Violation Description
IPMC Sec.302.8 - Motor Vehicles
"No inoperative or unlicensed motor vehicle shall be parked
or kept or stored on any premises, and no vehicle shall at
any time be in a state of disrepair,major disassembly or
in the process or being stripped or dismantled".

Sec. 12-1 Nuisances
(b) It is hereby declared to be a nuisance,the
enumerations of which are merely indications of the nature
of the type of acts,occurrences and conditions, and shall
not be deemed to be exclusive:
(11) For any person or business to allow vegetation
other than cultivated plants, shrubs or trees to exceed a
height of more than twelve(12) inches on any developed lot,
or within twenty(20)feet of any occupied residential

property,business property or city right of way.

Sec. 12-1 Nuisances
(b) It is hereby declared to be a nuisance,the
enumerations of which are merely indications of the nature
and type of acts, occurrences and conditions,and shall not
be deemed to be exclusive.
(7) For any person, either as the owner or occupant of a
building, structure, or property to utilize the premises
for the open storage of any abandoned or inoperable motor
vehicle,refrigerators or other appliance, household
furniture, glass,building material,building rubbish or
similar items.

Sec. 24-157. Fences, Walls and Similar Structures
(c)Maintenance of fences. Fences that have been
allowed to deteriorate to an excessive degree have a
negative impact on property values and the quality of
neighborhoods. Fences that are in a state of neglect,
damage or disrepair, shall be repaired ,replaced or
removed.
This letter requests that the noted violations be corrected by mowing the overgrown rear
yard,removing the junk boat and all junk stored in it, removing the inoperable Chevy
Corsica from the rear yard or make it operable,and repair the rear dilapidated wood
fencing within ten (10) days of the posting of this notice.
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
Enforcement. The Board may impose fines up to two hundred fifty($250.00)per day for
continuing violations.Upon completing the corrective action required, it is your responsibility to
contact Atlantic Beach Code Enforcement and arrange for an inspection to verify compliance.

ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted
in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach, Florida it is
Ordered:
THAT the Respondent is found in violation for non-compliance and must obtain compliance on
or before November 1, 2013 Failure to comply will result in fines of $200.00 for the first day and
$200.00 for every day thereafter while the violation continues to exist. In addition, any fine shall also
include the administrative costs to the City incurred in prosecuting this case.
THAT the Respondent is responsible for contacting the City of Atlantic Beach Code Enforcement
Officer and obtaining an inspection of compliance.
THAT failure to pay all accumulated fines will result in a lien being placed against the property at
981 Sailfish Dr for the total assessment plus costs incurred for the filing of the lien. All lien amounts are
to be made payable at an interest rate of ten(10)percent per annum from date of certification until paid.
This Order becomes self-executing upon an Affidavit of Non-Compliance being filed with the City
Clerk's Office.

any time be in a state of disrepair, major disassembly or
in the process or being stripped or dismantled".
Sec. 12-1 Nuisances
(b) It is hereby declared to be a nuisance,the
enumerations of which are merely indications of the nature
of the type of acts, occurrences and conditions, and shall
not be deemed to be exclusive:
(11) For any person or business to allow vegetation
other than cultivated plants, shrubs or trees to exceed a
height of more than twelve(12) inches on any developed lot,
or within twenty (20) feet of any occupied residential
property, business property or city right of way.
Sec. 12-1 Nuisances
(b) It is hereby declared to be a nuisance, the
enumerations of which are merely indications of the nature
and type of acts, occurrences and conditions, and shall not
be deemed to be exclusive.
(7) For any person, either as the owner or occupant of a
building, structure, or property to utilize the premises
for the open storage of any abandoned or inoperable motor
vehicle, refrigerators or other appliance, household
furniture, glass, building material, building rubbish or
similar items.

Ordered:
THAT the Respondent is found in violation for non-compliance and must obtain compliance on
or before November 1, 2013 Failure to comply will result in fines of $200.00 for the first day and
$200.00 for every day thereafter while the violation continues to exist. In addition, any fine shall also
include the administrative costs to the City incurred in prosecuting this case.
THAT the Respondent is responsible for contacting the City of Atlantic Beach Code Enforcement
Officer and obtaining an inspection of compliance.
THAT failure to pay all accumulated fines will result in a lien being placed against the property at
981 Sailfish Dr for the total assessment plus costs incurred for the filing of the lien. All lien amounts are
to be made payable at an interest rate of ten(10)percent per annum from date of certification until paid.
This Order becomes self-executing upon an Affidavit of Non-Compliance being filed with the City
Clerk's Office.

1. Respondent(Rena Koenig)previously owned the Property located at 981 Sailfish Drive, Atlantic
Beach, Florida. ("The Property"). The Property was foreclosed upon in December 2022 and a
writ of possession was obtained by the foreclosing Bank. Proper notice of the public hearing was
provided and Mr. Ryan Courson appeared at the Code Enforcement hearing for the Bank.
2. The original violations under IPMC Sec.302.8-Motor Vehicles were imposed on Sept 10, 2013
resulting in a fine of$200.00 per day with an interest rate of ten (10) percent per annum from the
date of the certification until paid. The lien amount on the Property is currently in excess of$1.6
million dollars.
3. The foreclosing Bank took possession of the Property and most of the violations have been
repaired or removed. The City of Atlantic Beach has requested the remaining items be set on a
time line for the Bank to correct. The Bank representative stated that the Bank is at the mercy of
HUD to pay the lien (or portion thereof) and prepare the Property to be sold.
4. The Respondent has requested a lien reduction due to the time frame and amount of the lien.
5. The City of Atlantic Beach agreed to a lien reduction to the amount of$50,000.00.
CONCLUSIONS OF LAW
6. The City of Atlantic Beach provided proper notice to the Respondent/Bank representative. The
original Respondent was in violation and a substantial lien was imposed. The City of Atlantic
Beach has agreed to a reduction of the lien to $50,000.00.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority
granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach,
Florida it is Ordered:
A. The lien shall be reduced to $50,000.00 payable within sixty (60) days and the
Respondent/Bank shall work with the City of Atlantic Beach to remove the remaining
violations (if any) in a timely manner.
