A RESOLUTION OF THE CITY OF ATLANTIC BEACH,
FLORIDA INITIATING THE PROCESS PURSUANT TO
SECTION 171.203, FLORIDA STATUTES FOR NEGOTIATING
AN INTERLOCAL SERVICE BOUNDARY AGREEMENT WITH
THE CITY OF JACKSONVILLE, FLORIDA; IDENTIFYING AN
INCORPORATED AREA OF THE CITY OF JACKSONVILLE TO
BE DISCUSSED FOR POSSIBLE ANNEXATION; IDENTIFYING
ISSUES FOR NEGOTIATION; PROVIDING DIRECTIONS TO
THE CITY CLERK; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Chapter 163,Part I, Florida Statutes, known as the 'Florida Interlocal Cooperation
Act of 1969" authorizes local governments to enter into interlocal agreements with each other to make
the most efficient use of their powers by enabling them to cooperate with each other on a basis of mutual
advantage and thereby to provide services and facilities in a manner and pursuant to forms of
governmental organization that will accord best with geographic, economic, population, and other
factors influencing the needs and development of local communities; and
WHEREAS, the Florida Legislature enacted the Interlocal Service Boundary Agreement Act,
Chapter 171, Part II, Florida Statutes, to provide an alternative process for local governments regarding
the annexation of territory into a municipality and the subtraction of territory from a n incorporated area
of another municipality ; to encourage local governments to jointly determine how to provide
services to residents and property in the most efficient and effective manner while balancing the needs
and desires of the community; to establish a more flexible process for adjusting municipal boundaries; to
encourage intergovernmental coordination in planning, service delivery, and boundary adjustments and to
reduce intergovernmental conflicts and litigation between local governments; to promote sensible
boundaries that reduce the costs of local governments, avoid duplicating local services, and increase
political transparency and accountability; and to prevent inefficient service delivery and an insufficient
tax base to support the delivery of those services; and
WHEREAS, the City Commission of the City of Atlantic Beach, Florida, has identified certain
lands, the boundary and legal description of which is depicted on Exhibit "A" (hereinafter referred to as
the "Selva Marina Country Club") that are logical for the City of Atlantic Beach to provide certain
municipal services and which may be appropriate for annexation into the City of Atlantic Beach; and
WHEREAS, the City Commission of the City of Atlantic Beach, Florida deems it to be
in the best interests of the City to negotiate an Interlocal Service Boundary Agreement with t h e
City of Jacksonville, Florida for the "Selva Marina Country Club" pursuant to the provisions of
Chapter 171,Part II,Florida Statutes; and
WHEREAS, the City Commission of the City of Atlantic Beach, Florida desires to initiate
negotiations for an Interlocal Service Boundary Agreement with the City of Jacksonville
concerning the "Selva Marina Country Club" pursuant to the provisions of Section 171.203, Florida
Statutes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF ATLANTIC BEACH, FLORDA, THAT:
1. The City of Atlantic Beach, Florida does hereby invite the City of Jacksonville, Florida
to commence the negotiation of an Interlocal Service Boundary Agreement regarding the incorporated
lands identified on Exhibit "A", attached hereto and incorporated herein by reference, to be referred to
as the "Selva Marina Country Club".
2. The City of Atlantic Beach agrees that negotiations regarding an Interlocal Service
Boundary Agreement will address, at a minimum, issues concerning service delivery, fiscal
responsibilities, and boundary adjustment as they concern Atlantic Beach ' s a n d
Jacksonville ' s responsibilities for the funding and delivery of the following services:
a. Public safety
b. Fire, emergency rescue, and medical
c. Water and wastewater
d. Road ownership, construction, and maintenance
e. Conservation,parks, and recreation
f. Stormwater management and drainage
3. Negotiations regarding an Interlocal Service Boundary Agreement will also address Land
Development Planning and Regulation; the effect on Ad Valorem taxes; Voluntary Annexation; and Future
Land Uses in annexed areas.
4. The City Clerk is hereby directed to send a copy of this Resolution by United States
Certified Mail to the chief administrative officer of each of the following: Duval County,
FL; the City of Jacksonville, FL; the City of Jacksonville Beach, FL; the City of Neptune Beach, FL; and
the Town of Baldwin, FL.
5. This Resolution shall be effective immediately upon adoption.
ADOPTED at a regular meeting of the City Commission of the City of Atlantic Beach, Florida,

Dear Mayor Brown:
On October 14th, 2013, pursuant to Chapter 171, Florida Statutes, the City of Atlantic Beach
adopted the above referenced resolution to initiate negotiations for an interlocal service boundary
agreement. A copy of the above referenced resolution is enclosed for your convenience. According to
Section 171.203(2), Florida Statutes,the City of Jacksonville is required to adopt a responding resolution
within sixty(60)days after receipt of the City of Atlantic Beach's resolution.
To my knowledge,the City of Jacksonville is interested in pursuing negotiations;however, due to
the City Council's meeting schedule, a resolution cannot be passed within the sixty (60) day time limit.
Therefore, after consultation with and direction from the City Commission of Atlantic Beach, the City of
Atlantic Beach has no objection to extending the time period for an additional sixty (60) days from
today's date to allow sufficient time for the City of Jacksonville to consider a responding resolution.

24 independent special districts within the county to enter into an
25 Interlocal Service Boundary Agreement; and
26 WHEREAS, Subsection 171 . 203 (1) , Florida Statutes, provides
27 that a county, a municipality, or an independent special district
28 shall commence the negotiation process for an Interlocal Service
29 Boundary Agreement by adopting an initiating resolution which must
JO identify an unincorporated area or incorporated area, or both, to
31 be discussed and the issues to be negotiated; and

1 WHEREAS, Paragraph 171 . 203 ( 1) (a) , Florida Statutes, provides
2 that the initiating resolution of an initiating municipality may
3 designate an invited municipality; and
4 WHEREAS, Paragraph 171 . 203 ( 1) (b) , Florida Statutes, provides
5 that an initiating municipality shall send the initiating
6 resolution by United States certified mail to the chief
7 administrative officer of the county and the invited municipality,
8 if any; and
9 WHEREAS, Subsection 171 . 203 (2) , Florida Statutes, provides
10 that within sixty ( 60) days after the receipt of an initiating
11 resolution, the county shall adopt a responding resolution; and
12 WHEREAS, Subsection 171 . 203 (2) , Florida Statutes, provides
13 that the responding resolution may identify additional issues for
14 negotiation; and
15 WHEREAS, Subsection 171 . 203 (2) Florida Statutes, provides that
16 the additional issues designated for negotiation, if any, must be
17 listed in the responding resolution and may include, but need not
18 be limited to, the issues listed in Subsection 171 . 203 (6) , Florida
19 Statutes; and
20 WHEREAS, Subsection 171 . 203 (2) , Florida Statutes, provides
21 that the responding resolution may also invite an additional
22 municipality or independent special district to negotiate the
23 Interlocal Service Boundary Agreement; and
24 WHEREAS, Paragraph 171 . 203 (2) (a) , Florida Statutes, provides
25 that within seven (7) days after the adoption of a responding
26 resolution, the responding county shall send the responding
27 resolution by United States certified mail to the chief
28 administrative officer of the initiating municipality, each invited
29 municipality, if any, and the independent special district that
30 receive an inviting resolution; and
31 WHEREAS, on October 14, 2013 the City Commission of the City

1 of Atlantic Beach, Florida, adopted Resolution No. 13-14 pursuant
2 to Chapter 171, Part II, Florida Statutes; and
3 WHEREAS, the City of Atlantic Beach Resolution No. 13-14
4 invites the City of Jacksonville to negotiate common issues
5 regarding the shared boundary of the two (2) local governments; and
6 WHEREAS, the City of Atlantic Beach Resolution No. 13-14 was
7 sent by certified mail and received by the City of Jacksonville
8 Chief Administrative Officer; and
9 WHEREAS, the President of the City Council of the City of
10 Jacksonville, Florida authorized the Office of General Counsel to
11 prepare a responding resolution to the City of Atlantic Beach
12 Resolution No. 13-14 in accordance with Subsection 171 . 203 (2) ,
13 Florida Statutes; and
14 WHEREAS, the City Council expressed an interest in accepting
15 the City' s invitation to negotiate an Interlocal Service Boundary
L6 Agreement; now therefore,
17 BE IT RESOLVED by the Council of the City of Jacksonville :
18 Section 1 . Responding Resolution. This responding
19 resolution is adopted pursuant to Chapter 171, Part II, Florida
20 Statutes, the Interlocal Service Boundary Agreement Act,
21 specifically Section 171 . 203, Florida Statutes .
22 Section 2 . Negotiation. The City of Jacksonville hereby
23 responds to the City of Atlantic Beach Resolution No. 13-14,
24 attached as Exhibit 1 and incorporated herein, by accepting the
25 City' s invitation to negotiate an Interlocal Service Boundary
26 Agreement .
27 Section 3 . Annexation Area. The City of Jacksonville
28 hereby identifies the incorporated area for discussion which is
described on the map as Exhibit 2 and incorporated herein. The
30 incorporated area is labeled "Proposed Annexation Area" on Exhibit
31 2 .

A RESOLUTION OF THE CITY OF ATLANTIC BEACH,
FLORIDA INITIATING THE PROCESS PURSUANT TO
SECTION 171.203, FLORIDA STATUTES FOR NEGOTIATING
AN INTERLOCAL SERVICE BOUNDARY AGREEMENT WITH
THE CITY OF JACKSONVILLE, FLORIDA; IDENTIFYING AN
INCORPORATED AREA OF THE CITY OF JACKSONVILLE TO
BE DISCUSSED FOR POSSIBLE ANNEXATION; IDENTIFYING
ISSUES FOR NEGOTIATION; PROVIDING DIRECTIONS TO
THE CITY CLERK; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Chapter 163,Part I, Florida Statutes,known as the 'Florida Interlocal Cooperation
Act of 1969"authorizes local governments to enter into interlocal agreements with each other to make
the most efficient use of their powers by enabling them to cooperate with each other on a basis of mutual
advantage and thereby to provide services and facilities in a manner and pursuant to forms of
governmental organization that will accord best with geographic, economic, population, and other
factors influencing the needs and development of local communities; and
WHEREAS, the Florida Legislature enacted the Interlocal Service Boundary Agreement Act,
Chapter 171, Part II, Florida Statutes, to provide an alternative process for local governments regarding
the annexation of territory into a municipality and the subtraction of territory from a n incorporated area
of another municipality; to encourage local governments to jointly determine how to provide
services to residents and property in the most efficient and effective manner while balancing the needs
and desires of the community; to establish a more flexible process for adjusting municipal boundaries; to
encourage intergovernmental coordination in planning, service delivery, and boundary adjustments and to
reduce intergovernmental conflicts and litigation between local governments; to promote sensible
boundaries that reduce the costs of local governments, avoid duplicating local services, and increase
political transparency and accountability; and to prevent inefficient service delivery and an insufficient
tax base to support the delivery of those services; and
WHEREAS, the City Commission of the City of Atlantic Beach, Florida, has identified certain
lands, the boundary and legal description of which is depicted on Exhibit "A" (hereinafter referred to as
the "Selva Marina Country Club") that are logical for the City of Atlantic Beach to provide certain
municipal services and which may be appropriate for annexation into the City of Atlantic Beach;and
WHEREAS, the City Commission of the City of Atlantic Beach, Florida deems it to be
in the best interests of the City to negotiate an Interlocal Service Boundary Agreement with the
City o f Jacks o n v i 11 e, Florida for the "Selva Marina Country Club" pursuant to the provisions of
Chapter 171,Part II,Florida Statutes; and
WHEREAS, the City Commission of the City of Atlantic Beach, Florida desires to initiate
negotiations for an Interlocal Service Boundary Agreement with the City of J a c k s o n v i l l e
concerning the "Selva Marina Country Club" pursuant to the provisions of Section 171.203, Florida
Statutes.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF ATLANTIC BEACH, FLORDA, THAT:
1. The City of Atlantic Beach, Florida does hereby invite the City of Jacksonville, Florida
to commence the negotiation of an Interlocal Service Boundary Agreement regarding the incorporated
lands identified on Exhibit "A", attached hereto and incorporated herein by reference, to be referred to
as the "Selva Marina Country Club".
2. The City of Atlantic Beach agrees that negotiations regarding an Interlocal Service
Boundary Agreement will address, at a minimum, issues concerning service delivery, fiscal
responsibilities, and boundary adjustment as they concern Atlantic Beach' s a n d
Jacksonville ' s responsibilities for the funding and delivery of the following services:
a. Public safety
' b. Fire, emergency rescue, and medical
c. Water and wastewater
d. Road ownership, construction,and maintenance
e. Conservation,parks,and recreation
f. Stormwater management and drainage
3. Negotiations regarding an Interlocal Service Boundary Agreement will also address Land
Development Planning and Regulation; the effect on Ad Valorem taxes;Voluntary Annexation; and Future
Land Uses in annexed areas.
4. The City Clerk is hereby directed to send a copy of this Resolution by United States
Certified Mail to the chief administrative officer of each of the following: Duval County,. •
FL; the City of Jacksonville, FL; the City of Jacksonville Beach, FL; the City of Neptune Beach, FL; and
the Town of Baldwin,FL.
5. This Resolution shall be effective immediately upon adoption.
ADOPTED at a regular meeting of the City Commission of the City of Atlantic Beach, Florida,
