Dear Board
We hereby thank the Board of Code Enforcement for Atlantic Beach for allowing us to answer
the Pleading concerning the above stated lot RE 169398-1046. We regret that due to employment
requirements we are unable to appear before the Board, and so we have prepared this letter on our
answer to the Pleading.
The application of the International Property Management Code(s)should not require an
interpretation of its meanings. The use of the IPMC Codes are a yard stick to measure an issue and
establish that there is a violation. Once the violation has be established it should be stated as the
section, but the actual underlining infraction should be clearly stated in the Pleading letter. This would
allow the Owner(s)to do the corrective action needed, and reduce the time the City is dealing with
these actions.
Example IPMC 304.4 St Augustine grass is considered a form of weed, should it be ban from use within
the City limits.
IPMC 302.4 Grass: Yard is being maintained by the Lender in a Court Action pending in the County of
Duval. Yard has been mowed
IPMC 304.15 Doors: After inspection of the property the owner(s)found no damage to any door or
window that would allow access to the property. Undefined
IPMC 304.6 Exterior Walls: On our inspection we again are unclear of the issues the City is attempting to
establish. Undefined
IPMC 301.3 Vacant Structures: On inspection we again are unclear as to the issues that the City is trying
to establish on this Pleading. Undefined
We intend no disrespect to the Board in our answer to the"Violation Deescriptions "used in
thei pleading. The use of the legal terms defined in the Violation Letter would require that the City use
clear and understandable language to insure the layman understand your intentions. The use of the
term "Respondent ",would define that this was a Civil Action and that the Petitioner is required to
provide clear information too, and prove the action against the Respondent.
We are asking that the Board clearly define the language of the issues in the notice, and so we
can petition the Court to force the Lender to start maintaining the property as we are unlawfully lock
out of the house.
The Next issues are on our inspection of the home we found numerous Violations throughout
the Community. The fence line along Mayport road is a blight on the neighborhood and the surrounding
area. Our Neighbor is storing an RV alongside the home, boats in the front yards,trailers,and we are
the only ones being cited for these issues,and this is bordering on Selective Enforcement.
