In Section 23-8, nuisance is defined as follows: "any tree, shrub, bush, grass or ground cover or other woody vegetation,
on public or private property,which is endangering or which in any way may endanger the public health, safety,security
or usefulness of any public street, public utility line or sidewalk; also any tree,shrub grass or ground cover,or other
woody vegetation with an infectious disease or insect problem.
Key to above being a PUBLIC danger. Private nuisances, aka those posing danger to private (individual) properties,are
not included in this definition because private property owners have civil remedies they can pursue.
Section 23-36 provides for the elimination of those trees afflicted with contagious diseases or pest-infested, due to the
spreading impact these can have on the entire community. There is nothing else which allows the City to require a tree
be removed from private property.

and arrange for an inspection to verify compliance.
