CLAIM OF LIEN
The City of Atlantic Beach, having given proper notice to the property owner, Harry L.
Cain,pertaining to property described as, 449 Mako Drive A/K/A R/P of Pt of Royal Palms
Unit 2A Lot 20 Block 12 for violation of Chapter 4, Sec 4-30 (b) (5) of the Code of Ordinances
of the City of Atlantic Beach Florida, and finding that Harry L. Cain, owner of the property, has
failed to make the required payments towards this obligation, it is the decision of the City of
Atlantic Beach that a Claim of Lien be filed against Harry L. Cain. Said Claim of Lien shall be
recorded in the public records of the office of the Clerk of the Circuit Court in and for Duval
County, Florida, and shall be payable with interest at the rate of 10%per annum until paid.
This Claim of Lien is to secure payment for the fines and administrative fees in the
following amounts:
Fine for non-compliance: $ 1,555.00
TOTAL DUE: $ 1,555.00

ORDER IMPOSING FINE
THIS CAUSE came for public hearing before the Code Enforcement Board on September 14,
2004, and the Board having heard testimony under oath,received evidence, and heard arguments respective
to all appropriate matters, and thereupon issues the Findings of Fact, Conclusions of Law and Order as
follows:
FINDINGS OF FACT
1. That Harry L. Cain is the owner of record of the property located at 449 Mako Drive,Atlantic
Beach,Florida.
2. That notice was served on August 31,2004 and that he was present at the hearing.
3. That notification of the violation of Chapter 4, Sec 4-30(b) (5)FAILURE TO PAY ANIMAL
CONTROL FINE IN SPECIFIED AMOUNT OF TIME, was made and served on the
Property Owner as evidenced in this hearing.
CONCLUSIONS OF LAW
That Harry L. Cain is guilty of violating Chapter 4, Sec 4-30(b)(5)FAILURE TO PAY
ANIMAL CONTROL FINE IN SPECIFIED AMOUNT OF TIME, and has failed to correct
such violation as of this hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the
authority granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of
Atlantic Beach,Florida it is Ordered:
THAT the Respondent be found guilty for non-compliance, and that the fine of$55.00 be
paid within 30 days and if not paid an additional fine of$50.00 a day for 30 days shall be
imposed.
THAT if full payment is not made, the total amount due be placed as a lien against the
property of 449 Mako Drive, at an interest rate of ten(10)percent per annum from the date of
certification until paid.
This Order becomes self-executing upon an Affidavit of
Compliance being filed
with the City Clerk's Office and a hearing shall not be necessary.
DONE AND ORDERED THIS 17th day of September 2004.
