The City of Atlantic Beach,having given proper notice to the property owner,Bruce L.
Smith,pertaining to property described as 417 Sailfish Drive E,31-00138-2S-29E ROYAL
PALMS UNIT 2 A LOT 6 BLOCK 27 CYNTHIA L O/R BK 4476-566,RE#171379-0000
for violation of Chapter 24, Sec 24-154 (G) of the Code of Ordinances of the City of Atlantic
Beach Florida, and finding that Bruce L. Smith,owner of the property,has failed to make the
required payments towards this obligation,it is the decision of the City of Atlantic Beach that a
Claim of Lien be filed against Bruce L. Smith. Said Claim of Lien shall be recorded in the
public records of the office of the Clerk of the Circuit Court in and for Duval County,Florida,
and shall be payable with interest at the rate of 10%per annum until paid.
This Claim of Lien is to secure payment for the administrative fees and fines in the
following amount:
Administrative Fees and Fines: $ 671.30
TOTAL DUE: $ 671.30

ORDER IMPOSING FINE
THIS CAUSE came for public hearing before the Code Enforcement Board on May 12,and the
Board having heard testimony under oath,received evidence,and heard arguments respective to all
appropriate matters,and thereupon issues the Findings of Fact,Conclusions of Law and Order as follows:
FINDINGS OF FACT
1. That Mr. Bruce L. Smith resides at the property located at 417 E. Sailfish Drive,Atlantic
Beach,Florida.
2. That notice was sent certified mail on April 28,2009 and that he wasn't present at the hearing.
3. That notification of the violation of Chapter 24,Sec 24-154(G): were made and served on
the resident as evidenced in this hearing.
CONCLUSIONS OF LAW
THAT Mr. Smith is not in compliance and has failed to correct such violation as of this
hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the
authority granted in Chapter 162,Florida Statutes, and the Code of Ordinances of the City of
Atlantic Beach,Florida it is Ordered:
THAT the Respondent be found guilty for non-compliance,and must come into
compliance by 12:00 pm,seven(7)days within receipt of this notice. Failure to comply will
result in Administrative fees and fines of$50.00 per day for every day after until compliance
is met.
THAT failure to pay all accumulated fines will result in a lien being placed against the
property of 417 E Sailfish Drive for the total assessment plus costs incurred for the filing of
the lien. All lien amounts are to be made payable at an interest rate of ten(10)percent per
annum from date of certification until paid.
This Order becomes self-executing upon an Affidavit of Non-Compliance being filed
with the City Clerk's Office and a hearing shall not be necessary.
DONE AND ORDERED THIS 13th day of May 2009.

Dear Mr. Smith,
Enclosed is a bill from the City of Atlantic Beach. This bill is the result of your failing to comply with
Code Enforcement Board's Findings of Fact dated May 131`,2009. A copy of their order was hand
delivered to your residence on June 1,2009 allowing 7 days to bring your property into compliance.
An inspection of your property on June 9,2009 revealed you had not complied and an assessment of
$311.30 in administrative fees,plus a$50.00 a day fine was imposed per the Code Enforcement Board's
Order.
Daily inspections of your property revealed that you continued to remain in violation until June 16,2009,
at which time additional fines were curtailed. Your total bill for failing to properly respond to the Code
Enforcement Board's Findings of Fact is$311.30 administrative fees,plus a total of$350.00 in fines for
the 7 days you remained non-compliant with the order,for a total of$661.30.
