Builder Merritt obtained a work permit for this upgrade from the City of Atlantic Beach and the Building Inspector posted it on the garage structure. 3.After the construction work was well in progress but not completed, a stop work order was posted by the Building Inspector. The work was stopped from completion. The Inspector refused to offer an explanation. 4..Obtained services of attorney John D. Rawls to seek reinstatment of work permit. Seeking remedy first through Atlantic Beach City Council and Zoning Board, the City refused to rescind the stop work order. 5. Filed lawsuit against the City for reinstatament of work permit. Court's decision was for owner and the City was ordered to remove the stop work order and let the work be completed. This was in Sept. 1977. Only stipulation to Court order was living space in garage apt. always be used exclusively by immediate relatives of the house owner. O R D E R THIS CAUSE having come on for hearing, and the Court having consid- ered the brief submitted, the testimony given, the oral argument presented and the candor and demeanor of all witnesses; and having further considered and resolved all conflicts of fact presented, the Court hereby makes the following findings of fact and conclusions of law: 1 . This cause came before the Court on a Petition for a Writ of Certiorari to the City of Atlantic Beach Board of Adjustment and to the City of Atlantic Beach. The following three points were raised in the petition and the brief which accompanies it: POINT I RESPONDENTS WERE AND ARE ESTOPPED TO EXERCISE THE ZONING POWERS OF RESPONDENT, CITY OF ATLANTIC BEACH, SO AS TO DENY RESIDENTIAL USE OF THE ENTIRE EXPANDED STRUCTURE BY PETITIONERS. POINT II RESPONDENT, CITY OF ATLANTIC BEACH BOARD OF ADJUSTMENT, ERRED AS A MATTER OF FACT AND OF LAW IN DENYING PETITIONERS A VARIANCE FOR RESIDEN- TIAL USE OF THE EXPANDED SEPARATE STRUCTURE. POINT III RESPONDENT, CITY OF ATLANTIC BEACH BOARD OF ADJUSTMENT, ERRED AS A MATTER OF FACT AND OF LAW IN DENYING PETITIONERS A FULL SIDELINE VARIANCE AS NECESSARY FOR THE NOW EXISTING EXPANDED SEPARATE STRUCTURE. t 2. After considering the petition and the accompanying brief the Court held a trial de novo as authorized under Section 144 of the Charter of the City of Atlantic Beach, that trial being in Chambers without a jury. Sev- eral neighbors and Atlantic Beach residents were present as spectators at that trial, as was William G. Noe, Jr. Esquire, an Atlantic Beach attorney. 3 . The Court notes that jurisdiction is granted it over this cause by Article 5 , Section 5(b) of the Florida Constitution, by Rule 1. 640 of the Florida Rules of Civil Procedure, and by Sections 141 through 145 of the Charter of the City of Atlantic Beach. 4. In April, 1977, the Petitioners undertook the construction of an .addition to the following described property situate in'Atlantic Beach, Duval County, Florida: Lot Eight (8) and the West Twenty-Five feet (W 25') of Lot Six (6) , Block Fourteen (14) , ATLANTIC BEACH, according to plat thereof recorded in Plat Book 5, page 69 , of the current public records of Duval County, Florida. The structure on this parcel consists of a three bedroom family house and a separate structure which prior to construction contained a one car garage and a living area equipped with a bedroom and a bathroom, the latter con- taining a toilet, a lavatory and a shower stall. 5 . The Petitioners undertook the construction to the separate garage structure in order to render the living area suitable for Mary R. Newfang, one of the Petitioners herein, who also is the mother of Max C. Brantley, another of the Petitioners herein. The Petitioners decided to accomplish their goal by converting the shower stall into a closet area, by adding a bathtub to the existing bathroom and by adding a new room to the north end of the existing garage structure. This new room was intended for use as a living room area and a kitchen area, and was built with dimensions of fourteen feet by twenty-two feet (14' x 22') . The entire construction had an anticipated cost of almost fourteen thousand dollars ($14, 000. 00). - Page 2 - f 6. This .area is zoned for one single family detached dwelling for each parcel. Because the pertinent zoning regulations were imposed after the previous garage structure had been built, including the original living quarters, the use of those original quarters for living purposes was exempt from thosp.'zoning regulations. . 7. Respondents have contended.that any use of the garage structure as living quarters in excess of the use to which it was put prior to the im- position of the applicable zoning regulations.would be in violation of those regulations. Specifically, Respondents have contended that present zoning regulations forbid the building of additional living's tructure s within ten feet (10') .of a side property line, the building of an additional nonresident struc- ture within five feet (5') of a side property line or the use of more than one structure upon any given parcel as a dwelling. 8. Respondent,. City of Atlantic Beach,.requires that all structural construction within its jurisdiction be performed pursuant to a building permit. Because Respondents relied heavily in*this cause upon the applications for building permits, the building per issued and the building plans which relate to Petitioners' construction, extensive testimony was presented to the Court concerning the permitting process in general and the obtaining of the permits used for this particular construction. That testimony demonstrated that little reliance can be.placed by anyone, including Respondents, upon the statements. and representations made in the applications and building plans required by the City of Atlantic Beach. At no point is the property owner required to become a party to the permitting proce.ss.' At no time is the permit applicant required to demonstrate that he has the property owner's approval or permission in making the application. The property owner is not required to examine the building plans or to verify the statements made on the applica- tion. Although the application form requests a valuation by the applicant of the proposed construction, that valuation is not verified or relied upon by the City of Atlantic Beach and has no relation to any regulatory function. - Page 3 - L The valuation is used to set the amount of the permit fee and for little else. In this regard, I note that this application was to construct three hundred eight feet (308') of enclosed .space;. from the testimony it is apparent that even storage areas cost far more than three dollars ($3 .00) a square foot to build at current prices. 9 The building plans used here were required to be submitted with the application for building permit and supposedly were to be strictly fol- lowed during all stages of construction. Respondents' own building Inspector, however, stated that he allowed construction to commence several days before he approved.the plans. He disapproved the plans initially be- cause they called for a continuation of the•east side of the existing garage structure. That existing structure and the proposed continuation would- have run parallel to and approximately three and a half feet (3 .5') from the east property line, but this parcel is zoned for a ten foot sideyard between a dwelling and the property line, and a five foot sideline between a nonresiden- tial structure and the property line. The existing structure, having existed before those restriction$ were imposed, is exempt from those restrictions , but the building inspector required that the proposed. addition be set back an additional one and a half feet (1.5') to comply with the sideyard requirements. The plans were changed. accordingly and then approved.' The city manager of the City of Atlantic Beach is also the city building official and is charged with enforcement of the zoning code. After the slab was poured but before any major structural construction above the slab level, the city manager and the building inspector met (as they both testified) with a representative of the contractor. Construction was proceeding along the original proposed line in violation of the approved building plans and the sideyard restrictions. At that meeting both city officials , without consulting the Board of Adjustment, agreed to let construction continue, the violations notwithstanding. 10. Detailed testimony was given concerning the inspections of the construction site..made by the building inspector. The first inspection was - Pago 4 - a foundation inspection on April 29 ,. 1977 , to inspect the monolithic slab. After this inspection the building inspector and the city manager agreed to allow the contractor to ignore the sideyard restrictions. On April 30, 1977, Petitioners made their first-of.three proj ected installment payments to the contractor, ,this payment being in the amount of four thousand two hundred dollars .($4, 200.00) . On May 4, 1977, the building inspector made his second inspection of the construction site, ordinarily his last inspection prior to completion of the building and the final inspection. This was a framing and rough electrical inspection, which the building passed even though the framing included a seven foot door aperture leading to the outside and the plans did not call for any door whatsoever leading to the outside. At the time of that inspection.a set of sliding glass doors was. sitting in the ti old bedroom area of the structure being improved. A reasonably diligent in- spection of the premises, including a review of the building plans, would have shown that sliding glass doors suitable. only for a residential structure were being'installed in violation of those plans. The following day the same building inspector received an inquiry from the mayor, returned to the con- struction site, consulted with the city manager and imposed a stop work notice on the premises. At-the time that notice was imposed, the new area basically consisted of framed-in walls, a slab and rough electrical wiring. 11 . The stop work notice was not imposed on May 5 as the result of any structural changes made after the inspection on May 4. It was im- posed solely to give the City of Atlantic Beach the opportunity to determine whether the new area.would be used for residential purposes. At a meeting of the five-man City Commission of Atlantic Beach on May 9 , 1977, Commissioner Allan C. Jensen was appointed to investigate the situation. In the course of his investigation CommissionerJensen was told by the Petitioners of their ihLontion to use the new area for residential purposes. He consulted with Mayor-Commissioner William S. Howell and Commissioner James E. Mhoon and the three of them, constituting a majority of the City -Page 5 i I Commission, decided to lift the stop work notice. There is a conflict in the testimony as to whether Commissioner Jensen warned Petitioner, Max C. Brantley, that further construction would be at the latter's own risk. The Court resolves that conflict by ruling as a matter of fact that Petitioners were given no express or implied warnings or admonitions which would cause a reasonable man to doubt that he could legally complete the. construction and use the additional area for residential purposes . In reliance upon the lifting of.the stop work notice, Petitioners resumed construction; they also made a second installment payment, in the amount of four thousand five hundred dollars ($4,500.00) , to the contractor on May 20,. 1977; the .proposed third installment has never been paid. 12. On May 31, 1977, Respondent Board of Adjustment considered Petitioners' request for two•zoning variances necessary to allow use of the virtually completed structure as an enlarged residential area. That Board de- nied Petitioners' request for a variance permitting residential use of the entire structure. The Board'took no recorded action on Petitioners' request for a sideyard variance to permit that same residential use. Thereupon, Petitioners filed their Petition for Writ of Certiorari. 13. The Court finds that, under these circumstances, Respondents are equitably estopped from failing to grant the variances sought and are further equitably-estopped from asserting the zoning code of the City of Atlantic Beach t in attempting to prevent use by the Petitioners of the entire structure for resi- dential purposes. The officials and employees of the City of Atlantic Beach have ignored the permitting requirements and zoning restrictions of that City throughout this series of events. Acting through its officials and employees the City of Atlantic Beach has shown a repeated disregard for its own Board of Adjustment and that Board's supposedly exclusive right to grant a variance. They ignored the Board's existence until it became expedient to let the Board disapprove what they had already approved. Having so acted throughout this Page 6 a process, and having allowed Petitioners to continue their construction and to expend substantial additional funds for that construction, the City will not now be heard to argue that only the Board of Adjustment can moderate the force and effect of the City's zoning code. 14. The Court was not asked to make,, and does not make, any . findings as to whether persons not related to one another by blood, marriage or adoption can occupy both structures on this parcel as residential dwellings, either now or at some point in the future., The Court simply notes that all persons presently dwelling on this parcel, being the Petitioners and their children and grandchildren, are so related. WHEREFORE, the Court being advised in the premises and having reached the above findings of fact and conclusions of law, it is ORDERED AND ADJUDGED that 1 . The, decisions of the City of Atlantic Beach Board of Adjustment here under review are hereby quashed. 2. The City of Atlantic Beach Board of Adjustment enter and file at its office its written decisions granting two variances to Petitioners, one allowing all of the new additional areas of the garage structure to be used for residential purposes, and one allowing the sideyard between those new additional areas and the east property line of this parcel to be three and one half feet (3 .5') wide. 3 .
