This letter is written to document the status of your contracted services and request all building
permits obtained by your company or associated subcontractors, are closed and finalized in the
next 7 days, NLT Tuesday, June, 10th, 2014.
Your contract and obligations were to complete all work at 1945 Brista De Mar Cir, Atlantic
Beach FI., 32233 by Apr. 15 in all main living spaces, with Master Bedroom, Master Bath, &
Pool Bath by May 1, 2014, or 5 days after doors and cabinets arrive. The impact of being
forced off the job by not properly filing a permit was a major factor for not meeting timelines, yet
we allowed a 2 week extension due to the circumstances. On May 1" we were forced to obtain
a Hotel room until May 8th, at which time work was to be completed. As of May 8th you worked
through Friday May 23rd, 2014, resulting in 3 unfinished Bathrooms, major amounts of tile work
needs repair/rework, Bathrooms, Plumbing, Electric, Sidewalks, Driveway, and defective work
as noted on a Certified Home inspection completed 5-21-15. Since Friday May 23rd, & the date
of this Letter it is evident that you removed all tools & have not returned to compete unfinished
work although all permits remain open that are filled with the City of Atlantic Beach FI.
I request that you have all open permits closed out immediately and/or write a letter to
the City of Atlantic Beach requesting closure of open permits. I expect all permits closed
NLT Tuesday, June 10th, 2014.
Upon closure of all existing permits, quotes for uncompleted and/or deficient work will be
obtained from alternate contractors for repair& completion.

Mr. Simon I disagree with the information contained in your letter. Below you will find my
response to your letter. I met with you and your wife 3 times prior to starting the project to
review the plans.At the last meeting you agreed to the plans. The problems that delayed this
project were your continued changes to the plan and your interference with the tradesmen
doing the work.Asking them directly to make changes that you had not cleared with me.This
caused many delays and scheduling problems.
You submitted to me your notarized permit application on March 17, 2014 the following day I
submitted to the building department of Atlantic Beach,they approved the respective permit
eight days after I submitted the application, March 26. We agreed to complete the project in
eight weeks.
During the progress of the construction you and your wife changed the original design approved
by the City of Atlantic Beach. These changes caused significant delays.You changed the plan for
the master bathroom after the framing and rough plumbing were completed also relocated
cabana bathroom, back porch.This caused the progress to be delayed.When we had the
drywall installed and finished in master bathroom, Master bedroom and rough electrical work
done, passed the respective inspection,you had the electrician relocated lights,exhaust fan and
switches,opening new holes when the finish work was completed in those spaces,the
electrician told me that the owners change their mind.You bypassed me the GC of the job and
went straight to the electrician and asked him to change the design again. Doing so caused us to
have to refinish the original spots for the lights and switches would have been.This caused a
delay in the progress and increased the labor cost for the project; you did not pay for this
increase labor. Also in the kitchen you change the original design,the kitchen sink was located
next to the wall, during the progress you decided to put the sink in the island. You required us to
install a temporary sink and cabinet in the kitchen because of the change you made to the plan
again.This caused a delay in our progress and created additional labor cost for which you did
not pay for. Another change that you made to the project was to build an insulated storage
space the attic over bedroom 3.This required us removing the existing drywall,ceiling joist,and
installing insulation,decking, new joist,dry wall, drop down stairs and repainting the area.Along
with this change you changed the original plans again when you decided to move the HVAC to

the attic when the original plans had it going in the garage. We had to create a safe secure space
for it in the attic.This change required approval from the structural engineer. This caused a
delay in the progress of the project.You changed the plan again when you required us to
remove the wood ceiling in the master bedroom.We removed the wood ceiling, installed new
dry wall,finished the dry wall then painted it.This again caused a delay to the progress of the
project not factored in the original plan. You changed the plan for the master bedroom again
when you asked us to remove the window and door to install sliders. This required us to demo
the wall, re frame it to accommodate the sliding door, install the door and re do the exterior
siding.Again another delay caused by you changing the plans.
The plan included a paver walk way.Which required us to remove the gravel and stones. When
we removed the stone and gravel and prepped the area for pavers. I provide some samples of
pavers.You and you wife choose the paver you preferred and I ordered it.The next day you
called me and said you would prefer to do the pavers yourself and canceled the pavers I
ordered.You did not compensate ProBuilders for the demo and prep work we did on the
sidewalk.
Days after we finished the guest bathroom we spoke and you told me you were unhappy with
how some of the glass tile turned out, so we replace the ones you pointed out.We agree to
replace decoration glass in the bathroom,two days after you told me that you prefer hire
another company.
There was another delay in the completion of the master bath caused by a delay in receiving
and installing the cabinets for the master bath and kitchen by the cabinet company you
contracted.This delayed the granite installation that in turn delayed the glass enclosure install.
On May 23 you required me move my people,tools and equipment out of your house.
The Plumbing company was waiting for you to received a missing piece to finish kitchen and call
for final inspection, Mrs. Brenda was supposed to let them known, as of June 6, 2014 they have
not heard from you, neither me.
You hired ProBuilders as the general contractor for the project, but you decided to deal directly
with the Electrical Contractor and HVAC Contractor trying to low costs no paying to me the cost
to coordinate those contractors.You caused many delays with the changes. At one point the
delay caused a conflict with timing of the electrical work and the floor work.The electrical
contractor passed and increased cost on to you based on these delay and you passed the cost
unfairly on to ProBuilders.

We were waiting for the electrician and shower enclosure that you were supposed to contract
to call for final inspection.
The project was done according with the Florida Building Code, Structural engineer Design and
we passed all the inspection required for the City of Atlantic Beach
I will contact the city of Atlantic Beach to close the building permit, because I don't feel
comfortable working in this situation. I am very sorry this project didn't work out the way you
