ORDER GRANTING REQUEST
The above referenced Applicant requested a two-part Zoning Variance to reduce the 20-foot front
yard setback to 17-feet and the 7.5-foot side yard setback to 5-feet on a lot at 483 Whiting Lane
to allow an addition in conjunction with the renovation of the existing single-family residence. The
Applicant also requested that the proposed new construction be permitted to encroach on the 25-foot
platted Building Restriction Line.
On November 20, 2007, said request was considered at a public hearing by the Community
Development Board for the City of Atlantic Beach. Having considered the application, supporting
documents and comments by the Applicant, the Community Development Board, approved the
request, finding it to be consistent with Chapter 24-64 of the Land Development Regulations.
NOW THEREFORE, the Community Development Board hereby GRANTS this request to reduce
the 20-foot front yard setback to 17-feet and the 7.5-foot southerly side yard setback to 5-feet on a
lot at 483 Whiting Lane and also to allow the proposed new construction to encroach on the 25-foot
platted Building Restriction Line in conjunction with the renovation of the existing single-family
residence.

The purpose of this correspondence is to serve as an Official Notification of Violation. As of
receipt of this letter, a formal process of code enforcement action has been initiated. The City's
Code Enforcement Office has identified the property commonly known as 483 Whiting Lane to
be in violation of several home occupational codes under, Chapter 24, Sections 24-159 (2), (3),
(5), and (6) of the City Code:
1. Only immediate family members residing on premises shall be involved in the
occupation.
2. All business activities conducted on the premises shall be conducted entirely within the
dwelling. There shall be no outside storage or outside use of equipment or materials.
3. No external sign or evidence that dwelling is being used for home occupation shall be
allowed.
4. There shall be no vehicular traffic, noise, vibration, glare, fumes or odors as a result of
the home occupation.
You will cease all bus washing and fluid additions/changes at the aforementioned property upon
receipt of this notification. All other violations must be brought into compliance not later then
February 28, 2001. Failure to bring your home business into compliance will result in the
revocation of your license and will result in a hearing before the Code Enforcement Board.
Furthermore you are reminded of your responsibility as a property owner and that failure to
comply will constitute a violation of city code. Continued violations of city code can incur fines
of up to $500.00 per day, per violation from the Code Enforcement Board.

Motion: Approve Ordinance 25-00-31 on first reading.
Mayor Meserve indicated the public hearing and final reading of the
ordinance would be held February 28, 1999.
There was no discussion the motion carried unanimously.

A. Public Hearing and action on a request for a Use-by-Exception
filed by Forest Thomas, to park school buses on property
located on Stock Street between 14`h Street West and Levy
Road, Zoned Commercial General (CG)
Motion: Grant Use-by-Exception filed by Forest Thomas to
park school buses on property located on Stock Street between
14" Street West and Levy Road zoned Commercial General
(CG)as recommended by the Community Development Board.
(The Community Development Board recommended approval with
the conditions that not more than twelve(12)buses be stored on the
site at any one time, the site may be used for the parking of school
buses only - no other commercial vehicles, a six foot high opaque
fence be installed around the site meeting the fence setback
requirements, a landscaped buffer be installed around the site,
meeting landscape ordinance provisions of Section 24-162, the
exception be granted with requirement that the applicant must
construct a building and relocate his place of business to this site
within eighteen (18) months of the grant of this exception or this
exception shall become void, and the exception be granted to the
applicant only and for this site only).
Mayor Meserve opened the public hearing and invited comments.

No one spoke and the Mayor declared the public hearing closed.
Discussion ensued regarding the type of on-site repairs which would be
allowed and Community Development Director Worley explained that only
minor repairs would be permitted.
A brief discussion ensued and it was the felt that an additional condition
should be included prohibiting major repairs at the site.
Amendment to the motion: Include no major auto repairs to be
conducted at this site as condition #8 of the Use-by-Exception.
There being no further discussion, the motion on the amendment carried
unanimously. The motion on the original motion,as amended,also carried
unanimously.
B. Public Hearing and action on a request for a Use-by-Exception
filed by Kirit Patidar to construct a motel on property located
470 feet north of Fairway Villas on Mayport Road, Zoned
Commercial General (CG)

This structure is being utilized as a rooming house and has been for years . it
is divided in half as in a duplex . The right side is apparently utilized by a
single B/F. The left side is being rented out by the individual room. Each
room has an external hasp and lock which is secured by the tenant. The left
side of this structure is housing 6 to 8 unrelated people .
We went into there tonight, CCR 90-011178 , to search for an armed man . There
were several people , all claiming to know little or nothing about the other , or
whom we are there for . They said the landlord lived out of town .
This residence is in a neighborhood of all single family residences . This may
be a matter for the Zoning Board or Code Enforcement Board .

Background:
Attached for consideration by the City Commission is a request by Mr.
Forrest Thomas to construct a commercial building on Lot S, Block 16,
of the Donner Subdivision. Mr. Thomas intends to utilize the building as
a welding and repair business. This use is permitted in a Business B
district.

Correspondence - continued - JIC
Mr. Robert Hall, Coast Electric Company submitted a request for a
zoning clarification of his property in Section H, Lot 5,Block 38,
which is zoned Business "A". He desires to construct a commercial
building to be used for electrical service repairs on automobiles,
primarily repairing and rebuilding automobile alternators, generators
and starters. The Ordinance states no outside vehicle repair work,
stored parts, bodies or junk allowed, and Mr. Jack Bennett, 131 Belved re
representing Mr. Hall, assured the Commission all work would be done
inside the building. Mr. Bennett was instructed to submit the plans
for the City Manager's perusal before placing the application on the
agenda.
Advisory PlanningBoard
Mr. John Andresen, Chairman of the Advisory Planning Board reported
that the next neeting has been scheduled for Thursday, May 6, 1982
at 7:30 p.m. and 'Hoped to receive some input by mail from comments th
audience made at the last meeting. He added that the Board is plannin
to reconsider some of the items discussed at the last meeting before
the proposed zoning Ordinance is passed on to the Commission. Com-
missioner Johansen asked how long the terms of office of the Board
were extended and Mayor Persons responded until July 1, 1982. Com-
missioner Van Ness expressed the opinion that the proposed Ordinance
could conceivably be presented to the Commission within one month.
But, there was some concern among all the Commissioners if the Ordi-
nance could be passed on or before July lst. Mayor Persons stated tha
the members' service on the Board could be extended again if necessary,
The Commission unanimously agreed.

Mr. Moss requested permission to issue a permit to Forrest Thomas j
to construct a commercial building on lot 5,Block 16, Donners Sub-
division, which is zoned Business B. The City Manager stated that he r
had reviewed the plans, and they meet all the requirements of the Cit
Code.
Motion: Authorize the City Manager to issue a permit to Forrest Gulliford x x
Thomas to construct a commercial building on Lot 5, Block Jensen x
16, Donner Subdivision, to be used as a welding and repai Johansen x x

Persons -
Before the vote, Commissioner Van Ness reminded Mr. Thomas that his
building is going to be in an area where the zoning may change,
and that he should be well advised that if 51% of the structure was
destroyed, it would not be grandfathered in and he would not be allow-
ed to rebuild. Mr. Thomas replied that he had understood that at the
last meeting. Co7missioner Van Ness added that she simply wanted it

it is one of those circumstances that we really can't do anything abo t
right now. The question was called and the motion carried with four
ayes. Mayor Persons abstained from voting.
B. Item #2-Request by Leigh Broward to construct storage building
for Stor-Park-Systems
Mr. Leigh Broward requested permission to construct an additional
storage building at the present Stor-Park-Systems site on Levy Road,
which is presently zoned "Industrial". There was some indication in
his application that the structure would be used as a paint building
for automotive painting. Discussion followed on uses permitted in
the industrial area. Commissioner Jensen expressed the opinion that
the building as presented meets with the city's code requirements for
the area and Mr. Broward should be allowed the permit to construct.
The tenant of the building will have to obtain an occupational licens
and if the use does not comply with the city's zoning ordinance, then
the prospective tenant will be unable to obtain an occupational licen e.
Commissioner Gulliford agreed,but stated that the intent is to local-
ize any type of industrial usage, and he saw no real problem in paint-
ing and spraying there.

C. Item #3- 1981 Crime Statistics
Mr. Moss presented a report' that was based on statistics provided
by the Florida Department of Law Enforcement for the year 1981. He
stated that it should be noted that Atlantic Beach has among the high-
est arrest records of any community of its size in the State of Fla. ,
and also has among the lowest number of police personnel per 1,000
population. We have on the street 2.03 officers per 1,000 in comparis n
to St. Pete with 3.61 per 1,000. Fernandina Beach has 2. 72 per 1,000
and St. Augustine has 2.51 officers per 1,000. Mayor Persons opined t at
one of the most significant parts of the analysis is the section that
states that statewide crime increased in all categories, but overall,
the index crimes decreased 5.0% in Atlantic Beach in 1981. He commend d
the Chief and his entire department.
D. Item #4-Acceptance of Improvements for Selva Marina Garden and
Authorization to Proceed with the Planned Unit Development
Mr. Moss presented a three page sunmary report summarizing actions
at the last meeting and events that have occurred since the meeting.
