ORDER IMPOSING FINE
THIS CAUSE came for public hearing before the Code Enforcement Board on July 12,2011 and the Board
having heard testimony under oath,received evidence, and heard arguments respective to all appropriate matters, and
thereupon issues the Findings of Fact, Conclusions of Law and Order as follows:
FINDINGS OF FACT
1. That the Respondent Sonja Gross owns the property located at 331 Seminole Road,Atlantic Beach,
Florida.
2. That notice was posted and sent by certified mail and that Respondent was not present at the hearing.
3. That notification of the violations of the International Property Maintenance Code Sections 307.1
Accumulation of rubbish or garbage was made and served on the Respondent as evidenced in this
hearing.
4. All premise and exterior property shall be corrected by removing all rubbish and trash stored in carport at
the aforementioned property.
CONCLUSIONS OF LAW
THAT Sonja Gross is not in compliance and has failed to correct such violation as of this hearing date.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted in Chapter
162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach,Florida it is Ordered:
THAT the Respondent is found in violation for non-compliance, and must come into compliance on or before
August 12,2011. Failure to comply will result in fines of$100.00 per day for everyday thereafter until compliance
is met.
THAT the Respondent is required to call the City of Atlantic Beach and request an inspection to confirm that
they are in compliance and a failure to call will result in the fine being imposed until an inspection is requested and
completed finding no violations.
THAT failure to pay all accumulated fines will result in a lien being placed against the property at 331
Seminole Road for the total assessment plus costs incurred for the filing of the lien. All lien amounts are to be made
payable at an interest rate of ten(10)percent per annum from date of certification until paid.
This Order becomes self-executing upon an Affidavit of Non-Compliance being filed with the City Clerk's Office.
DONE AND ORDERED THIS 12th day of July 2011.

Dear Ms. Gross:
I am the City Attorney for Atlantic Beach and am writing in regard to property you own at the
above-referenced address. As you know, the Atlantic Beach Code Enforcement Board entered an
Order imposing a fine of$100.00 per day for violations regarding trash, rubbish and debris on your
property. The violations were corrected and a fine of$25,160.09 was established. Interest at the
rate of 10%per year is also added to the amount owed, per Florida Statutes.
Please contact the City on or before June 15, 2012, to make arrangements for payment of the fine.
You may call Kathy Styles at 247-5855 or Mike Griffin at 247-5813. They are the Code
Enforcement Officer and Building Official, respectively. If arrangements are not made to pay the
outstanding fine, I will seek authority from the City to initiate a foreclosure action in court to
foreclose the City's lien on your property. This could result in additional cost to you for not only

3. That notification of the violations of the International Property Maintenance Code Sections 307.1
Accumulation of rubbish or garbage was made and served on the Respondent as evidenced in this
hearing.
4. All premise and exterior property shall be corrected by removing all rubbish and trash stored in carport at
the aforementioned property.
CONCLUSIONS OF LAW
THAT Sonja Gross is not in compliance and has failed to correct such violation as of this hearing date.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted in Chapter
162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach,Florida it is Ordered:
THAT the Respondent is found in violation for non-compliance,and must come into compliance on or before
August 12,2011. Failure to comply will result in fines of$100.00 per day for everyday thereafter until compliance
is met.
THAT the Respondent is required to call the City of Atlantic Beach and request an inspection to confirm that
they are in compliance and a failure to call will result in the fine being imposed until an inspection is requested and
completed finding no violations.
THAT failure to pay all accumulated fines will result in a lien being placed against the property at 331
Seminole Road for the total assessment plus costs incurred for the filing of the lien. All lien amounts are to be made
payable at an interest rate of ten(10)percent per annum from date of certification until paid.
This Order becomes self-executing upon an Affidavit of Non-Compliance being filed with the City Clerk's Office.

Code adopted to wit:
VIOLATIONS
Section 307.1 Accumulation of rubbish or garbage. All exterior property and premises,and the
interior of every structure, shall be free from any accumulation of rubbish or garbage.
This letter requests that the noted violations be corrected by removal of all rubbish,trash stored in
carport within ten(10)days from receipt of this letter.
A re-inspection will be done on or before June 27,2011. To avoid having this case be referred to the
Code Enforcement Board,all listed violations on this notice must be in compliance on or before the date
established by Atlantic Beach Code Enforcement. The Board may impose fines up to two hundred fifty
($250.00)per day for continuing violations.

Dear Ms. Gross:
The Code Enforcement Board of the City of Atlantic Beach was created pursuant to
Florida Statutes and exists for the purpose of facilitating the enforcement of the Code of
Ordinances. It is comprised of seven citizens, residents of Atlantic Beach, who meet regularly to
hear allegations of code violations.
You are hereby notified and ordered to appear at the next public hearing of the Code
Enforcement Board on Tuesday, the 12th day of July, 2011, at 6:00 pm at Atlantic Beach City
Hall, Commission Chamber, 800 Seminole Road, to answer and be heard to the following
alleged violations on the property known as 331 Seminole Road, Atlantic Beach, Saltair Sec 2
Lot 280,RE#170436-0000:
International Property Maintenance Code
Section 307.1 Accumulation of rubbish or garbage. All exterior property
and premises, and the interior of every structure, shall be free from any
accumulation of rubbish or garbage. Accumulation of rubbish and
garbage in carport.
A re-inspection will be done on or after July 11, 2011. The Code Enforcement Board may
levy fines up to $250.00 per day for the first offense and $500.00 for the second offense against
the property, if a violation is found to exist beyond the date set by the Board for compliance. If
the violation is corrected and then recurs or if the violation is not corrected by the time specified
for correction by the code inspector, the case could be presented to the enforcement board even if
the violation has been corrected prior to the board hearing. Upon completing the corrective
action required, it is your responsibility to contact Atlantic Beach Code Enforcement and arrange
for an inspection to verify compliance at (904) 247-5855.
You have the right to obtain an attorney at your own expense and to present witnesses in
your behalf. If you desire to have witnesses subpoenaed or if you have questions regarding the
procedure, please contact Donna Bartle, Secretary of the Code Enforcement Board within five
days of the receipt of this notice at 247-5809. Please note the presence of a court reporter for
the purpose of insuring a verbatim record in the event an appeal should be secured at your

10/05/10— I received an anonymous complaint of junk in the carport of 331
Seminole Road.
The owner of Record is Sonja Gross. I spoke with her and she said that she had
lost the house and she would contact the bank. I called her back 10/15/10 she
again said she would call the bank. She never called back.
10/27/10— I mailed a letter Stating violations and asking her to correct the
violations. IPMC 307.1 Accumulation of rubbish and garbage, 302.4 High grass
& weeds. Sonja signed for the letter but nothing was done.
11/8/10— Mailed a letter to Mark E. Steiner, Esquire with Bank of New York.
The letter was signed for in Mr. Steiner's office on 11/10/10. Nothing done.
11/19/10— Received another complaint from neighbor at 317 Seminole Road.
I attempted to call Ms. Gross again but received no return calls.
6/15/11 - Mailed another letter of violation to Sonja Gross, posted the property
and posted at City Hall. No response and nothing done.
6/30/11 — Letter was mailed certified, posted on property and at City Hall
informing that this case was to be brought before the City of Atlantic Beach
Code Enforcement Board on July 12, 2011 at 6:00.
These pictures were taken yesterday afternoon — 7/11/11.
1 recommend that the board find the property owners in violation & assess a
fine of $100.00 a day after giving 30 days to bring property into compliance.
That would make the date on or before (August 12, 2011).

Please be advised, Atlantic Beach Code Enforcement has found the property referenced above to
be in violation of Chapter 3, Section 307.1 —Accumulation of rubbish and garbage and Section
302.4—Weeds, International Property Maintenance Code, as adopted by the City of Atlantic
Beach, Code of Ordinances.
This letter requests you comply by removal of all trash, rubbish from carport and around
the entire property and clean and mow premises and all must be maintained within ten (10)
days of receipt of this notice.
A re-inspection will be done on or after November 15,2010. If the violation is corrected and
then recurs or if the violation is not corrected by the time specified in this notice this case may be
presented to the Atlantic Beach Code Enforcement Board even if the violation has been corrected
prior to the board meeting. The Code Enforcement Board may impose fines up to two hundred
fifty ($250.00) dollars per day for each day the violation is not corrected. Upon completing the
corrective action required, it is your responsibility to contact Atlantic Beach Code Enforcement
and arrange for an inspection to verify compliance.
It is our goal to enforce the codes and ordinances of the City of Atlantic Beach and protect the
health, safety and welfare of the City, and accordingly, your cooperation in this matter is greatly

Gross,pertaining to property described as 331 Seminole Road, 10-1516-2S-29E Sec 2 Saltair
Lot 280,RE#170436-0000 for violation of Chapter 12, Sec 12-1 (b) (11)of the Code of
Ordinances of the City of Atlantic Beach Florida, and finding that Sonja Gross,owner of the
property,has failed to make the required payments towards this obligation, it is the decision of
the City of Atlantic Beach that a Claim of Lien be filed against Sonja Gross. Said Claim of Lien
shall be recorded in the public records of the office of the Clerk of the Circuit Court in and for
Duval County, Florida,and shall be payable with interest at the rate of 10%per annum until

Margaret Sherrill with Keller Williams Realty has my permission to represent me before the Code
Enforcement Board on Tuesday, March 13, 2012 regarding the lien placed on 331 Seminole Road,
Atlantic Beach, FL 32233. 1 thank you for allowing Mrs. Sherrill to speak on my behalf and for taking her
statements into consideration regarding this issue.
Please accept my apologies for my lack of action on your past attempts to discuss the condition of 331
Seminole Road. I have not lived in the property for 4 years, and in fact,was told by my attorney that it
no longer belonged to me. That was my belief until this past December when Bank of America
contacted me regarding the short sale of the property.
This property is being sold as a short sale with no funds coming to me personally. I do not have
sufficient income or assets to rectify this situation. I lost my business in 2008 and have not been able to
find permanent full time employment since that time. I am not asking for the lien to be forgiven, but
adjusted to an amount that Mrs. Sherrill feels my lender will allow for the sales process to move
forward.
It is my understanding that the buyer is very anxious to close on this property and intends to make
repairs and improvements as soon as possible. I sincerely hope that the Code Enforcement Board can
come to a resolution that will allow the people who want to buy the home to complete their purchase
and bring the home into the proper condition. It is my hope that with your help,we can come to an
agreement to solve this problem that benefits the neighbors and the citizens of Atlantic Beach.

The motion was approved unanimously.
Chairman Martin explained to Mr. Brown that his appeal has been rejected and Mr. Griffin will be at his
door at 10:00 am to inspect the property.
Mr. Pendleton asked if another item could be addressed. Chairman Martin indicated that if it is not on
the agenda, it could not be addressed. He asked if it was a different issue. Mr. Pendleton explained that
it is not, it is the same property and regarding the treatment of previous fines on this property and
believes it has bearing on what we do. (more to follow beginning around 6:44)

Code Enforcement Officer Kathy Stiles presented the case and recommended that the board find the
property owner in violation and assess a fine of$100.00 a day after giving 30 days to bring the property
into compliance, making the date on or before August 12, 2011.
Chairman Martin asked if she determined that the property is in foreclosure. Officer Stiles explained
that there was paperwork filed, but it appears it has been rescinded and the property is still in her name
according to the property appraiser's records. Chairman Martin explained that the record is not always
updated right away, but usually changed the following year. Mr. Dodaro asked if the issue of
foreclosure is relevant to our decision. Chairman Martin replied not really, but it's just that our standing
and our status changes a little bit, but I was just thinking that for notice,we might be better off notifying
whoever brought this foreclosure. Officer Stiles explained the various ways she researched it. Mr.
Luthringer asked if a Certificate of Title was issued. Officer Stiles replied she did not. Mr. Luthringer
explained how you can pull up public records search, search her name and it should show whether a
Certificate of Title was issued. If so, it has transferred title and then he believes that in that case, but
confirm with counsel,that notice was not provided for this since we would need to notify that person
through the actual owner and they would be the one responsible for bringing the property into
compliance. He believed it should be confirmed whether a Certificate of Title was issued before making
a decision. Mr.Jensen advised that we need to determine who owns the property. Mr.Jensen reported
that in the case of foreclosure,you can pull up the docket sheet and see what documents have been
entered in that court file. Mr. Luthringer asked if it would be prudent for the Board to decide on
compliance on the person that signed for the letter and that if our research indicates there is a different
owner he could reinstitute a case on the next meeting. Chairman Martin agreed we would be that one
step ahead. Mr. Pendleton suggested an alternate that they could find the owner of the property in
violation and once the owner is determined if that owner had been contacted then put it in non-
compliance. Chairman Martin explained that what he said was that we would go ahead and presume
that the person we notified was still the owner and then our motion and order would already be in place
and if there had not been a change of ownership it will be effective and if there has been a change of
ownership then we would have to back up at the next meeting and pass a new motion.
Motion: The owner of the property at 331 Seminole Road Sonya Gross is found to be in non-
compliance and the oropertv must be broueht into compliance before August 12 2011 (within thirty
days from todav)or a fine of$100.00 a day for everyday thereafter will be imposed
Motion made by Mr. Dodaro, seconded by Mr. Ouellette
Mr. Luthringer reported that he had determined that the action which had been pending against this
property had been dismissed and that further action had been brought to reinstate but that was denied
by the court so Sonja Gross is still the owner. Mr.Jensen advised that they may want to consider
incorporating in your motion that it is incumbent upon the property owner to call for an inspection and
demonstrate to the City that they are in compliance. Chairman Martin agreed that it should be part of
the order before the signature instead of having it at the bottom.
Amended Motion: Amend the motion by addine language that it is incumbent upon the property
owner to call the City and request an inspection when the property has been brought into compliance
and failure to do so will result in the fines being imposed as stated

4B. 765 Sabalo Road, Randy and Vanessa Dedman, Case#77510
Code Enforcement Officer Kathy Stiles presented the case stating that this is a vacant home and has
been vacant for a long time. She explained that she had sent a letter of violation to the owners shown
on the property appraiser's website which was Randy L. and Vanessa Dedman. The violations were
IPMC 302.4. High grass and weeds. City Ordinance Sec. 24-173—Neighborhood preservation and
property maintenance standards. The letter asked them to clean up the accumulation of rubbish and
garbage in carport and surrounding the entire house and also to cut the grass and to maintain it. She
showed photos of the property. She reported that Randy signed for the letter but nothing was done.
The letter was also sent to Enrico G.Gonzalez, which was the attorney listed and someone by the name
of L. Fisher from his office signed for the letter. She explained the City eventually cut the grass.
Chairman Martin asked where she got the attorney's name from. She replied it was on the Clerk of
Court website. He asked if someone could look it up and confirm ownership. It was confirmed by Mr.
Luthringer that they were still the owners. Officer Stiles explained she had made several attempts to
contact them, so on 6/15/2011, a letter was mailed and posted on the property and at City Hall but

The Code Enforcement Board of the City of Atlantic Beach was created pursuant to
Florida Statutes and exists for the purpose of facilitating the enforcement of the Code of
Ordinances. It is comprised of seven citizens, residents of Atlantic Beach, who meet regularly to
hear allegations of code violations.
You are hereby notified and ordered to appear at the next public hearing of the Code
Enforcement Board on Tuesday, the 12th day of July, 2011, at 6:00 pm at Atlantic Beach City
Hall, Commission Chamber, 800 Seminole Road, to answer and be heard to the following

International Property Maintenance Code
Section 307.1 Accumulation of rubbish or garbage. All exterior property
and premises, and the interior of every structure, shall be free from any
accumulation of rubbish or garbage. Accumulation of rubbish and
garbage in carport.
A re-inspection will be done on or after July 11, 2011. The Code Enforcement Board may
levy fines up to $250.00 per day for the first offense and $500.00 for the second offense against
the property, if a violation is found to exist beyond the date set by the Board for compliance. If
the violation is corrected and then recurs or if the violation is not corrected by the time specified
for correction by the code inspector, the case could be presented to the enforcement board even if
the violation has been corrected prior to the board hearing. Upon completing the corrective
action required, it is your responsibility to contact Atlantic Beach Code Enforcement and arrange
for an inspection to verify compliance at(904)247-5855.
You have the right to obtairi'an attorney at your own expense and to present witnesses in
your behalf. If you desire to have witnesses subpoenaed or if you have questions regarding the

10 — received an anonymous complaint of junk in the carport of 331
Seminole Road.
The owner of Record is Sonja Gross. I spoke with her and she said that she had
lost the house and she would contact the bank. I called her back 10/15/10 she
again said she would call the bank. She never called back.
10/27/10— I mailed a letter Stating violations and asking her to correct the
violations. IPMC 307.1 Accumulation of rubbish and garbage, 302.4 High grass
& weeds. Sonja signed for the letter but nothing was done.
11/8/10— Mailed a letter to Mark E. Steiner, Esquire with Bank of New York.
The letter was signed for in Mr. Steiner's office on 11/10/10. Nothing done.
11/19/10— Received another complaint from neighbor at 317 Seminole Road.
attempted to call Ms. Gross again but received no return calls.
6/15/11 - Mailed another letter of violation to Sonja Gross, posted the property
and posted at City Hall. No response and nothing done.
6/30/11 — Letter was mailed certified, posted on property and at City Hall
informing that this case was to be brought before the City of Atlantic Beach
Code Enforcement Board on July 12, 2011 at 6:00.
