Subject: CITY COMMISSION ACTIONS FEBRUARY 9, 1987
1. Mr. and Mrs. McManus, residents of North Atlantic Beach, appeared
before the City Commission to request the upgrading of the zoning-
on property owned by Mr. Hayward who proposes to build seven
multi-family units. The City Commission took the position the area
is properly zoned for multi-family and legally there is nothing the
City can do at the present time. However, a question has arisen
regarding the right of way for Beach Avenue in that area, and no
permit is to be issued until that matter has been resolved.
2. The City Commission approved an application for an exception for
Tom West for an auto service garage at 61-63 West Second Street in
Section H with the provision there be no outside work and no
outside storage.
3. The City Commission reversed the Advisory Planning Board and
granted the application for exception from the Sunrise Community
Church for a day-care center on the church grounds near Aquatic
Gardens, contingent upon the operators furnishing satisfactory
evidence that HRS has review, evaluated and approved the facility,
and further, that the Sunrise Community Church be furnished with a
copy of the day-care regulations from the City of Atlantic Beach
Code, which you will find on Page 1454. Please copy me with the
letter you send to them authorizing the exception and including a
copy of these provisions.
4. Approved on final reading an Ordinance rezoning the Steve
Mabry/John Tolbert property on Church Road from RG1 to RG2.
5. As you know, the Ellen Price rezoning request has been withdrawn.

Mr. T<alijurt pr-e::;calitvd the !Board with a prelimirlar y cite plan of
the property that indicated four lots 100' x 1891 , each with a
four uriit building. Mr. 'Talbert pointed out the small percentage
of lot coverage. lie noted that the property backu up to a park,
and that to the wont :io a large area of open apace owned by the
city. Ile added that they proposed to construct two or three
bedroom units and that adequate parking would be provided.
Candacr, Nordan que:jtioned whei.her they should limit the number of
bedroomo to two in order to maintain a low density. The Board
felt they could riot limit thu iiumber of bedrooms due to
marketability. After further discussion Ruth Gregg motioned to
recommend approval of the request. Candace Nordan seconded the
motion which carried unanimous-ly.

A. Request .for Rezoning from RS2 to RG2 - Ellen C. Price; Lot
80, North Atlrantic Beach Unit No. 3
Mrs. Price, 1810 Sevilla Boulevard No. 306, stated that due to
having a mild stroke in September 1986, she was not aware of the
annexation of her property into Atlantic Beach or the change of
zoning from RGA, which would allow construction of a triplex to
RS2, single family. She stated that she had plans to construct a
triplex with underground parking.
The Board was in receipt of a petition with 61 signatures and
five letters from surrounding property owners expressing
opposition to the rezoning. The following people spoke against
the application: Frank Delaney, 2371 Seminole fioad; Gene
Montanye, 1731 Beach Avenue; Bert Russell, 2077 Beach Avenue.
The Board members were concerned about "spot zoning" the
property. After a lengthy discussion, Candace Nordan motioned to
recommend denial of the application. Ron Gray seconded the
motion which carried unanimously.
B. Request for Use by Exception for an Automotive Service Garage
in CG; 61--63 West Second Street, Lot 7 and Half of Lot 6,
Block ':'6, Section 11; by Tom West Homes, Inc.
John Murr, 7632 Southside Boulevard, stated that he was renting
one of the units and that he wished to open a small automotive
service garage. Ile stated that he would do the work himself and
that the cars would be kept inside the garage. He added that he
has a wrecker and that it would go home with him at night.
Ruth Gregg stated that there were several cars on the premise--
now.

that he had talked to him about it. The Board asked that the
Codes Enforcement Officer look into the matter.
There was a discussion as to a previous application for use, by
exception on the same premises. Ruth Gregg motioned to recommend
approval of the application subject to general cleanliness of the
premises and that there be no outside work or storage. Ron Gray
seconded the motion which carried unanimously.
C. Request for Use by Exception for a Childcare Center in RG2
298 Aquatic Drive; Sunrise Community Evangelical Free Church
Representing the church were Melaney Blevin and Sharon Pino.
They stated that the church was requesting permission to open a

childcare center for a ma:;imum of 42 children. The hours would
be from 9:00 and until 12:00 noon, five days per week and that the
calendar would be the same as public schools.
Ron Gray asked flow close the nearest house was to the church.
They replied that the closest building was the sales office for
Aquatic Gal-derls Subdivision. Ruth Gregg and Candace Nordan felt
it was a good location. Ron Gray was concerned about the
increased traffic on Aquatic Drive. He quoted sections from the
minutes of the Planning Board of January 25, 1983 when the Church
first applied for their use by exception. The applicants had
stated that they had no plans for a school.
Candace Nordan motioned to recommend denial of the application
based on title original use by exception in which they stated they
would have no schools. Ruth Gregg seconded the motion which
carried unanimously.
D. Request for Expansion of Use by Exception for an Additional
Fifty Seats for Sale of Liquor - Ragtime Tavern, 207
Atlantic Boulevard; William and Thomas Morton
William Morton stated that they had preliminary plans to expand
into one or two of the adjoining units. Mr. Morton stated that
they had plans to construct a rear entrance ( to better utilize
the rear parking ) including lighting and landscaping. There was
considerable discussion regarding the insufficient parking.
Suggestions were made to possibly leasing parking from the
southeast corner parking lot, the Sea Turtle parking lot, or the
southwest dirt parking lot. There was a brief discussion as to
the fate of "Zanadu", directly next door, and as to flow they
could expand westerly.
Candace Nordan asked the applicants to withdraw their request and
come back with ideas to solve the parking problems. Mr. Morton
withdrew the request.
There being rlo further business before the Board Gregg McCaulie
motioned that ttie meeting be adjourned. Ron Gray seconded the
motion which carried unanimously.

Subject: Board Actions of November 18, 1986 with Recommendations
Your Advisory Planning Board considered three applications for
Use by Exception, two applications for relief from the septic
tank moratorium, one subdivision replat, and establishment of
zoning districts for Seminole Beach at its regular meeting of
November 18, 1986, and makes the following recommendations.
1. The Board recommends approval of an amended application for
Use by Exception by Tom West for a contractor with no outside
storage in a Commercial General zoning district. The property is
located at 61-63 West Second Street.
2. The Board recommends approval of an application for Use by
Exception by Mini Storage Associates, LTD. to expand the existing
Mayport Mini Storage facility at 1650 Mayport Road. The
recommendation is subject to installation of a 6' shadow box
fence (with the most aesthetic side out), with three-2' insets,
and with trees 3" in diameter planted in each inset; and subject
to there being no ingress or egress on Levy Road.
3. The Board recommends approval of a use by exception for a
church in an RG1A zoning district by Johnson Properties, Inc.
The property is located in the east half of the Snug Harbor
subdivision and is bordered by Orchid Street, the West Plaza
drainage ditch, and Snug Harbor Court.
4. The Board recommends denial of a request for relief from the
septic tank moratorium by Raymond C. Flott for property located
at Block 138, Section H. Mr. Flott presented a sales contract
that was executed prior to the date of the resolution. The
contract was contingent upon the buyer obtaining septic tank
permits. The Board recommends denial of the request due to the
hardship being of economic character. The Board also expressed
concern regarding the elevation of the property.
