He is going to look for some case law to support his position that the City's lien was extinguished and get back to me. However, Mr. McKillop did indicate that the amount owed on the property was in excess of$250,000,it was foreclosed to the lender for approximately $92,000 and is being sold now for around$90,000. In this scenario, the City would not have recovered any amount of our lien. After I hear back from Mr. McICillop, I will let you and Donna know if there is any additional action required on our part. He is going to look for some case law to support his position that the City's lien was extinguished and get back to me. However,Mr. McKillop did indicate that the amount owed on the property was in excess of$250,000,it was foreclosed to the lender for approximately$92,000 and is being sold now for around$90,000. In this scenario, the City would not have recovered any amount of our lien. After I hear back from Mr. McKillop, I will let you and Donna know if there is any additional action required on our part. [4] The purpose of notice of lis pendens is to warn all persons that title to the property is in litigation and that they are in danger of being bound by an adverse judgment. [5] Section 48 .23 (1) (a) , F. S. , provides that no action in any of the state or federal courts in this state operates as a lis pendens on any real or personal property until a notice of the commencement of the action is recorded in the office of the clerk of circuit court of the county where the property is located.
