We have been informed that we need to re-site an existing fence along Ocean Boulevard. We acknowledge the fence is not within the property line. We are requesting a Revocable Encroachment Permit based upon the following: • Neil McGuiness, the previous owner of the property, applied for a fence permit indicating the fence would be within the property lines and received approval. • Mr. McGuiness in fact placed the fence over the property line. • We, the buyers, we told that the fence was properly permitted and approved. • The fence has been in place for more than 4 years, dating to before we purchased the property. • Atlantic Beach Police have examined the intersection at least twice and found no safety issue, especially given that the sightlines are within code. Irrespective, the intersection is a four-way stop and the sightline requirements are not applicable. • The City has not been impeded by the fence, inclusive of replacing the water main on Ocean Boulevard. • Moving the fence may jeopardize a 40' palm tree in place. As there is no serious threat to the public health, safety or welfare, we respectfully request you grant this permit to spare the property owner the unnecessary expense of removing vegetation, moving the fence and replacing vegetation. The status quo is not problematic, but the prescribed remedy is a burden on the property owner.
