I understand the program has been successful throughout Duval County and that such programs currently exist at several of the beaches schools. An Atlantic Beach police officer has entered into an agreement with the Duval County School Board for such an arrangement. Unfortunately, neither the School Board nor the police officer checked the Atlantic Beach ordinances prior to moving the mobile home onto school property. A stop work order was placed on the mobile home by the Code Enforcement Officer on January 29, 1990. Our City Attorney has advised that enabling legislation exists under Section 24-168 of the Code of Ordinances which states "A mobile home may be placed on public property within the city for the purpose of protecting such property when approved by the city commission during a regular meeting, and providing that all other sections of this chapter are met when applicable to the location. No. 65. The Duval County School Board, owner of- said property, implemented a program on April 2, 1973, to place security personnel on school grounds in a permanent living arrangement in order to provide 24-hour security. This program is beneficial in reducing the amount of vandalism committed at our schools in that the security officer is able to keep a watchful eye on the school site and buildings, as well as the immediate neighborhood. An Atlantic Beach police officer and his family will be residing in the mobile home. It is my understanding that the City has already obtained a copy of the Board's agreement with this police officer, which spells out the specific duties and requirements of the officer. THE SCHOOL BOARD shall , at its expense, prepare said space to include site leveling and preparation, installation of all utility lines anc hook-ups and provide maintenance and repair for utilities up to the point of connection to the mobile home. 3. THE SCHOOL BOARD shall furnish water, sewer, propane gas, and electrical services to OWNER for his mobile home at the school site at THE SCHOOL BOARD'S expense. 4. Except as hereinafter provided, any and all expenses and/or liability incurred in moving OWNER'S mobile home to- or from the designated space, blocking, or maintaining said mobile home shall be the responsibility of the OWNER, and OWNER shall hold THE SCHOOL BOARD harmless for the same. 5. OWNER shall locate his mobile home on the designated space, and shall maintain the same as his residence with his family. OWNER shall give at least twelve (12) hours advance notice to the Principal. of the s hool and School Security of any absence of twenty-four or more con ecutive hours. In the event that the OWNER fails to give such advance iotice of absence, the OWNER'S mobile home may be considered abandoned property and subject to removal from the above school site and OWNER shall bear all cost related to such removal . 6. OWNER shall not keep any pets, install any outbuildings , or construe any permanent improvements on said space, except as agreed to in adance in writing by the School Principal , Assistant Superin- tendent if Facilities and the Security Director. 7. OWNER shall be responsible for maintaining the mobile home and desi nated space, together with any improvements thereon, in a clean, orderly and sanitary condition at all times. Owner shall install skirting of his choice around said mobile home . 8. OWNER shall not operate or maintain on the premises, any business or commercial venture, but shall only use the same as a single family residence. OWNER shall not "tie in" or connect any additional electric lines to the electric service pole owned by THE SCHOOL BOARD. 9. OWNER shall , at his expense, have installed and maintain in his mobile home, a telephone in his name, and shall furnish the Security Division and the School Principal with the number of such telephone. 10. OWNER small keep a watchful eye on the school site and buildings, and shall immediately report by telephone any trespassers to the proper law enforcement agency and to the School Principal or his designee. 11 . OWNER shall make a' security check to verify proper closing and locking of all exterior doors and windows at the school site at least once every twenty-four (24) hours. Security check shall be made during the time the building is not occupied by students or school staff. Family members of owner are not authorized to make security checks. 1 . OWNER shall maintain a log of activity on forms provided by the Security Division, and shall submit such completed forms to the School Principal , on the first and fifteenth of each month during the term of this agreement. OWNER shall sign and verify all information contained in each form. Completed forms are to be returned to the Security Division by the school for a permanent record of the OWNER'S activities. 13. OWNER shall allow THE SCHOOL BOARD at its discretion and expense to install an intrusion alarm monitor in the OWNER'S mobile home, which will allow the OWNER to detect unseen intruders and notify appropriate authority as provided in Paragraph 10. 1-4 It is expressly•agreed and understood by the parties hereto that 'Chi ; agreement is entered into as a part of a program for the express p rpose of reducing vandalism on school property, and that this agreement may be terminated by either party upon delivering written notice of said termination to the other party, but in no event shall said termination be effective until thirty (30) days after the delivery of said notice to the other party. The Superintendent shall have the express power to terminate this agreement on behalf of THE SCHOOL BOARD. 15 Either party may terminate this agreement in the manner provided in Paragraph 14 above at any time, and said termination shall be at the sole discretion of the party terminating, and no cause for said ter7iination shall be required. This may be a class action suit, if appropriate. The cau a of this action is the recent rezoning of a section of the Atl ntic Beach Elementary School grounds in the 200 block of Poinset is Street to Residential, and the subsequent placement of a mobil home on those grounds . It is our contention that the required proper public notice of the rezoning hearing was not given and is therefore illegal. As a matter of fact (and as you well know) , construction was begun on the mobile home site prior to the rezoning hearing, demonstrating bad faith from the outset. The result of this illegal action is significant lowering of the market values of the res dential properties on the southern half of the 200 block of Poinsettia Street, as well as adjacent residential properties on and bout the intersections of Poinsettia, David, and Sylvan streets The mobile home is an eyesore, as is the inexpensive' wooden fence erected. Both detract greatly from the general appearance of the area. It is clear that this type of manufactured residential construction is completely inappropriate in this area. The other residents, with whom I have conferred, and I will only be satisfied by the complete and immediate removal of this structure, or by being compensated fairly for the decrease in market value of our homes. This event was particularly untimely for me and for my neighbor at 210 Poinsettia, as we both were placing our homes up for sale at this very time. If you would like to discuss preventing this lawsuit, which clearly has great merit and would cost the city a substantial sum in damages, legal fees, and court costs, please contact me. Otherwise, you will be hearing from my attorney in the very near future. While we are very unhappy and quite angry, all of us are most willing to be cooperative. We all enjoy living in Atlantic Beach (a fine community, with this one exception) and realize that the cost of resolving this ill-considered act will ultimately be paid out of our taxes.
