal structure during the marine turtle nesting season. (UES) presents the results of the suspect Asbestos Containing Materials (ACMs) Evaluation performed on February 25, 2013 of the interior and exterior of the residential structure located at 587 Beach Avenue, Atlantic Beach, Florida. This service was conducted according to the proposal, 2013J- 102, dated February 22, 2013. This service was authorized by Mr. Michael Lenahen, Owner. 1.2 PURPOSE AND SCOPE The purpose of this study was to perform an evaluation of the interiors and exteriors of the structure for the presence of ACMs. The activities and procedures used to accomplish this task are as follows: 1. Review available information concerning the structures including the initial dates of construction, significant renovations, types of construction, various types of mechanical systems, and information regarding the use of the structures. 2. Walk-through and observe accessible areas within the structures to identify, locate, and assess suspect ACMs. 3. Obtain samples of each suspect ACM. 4. Analyze the collected samples at a National Voluntary Laboratory Accreditation Program (NVLAP) accredited laboratory using Polarized Light Microscopy (PLM) for the presence of asbestos fibers. 5. Prepare and submit a report of our findings. Complete destructive observation and sampling procedures were not generally used during our evaluation of the structure. The scope of our investigation did not include an evaluation of fixtures, equipment, or stored materials. i Project No. 0940.1300024.0000 Report No. 1019580 2.0 BUILDING CHARACTERISTICS AND INFORMATION 2.1 GENERAL The subject property consisted of a two story residential structure. The subject property was located at 587 Beach Avenue, Duval County, Florida. This asbestos evaluation was of the interior and exterior of this structure for scheduled demolition activities. The residence was a two story structure, approximately 8,600 square feet in size, and was listed on the Duval County Property Appraisers website as being constructed in 1908 and renovated in 1995. 2.2 MECHANICAL SYSTEMS The mechanical system ductwork associated with the structure had a white mastic on the fiberglass insulation seams. This mastic material was tested and found to be negative for asbestos content. No other suspect insulation materials were observed on the mechanical systems. 2.3 AVAILABLE MATERIAL INFORMATION UES was not provided with copies of building plans or other material information in reference to the structure located on the subject property. 2.4 BUILDING USE At the time of the asbestos survey, the subject property was vacant. The current plan is to demolish the existing building and construct a new residence on the property. 3.0 BUILDING INSPECTION Three forms of asbestos containing materials are typically found in buildings: (1) sprayed- on or troweled-on surfacing materials; (2) thermal system insulation on pipes, boilers, and duct work; and (3) miscellaneous materials such as drywall, ceiling tile, and floor tile. A walk-through inspection was conducted to identify these potential asbestos containing materials and other materials present within the interior, exterior and roof of the structure. 3.1 INSPECTION PROCEDURES Our field inspection was performed by accredited Environmental Protection Agency (EPA) inspectors, Mr. James Blythe, according to Federal Regulation 49 CFR, Part 763 (AHERA). After a preliminary walk-through of the buildings, an inspection was conducted to evaluate the location and extent of the suspect ACMs. Upon identification, these materials were categorized into homogeneous sampling areas (HSA) of the same type, age, visual appearance, texture, composition, and etcetera. 2 Project No. 0940.1300024.0000 Report No. 1019580 Random, and in some cases judgmental, samples of each homogeneous area of material were then collected. The physical condition and potential for disturbance and damage of each material was assessed. In addition, a tactile inspection of the material was performed to evaluate friability. If the material, when dry, can be crumbled, pulverized, or reduced to powder by hand pressure, it is considered friable. On February 25, 2013, UES collected a total of eighteen (18) samples of suspect ACMs from the residential structure. 3.2 SUSPECT ASBESTOS CONTAINING BUILDING MATERIALS Based on our review of the available building system information and visual survey of the interiors and exterior, UES identified seven (7) homogeneous materials associated with the two story residence as possibly containing asbestos. The roofing was observed to be fiberglass shingles and was not sampled as part of our asbestos survey due to high winds on the day of the field visit. Detailed information concerning the description and sample locations of the suspect ACMs is presented on the Asbestos Containing Materials Chain- of-Custody in Appendix B. 4.0 LABORATORY ANALYSIS 4.1 BULK SAMPLES The samples of the suspect ACMs collected during the field inspection were transported with chain-of-custody documentation to EMSL Analytical, Inc., located in Orlando, Florida. EMSL Analytical, Inc. is an accredited laboratory for bulk sample analysis according to the NVLAP. The samples were analyzed for the presence of asbestos fibers using PLM. The analyses were performed according to EPA Method 600/R- 93/116 July 1993. Copies of the laboratory reports are included in Appendix B. 4.2 POINT COUNT Samples of the suspect ACMs collected during the field inspection were not point counted as part of this survey. 3 Project No. 0940.1300024.0000 Report No. 1019580 5.0 FINDINGS The laboratory analyses indicated that no asbestos fibers were detected in excess of one percent in any of the homogeneous materials analyzed from the structure. Bulk samples of each of those materials were collected and submitted to a NVLAP accredited laboratory for analysis. The results indicated that none of the suspect materials contained asbestos fibers in excess of one percent. 4 Project No. 0940.1300024.0000 Report No. 1019580 7.0 REGULATORY INFORMATION The NESHAP regulations do not cover individual residential buildings containing four or fewer dwelling units unless the residential building is demolished or renovated as part of larger projects, for instance, highway construction projects. There are federal and state statutes and regulations which govern the abatement and disposal of ACMs. The renovation or demolition of buildings and roofs containing ACMs is regulated under the NESHAP statute. The NESHAP regulations require notification to the controlling agency and removal of all regulated asbestos containing materials (RACM) prior to renovation or demolition. RACM is defined as (1) friable asbestos material, (2) Category I non-friable asbestos containing material that has become friable, (3) Category I non-friable asbestos containing material that will be or has been subjected to sanding, grinding, cutting or abrading, or (4) Category II non-friable asbestos containing material that has a high probability of becoming or has become crumbled, pulverized, or reduced to powder by the forces expected to act on the material in the course of demolition or renovation operations regulated by NESHAP. We strongly recommend that you contact the Controlling Agency prior to renovation or demolition regarding the proper disposition of the ACMs. It is important to note that even though an activity may be exempt from the EPA NESHAP regulations; such exemption does not extend to Occupational Safety and Health Administration (OSHA) standards or other state and federal statutes. Renovation or demolition activities in buildings and on roofs that contain ACM or presumed asbestos containing material (PACM) are regulated under the OSHA Asbestos Construction Standard (CFR 1926.1101). The OSHA standard requires the building owner to inform their employees who will work in or adjacent to areas containing ACM or PACM, perspective employers applying or bidding for work whose employees reasonably can be expected to work in or adjacent to areas containing ACM or PACM, all employers of employees on multi-employer work sites who will be performing work with or adjacent to areas containing asbestos and tenants who will occupy areas containing ACM or PACM, of the presence, location, and quantity of ACM or PACM at the work sites in their building and facilities. Further, the OSHA standard (1926.1101) requires employers who discover ACM or PACM to convey information concerning the presence, location and quantity of such newly discovered ACM or PACM to others employers of employees working at the work site within 24 hours of discovery. While OSHA says the notification can be written or personal communication, there are many advantages to written communication. Renovation or demolition of the structures located within the subject properties should be conducted in strict compliance with the aforementioned federal statutes and other applicable regulations, and good health and safety practices. All procedures, methods and documentation should be accomplished by and be the responsibility of appropriately licensed professionals (asbestos consultants and contractors). Any material identified as non-friable ACM must be treated as friable ACM when the material is about to become friable as a result of activities performed within the building. The OSHA construction standard (CFR 1926.1101) also contains specific training, work practices, procedures, engineering controls, notifications, permissible exposure limits, { s i Project No. 0940.1300024.0000 Report No. 1019580 personal protection, record keeping and a multitude of other requirements for the demolition, renovation, construction, alterations, repair, maintenance of structures, substrates or portions thereof that contain asbestos. It should be noted that recent court rulings have exempted roofing cement from the OSHA Construction Industry Asbestos Standard. 8.0 CONTROLLING AGENCIES The Controlling Agency for the coordination of projects involving asbestos renovation and demolition for Duval County, Florida is the Duval County Environmental and Compliance Department. Ms. Kathryn Russell is the contact person and may be contacted by phone at 904-255-7184. For a structure covered under the NESHAP regulations, a 10-Day NESHAPS notification is required by the Asbestos Abatement Contractor and also for the Demolition Contractor_ Due to this project being a single family residence, it is our opinion that the NESHAPS does not apply to this project. Other local permits may be required by the demolition contractor. 9.0 CONDITIONS AND LIMITATIONS OF THIS SURVEY A representative of Universal Engineering Sciences, Inc. (UES) obtained samples of building materials which were observed during a walk-through of the subject building that are typically suspected of containing asbestos as a constituent. The bulk samples were submitted to an NVLAP approved laboratory for analysis using EPA approved methods for industry accepted standards. UES offers no warranty, express or implied. In general, inspection and sampling procedures were incorporated which allowed assessment of reasonably accessible building materials. Any suspect building materials, not addressed in this report which are encountered during renovation or demolition, should be assessed for asbestos content prior to being damaged and/or removed. Building equipment, fixtures, stored materials and under mirrors were not inspected or sampled as part of this evaluation. Analysis of the flooring and/or resinously bound materials by EPA Method 600/R-93/116 July 1993, may yield false-negative results because of method limitations in separating closely bound fibers and in detecting fibers of small length and diameter. SUMMARY: On November 20, 1990, the Federal Register published the Environmental Protection Agency's (the Agency's)revision of the National Emission Standard for Hazardous Air Pollutants for Asbestos(asbestos NESHAP),40 CFR part 61, subpart M. 55 FR 48406. Since the publication of this revision,EPA has received several inquiries from municipalities regarding whether the "residential building exemption"from the asbestos NESHAP applies to the demolition or renovation of isolated residential buildings with four or fewer dwelling units ("small residential buildings")that have been declared safety hazards or public nuisances by local governments. EPA is publishing this notice to clarify that, in EPA's opinion, the demolition or renovation of an isolated small residential building by any entity is not covered by the asbestos NESHAP.This notice does not affect EPA's policy regarding demolition by fire.However,EPA also believes that the demolition or renovation of multiple (more than one)small residential buildings on the same site by the same owner or operator(or owner or operator under common control) is covered by the asbestos NESHAP. The Asbestos NESHAP and the "Residential Building Exemption" On April 6, 1973,the Agency published its initial NESHAP for asbestos(38 FR 8820) after determining that asbestos was associated with asbestosis and certain cancers. The initial asbestos NESHAP covered "any institutional,commercial and industrial building(including apartment buildings having more than four dwelling units), structure, facility, installation or portion thereof * * *" 38 FR 8829 (codified at 40 CFR 61.22(d) (1973)). The NESHAP did not cover individual residential buildings containing four or fewer dwelling units. EPA based this "residential building exemption"on a National Academy of Sciences'Report which stated "[i]n general, single-family residential structures contain only small amounts of asbestos insulation."EPA stated that apartment houses with four or fewer dwelling units were considered to be equivalent to single-family residential structures. 38 FR 8821. Since that time, EPA has revised the asbestos NESHAP on several occasions. EPA has not substantially revised the exemption for small residential buildings. However,EPA has stated that residential buildings demolished or renovated as part of larger projects, for instance,highway construction projects,were not exempt from the NESHAP. II. The 1990 Revisions to the Asbestos NESHAP On November 20, 1990, EPA published a revision to the asbestos NESHAP. 55 FR 48406.The purpose of the revision was"to enhance enforcement and promote compliance with the current standard without altering the stringency of existing controls."Id.The revisions revised and added several definitions in order to clarify the requirements of the NESHAP. The preamble accompanying the revisions also contained clarifying information. In particular,the 1990 revisions clarified the definition of"facility"to include: Any institutional, commercial,public, industrial, or residential structure, installation, or building(including any structure, installation or building containing condominiums or individual dwelling units operated as a residential cooperative, but excluding residential buildings having four or fewer dwelling units) * * * The 1990 amendments also added a definition of"installation"that stated: Installation means any building or structure or any group of buildings or structures at a single demolition or renovation site that are under the control of the same owner or operator (or owner or operator under common control). Id. (codified at 40 CFR 61.141). In responding to comments regarding the"residential building exemption,"the preamble noted that: EPA does not consider residential structures that are demolished as part of a commercial or public project to be exempt from this rule. For example, the demolition of one or more houses as part of an urban renewal project, a highway construction project, or a project to develop a shopping mall, industrial facility, or other private development would be subject to the NESHAP. * * * The owner of a home that renovates his house or demolishes it to construct another house is not to be subject to the NESHAP. Id. at 48412.1 Further, in response to a comment asking whether a group of residential buildings at one location would be covered by the rule, the preamble stated: A group of residential buildings under the control of the same owner or operator is considered an installation according to the definition of"installation"and is therefore covered by the rule. III. Programs to Demolish or Renovate Residential Buildings Since the publication of the 1990 revisions to the asbestos NESHAP, certain questions have arisen regarding whether demolitions or renovations of residential homes that are demolished or renovated by municipalities for reasons of public health welfare or safety("nuisance abatement demolitions") are covered by the asbestos NESHAP. 2 Several municipalities have stated that they believe such demolitions or renovations to be excluded from the NESHAP under the residential building exemption. Municipalities have also stated that EPA officials have been inconsistent in their determinations of this issue. In particular, officials from several municipalities in Florida have asked EPA toissue a notice clarifying EPA's interpretation of the asbestos NESHAP with regard to this issue. In addition, the House of Representatives Report accompanying H.R.4624(House Report 103-555,reported by the House Appropriations Committee), also noted these allegedly inconsistent interpretations and directed EPA to issue a notice of clarification that a nuisance abatement demolition or renovation does not subject an otherwise exempt structure to the asbestos NESHAP regulations. In an effort to clarify this issue for the regulated community, EPA is presenting this notice giving its interpretation of the NESHAP with regard to this issue. IV. EPA Interpretation EPA believes that individual small residential buildings that are demolished or renovated are not covered by the asbestos NESHAP. This is true whether the demolition or renovation is performed by agents of the owner of the property or whether the demolition or renovation is performed by agents of the municipality. EPA believes that the residential building exemption applies equally to an individual small residential building regardless of whether a municipality is an "owner or operator" for the purposes of the demolition or renovation. EPA believes that the exemption is based on the type of building being demolished or renovated and the type of demolition or renovation project that is being undertaken, not the entity performing or controlling the demolition or renovation. However, EPA believes that the residential building exemption does not apply where multiple (more than one) small residential buildings on the same site 3 are demolished or renovated by the same owner or operator as part of the same project or where a single residential building is demolished or renovated as part of a larger project that includes demolition or renovation of non.residential buildings. The definition of facility specifically includes "any residential structure, installation or building"but excludes only "residential buildings having four or fewer dwelling units" [emphasis added]. Id. at 48415. Specifically not excluded from the definition of facility were residential installations. EPA believes that the fact that the residential building exemption is limited to residential buildings, and does not include residential installations, shows that the residential building exemption was not designed to exempt from the NESHAP demolitions or renovations of multiple buildings at a single site by the same owner or operator. Moreover, to the extent the regulations are ambiguous, EPA believes the language of the preamble to the 1990 regulations quoted above makes clear that the Agency interpreted the residential building exemption not to include the demolition of a group of residential buildings on the same site under the control of the same owner or operator.The preamble also notes that demolitions of residential buildings as a part of larger demolition projects(e.g. construction of a shopping mall) are not excluded from the NESHAP. EPA believes that this interpretation is consistent with the original purpose of the residential building exemption,which was to exempt demolitions or renovations involving small amounts of asbestos. EPA does not believe the residential building exemption was designed to exempt larger demolitions or renovations on a particular site, even where small residential buildings are involved. While this notice clarifies EPA's belief that certain demolitions or renovations performed by municipalities are not subject to the asbestos NESHAP,EPA encourages municipalities(and other owners and operators)to perfnrm such demolitions or renovations in a manner that provides appropriate consideration for any potential adverse health impacts to the public. In EPA's view, an entire municipality, or even a neighborhood in a municipality, should not be considered a single site. Where an area is made up of multiple parcels of land owned and operated by various parties, EPA believes that parcels on the same city block may be considered as a single site. (Where a site can not be easily defined as a city block, the site should be a comparably compact site.
