CE 61 W 2ND ST childcare center for a maximum of 42 children. The hours would
be from 9:00 am until 12:00 noon, five days per week and that the
calendar would be the same as public schools.
Ron Gray asked how close the nearest house was to the church.
They replied that the closest building was the sales office for
Aquatic Gardens Subdivision. Ruth Gregg and Candace Nordan felt
it was a good location. Ron Gray van concerned about the
increased traffic on Aquatic Drive. He quoted sections from the
minutes of the Planning Board of January 25, 1983 when the Church
first applied for their use by exception. The applicants had
stated that they had no plans for a school.
Candace Nordan motioned to recommend denial of the application
based on the original use by exception in which they stated they
would have no schools. Ruth Gregg seconded the motion which
carried unanimously.
D. Request for Expansion of Use by I Exception for an Additional
Fifty Seats for Sale of Liquor - Ragtime Tavern, 207
Atlantic Boulevard; William and Thomas Morton
William Morton stated that they had preliminary plans to expand
into one or two of the adjoining units. Mr. Morton stated that
they had plans to construct a rear entrance (to better utilize
the rear parking) including lighting and landscaping. There van
considerable discussion regarding the insufficient parking.
Suggestions were made to Possibly leasing parking from the
southeast corner parking lot, the Sea Turtle parking lot, or the
southwest dirt parking lot. There was a brief discussion as to
the fate of RZanaduffo- directly next door, and as to how they
could expand westerly.
Candace Norden asked the applicants to withdraw their request and
come back with ideas to solve the parking problems. Mr. Morton
withdrew the request.
There being no further business before the Board Gregg McCaulie
motioned that the meeting be adjourned. Ron Gray seconded the
motion which tarried unanimously.

The Code Enforcement Board of the City of Atlantic Beach was created pursuant to Florida
Statutes and exists for the purpose of facilitating the enforcement of the Code of Ordinances. It is
comprised of seven citizens of Atlantic Beach who meet regularly to hear allegations of code violations.
You are hereby notified and ordered to appear at the next public hearing of the Code
Enforcement Board on Tuesday, May 14, 2013 , at 6:00 pm at Atlantic Beach City Hall, Commission
Chamber, 800 Seminole Road, to answer and be heard to the following alleged violations on the

CITY OFATLANTIC BEACH CODE OF ORDINANCES
Section 24-173. Neighborhood preservation and property maintenance standards.
(b) Appropriate maintenance and upkeep. All areas of a lot and structures that are visible
from a street or a neighboring property shall be maintained in an acceptable manner, which shall be
defined by the following characteristics.
(1) Lots are maintained free of letter, trash, debris, discarded belongings, automotive parts and
old tires, construction materials, and broken and abandoned items.
INTERAA TIONAL PROPERTY MAINTENANCE CODE
Section 302.8 — Motor Vehicles "No inoperative or unlicensed motor vehicle shall be parked or kept or
stored on any premises, and no vehicle shall at any time be in a state of disrepair, major disassembly or
in the process or being stripped or dismantled".
The Code Enforcement Board may levy fines up to $250.00 per day for the first violation and
$500.00 per day for a repeat violation. If the violation is corrected and then recurs or if the violation is
not corrected by the time specified for correction by the Code Enforcement Officer, the case could be
presented to the Code Enforcement Board even if the violation has been corrected prior to the Board
hearing. Upon completing the corrective action required, it is your responsibility to contact Atlantic
Beach Code Enforcement and arrange for an inspection to verify compliance at (904) 247-5855.
You have the right to obtain an attorney at your own expense and to present witnesses in your
behalf. If you desire to have witnesses subpoenaed or if you have questions regarding the procedure,'
please contact Dayna Williams, Secretary of the Code Enforcement Board within five days of the
receipt of this notice at (904) 247-5810. Please note the presence of a court reporter for the purpose of

Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted
in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach, Florida it is
Ordered:
THAT the Respondent is found in violation for non-compliance and must obtain compliance on
or before May 31,2013. Failure to comply will result in fines of$100.00 for the first day and $100.00 for
every day thereafter while the violation continues to exist. In addition, any fine shall also include the
administrative costs to the City incurred in prosecuting this case.
THAT the Respondent is responsible for contacting the City of Atlantic Beach Code Enforcement
Officer and obtaining an inspection of compliance.
THAT failure to pay all accumulated fines will result in a lien being placed against the property at
61 63 W 2nd St for the total assessment plus costs incurred for the filing of the lien. All lien amounts are
to be made payable at an interest rate of ten(10)percent per annum from date of certification until paid.
This Order becomes self-executing upon an Affidavit of Non-Compliance being filed with the City
Clerk's Office.

8. Acknowled&e receipt of petition from property owners on Begonia St.
asking for street paving improvements
Mayor Howell acknowledged receipt of a petition signed by six property
owners in the 1200 block of Begonia Street that requested the street
paving work to be done on Begonia St. be extended through the 1200
block of Begonia and not stopped as presently planned prior to entering
the 1200 block of Begonia. No one was present for discussion, and it
was uncertain whether the property owners wanted Just paving. The City
Manager was instructed to contact the property owners for clarification
and report back to the Commission.

auto service garage at 61-63 West Second Street in Section H, with the
provision there would be no outside work and no outside storage
Mayor Howell announced the application had been approved by the Advisory

Acting Chairman Ron Gray called the meeting to order at 7:00 p. m.
He asked for a motion on the minutes of the meeting of December
is, 1986. Candace Nordan motioned that they be approved as
presented. Ruth . 'Gregg seconded the motion which carried
unanimously. Mr. Gray asked for a motion an the minutes of the
workshop meeting of January 6, 1987. Ruth Gregg motioned that
they be approved as presented. Ron Gray seconded the motion.
The motion carried unanimously.
OLD BUSINESS
A. Request for Rezoning from RGI to RG2 and Preliminary Site
Plan Approval - Stephen Mabry and John Talbert (Deferred
from Meeting of December 16, 1986) at George Street and
Church Road
Mr. Talbert presented the Board with a preliminary site plan of
the property that indicated four lots 1000 x lag,, each with a
four unit building. Mr. Talbert pointed out the small percentage
of lot coverage. He noted that the property backs up to a park,
and that to the west is a large area of open space owned by the
city. He added that they proposed to construct two or three
bedroom units and that adequate parking would be provided.
Candace Nordan questioned whether they should limit the number of
bedrooms to two In order to maintain a low density. The Board
felt they could not limit the number of bedrooms due to
marketability. After further discussion Ruth Gregg motioned to
recommend approval of the request. Candace Nordan seconded the
motion which carried unanimously.
NEW BUSINESS
A. Request for Rezoning from RS2 to R02 - Ellen C. Price; Lot
80. North Atlantic Beach Unit No. 3
Mrs. Price, 1a10 Sevilla Boulevard No. 306, stated that due to
having a mild stroke in September 1986, she was not aware of the
annexation of her property into Atlantic Beach or the change of
zoning from RGA, which would allow construction of a triplex to
RS2, single family. She stated that she had plans to construct a
triplex with underground parking.
The Board was in receipt of a petition with 61 signatures and
five letters from surrounding property owners expressing
opposition to the rezoning. The following people spoke against
the application: Frank Delaney, 2371 Seminole Road; Gene
Montanye, 1731 Beach Avenue; Bert Russell, 2077 Beach Avenue.
The Board members were concerned about *spot zoning" the
property. After a lengthy discussion, Candace Nordan motioned to
recommend denial of the application. Ron Gray seconded the
motion which carried unanimously.
B. Request for Use by Exception for an Automotive Service Garage
in CG; 61-63 Went Second Street, Lot 7 and Half of Lot 6,
Block 26, Section H; by Tom Went Homes, Inc.
John Murr, 7632 Southeide Boulevard# stated that he van renting
one of the units and that he wished to open a small automotive
service garage. He stated that he would do the work himself and
that the care would be kept inside the garage. He added that he
has a wrecker and that it would go home with him at night.
Ruth Gregg stated that there were several cars on the premises
now. Mr. Murr stated that they belong to the other tenant and
that he had talked to him about it. The Board asked that the
Codes Enforcement Officer look into the matter.
There was a discussion as to a previous application for use by
exception on the same premises. Ruth Gregg motioned to recommend
approval of the application subject to general cleanliness of the
premises and that there be no outside work or storage. Ron Gray
seconded the motion which carried unanimously.
C. Request for Use by Exception for a Childcare Center in RG2
298 Aquatic Drive; Sunrise Community Evangelical Free Church
Representing the church were Melanoy Blevin and Sharon Pino.
They stated that the church van requesting permission to open a

owners in the 1200 block of Begonia Street that requested the street

was uncertain whether the property owners wanted jpst paving. The City
Manager was instructed to contact the property owners for clarification

This letter requests that the noted violations be corrected by removal of all the junk, major
and partially dismantled, inoperable, unlicensed, disassembled vehicles, trailers and panel
trucks and vehicle parts and components automotive parts, tires, large parts/vehicle
component stored in trailers, beds of inoperable vehicles, including tires, bumpers, large
automobile parts, pallets, cardboard boxes, and misc.junk and debris all stored on your
property and the adjacent public right-of-way within thirty (30) days from receipt of this
notice and in accordance with the conditions of your use by exception granted on February
9, 1987 (copy attached).
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
Enforcement. The Board may impose fines up to two hundred fifty ($250.00) per day for
continuing violations.
