haven't heard a response to our offer yet and haven't begun the required improvements as of this writing.
We want to work with the City of Atlantic Beach rather than against it. Honestly, we thought we would have

I am in receipt of correspondence from Jim Perkins and emails from Alan Jensen about the home at the
referenced address. It is my understanding that you were in attendance at a meeting with my associate, Steve
Starke, and Jim Perkins concerning the billing situation for the sewer.
It was Mr. Starke's belief that the billing for the original sewer tap would be billed to the renter(s) along with
their sewer bill. At some point, that intent was missed and the renter(Jacob Lauer) apparently paid none of the
sewer bills. If the City of Atlantic Beach had billed us for the sewer we would have known that bills weren't
being paid and could have addressed the problem.
As it turns out, we were surprised by a 7 page list of code violations AFTER we began the eviction process for
none payment of rent AND after the tenant shot out windows and did significant damage ( in the thousands of
dollars). At which time he called in the code complaint.
We have been caught in the middle of a tenant who somehow thinks he will 'get even'by creating an home that
cannot be rented and the City of Atlantic Beach that is telling us that since we haven't paid for the sewer tap
they have disconnected the sewer meter. That makes the home even more unusable and means that an additional
$5000+is going to required to have the utilities turned back on.
As I'm sure you are aware, this home is in foreclosure. Whenever the property is sold the sewer tap lien will
have to be paid in order to give clear title. So the money will be paid. As it stands at this time, there is no
incentive the do any repairs or maintenance on the property in order to get it up to code.
I would propose to the City of Atlantic Beach that we step back and look at the overall situation as to want is
best for the taxpayers, and the owner. If the owner does nothing, the city must safe-up the house, maintain the
property and collect no sewer fees. A home in disrepair tends to push property values down much to the
displeasure of the neighbors.
As a compromise,we are prepared to spend the thousands of dollars to bring the home up to code, bring the lien
payment plan current and pay for future lien payments if the city will restore the necessary utilities to the home.

opposed to 'just walking away'. I look forward to your thoughts.

Please be advised, Atlantic Beach Code Enforcement has found your property referenced above
to be in violation of the City of Atlantic Beach, Code of Ordinances, Chapter 24 and Chapter 6,
and International Property Maintenance Code as adopted to wit:
VIOLATIONS
Sec. 108.1.3. Structure unfit for human occupancy. A
structure is unfit for human occupancy whenever the code
official finds that such structure is unsafe, unlawful or
because of the degree to which the structure is in
disrepair or lacks maintenance, is unsanitary,vermin or
rat infested, contains filth and contamination, or lacks
ventilation, illumination, sanitary or heating facilities
or other essential equipment required by this code, or
because the location of the structure constitutes a hazard
to the occupants of the structure or to the public.

STRUCTURE MAY NOT BE OCCUPIED
Section 109.2 Temporary Safeguards. Notwithstanding other
provisions of this code, whenever, in the opinion of the
code official,there is imminent danger due to an unsafe
condition, including the boarding up of openings,to render
such structure temporarily safe whether or not the legal
procedures herein described has been instituted; and shall
cause such other action to be taken as the code official

IPMC 302.4 Weeds.
All premises and exterior property shall be
maintained free from weeds or plant growth in excess of
twelve(12)inches. All noxious weeds shall be prohibited.
Weeds shall be defined as all grasses, annual plants and
vegetation, other than trees or shrubs provided; however,
this term shall not include cultivated flowers and gardens.

IPMC Sec. 302.5 Rodent harborage.
All structures and exterior property shall be kept free
from rodent harborage and infestation. Where rodents are
found,they shall be promptly exterminated by approved
processes which will not be injurious to human health.
After pest elimination,proper precautions shall be taken
to eliminate rodent harborage and prevent re-infestation.

IPMC Sec. 303.1 Swimming pools.
Swimming pools shall be maintained in a clean and
sanitary condition, and in good repair.
(Pool in front yard is green and unsanitary)
IPMC Sec. 304.1 General.
The exterior of a structure shall be maintained in good
repair, structurally sound and sanitary so as not to pose a
threat to the public health, safety or welfare.
(Front steps and deck are not in sound condition, missing shingles, holes
in exterior walls, etc.)
IPMC Sec.304.10 Stairways,decks,porches and balconies.
Every exterior stairway, deck,porch and balcony, and
all appurtenances attached thereto, shall be maintained
structurally sound, in good repair, with proper anchorage
and capable of supporting the imposed loads. (Front
porch and deck need to be repaired/replaced to be structurally sound)
IPMC Sec. 304.12 Handrails and guards.
Every handrail and guard shall be firmly fastened and
capable of supporting normally imposed loads and shall be
maintained in good condition.
(Missing and inadequate handrails and guardrails inside and outside)
IMPC Sec 304.13 Window, skylight and door frames.
Every window, skylight, door and frame shall be kept in
sound condition, good repair and weather tight.
(Front door and frame are busted,broken windows,busted skylights)
IPMC Sec. 304.13.1 Glazing.
All glazing materials shall be maintained free from cracks
and holes.
(Window in kitchen has bullet hole and is cracked,etc.)
IPMC Sec. 304.13.2 Openable windows.
Every window, other than a fixed window, shall be easily
openable and capable of being held in position by window
hardware. (Windows are not openable)
IPMC Sec. 304.15 Doors.
All exterior doors, door assemblies, operator systems if
provided, and hardware shall be maintained in good
condition. Locks at all entrances to dwelling units and
sleeping units shall tightly secure the door. Locks on
means of egress doors shall be in accordance with Section
702.3. (Front door is busted around knob and needs to be replaced)
304.7 Roofs and drainage.
The roof and flashing shall be sound,tight and not have
defects that admit rain. Roof drainage shall be adequate to
prevent dampness or deterioration in the walls or interior
portion of the structure. Roof drains, gutters and
downspouts shall be maintained in good repair and free from
obstructions. Roof water shall not be discharged in a
manner that creates a public nuisance. (Roof shingles are missing,rotted,
large holes in roof, numerous leaks)
305.3 Interior surfaces.
All interior surfaces, including windows and doors, shall
be maintained in good, clean and sanitary condition.
Peeling,chipping, flaking or abraded paint shall be
repaired,removed or covered. Cracked or loose plaster,
decayed wood and other defective surface conditions shall
be corrected. (Extensive water damage on interior walls, ceilings floors,
etc.,numerous holes in walls and ceilings,missing drywall, damaged
drywall,open sections with missing and inadequate wall coverings, etc.)
305.4 Stairs and walking surfaces.
Every stair,ramp, landing,balcony,porch,deck or other
walking surface shall be maintained in sound condition and
good repair.
(Interior stairs are inadequate, in poor condition,etc.)
IPMC Sec.307.1 Handrails and guardrails.Every exterior
and interior flight of stairs shall have a handrail on one
side of the stair and every open portion of a stair,
landing, balcony,porch, deck, ramp or other walking
surface which is more than 30 inches(762 mm) above the
floor or grade below shall have guards. Handrails shall not
be less than 30 inches (762 mm)in height or more than 42
inches (1067 mm)in height measured vertically above the
nosing of the tread or above the finished floor of the
landing or walking surfaces. Guards shall not be less than
30 inches (762 mm)inches in height above the floor of the
landing,balcony,porch, deck or ramp or other walking
surface.
(No handrails on interior stairs or exterior stairs, guardrails on 2°d story
deck in front at main entrance are not to code)
IPMC Sec.309.1 Infestation.
All structures shall be kept free from insect and rodent
infestation. All structures in which insects or rodents are
found shall be promptly exterminated by approved processes

IPMC Sec. 403,5 Clothes dryer exhaust.
Clothes dryer exhaust systems shall be independent of all
other systems and shall be exhausted outside the structure
in accordance with the manufacturer's instructions. (Two dryer exhaust
ducts not properly installed/maintained)
IPMC Sec. 505 Water System. 505.1 General.
Every sink, lavatory, bathtub or shower, drinking fountain,
water closet or other plumbing fixture shall be properly
connected to either a public water system or to an approved
private water system. All kitchen sinks, lavatories,
laundry facilities,bathtubs and showers shall be supplied
with hot or tempered and cold running water in accordance
with the International Plumbing Code.
(water supplied from shallow well,tenant states water is discolored and
not potable-city water is available)
IPMC Sec. 505.3 Supply.
The water supply system shall be installed and maintained
to provide a supply of water to plumbing fixtures, devices
and appurtenances in sufficient volume and at pressures
adequate to enable the fixtures to function properly,
safely, and free from defects and leaks.

IPMC Sec. 602 Heating facilities. Sec. 602.1 Facilities
required. Heating facilities shall be provided in
structures as required by this section. 602.2 Residential
occupancies. Dwellings shall be provided with heating
facilities capable of maintaining a room temperature of
68°F (20°C) in all habitable rooms, bathrooms and toilet
rooms based on the winter outdoor design temperature for
the locality indicated in Appendix D of the International
Plumbing Code. Cooking appliances shall not be used,nor
shall portable unvented fuel burning space heaters be used,
as a means to provide required heating.

IPMC Sec.604.1 Facilities required.
Every occupied building shall be provided with an
electrical system in compliance with the requirements of
this section and Section 605.

IPMC Sec. 704.2 Smoke alarms. Single or multiple station

R-2, R-3, R-4 and in dwellings not regulated in group R
occupancies. Regardless of occupant load at all of the
following locations:
1. On the ceiling or wall outside
of each separate sleeping area in the immediate vicinity of
bedrooms.
2. In each room used for sleeping purposes.
3. In each story within a dwelling unit, including basements
and cellars but not including crawl spaces and
Un inhabitable attics. In dwellings or dwelling units with
split levels and without an intervening door between the
adjacent levels, a smoke alarm installed on the lower level
provided that the lower level is less than
one full story below the upper level
Section 704.4 Interconnection. Where more than
one smoke alarm is required to be installed within an
individual dwelling unit if Group R-2,R-3, R-4 and in
dwellings not regulated as Group R occupancies,the smoke
alarms shall be interconnected in such a manner that the
activation of one alarm will activate in such a manner
that the activation of one alarm will activate all of the
alarms in the individual unit. The alarm shall be clearly
audible in all bedrooms over background noise levels with
all intervening doors closed. (none provided)
Sec.24-154. Outdoor display,sale and storage of
furniture,household items,merchandise and business
from a street or a neighboring property shall be maintained
in an acceptable manner, which shall be defined by

construction materials, and broken and abandoned items.

intended to be used and maintained within the interior of

in a manner or amount such that an unsightly nuisance to
neighboring properties or an environment that attracts
rodents, insects, or other animals and pests is created.
Sec.24-164 Swimming Pools.
(c) Fences: All swimming pools and any ornamental pool
with a depth greater than two (2) feet shall be enclosed by
a fence,wall or equivalent barrier at least four(4) feet
in height and designed in compliance with all applicable
state and local regulations. (No fencing/barrier around pool in front yard
as required creating a hazardous condition)
Sec.24-157(e) Maintenance of fences. Fences that have
been allowed to deteriorate to an excessive degree have a
negative impact on property values and the quality of
neighborhoods. Fences that are in a state of neglect,
damage or disrepair, shall be repaired,replaced or
removed.
Unacceptable fences are identified as those containing any
of the following characteristics that can be easily
observed from the street or by a neighboring property.
i. Components of the Fence are broken,bent,visibly
rusted or corroded.
ii. Portions of the fence are no longer connected to the
support posts and rails.
iii. Any components are rotten,broken or missing.
iv. Weed are overtaking the fence.

condition)
This letter requests that the property be boarded and secured (all openings including all
windows, doors and busted sky lights and holes in the roof to prevent occupancy and that
the pool have a minimum 4' tall fence/barrier adequate to prevent access the pool in the
front yard within ten (5) days of the receipt of this notice. In addition, compliance is required
by mowing and cleaning the yard and removal of all items stored outside and cleaning and
maintaining clean the pool located in the front yard within ten(10)days of receipt of this notice.
Remaining violation must be corrected within ninety(90)days of receipt of this notice with
permits from State of Florida licensed contractors.
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
Enforcement. The Board may impose fines up to two hundred fifty($250.00)per day for
continuing violations. Upon completing the corrective action required, it is your responsibility to
contact Atlantic Beach Code Enforcement and arrange for an inspection to verify compliance.

Thank you for getting back with me so quickly. Per our conversation, the lender is in the process of having me appointed
by the Court as Receiver for the above referenced property.
As we discussed, my intent is to demolish the structure. As soon as I am appointed by the Court and have the legal
authority, I will immediately begin demolition. I have already received a quote from Burkhalters that I feel comfortable
presenting to the Court.
I am very pleased that the code enforcement fines will not be an issue. One less thing for me to have to address with the
Court.
Please send whatever documentation you have regarding this property. I will forward same to the lender's attorney and
recommend he pay the$10 for the lien search as you recommended. I understand there will be at minimum the lien for
the sewer hookup. I will get that issue addressed as we discussed after the demolition is complete.

This letter requests that the noted violations be corrected by contacting Jim Perkins,Utility
Supervisor at(904)247-5811 and make payment in full of all fees, and pay all charges to
connect to the-city water system and obtain the services of a State of Florida licensed
plumber to make connection to city water system with a permit and approved inspection
within fifteen(15)days of the receipt of this notice.
To avoid having this case be referred to the Code Enforcement Board,all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
Enforcement. The Board may impose fines up to two hundred fifty($250.00)per day for
continuing violations. Upon completing the corrective action required, it is your responsibility to

Dear Mr. Coffield,
The City of Atlantic Beach has disconnected the sewer tap from 65 Shell St for nonpayment of the sewer
lein. Prior to reconnecting the sewer service to this location the outstanding balance of the lien plus any
interest owed and disconnection/reconnection charges will need to be paid.
This property has been using a well for the water service.The City is now requiring that the property be
connected to City water. Charges for adding water are on the following page.
All charges need to be paid prior to anyone starting water/sewer service at this location. The charges are
based on the paying all charges prior to reconnecting sewer.The financing of any of the charges requires
approval from Finance and contract signed. If any charge(s) are financed they will be billed separate
from the utility bill for this location to the property owner. See the following page for the list of charges.
I have notified the City's Code Division that sewer service has been disconnected.

The City has physically capped the sewer lines cri the above addresses due to nonpayment on Wednesday May 8, 2013.
65 Shell St was capped due to an unpaid lien for sewer connection.The property is owned by Harold Coffield and is
vacant. Mr. Coffield had been notified by City Attorney Alan Jensen that service would be cut if lien not paid.The water
for this address is supplied by a well
372 Royal Palms Drive was disconnected for nonpayment of the sewer bill in the amount of$1,257.61.The owner

Dear Mr. Van Liere
I am in receipt of correspondence from Jim Perkins and emails from Alan Jensen about the home at the
referenced address. It is my understanding that you were in attendance at a meeting with my associate, Steve
Starke, and Jim Perkins concerning the billing situation for the sewer.
It was Mr. Starke's belief that the billing for the original sewer tap would be billed to the renter(s) along with
their sewer bill. At some point, that intent was missed and the renter(Jacob Lauer) apparently paid none of the
sewer bills. If the City of Atlantic Beach had billed us for the sewer we would have known that bills weren't
being paid and could have addressed the problem.
As it turns out, we were surprised by a 7 page list of code violations AFTER we began the eviction process for
none payment of rent AND after the tenant shot out windows and did significant damage ( in the thousands of
dollars). At which time he called in the code complaint.
We have been caught in the middle of a tenant who somehow thinks he will 'get even' by creating an home that
cannot be rented and the City of Atlantic Beach that is telling us that since we haven't paid for the sewer tap
they have disconnected the sewer meter. That makes the home even more unusable and means that an additional
$5000+is going to required to have the utilities turned back on.
As I'm sure you are aware, this home is in foreclosure. Whenever the property is sold the sewer tap lien will
have to be paid in order to give clear title. So the money will be paid. As it stands at this time, there is no
incentive the do any repairs or maintenance on the property in order to get it up to code.
I would propose to the City of Atlantic Beach that we step back and look at the overall situation as to want is
best for the taxpayers, and the owner. If the owner does nothing, the city must safe-up the house, maintain the
property and collect no sewer fees. A home in disrepair tends to push property values down much to the
displeasure of the neighbors.
As a compromise, we are prepared to spend the thousands of dollars to bring the home up to code, bring the lien
payment plan current and pay for future lien payments if the city will restore the necessary utilities to the home.
However, this offer has a limited time for action. I believe we can find a solution that all can work with, as
opposed to 'just walking away'. I look forward to your thoughts.

Dear Mr Perkins
As I said in my offer,we are willing to bring the payment plan current and to pay the original monthly amount.
I must remind you that we were unaware that the sewer bill was not being paid by the tenant(s)until recently.
Keep in mind, we are not trying to cheat the City of Atlantic Beach out of any revenue. But without some
understanding on the city's part, it would be hard justify any expenditures to bring the property up to code.
It would be difficult anyone to explain why the city has chosen to accept no money now and continue a code
violation, when you could have a paying customer,the lien payments brought current, and the home brought
into code compliance.
We are ready to move forward with this situation but time is a factor. Should you not consider the offer we have
made,you severely limit our options.

Please be advised, Atlantic Beach Code Enforcement has found your property referenced above
to be in violation of the City of Atlantic Beach, Code of Ordinances, Section 6-120,
International Property Maintenance Code as adopted to wit:

505.1 General.
Every sink, lavatory, bathtub or shower, drinking fountain,
water closet or other plumbing fixture shall be properly
connected to either a public water system or to an approved
private water system. All kitchen sinks, lavatories,
laundry facilities, bathtubs and showers shall be supplied
with hot or tempered and cold running water in accordance
with the International Plumbing Code. (Dwelling must be
connected to city water system)
IPMC Sec. 506.1 General.
All plumbing fixtures shall be properly connected to either a
public sewer system or to an approved private sewage disposal
system or an approved private sewage disposal system. (Sewer
connection to city sewage system has been caped/disconnected for non-
payment)
This letter requests that the noted violations be corrected by contacting Jim Perkins, Utility
Supervisor at(904)247-5811 and make payment in full of all fees, and pay all charges to
connect to the city water system and obtain the services of a State of Florida licensed
plumber to make connection to city water system with a permit and approved inspection
within fifteen (15) days of the receipt of this notice.
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
Enforcement. The Board may impose fines up to two hundred fifty($250.00)per day for
continuing violations. Upon completing the corrective action required, it is your responsibility to
contact Atlantic Beach Code Enforcement and arrange for an inspection to verify compliance.

charges for the unpaid sewer tap and other charges mentioned in my May 8th letter to you.

The Receiver hearing is set for 3 Sept. Per our discussions, I plan to demolish the structure using Burkhalters. The only
form I found online is the attached. Are there any other forms I need to complete?

Please be advised, Atlantic Beach Code Enforcement has found your property referenced above
to be in violation of the City of Atlantic Beach, Code of Ordinances, Section 6-120,
International Property Maintenance Code as adopted to wit:
VIOLATIONS
IPMC Sec. 505 Water System.
505.1 General.
Every sink, lavatory, bathtub or shower, drinking fountain,
water closet or other plumbing fixture shall be properly
connected to either a public water system or to an approved
private water system. All kitchen sinks, lavatories,
laundry facilities, bathtubs and showers shall be supplied
with hot or tempered and cold running water in accordance
with the International Plumbing Code. (Dwelling must be

IPMC Sec. 506.1 General.
All plumbing fixtures shall be properly connected to either a
public sewer system or to an approved private sewage disposal

This letter requests that the noted violations be corrected by contacting Jim Perkins, Utility
Supervisor at (904) 247-5811 and make payment in full of all fees, and pay all charges to
connect to the city water system and obtain the services of a State of Florida licensed
plumber to make connection to city water system with a permit and approved inspection
within fifteen (15) days of the receipt of this notice.
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
Enforcement. The Board may impose fines up to two hundred fifty($250.00)per day for

Dear Property Owner:
Please be advised, Atlantic Beach Code Enforcement has found your property referenced above
to be in violation of the City of Atlantic Beach, Code of Ordinances, Chapter 24 and Chapter 6,
and International Property Maintenance Code as adopted to wit:
VIOLATIONS
Sec. 108.1.3. Structure unfit for human occupancy. A
structure is unfit for human occupancy whenever the code
official finds that such structure is unsafe, unlawful or
because of the degree to which the structure is in
disrepair or lacks maintenance, is unsanitary, vermin or
rat infested, contains filth and contamination, or lacks
ventilation, illumination, sanitary or heating facilities
or other essential equipment required by this code, or
because the location of the structure constitutes a hazard
to the occupants of the structure or to the public.
(collapsing roof, collapsing glass roof/skylights, infestation, disrepair, etc.)
STRUCTURE MAY NOT BE OCCUPIED
Section 109.2 Temporary Safeguards. Notwithstanding other
provisions of this code, whenever, in the opinion of the
code official, there is imminent danger due to an unsafe
condition, including the boarding up of openings, to render
such structure temporarily safe whether of not the legal
procedures herein described has been instituted; and shall
cause such other action to be taken as the code official
deems necessary to meet such emergency.
(Board and secure all openings windows, doors, broken skylights, and
install a minimum 4' tall fence/barrier around the in ground pool in front
yard to prevent access)
IPMC 302.4 Weeds.
All premises and exterior property shall be
maintained free from weeds or plant growth in excess of
twelve (12) inches. All noxious weeds shall be prohibited.
Weeds shall be defined as all grasses, annual plants and
vegetation, other than trees or shrubs provided; however,
this term shall not include cultivated flowers and gardens.
(Property is very overgrown)
IPMC Sec. 302.5 Rodent harborage.
All structures and exterior property shall be kept free
from rodent harborage and infestation. Where rodents are
found, they shall be promptly exterminated by approved
processes which will not be injurious to human health.
After pest elimination, proper precautions shall be taken
to eliminate rodent harborage and prevent re-infestation.
(Evidence of rat infestation and raccoons, bees and carpenter ants)
IPMC Sec. 303.1 Swimming pools.
Swimming pools shall be maintained in a clean and
sanitary condition, and in good repair.
(Pool in front yard is green and unsanitary)
IPMC Sec. 304.1 General.
The exterior of a structure shall be maintained in good
repair, structurally sound and sanitary so as not to pose a
threat to the public health, safety or welfare.
(Front steps and deck are not in sound condition, missing shingles, holes
in exterior walls, etc.)
IPMC Sec.304.10 Stairways, decks, porches and balconies.
Every exterior stairway, deck,porch and balcony, and
all appurtenances attached thereto, shall be maintained
structurally sound, in good repair, with proper anchorage
and capable of supporting the imposed loads. (Front
porch and deck need to be repaired/replaced to be structurally sound)
IPMC Sec. 304.12 Handrails and guards.
Every handrail and guard shall be firmly fastened and
capable of supporting normally imposed loads and shall be
maintained in good condition.
(Missing and inadequate handrails and guardrails inside and outside)
IMPC Sec 304.13 Window, skylight and door frames.
Every window, skylight, door and frame shall be kept in
sound condition, good repair and weather tight.
(Front door and frame are busted, broken windows, busted skylights)
IPMC Sec. 304.13.1 Glazing.
All glazing materials shall be maintained free from cracks
and holes.
(Window in kitchen has bullet hole and is cracked, etc.)
IPMC Sec. 304.13.2 Openable windows.
Every window, other than a fixed window, shall be easily
openable and capable of being held in position by window
hardware. (Windows are not openable)
IPMC Sec. 304.15 Doors.
All exterior doors, door assemblies, operator systems if
provided, and hardware shall be maintained in good
condition. Locks at all entrances to dwelling units and
sleeping units shall tightly secure the door. Locks on
means of egress doors shall be in accordance with Section
702.3. (Front door is busted around knob and needs to be replaced)
304.7 Roofs and drainage.
The roof and flashing shall be sound, tight and not have
defects that admit rain. Roof drainage shall be adequate to
prevent dampness or deterioration in the walls or interior
portion of the structure. Roof drains, gutters and
downspouts shall be maintained in good repair and free from
obstructions. Roof water shall not be discharged in a
manner that creates a public nuisance. (Roof shingles are missing, rotted,
large holes in roof, numerous leaks)
305.3 Interior surfaces.
All interior surfaces, including windows and doors, shall
be maintained in good, clean and sanitary condition.
Peeling, chipping, flaking or abraded paint shall be
repaired, removed or covered. Cracked or loose plaster,
decayed wood and other defective surface conditions shall
be corrected. (Extensive water damage on interior walls, ceilings floors,
etc., numerous holes in walls and ceilings, missing drywall, damaged
drywall, open sections with missing and inadequate wall coverings, etc.)
305.4 Stairs and walking surfaces.
Every stair, ramp, landing, balcony, porch, deck or other
walking surface shall be maintained in sound condition and
good repair.
(Interior stairs are inadequate, in poor condition, etc.)
IPMC Sec. 307.1 Handrails and guardrails. Every exterior
and interior flight of stairs shall have a handrail on one
side of the stair and every open portion of a stair,
landing, balcony, porch, deck, ramp or other walking
surface which is more than 30 inches (762 mm) above the
floor or grade below shall have guards. Handrails shall not
be less than 30 inches (762 mm) in height or more than 42
inches (1067 mm) in height measured vertically above the
nosing of the tread or above the finished floor of the
landing or walking surfaces. Guards shall not be less than
30 inches (762 mm)inches in height above the floor of the
landing, balcony,porch, deck or ramp or other walking
surface.
(No handrails on interior stairs or exterior stairs, guardrails on 2"d story
deck in front at main entrance are not to code)
IPMC Sec. 309.1 Infestation.
All structures shall be kept free from insect and rodent
infestation. All structures in which insects or rodents are
found shall be promptly exterminated by approved processes

Clothes dryer exhaust systems shall be independent of all

ducts not properly installed/maintained)

IPMC Sec. 602 Heating facilities. Sec. 602.1 Facilities
required. Heating facilities shall be provided in
structures as required by this section. 602.2 Residential
occupancies. Dwellings shall be provided with heating
facilities capable of maintaining a room temperature of
68°F (20°C) in all habitable rooms, bathrooms and toilet
rooms based on the winter outdoor design temperature for
the locality indicated in Appendix D of the International
Plumbing Code. Cooking appliances shall not be used, nor
shall portable unvented fuel burning space heaters be used,
as a means to provide required heating.

IPMC Sec. 604.1 Facilities required.
Every occupied building shall be provided with an
electrical system in compliance with the requirements of
this section and Section 605.

Duct systems shall be maintained free of obstructions and
shall be capable of performing the required function.
IPMC Sec. 704.2 Smoke alarms. Single or multiple station
smoke alarms shall be installed and maintained in groups
R-2, R-3, R-4 and in dwellings not regulated in group R
occupancies. Regardless of occupant load at all of the
following locations:
1. On the ceiling or wall outside
of each separate sleeping area in the immediate vicinity of
bedrooms.
2. In each room used for sleeping purposes.
3. In each story within a dwelling unit, including basements
and cellars but not including crawl spaces and
Un inhabitable attics. In dwellings or dwelling units with
split levels and without an intervening door between the
adjacent levels, a smoke alarm installed on the lower level
provided that the lower level is less than
one full story below the upper level
Section 704.4 Interconnection. Where more than
one smoke alarm is required to be installed within an
individual dwelling unit if Group R-2,R-3, R-4 and in
dwellings not regulated as Group R occupancies, the smoke
alarms shall be interconnected in such a manner that the
activation of one alarm will activate in such a manner
that the activation of one alarm will activate all of the
alarms in the individual unit. The alarm shall be clearly
audible in all bedrooms over background noise levels with
all intervening doors closed. (none provided)
Sec. 24-154. Outdoor display, sale and storage of
furniture, household items, merchandise and business
from a street or a neighboring property shall be maintained
in an acceptable manner, which shall be defined by :
1. Lots are maintained free of litter, trash, debris,
discarded belongings automotive parts, old tires,
construction materials, and broken and abandoned items.
5. Household items of any type that are customarily
intended to be used and maintained within the interior of
the residence are not stored or discarded in any location
on a lot that is visible from a street. Similarly, within
the rear or side yards of a lot, such items are not stored
in a manner or amount such that an unsightly nuisance to
neighboring properties or an environment that attracts
rodents, insects, or other animals and pests is created.
Sec. 24-164 Swimming Pools.
(c) Fences: All swimming pools and any ornamental pool
with a depth greater than two (2) feet shall be enclosed by
a fence, wall or equivalent barrier at least four(4) feet
in height and designed in compliance with all applicable
state and local regulations. (No fencing/barrier around pool in front yard
as required creating a hazardous condition)
Sec. 24-157(e) Maintenance of fences. Fences that have
been allowed to deteriorate to an excessive degree have a
negative impact on property values and the quality of
neighborhoods. Fences that are in a state of neglect,
damage or disrepair, shall be repaired, replaced or
removed.
Unacceptable fences are identified as those containing any
of the following characteristics that can be easily
observed from the street or by a neighboring property.
i. Components of the Fence are broken, bent, visibly
rusted or corroded.
ii. Portions of the fence are no longer connected to the
support posts and rails.
iii. Any components are rotten, broken or missing.
iv. Weed are overtaking the fence.
(wire fencing on eastside of property is covered in vines and in poor
condition)
This letter requests that the property be boarded and secured (all openings including all
windows, doors and busted sky lights and holes in the roof to prevent occupancy and that
the pool have a minimum 4' tall fence/barrier adequate to prevent access the pool in the
front yard within ten (5) days of the receipt of this notice. In addition, compliance is required
by mowing and cleaning the yard and removal of all items stored outside and cleaning and
maintaining clean the pool located in the front yard within ten (10) days of receipt of this notice.
Remaining violation must be corrected within ninety(90) days of receipt of this notice with
permits from State of Florida licensed contractors.
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
