Ford, Building Official RE: Lifetime Enclosures Incorporated Application for a Screened Enclosure at 1821 Tierra Verde Drive In the Commission meeting of January 25 , 1993 , the City Commission granted a variance to Mrs . Margaret Cresson at 1821 Tierra Verde Drive to construct a screened enclosure on the east side of her home. Lifetime Enclosures applied for a permit to construct the screened enclosure. After reviewing the permit application I have returned the information to Lifetime Enclosures for the following reasons: The plans as drawn do not meet the 1991 Standard Building Code in that the structure is not designed to withstand 110 mph winds . The builder was rather concerned as he was under the impression that the Commission had ordered us to award a permit . I have explained to the builder and also to Mrs . Cresson that the Commission granted them a variance to allow them to build closer than the existing setbacks permit . The Commission did not grant any variances to the building code and the structure will have to meet the building code just as any other structure in Atlantic Beach will have to meet the code. I bring this to your attention as there was quite a bit of discussion in the Commissions ' deliberations about this structure being built on an existing wooden deck. The main problem with the structure is that the wooden deck is not an allowable platform to build a structure on. In order for the enclosure to be built on the deck, the deck would have to have some sort of tie downs , footing or an equal structural platform to allow the aluminum frame to resist high winds . My concern with the granting of the variance for this particular property is that apparently the citizen, in the form of Mrs . Cresson, and the contractor were not made aware that their variance did not include any variances from the building code. Lifetime Enclosures is back to the drawing board now and having to redesign the entire structure to meet 110 mph winds whereas they were under the impression that they could start construction immediately after the variance was granted. { Kim Leinbach February 2, 1993 Page 2 I wonder if it would be possible to be sure we include in our wording, when we grant variances that all other codes and City ordinances must be complied with and be very specific about the variance being granted. Wolfson Reference: Cresson Variance Upon reflection of the meeting which was held on Monday. June 14th, 1993 in the Commission Chambers among the Atlantic Beach City Commissioners and the Atlantic Beach Community Development Board members, I believe that it is incumbent upon me to attempt to set the record straight regarding what has become more commonly known as the "Cresson Variance". As I referred to the Jennifer Wise article which appeared in The Beaches Leader of January 27, 1993, see the attached copy for your review, you and the City Attorney, Alan Jensen, strongly urged me to disregard what information appeared in this article regarding the action which was taken by the Commission at the City Commission meeting of January 25, 1993. When I asked you and the City Attorney whether or not the Commission granted Ms. Cresson the variance which was denied by the Atlantic Beach Community Development Board on November 17, 1992 by a vote of 5 to 2, neither of you nor the other Commissioners answered affirmatively. The Board Members opposed to the motion to grant the variance were: Greg McCaulie, Chairman; Robert Frohwein, Pat Pillmore, Mark McGowan and myself. Those in favor of granting the variance were: Ruth Gregg who made the motion and Sam Howie who seconded the motion. I have enclosed a copy of our minutes for your review. Should you wish to review the actual transcripts, I suggest that you listen to them in detail at City Hall. Without getting into the details of our extended discussions I will proceed. Sometime ago, Mr. Jensen determined that any decisions rendered by the Atlantic Beach Community Development Board regarding variances can be appealed to the Atlantic Beach City Commission although this appears to contradict the basis of appeals as set forth in Chapter 14, Sections 14-24 and 14-25 on pages 842 and 843 of the Atlantic Beach Codes as well as in Chapter 24, Section 24-49, (1), (2) and (3). It appears that the only basis for granting an appeal as the code is presently written should be based upon the question of "legality" rather than upon the question of "hardship". Notwithstanding this contradiction, we reluctantly inform those citizens who do not agree with our recommendations to seek another opinion from the City Commis- sion as an appeals board. per Mr. Jensen's opinion, which may be more favorable to the applicant. Therefore, Ms. Cresson's appeal appeared before you for your consideration at your meeting of January 25, 1993. Since you and Mr. Jensen instructed me to dis- regard the article referred to above and since neither you nor Mr. Jensen nor the other commissioners could recall whether or not the City Commission overturned our recommendation and granted Ms. Cresson the variance which she requested, I 4. 1 The Honorable William Gulliford, Mayor June 22, 1993 Page 2 am enclosing herewith a copy of the minutes of your January 25th meeting which clearly and unequivocally explains to you why the actions of you and the Commis- sion have placed the City Commission and the Atlantic Beach Community Development Board in conflict by confusing us with the words and the contradictory actions of the Commission. On page two, Item #4, the minutes will show that you . . ."felt the screened enclosure under discussion fit the definition of 'accessory building' and, thus there was no need to obtain a variance. " You go on to explain that "the respon- sibility of the Commission was to define the City's ordinances and he (you) felt that the screened enclosure fell under the description of 'accessory building' as indicated in the Code". The ensuing discussion revealed that there is a difference of opinions among the Commissioners regarding the definition of "accessory building". Now the confusion really sets in because although the City Commission accepts your opinion of the vagueness and ambiguity of this definition, a new motion was made and seconded to "grant appeal and overturn action of the Community Development Board". It is my understanding from this action that you and the Commission unanimously disagreed with our recommendation and approved a variance. Therefore, instead of interpreting the Code and instructing the Community Development Director, George Worley, not to submit these requests for variances to the Atlantic Beach Com- munity Development Board for consideration, we receive them, consider the merits of the requests on a case-by-case basis and make the recommendation of the major- ity of our Board as long as the City Commission has acknowledged by its very own action of January 25, 1993 that such a request MUST be considered on an "Applica- tion for Variance". Hopefully, the proposed Ordinance amending sections 24-17 and 24-151 will resolve the confusion, however, until such an Ordinance is ratified, the confusion will continue because of the set of circumstances which transpired on January 25, 1993. Although Mr. Jensen has told the Atlantic Beach Community Development Board that the position of the City Commission is clear on this issue, and that the Commission has instructed us by its own actions as to how we should approach these requests for variances, I, as a member of the Atlantic Beach Community De- velopment Board still am confused by the Commission's words and deeds. Our Board continues to deny such requests because it is the opinion of the majority of our full Board that attached "accessory structures" are another way to circumvent the guidelines of the set-backs. Not once have we approved such a request including and subsequent to the "Cresson Variance". However, of the four appeals which have come before the Commission for consideration, the Commission has granted two appeals and denied two appeals. Therefore, not only are the words of the Commis- sion confusing regarding this matter, but the actions taken by the Commission have sent a clear and unequivocal message to the Atlantic Beach Community Devel- opment Board that there is not a consensus among the Commissioners and that this problem must be urgently resolved. Mayor Gulliford reported Alan Jensen wished to make a statement concerning a conflict that appeared in the Code concerning appeals of decisions of the Community Development Board. Alan Jensen referred to Chapter 14 of the City Code which established the Community Development Board. He also referred to Chapter 24 and he read several sections contained in Chapter 24 to the Commission. He reported Section 24-49, Subsection 3, contained language concerning appeals of the Community Development Board, and appeared to be somewhat in conflict with the language in Chapter 14. He felt the Commission was the final word on anything that came before it. He added that anyone who appealed the granting or the denial of a variance from the Community Development Board should be entitled to have a hearing before the City Commission, and the City Commission should take action. He suggested anyone who had appeared at previous City Commission meetings and who were not afforded the opportunity of presenting their appeal to the Commission, should now have the opportunity to present their appeal. B. Appeal of variance denial by Community Development Board to construct a screen enclosure in violation of rear setback (Margaret Cresson) Margaret Cresson, 1821 Tierra Verde Drive, stated when she bought her house it had a deck with a tree growing through the floor of the deck. She indicated she wished to screen in the deck at the time she bought the house but was told that because of the tree it would not be possible. Later, she indicated she was told by the City she could cut down the tree. She had the tree removed, but when she attempted to obtain a permit to screen in the deck, it was denied. She indicated she had 19 feet setback to the rear of the property line, instead of 20 feet. She added she was handicapped and housebound and would like to sit out on the deck. Susan Copeland, 1809 Tierra Verde Drive, indicated she was a neighbor of Margaret Cresson, and supported Ms. Cresson' s desire to screen in her deck. She referred to a petition that was signed by neighbors indicating their support. A discussion ensued and it was determined the deck was 8 ' x 101 , ( 8 ' into the setback ) . DATE : January 20 , 1993 BACKGROUND: At the last meeting of the City Commission the appeal by Mrs. Cresson was heard by the Commission . Because of questions relating to the Covenants and Restrictions pertaining to her lot the Commission deferred action on her appeal . Further investigation into the covenants was requested . A copy of the covenants was reviewed and it was found that amendments are possible with the approval of 75% of the property owners. However, it is the position of the staff , supported by the City Attorney , that any such covenants are beyond the scope of the City Zoning Code and that enforcing compliance with such covenants rightfully belongs with the effected property owners . Given this position , staff recommends that the City Commission act upon Mrs . Cressons appeal based upon the merits of her request solely in light of the regulations of the Zoning Code of the City . It is Mrs . Cres,�,,ons obligation to ensure that her actions do not violate her covenants . Failing that neighboring property owners may act to enforce the covenants. CITY OF ATLANTIC BEACH CITY COMMISSION MEETING STAFF REPORT AGENDA ITEM: Appeal of Variance Denial by Margaret Cresson SUBMITTED BY: George Worley , City Planner DATE: January 4 , 1993 BACKGROUND: Margaret Cresson applied for a Variance to construct a screened addition to the rear of her home at 1821 Tierra Verde Drive encroaching the rear yard setback requirement of 20 feet. Mrs. Cresson proposed to build to within 12 feet of the rear property line. The Board discussed special conditions which could warrant a Variance but after a motion and second to approve, the Board voted 2 yes and 5 no. RECOMMENDATION: The proposed use of this addition is for " reading" space and as such it is merely for the convenience of the owner and granting this request would give special privilege to the applicant which is not enjoyed by other owners in the district. Staff recommends against the granting of a Variance. It has taken three and one-half months , for one reason or another , to "reject" Mrs . Cresson 's request because the deck was built one foot over the "set back" area . Ms . Cresson is eighty years old , walks with a cane and does not venture out after dark . She had even gone to the expense of $300 .00 to have a tree removed so _ the deck could be screened easily . This decision does not seem fair to me and many others as expressed in the enclosed petition. Margaret Cresson _ is a person who wanted to do everything "by the book" and look what it got her ! Upon motion duly made and seconded said minutes were approved: OLD BUSINESS: I. Application for Variance filed by Dorothy and Stan Jones to park a motor home in the front yard setback of property located at 2051 Seminole Road. Stan Jones introduced himself to the board and explained the reasons the original Variance was requested. He requested an extension of that original Variance until the certificate of occupancy was issued for his new home currently under construction. After discussion He. Gregg moved to approve an extension of six (6) months. Mr. Howie seconded the motion and it was approved by a vote of 4 - 1. II. Application for Variance filed by Jamee 8arvlagtoa Darby to construct a carport which will encroach the side yard setback on property located at 350 Ocean Boulevard. Mr. Darby introduced himself to the board and stated the reasons a variance was requested. After discussion, Mr. Howie moved to approve the variance with the condition that the structure be constructed with non- flammable materials. Ms. Gregg seconded the motion and it passed by a vote of 4 - 3. NEW BUSINESS: I. Application for Variance filed by Margaret Cresson to enclose an existing wood deck which would encroache the rear yard setback requirements on property located at 1821 Tierra Verde Drive. Ms. Cresson introduced herself to the board and explained that the variance was requested to allow construction of a screened enclosure on an existing deck. After discussion of whether a hardship existed and the impact on other properties, Ms. Gregg moved to approve the variance as requested. Mr. Howie seconded the motion. The motion failed by a vote of 2 - 5. II. Application for Variance filed by The Church of the Living God to construct an addition to the church which will . encroach the setback requirements on property located at 390 Church Road. Mr. James Rivers introduced himself to the Board and explained that the Church was requesting a variance to add needed room for the congregation. After discussion, Ms. Pillmore moved to approve the variance. Ms. Gregg seconded the motion and it was unanimously approved. III. Application for Variance filed by _Clyde and Elizabeth Asbury to park a motor home in the front setback of property located at 545 Seaspray Avenue. Mr. and Mrs. Asbury introduced themselves to the Board and explained that the variance was requested to permit them to continue to park a motor home in violation of the front yard setback due to health problems. The Chairman presented a letter from a neighbor expressing approval of the variance request. Mr. Asbury stated that another 14 approvals were submitted with their application. After discussion, Ms. Pillmore moved to approve the variance on a temporary basis until such time as Mr. Asbury could no longer operate the motor home. Mr. Howie seconded the motion. The motion failed by a vote of 3 - 4. IV. Application for Variance filed by Gudron Morrison to retain a screened enclosure in violation of the rear .yard setback an .. property located at 403 Seaspray Avenue. Ms. Lori Hesketh, a friend of the applicant, introduced herself to the board and explained the reasons the variance was requested. Reasons included mosquito infestation and raccoons. She explained that the structure had already been constructed. After discussion, Mr. Wolfson moved to deny the variance. Mr. McGowan seconded the motion and it passed by a vote of 4 - 3. V. Application for Variance filed by Townsend and Virginia Hawkes to construct a garage apartment on a non-conforming lot located at 1771 Beach Avenue. Mr. and Mrs. Townsend Hawkes introduced themselves to the Board and explained that the variance was requested to allow them to construct a garage apartment on a 50 x 50 lot on the west side of Beach Avenue. Variances are needed for minimum lot size and rear yard setback. After discussion, Mr. Wolfson moved to deny the variance. Mr. Frohwein seconded the motion and the variance was denied by a vote of 5 - 2. VI. Application for Plat Review by William Morgan for property located on the north corner of 19th Street. Mr. William Morgan introduced himself to the Board and explained that he desired to replat the property into six separate lots for the purpose of selling them. After discussion, Mr. Wolfson moved to recommend the replatting to the City Commission and to encourage the proposed use of single family homes as well as one-way traffic on the street. Ms. Pillmore seconded the motion and it was unanimously passed. There being no further business to come before the board on motion made and seconded the meeting was adjourned. The community development board, as established by the city commission, shall serve as the planning agency and shall have the following duties and responsibilities: (1) To review those matters referred to the planning agency and hold regularly sched- uled meetings for the purpose of reviewing such documents; (2) To review site plans for all proposed subdivision development redevelopment, includ- ing planned unit developments, in the city; (3) To transmit to the proper governmental bodies, agencies or departments the written recommendation of the planning agency, where the recommendations are called for by this chapter; (4) To provide for internal procedures, with the assistance of the administrative official, required to carry out the intent of this article. Such procedures shall include dead- lines for filing applications prior to regularly scheduled meetings to allow time for adequate review and.the preparation-of a written report and recommendation of each application. (Ord. No. 90-82-74, § 2(11I, B, 3), 7-26-82; Ord. No. 90-87-117, § 1, 3-9-87) Sec. 2449. Community development board. The community development board shall be appointed by the city commission. The organization and procedures under which this board operates, its arrangement of meetings, adoption of rules and its method of handling appeals, variances or other related matters shall be in conformity with the provisions of Chapter 14 of this Ordinance Code. (1) Power and duties. The community development board may: a. Hear and decide appeals where it is alleged there is an error in any order, requirement, decision or determination made+y the administrative offitiai in' the enforcement of this chapter; b. Authorize, upon appeal in specific cases, and upon findings of fact, such minor variances from the terms of this chapter as will not be contrary to the public interest where, owing to special conditions, a literal enforcement of the provi- Supp.No-5 1422 § 24-49 ATLANTIC BEACH CODE specifying the grounds thereof. The appeal shall be in the form prescribed by the rules of the board. The administrative official shall, upon notification of the filing of the appeal, transmit to the community development board, all the documents, plans, papers or other materials constituting the record upon which the action appealed + from was taken. a. Stay of work. An appeal to the community development board stays all work on the premises and all proceedings in furtherance of the action appealed from, unless the administrative official shall certify to the community development board that, by reason of facts stated in the certificate, a stay would cause imminent peril to life or property. In such case,proceedings or work shall not be ; stayed except by a restraining order, which may be granted by the community development board after application to the officer from whom the appeal is taken and on due cause shown. b. Hearings of appeals. The community development board shall fix a reasonable time for the hearing of the appeal, give public notice thereof, as well due notice to the parties in interest, and decide the same within a reasonable time. Upon the hearing, any party may appear in person, by agent or by attorney. (3) Appeals of decisions of the community development board Any person or persons, jointly or severally, aggrieved by any decision of the community development board or any taxpayer, or any officer, department, board or bureau of the city commission, may present to the city commission a petition, duly verified, setting forth that such decision is illegal, in whole or in part, specifying the grounds of the illegality. The petition shall be presented to the commission within thirty (30) days after the filing of the decision in the office of the board. (4) In exercising the powers granted by this section,the community development board, by the concurring vote of the majority of members, may reverse or affirm, wholly or partly, or modify the order, requirement, decision or determination appealed from, and may make such order, requirement, decision or determination as should be made,and to that end shall have all the power of the official from whom the appeal is taken. In order to authorize 'se any variance from the terms of this chapter, the community development board must find that: tet- 1. Special conditions and circumstances exist which are peculiar to the land, (7) structure or building involved and which are not applicable to other lands, ts; structures or buildings in the same district; 2. The special conditions and circumstances do not result from the actions of of the applicant; to 3. Granting the variance requested will not confer on the applicant any special of privilege that is denied by this chapter to other lands, buildings or struc- tures in the same zoning district; 4. Literal interpretation of the provisions of this chapter would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of this chapter and would work unnecessary and as undue hardship on the applicant; 5. The variance granted is the minimum variance that will make possible the ed- reasonable use of the land, building or structure; 6. The granting of the variance will be in harmony with the general intent and ud- purpose of this chapter and the variance will not be injurious to the area involved or otherwise detrimental to the public welfare. C. In granting any variance, the community development board may prescribe ten appropriate conditions and safeguards in conformity with this division and any for ordinance enacted under its authority. Violation of the conditions and safeguards, when made a part of the terms under which the variance is granted, shall be :ial, deemed a violation of this chapter. lad- d. Under no circumstances, except as permitted above,shall the community devel- for opment board grant a variance to permit a use not generally permitted or ach permitted by exception in the zoning district involved or any use expressly or by implication prohibited by the terms of this chapter in the zoning district. Mrs. Cresson proposed to build to within 12 feet of the rear property line. The Board discussed special conditions which could warrant a Variance but after a motion and second to approve, the Board voted 2 yes and 5 no. RECOMMENDATION : The proposed use of this addition is for " reading" space and as such it is merely for the convenience of the owner and granting this request would give special privilege to the applicant which is not enjoyed by other owners in the district. Staff recommends against the granting of a Variance . Upon motion duly made and seconded said minutes were approved: OLD BUSINESS: I. Application for Variance filed by Dorothy and Stan Jones to park a motor home in the front yard setback of property located at 2051 Seminole Road. Stan Jones introduced himself to the board and explained the reasons the original Variance was requested. He requested an extension of that original Variance until the certificate of occupancy was issued for his new home currently under construction. After discussion Ms. Gregg moved to approve an extension of six (6) months. Mr. Howie seconded the motion and it was approved by a vote of 4 - 1. II. Application for Variance filed by James Barrington Darby to construct a carport which will encroach the side yard setback on property located at 350 Ocean Boulevard. Mr. Darby introduced himself to the board and stated the reasons a variance was requested. After discussion, Mr. Howie moved to approve the variance with the condition that the structure be constructed with non- flammable materials. Ms. Gregg seconded the motion and it passed by a vote of 4 - 3. NEW BUSINESS: I. Application for Variance filed by Margaret Cresson to enclose an existing wood deck which would encroache the rear yard setback requirements on property located at 1821 Tierra Verde Drive. Ms. Cresson introduced herself to the board and explained that the variance was requested to allow construction of a screened enclosure on an existing deck. After discussion of whether a hardship existed and the impact on other properties, Ms. Gregg moved to approve the variance as requested. Mr. Howie seconded the motion. The motion failed by a vote of 2 - 5. 1I. Application for Variance filed by The Church of the Living God to construct an addition to the church which will encroach the setback requirements on property located at 390 Church Road. Mr. James Rivers introduced himself to the Board and explained that the Church was requesting a variance to add needed room for the congregation. After discussion, Ms. Pillmore moved to approve the variance. Ms. Gregg seconded the motion and it was unanimously approved. III. Application for Variance filed by _Clyde and Elizabeth Asbury to park a motor home in the front setback of property located at 545 Seaspray Avenue. Mr. and Mrs. Asbury introduced themselves to the Board and explained that the variance was requested to permit them to continue to park a motor home in violation of the front yard setback due to health problems. The Chairman presented a letter from a neighbor expressing approval of the variance request. Mr. Asbury stated that another 14 approvals were submitted with their application. After discussion, Ms. Pillmore moved to approve the variance on a temporary basis until such time as Mr. Asbury could no longer operate the motor home. Mr. Howie seconded the motion. The motion failed by a vote of 3 - 4. IV. Application for Variance filed by Gudron Morrison to retain a screened enclosure in violation of the rear yard setback on property located at 403 Sear-pray Avenue. Ms. Lori Hesketh, a friend of the applicant, introduced herself to the board and explained the reasons the variance was requested. Reasons included mosquito infestation and raccoons. She explained that the structure had already been constructed. After discussion, Mr. Wolfson moved to deny the variance. Mr. McGowan seconded the motion and it passed by a vote of 4 - 3. V. Application for Variance filed by Townsend and Virginia Hawkes to construct a garage apartment on a non-conforming lot located at 1771 Beach Avenue. Mr. and Mrs. Townsend Hawkes introduced themselves to the Board and explained that the variance was requested to allow them to construct a garage apartment on a 50 x 50 lot on the west side of Beach Avenue. Variances are needed for minimum lot size and rear yard setback. After discussion, Mr. Wolfson moved to deny the variance. Mr. Frohwein seconded the motion and the variance was denied by a vote of 5 - 2. VI. Application for Plat Review by William Morgan for property located on the north corner of 19th Street. Mr. William Morgan introduced himself to the Board and explained that he desired to replat the property into six separate lots for the purpose of selling them. After discussion, Mr. Wolfson moved to recommend the replatting to the City Commission and to encourage the proposed use of single family homes as well as one-way traffic on the street. Ms. Pillmore seconded the motion and it was unanimously passed. There being no further business to come before the board on motion made and seconded the meeting was adjourned. The community development board, as established by the city commission, shall serve as the planning agency and shall have the following duties and responsibilities: (1) To review those matters referred to the planning agency and hold regularly sched- uled meetings for the purpose of reviewing such documents; (2) To review site plans for all proposed subdivision development redevelopment, includ- ing planned unit developments, in the city; (3) To transmit to the proper governmental bodies, agencies or departments the written recommendation of the planning agency, where the recommendations are called for by this chapter; (4) To provide for internal procedures, with the assistance of the administrative official, required to carry out the intent of this article. Such procedures shall include dead- lines for filing applications prior to regularly scheduled meetings to allow time for adequate review and the preparation of a written report and recommendation of each application. (Ord. No. 90-82-74, § 2(III, B, 3), 7-26-82; Ord. No. 90-87-117, § 1, 3-9-87) Sec. 2449. Community development board. The community development board shall be appointed by the city commission. The organization and procedures under which this board operates, its arrangement of meetings, adoption of rules and its method of handling appeals, variances or other related matters shall be in conformity with the provisions of Chapter 14 of this Ordinance Code. (1) Power and duties. The community development board may: a. Hear and decide appeals where it is alleged there is an error in any order, requirement, decision or determination made by the administrative official in the enforcement of this chapter; b. Authorize, upon appeal in specific cases, and upon findings of fact, such minor variances from the terms of this chapter as will not be contrary to the public interest where, owing to special conditions, a literal enforcement of the provi- Supp.No.5 1422 § 24-49 ATLANTIC BEACH CODE specifying the grounds thereof. The appeal shall be in the form prescribed by the rules of the board. The administrative official shall, upon notification of the filing of the appeal, transmit to the community development board, all the documents, plans, papers or other materials constituting the record upon which the action appealed from was taken. a. Stay of work. An appeal to the community development board stays all work on the premises and all proceedings in furtherance of the action appealed from, unless the administrative official shall certify to the community development board that, by reason of facts stated in the certificate, a stay would cause imminent peril to life or property. In such case, proceedings or work shall not be stayed except by a restraining order, which may be granted by the community development board after application to the officer from whom the appeal is taken and on due cause shown. b. Hearings of appeals. The community development board shall fix a reasonable time for the hearing of the appeal, give public notice thereof, as well as due notice to the parties in interest, and decide the same within a reasonable time. Upon the hearing, any party may appear in person, by agent or by attorney. (3) Appeals of decisions of the community development board Any person or persons, jointly or severally, aggrieved by any decision of the community development board or any taxpayer, or any officer, department, board or bureau of the city commission, may present to the city commission a petition, duly verified, setting forth that such decision is illegal, in whole or in part, specifying the grounds of the illegality. The petition shall be presented to the commission within thirty (30) days after the filing of the decision in the office of the board. (4) In exercising the powers granted by this section, the community development board, by the concurring vote of the majority of members, may reverse or affirm, wholly or partly, or modify the order, requirement, decision or determination appealed from, and may make such order, requirement, decision or determination as should be made,and to that end shall have all the power of the official from whom the appeal is taken.
