Lack of required condo board maintenance over the years, specifically to my respective unit and two adjacent units, is reason for alarm. Our association property is becoming unsafe. Unfortunately, I am currently residing (in unit #22) between two compromised units that have been found to be structurally unsound by a professional structural engineer 2 months ago. As of this date, serious damages to both units have not been corrected or safe for occupancy. Main to discuss my unit's various overdue Ocean Village maintenance problems, an active leak through my unit's NE corner wall abutting the common breezeway, and serious potential roofing leaks concerning my respective unit. Her son who appeared to be knowledgeable concerning construction accompanied her. I again detailed these exact problems at the Ocean Village Board meeting 16 July in the board's presence and discussed same with board member Ms. D. Fletcher on 21 July 2001. To recap, please note the following summary, which is not intended to be all inclusive of my unit's exterior deferred maintenance problems: • The privacy fence between my unit 22 & unit 23 is rotten and failing down after many years of neglect. It's an unsightly safety issue that must be rectified immediately. The SE concrete block stucco party wall-between my unit 22 & unit 23 is deeply cracked at X105 both the second floor and ground floor elevations from an apparent lightning strike. The stucco system is now unstable. It could leak water and damage my unit's interior at anytime, and looks very unsightly The NE concrete block privacy wall between my unit and the common breezeway has ps separated from the party wall, is leaning toward my unit, and has an apparent foundation ✓3 settlement problem. It presents safety and potential water leakage issues. My unit's front mansard tile roof has cracked roofing tiles and subject to leaks. CSS' 3 My unit's rear mansard tile roof has obvious problems visible to the naked eye -several missing roofing tiles and end pieces, many cracked roofing tiles, failed sheeting and waterproof roof support system, and progressive roofing leaks for many years. Structural roofing support systems(rafters/joists) can only be determined after the roof is torn off and replaced. Emergency repairs were executed 21 June. Questionable structural support and beam system carrying the entire 2"d floor on the eastern elevation of my unit. Settlement is obvious and causes difficulty in closing both my upstairs and downstairs rear sliding glass doors for many years. Painting on both my eaves, flashing, and fascia boards is of poor quality and defective. A/C electrical breaker boxes on the NE party wall are rusted and dangerously exposed to -3 the elements. Leaks inside my 3 double-paned fixed glass windows were stained from outside water 3�5intrusion coming from an upper level floor leak. The exterior of the upper level sliding glass door opening has multiple levels of caulking from numerous leaks reported to Ocean Village Association over the past 3 years. The 3� water has repeatedly leaked and ponded downstairs next to the lower sliding glass door. The entire eastern exposure of my unit's existing T1-11 siding system is deteriorating and ©�_'L needs to be replaced. Numerous areas are caulked to stop previous leaks and exposure to the elements. 1 EMERGENCY REPAIRS: On Friday evening 20 July 2001 our family observed water actively leaking into our unit and running down our custom wood interior/drywall on the inside SE wall. The weather that night was only an intermittent drizzling rain. Saturday morning 21 July the entire wall was soaking wet and water damaged inside. I went outside to our upstairs deck and further observed (from a distance of only about 5 feet) that the roof sheeting/waterproofing was completely rotted away underneath the tiles, water was running internally into the eaves, the fascia was rotted away, and flashing was bent and ineffective. I reported this to board member D. Fletcher at 9 AM and she arranged for a temporary emergency "patch" to stop the water from coming into my unit later that morning. Although I greatly appreciate her quick response and concerns, it does not address the larger roofing problems with rotten wood/cracked tiles and potential costly leaks into our custom interior. Several weeks prior to discovering the leaks, I addressed these problems with several Ocean Village board members in person and had given them a first-hand / close-up inspection for their evaluation. Only several days ago I further expressed concerns for my unit's specific problems at a regularly scheduled board meeting and noted that the leak problems dated back to the 1980's. No immediate action was forthcoming. I have attached a letter from the Florida certified roofing contractor, Ryan Mills of AIA Roofing, which details his findings concerning my particular temporary repair. The roofing contractor showed me the appalling neglect of the rotten roof and discussed the likelihood of more potential water damage. He shares the same concerns about leaks and recommends repair / roof replacements ASAP (as soon as possible). Having witnessed his repairs to my unit on 21 July, I agree with his professional assessment. Consequently, our family is left with no readily available alternative to protect our property's interior from further leaks with the looming hurricane season on our doorstep in the next 30 days. As installed, the contractor's temporary patchwork of fixes to our roof is unacceptable and questionably watertight under expected heavy rains & winds on a daily basis. In accordance with the practice of professional "due diligence" him & I discussed the work scope particulars of the re-roofing of my unit; proposed credits for the clay tiles, contract pricing, payment, & subcontractor status/notices/insurances/licenses, and critical recommendations regarding his schedule. 1 consider this an emergency to be dealt with immediately, but have not given AIA Roofing a notice to proceed with my unit's re-roof job. I have received a copy of AIA Roofing's written proposal that was given to Ocean Village Association prior to commitments. However, my unit's leaks present ongoing serious safety and water damage issues More leaks are imminent due to daily inclement weather. Consequently we're left with no viable options to protect our property except to proceed with immediate repairs. Please be advised that if the Board of Directors for Ocean Village does not resolve our roofing problem, with a new roofing system on front and rear of our respective unit on or before Tuesday 1 August 2001, it is our intention to give AIA Roofing a notice to proceed to execute whatever work and material installation is necessary to replace our deteriorating roof system. I have done everything reasonably possible in the best interest of Ocean Village Association to mitigate the costs and will confirm completion prior to an approval for payment to confirm a professionally installed product. After the work is finished to a prevailing standard in our community, I will present the original AIA roofing bill for timely payment to Ocean Village Association. If the AIA Roofing bill is rejected for payment, either directly or indirectly, we will aggressively pursue other statutory legal remedies and/or contact appropriate state agencies to prevent mechanic liens and seek yet to be specified restitution for extensive interior repairs. Approximately 6 tiles landed on my rear appurtence, rear deck, and front patio areas. This is a very dangerous situation and cannot continue. I brought my unit's similar dangerous roofing condition to your attention several weeks ago and raised the problem at a scheduled board meeting two months ago including a follow-up registered letter THEREAFTER to your attention. Several weeks ago I "red taped" the rear deck of my unit to warn my neighbors/passerby FOOT-traffic of falling tiles. To avoid further chance of association liability, I implore you to red-tape the entire area behind units 22, 23, and not allow foot traffic in the area of the breezeway. It will be a costly oversight if someone should is injured by association property that is dangling precariously overhead. On the continuing problem of my own needed roof repairs conducted 14 September 2001, the 2nd patch job this week(3 total to date) has not been water tested as yet. The underlying 1 foot by 1 foot hole in my rear roof has not been repaired and damaged wood replaced since I showed you this situation 6 weeks ago. I now have an entire interior wall that must be removed due to roof water damage to replace custom woodwork and plasterboard. The underlying structural support may also be comprised. I have interior ceiling damage to my custom wood (buckling from roof water leaks) adjacent to the damaged wall. Roofing tiles are starting to crack on the front and rear of my condo roof. As you know, some of my roofing tiles have fallen to the deck below already. Water is still coming in my rear NE corner floor area from the common elements under the breezeway. Fresh water damage to my custom wood is also apparent in this area downstairs. The cracks on my exterior stucco SE party wall remains damaged and has cracks that are 1 '/z"(one & one-half inches) thick. The soffitt and fascia wood on the rear of my unit is rotting and may fall at any minute. The rotten fence has almost fallen down that separates my rear area from unit #23. It's a disgusting site and must be removed immediately for safety reasons. It fell on my AIC unit over the weekend. My intention is to relay this information to the City of Jacksonville and have the appropriate controlling agency investigate condemnation proceedings in the next two weeks. I am surrounded by two Ocean Village structures that cannot be occupied/enjoyed by current residents. Repair of these structures in the next two weeks is not forthcoming by our legally responsible board members. This is my full-time residence and I do not want to leave. However, if it becomes necessary for me to vacate my premises due to reasons of uninhabitable conditions (at Ocean Village) through Ocean Village Board of Directors negligence, I will be forced move to the nearest oceanfront hotel accommodations of comparable amenities. This is because any change in moisture content Is accompanied by dimensional changes( shrinkage or swelling ) that may tend to withdraw or loosen the fastener. Whether the wood splits or not, the strength of the connection is severely reduced_ A crack along the flashing of the fire wall of unit#23A and the attempted roof repair of unit#22A were observed (see Photograph 44 )_ Note that the barrel-shaped roof tiles have fallen off the roof of unit #2'9A Cracks were observed on the east face of the 8'CMU fire wall (see Photographs#5 &96)_ Similar cracks vuem observed on the other fire walls( see Photograph 07 ). These cracks are caused by rusting of the mild reinforcement in the end cell of the CMU fire wall. Cracking and spalling induced by steel corrosion is a function of the following variables: 1)CMU tensile strength. 2) Quality of concrete cover over the reinforcement. 3) Bond condition of the interface between the rebar and surrounding concrete. 4) Diameter of the reinforcing bars 5) Percentage of corrosion by weight of the reinforcing bar_ The structural capacity of the concrete is affected by bar corrosion- Research has demonstrated that the ultimate load capacity begins to fall with more than 1.5%commiom and when it reaches 4.5%the ultimate load is reduced as much as 12%. it is my opinion that the Presence of chlorides iry the concrete is the maln cause of corrosion of the reinforcing bars. Chlorides can be induced Into concrete by coming into contact w461. erivironme^S containing chlorides- Penetration of the chlorides starts at the surface, then moves inwrard_ Penetration takes time, depending upon: 1)The amount of chlorides coming into contact with the concrete. 2)The permeability of the concrete 3)The amount of moisture present_ Spalling and delamination occurs if the natural forces of gravity act on the loose concrete. When cracking and delamination progress, accelerated corrosion takes place because of easy access of corrosive salts, oxygen, and moisture. corrosion then begins to affect rebars buried further within the concrete. The concentration of chlorides necessary to promote corrosion, among other factors, Is greatly affected by the concrete's pH, A threshold level of 8000 ppm of chloride ions is required to initiate corrasion when the pH is 132_ As the pH is lowered to 11.6. corrosion is initiated with only 71 ppm of chloride ions. Mees' corrosion. may take place even in high alkaline environments if chlorides are present- Chlorides are not consumed in the corrosion process, but instead act as catalysts to the process and remain in the concrete- The corrosion process is progresNve, beginning at the intersection of the crack within the reinforcing bar, then progressing along the bar as shown in Photographs#6&V. The exterior of the recreation center was observed ( we Photograph#8 ). Some of the 4x4 wood posts supporting the built-up 2-2x12 with Y4'steel flitch plate (see Photograph#9) were replaced with 6x6 wood posts(see Photograph#10 ). The flitch beam has slightly rotated and the soffit trim piece has been crushed at the 6x6 vtiood post. About three months ago the siding and roofing were repaired when the windortivs were replaiced. Improper roofing repairs of other units has also been performed( see Photographs in attached Exhibit'C'and Photograph#4 in attached Exhibit"B" ). Water infiltration through the northern wall of unit#12A(--x--e Photograph#14 ) was observed near the northeastern comer of the living room_ Water stains in the kitchen also exist A crack along the second floor 8'x8'conc•rte tie beam was observed (see Photograph#15). A similar crack in the eastern► CMU wall of unit#11 B was also observed (see Photograph#16 )- The inside of unit#23A was observed_ Temporary wood shoring of the eastem ends of the 2x10 floor joists was observed ( see Photograph#17)- %*gypsum board and a wood stud with a completely damaged top portion ora 2x4 wood stud were observed ( see Photograph#18 ). Water stains and damage in the ceiling were observed ( see Photographs#19.#20,421 &#22 ). Cracks due to differential settlements were also observed over doors(see Photrgraphs#23&#24). A crack along the second floor level 8"x8'concrete tie beam west wall of the building containing the 3-bedroom units#288, #2913 and#3pB was observed(see Photograph#25)with a downspout discharging rainfall water runoff on the same wall where a crack in the stucco exists between the CMU wall and concrete slat-on-grade ( see Photograph#26 ). diverting the rainfall discharge away from the footprint of the building is advised. Repaired lintels over some windows of the building containing units#318,9328, 4338, #3413, and 9358 were observed where they have been repaired in the past, but leaks still occurred during the recent heavy wnd-driven rain by trwicai storm Gabrielle. CONGt_us1ONS MID RECQMMENOATIONS: Based on my past experience, field observations, and the contents of this report, it is my opinion that, starting with unit#23, the entire eastern wall must be rebuilt as follows.- Provide ollows:Provide temporary bracing near the east ends of the 2x10 floor joists and roof trusses, Le_ at both levels. • Use a continuous 3 1/8"x 12'Glu-Lam beam for a header over the windows and sliding glass door at the first floor level and a continuous 4x12 wood beam for a header over the sliding glass doors at the second floor level_ Also, use 2x4 studs at 12"on centers with an'RSP4' ( see attached Exhibit"D" ) stud plate tie top S bottom of each stud. • Use a 4x4 wood post to support the new beams with'ACE4 MAX' post caps over exterior posts and 'AC4 MAX" post caps over interior posts. Use a"SC40" post base at the bases of the posts( see attached Exhibit'L)" ). • Make exploratory cuts in the floor sheathing near the ends of wall openings. Inure that the east ends of the exlsttng floor joists are in good condition and that all cantilevered 2x6 joists of the balcony are pressure-treated having a minimum of 8'-0" length and lapping 4'-0" with the floor joists. Hire a waterprmfin9 expert to provide flashing and waterproofing details for the roof and walls, esIxicially around openings. • Repair of the crack at the east end of the fire wall must be performed by a reputable contractor specializing in this kind of work. The=rk must include the following: 1) Surface preparation requires removal of all loose and deteriorated concrete, and also includes concrete removal. 2)All heavy rust and scale should be removed from the rebar to promote maximum bond with repair material. A tightly handed light oxide build-up may develop after cleaning. This is usually not detrimental to bond. If protective coating is being applied to the rebar, the manufacturer's recommendations for surface preparation must be followed. 3) Rebar might require splicing or replacing in areas where corrosion has exceeded tolerable limits_ 4) Shotcrete( gunite ), hand placement, or farm and pump the repair material into cavity to be repaired. Since our conversation I have had more definitive pictures developed that were taken in the past 6 weeks concerning specific problems. I have been an owner of my unit since 1977. I'm absolutely appalled at the condition of my property and lack of maintenance in many areas of the complex. During your inspector's visit, he should take particular note of the following safety hazards - just to name a few of the most obvious: 1) In the common breezeway recreation room adjacent to unit #22: In July of this year, we were told at a board meeting, that the upstairs rec. room could not be used pursuant to an engineer's report. The rec- room has failed beams across the breezeway, sagging roof lines, roof tiles that have fallen below onto the common sidewalk, many missing roof tiles on all 4 corners of the rec. room that have fallen below where the public walks. on the SE corner of the rec. room - missing roof tiles are causing water to enter the interior of the building. During a recent storm, the large rec. room roof access hatch blew off the roof and damaged the awning in the front of the building next to my doorway. Remaing cracked and loose tiles on the mansard the roofs will surely fall in the next bout of heavy winds. Gutter and downspouts are missing or damaged. Facia boards are rotting and metal flashing is hanging above over the breezeway. All electrical conduits in the breezeway are rusted badly- All the overhead sheetrock should be removed before it falls down into the breezeway. The concrete block decorative sE privacy wall foundation(about 7 feet tall) , with a maze of wires and failed downspouts, has settled and leaning toward unit #22. 2) The common oceanfront overlook deck(behind the rec. room) has serious damage, rotting deck boards, portruding nails and should be Lorn down for safety reasons. 3) Unit No. 23 : This unit's interior support beam has been shored with support columns for safety reasons and a failed support beam over the doorways. They are visible from the outside. The poorly installed visqueen/plastic(over the doors) has been covering up this problem for 4 months and I'm sure that water is running inside his unit over the exposed windows making matters worse. The detailed engineer's report I gave you does not mention water damage. 4) Unit No. 21: Has missing roof tiles that have blown down into the area below next to the common breezeway. 5) Asphalt Parking Lot: Potholes in the entrance-way and damaged curbing in other areas. 6) Trees and shrubbery completely overhanging sidewalks(forcing kids and older adults off the sidewalk) around the complex need to be trimmed. The engineer's report addresses the two adjacent structures in detail which concerne me GREATLY that he has virtually condemned both the buildings with his professional assessments. Water was pouring into the interior of my unit(5E wall) until 3 patch jobs were completed. The eastern roof scupper is rusted with holes which allowed water to go behind the roof sheeting. The roofer identified a huge hole in my roof sheeting that exists to this day. The board of directors told him NOT to fix the sheeting. I have severe beam failure/settlement on the ocean side that has affected my overhead door jambs for many years. The party wall electrical breaker boxes and external conduits don't meet code and should be replaced n 22 & immediately (between 22/23) . The SE stucco party ,�all 23) leaks water due to 2" concrete spalding cracks. In every blowing rain from the ocean exposure I have water intrusion on the east w all due to rotting wood underneath the rec. room. My fixed double-paned glass windows on the eastern exposure have water intrusion between the panes due to leaking water from the failed siding joints and failed beam settlement. Soffit and fascia wood is rotten and may enhance failure of the heavy roof tiles on the eastern exposure of my unit. g) I've told by Patrick Flynn of the Florida Bureau of Condominiums in Tallahassee that he has contacted the board at Ocean Village and are currently investigating this situation. The following is a list of violations I observed during my inspection on Friday, November 9, 2001: 1. Breaks in the concrete block stucco party walls between Units 22 and 23. Large cracks were observed which is a violation of Section 305.2 Standard Housing Code which requires exterior walls shall be free of holes, breaks, loose rotting board or timbers, etc. All siding and materials shall be kept in good repair; 2. The concrete block party wall between Unit 22 and the breeze way shows signs of deterioration and has shown evidence of some water leakage. This is also a violation of Section 305.2 Standard Housing Code; 3. The mansard the roof has cracked roofing tiles and several missing tiles and end piecesafailed sheathing shows evidence of water leakage which is a violation of Section 305.3.2 Standard Housing Code which states that portions, additions or sections of the roof including but not limited to the fascia, eaves, soffit, sheathing, rafter tails, barge rafters, vent screening, gutters, down spouts, roof jacks, lead or metal flattening, shall be complete with all trim strips, moldings, brackets, braces and supports in accordance with common building practices. No items shall display signs of deterioration, abuse or improper installation that can be construed to affect the purpose of that item or cause damage to the immediate area or roof structure that could allow dampness or admit rain to the interior of that building 4. The air conditioning electric disconnect boxes on the northeast party wall have rusted and the wiring is exposed to the weather. Section 373.2 5. National Electric Code says that enclosures installed in wet locations shall be weather proofed. 6. The three double-pane glass windows are leaking. Section 305.7 Standard Housing Code requires every window shall be substantially weather tight, water tight and rodent proof and shall be kept in sound working condition and good repair. 7. The exterior of the upper level sliding glass doors has been caulked and is showing evidence of leaks. The water has ponded downstair. Section 305.12 Standard Housing Code requires that exterior door frames shall be kept properly maintained and shall be affixed with weather stripping and thresholds as required to be substantially weather tight , water tight and rodent and insect resistant when the door is in the closed position. 8. The eastern exposure of Unit 22, T-111 siding is deteriorating and should be replaced which is in violation of Section 305.2 Standard Housing Code. Every exterior wall shall be free of holes, breaks, loose or rotting boards or timbers or any other condition which might admit rain or dampness to the interior portions of the walls or to the occupied spaces of the building. All siding materials shall be kept in repair. From today's date you are required to correct the aforementioned violations within thirty (30) days. On January 15, 2002, the City of Atlantic Beach Building Department will conduct an inspection of the property to determine if the violations have been corrected. If upon inspection the violations have not been corrected by the stated deadline this case will be turned over to the Code Enforcement Board. Under Section 162 of the Florida Statutes the Code Enforcement Board may levy fines of up to $250.00 a day for first violations and $500.00 per day for second violations not to exceed $5,000.00.
