The Code Enforcement Board of the City of Atlantic Beach was created pursuant to
Florida Statutes and exists for the purpose of facilitating the enforcement of the Code of
Ordinances. It is comprised of seven citizens of Atlantic Beach who meet regularly to hear
allegations of code violations.
You are hereby notified and ordered to appear at the next public hearing of the Code
Enforcement Board on Tuesday, July 9, 2013 , at 6:00 pm at Atlantic Beach City Hall,
Commission Chamber, 800 Seminole Road, to answer and be heard to the following alleged
violations on the property known as LOT PT 19 BLOCK 1 ATLANTIC BEACH, RE# 169733-

Violation Description
Chapter 20 Business Tax Receipts
Section 20-52. Levy. A business license tax shall be
levied on:
(1) Any person who maintains a permanent business
location or branch office within the City, for the
privilege of engaging in or managing any business within
itsjurisdiction.
(2)Any person who maintains a permanent business
location or branch office within the City, for the
privilege of engaging in or managing any profession or
occupation within its jurisdiction.
The Code Enforcement Board may levy fines up to $250.00 per day for the first violation
and $500.00 per day for a repeat violation. If the violation is corrected and then recurs or if the
violation is not corrected by the time specified for correction by the Code Enforcement Officer,
the case could be presented to the Code Enforcement Board even if the violation has been
corrected prior to the Board hearing. Upon completing the corrective action required, it is your
responsibility to contact Atlantic Beach Code Enforcement and arrange for an inspection to
verify compliance at(904) 247-5855.
You have the right to obtain an attorney at your own expense and to present witnesses in
your behalf. If you desire to have witnesses subpoenaed or if you have questions regarding the
procedure,please contact Dayna Williams, Secretary of the Code Enforcement Board within five
days of the receipt of this notice at (904) 247-5810. Please note the presence of a court reporter
for the purpose of insuring a verbatim record in the event an appeal should be secured at your
expense.

A business license tax shall be levied on:
(1) Any person who maintains a permanent business location or branch office
within the City, for the privilege of engaging in or managing any business
within its jurisdiction.
(2) Any person who maintains a permanent business location or branch office
within the City, for the privilege of engaging in or managing any profession or
occupation within its jurisdiction.
Section 20-54. Due dates and delinquencies; penalties.
(a) All receipts shall be sold by the city clerk beginning September first of each year
and shall be due and payable on or before October first of each year and shall

expire on September thirtieth of the succeeding year. If October first falls on a
weekend or holiday, the tax shall be due and payable on or before the first working
day following October first. Those receipts not renewed when due and payable
shall be considered delinquent and subject to a delinquency penalty of ten (10)
percent for the month of October, plus an additional five (5) percent penalty for
each month of delinquency thereafter until paid. However, the total delinquency
penalty shall not exceed twenty-five (25) percent of the local business tax fee for
the delinquent establishment. If receipt is not paid by January thirty-first, the city
clerk shall have the city water service disconnected until business tax fee plus
delinquent charges are paid in full.
(b) Any person engaging in or managing any business, occupation or profession without
first obtaining a local business tax receipt, if required in this article, shall be subject
to a penalty of twenty—five (25) percent of the business tax fee determined to be due,
in addition to the penalty provided by F.S. Ch. 162; any such business may be closed
by the city manager or his designee until the business tax requirements have been
met.
This letter requests that application be submitted to the City of Atlantic Beach, City Clerk's
Office within ten (10) days of receipt of this notice and that full compliance be achieved by
obtaining the business tax receipt including full payment of the appropriate fees within
twenty (20) days following the date of the application submittal. I have enclosed the
appropriate application for your convenience.
Failure to comply may result in your water service being disconnected, your business being closed
or this case being referred to the Code Enforcement Board. The Board may impose fines up to two
hundred fifty ($250.00) dollars and impose administrative charges including attorney's fees for
continuing violations.
It is our goal to enforce the codes and ordinances of the City of Atlantic Beach and protect the
health, safety and welfare of the City, and accordingly, your cooperation in this matter is greatly
