CE 780 BEGONIA White, Debbie From: Griffin, Michael Sent: Thursday, October 31, 2013 1:17 PM To: Hubsch, Jeremy, pgunsaulies @yahoo.com Cc: White, Debbie; Hubsch, Jeremy Subject: RE: Code Enforcement Moratorium - 15ft Rule Mr. Gunsaulies, The commission at the October 28 workshop agreed to bring this up at the November 11, 2013 regular meeting and place a moratorium on code enforcement action. The community development board will address this issue to recommend any changes to the current code at their November 19, meeting. Therefore until the community development board provides a recommendation to the commission all code enforcement action will be abated. Before any action or fines occur the code enforcement board will need to find that there is a violation, that will not happen unless you are cited before code enforcement board. If you want to provide your opinion you can attend the November 19 community development board at 6:00 p.m. If you have any questions please let me know. He is the city employee who has been working on this issue with the commission and community development board. I believe they voted to enact a moratorium on enforcement of the code until the issue comes back to them in December. I've included Mr. Griffin on this email, and I'm sure he can answer any further questions you have. Had spoken to Jonathan earlier in the day and he was under the same impression I was until he spoke with the City Manager who apparently had not acted on the request by the council for a moratorium on code enforcement of the 15ft rule until they could rule on any changes. Because this wasn't acted on, now I'm in a bind with code enforcement with no options being told I've got to move by the 31 st or face $250/day in fines. Any suggestions? Also, who was the gentleman you were sitting next to behind me? (the one who spoke to me about the City Manager) I've seen him at several meetings. Does he work for the City? Thanks, Paul On Monday, October 28, 2013 12:21 PM, Mr Paul Gunsaulies <pqunsauliesCQYahoo com> wrote: Hello again, As you may remember, I appeared at a workshop several months ago discussing the possibility of amending the current 15ft rule in place for trailers/boats/recreation vehicles. In my case, my property line is in the middle of my yard so I am hoping that the rule can simply be amended from "15ft off the property line" to "15ft off of the street" in order that I can be treated fairly like any other homeowner in Atlantic Beach. At that meeting, it was my understanding (and that of the commissioners I believe) that the commission agreed to ask the City Manager / Code Enforcement for a moratorium on enforcement of the current rule until it could be considered and come up for vote by the commission (after review by the Community Development Board - which is still in progress). Despite this, much to my surprise, I received a notice of violation on October 21st! The violation letter asked for removal within 10 days which would be this Thursday. As mentioned previously, given the width of my yard, I do not have an option of putting anything on the sides of my house. So, I'd like to ask you to follow up on the previous moratorium request at tonight's meeting. I will be in attendance at 6:30 in case you need any clarification from myself. Thanks, Paul Gunsaulies 2
