He saw constriction debris at your client's house at 41 6th St. and stopped to check it out. From this point on the statements of the three people at the scene differ. Mr. Ford stated he asked the painter, Mr. Peterson, while he was outside the house if he could go in and have a look and, according to Mr. Ford, Mr. Peterson agreed. Mr. Peterson said that Mr. Ford"appeared" in the house while he was inside and that he was not aware until that time that Mr. Ford was on the premises. Mr. Larue,the plumber, was outside the house when Mr. Ford arrived and said that Mr. Ford spoke with Mr. Peterson before going into the house. The preponderance of evidence on this matter supports Mr. Ford's version of the event. 2) Mr. Ford went upstairs in Mr. Parham's house and ordered two plumbers in the upstairs bathroom to leave on November 4; According to the statements of the three people on the site on November 4th (Ford, Peterson and Larue), no one else was at the house at that time. 3) Mr. Ford was angry and otherwise unprofessional in his actions; Mr. Larue stated that Mr. Ford polite and"just doing his job". Mr. Peterson said that Ford was not rude, possibly a little "cocky"but just doing his job. The two people working for Mr. Parham have both made statements that dispute this allegation. l 4) Mr. Ford subsequently harassed Mr. Parham on November e by issuing another stop work order and calling the police to enforce it. When a stop work order is issued on a job site, all work must stop. This includes work that may not otherwise require a permit. Painting is included in a stop work order because it covers up un-permitted work that must be inspected. Someone had unlawfully removed the original Stop Work Order put up several days before and all of the proper permits had not yet been issued. It appears to me that the issuance of a second Stop Work Order on November 8`h was the correct step to take. When Mr. Peterson repeatedly refused to stop work at that time, Mr. Ford called a police officer to convince him that he had to stop. This is within the parameters of Mr. Ford's authority as outlined in Section 6-17 (b)(3) of the Atlantic Beach Code. Atlantic Beach has still not received from Mr. Parham his State licensing or insurance documents that would normally be required prior to the issuance of these permits on the condition that they be submitted shortly thereafter. We would appreciate it if you would remind your client that these are still due. After reviewing this letter and Chief Campbell's report, I am confident that you will agree that Don Ford's actions concerning Mr. Parham's construction project were legal, appropriate, professional and courteous. No apology to Mr. Parham is warranted and no reprimand of Mr. Ford will be made. If you have any questions or require any further information please let me know. After discussion of your letter with Mr. Jensen, we concluded that the best way to investigate your allegations was to utilize the City's Deputy Police Chief, John Campbell who has handled numerous internal affairs investigations for the City Police Department and has proven to be knowledgeable of appropriate procedure,thorough and unbiased. Chief Campbell returned his findings to me in a memo dated December 13, 2004. His findings were based on interviews of Mr. Ford, Edward Larue of Turner Plumbing, and Mr. Petersen, the painter working for Mr. Parham. Chief Campbell's findings are summarized in his concluding paragraphs as follows: "No one I talked to would classify Mr. Ford as being rude or audacious in his demeanor towards anyone that was at the site. In interviewing Mr. Petersen he would not classify Mr. Ford as rude or audacious, contrary to what is stated in the letter that Mr. Ford `forcefully and rudely ordered Mr. Petersen to stop all work and leave the premises.' Mr. Ford was described as polite by Mr. Larue, and perhaps a little `cocky' by Mr. Petersen. Both stated he was just doing his job. Accordingly to Mr. Larue and Mr. Petersen,there was no one else present other than them at the time Mr. Ford was there. Therefore,the statement that Mr. Ford `went up the stairs and angrily ordered the plumber to leave the house' does not appear to be valid. Nor the statement that Mr. Ford was seen by two plumbers in the upstairs bathroom, accordingly to Mr. Larue, he was the only plumber working there and according to both Mr. Larue and Mr. Petersen there was no one else present." .y "I cannot find any misconduct by Mr. Ford nor does anyone substantiate that he was rude, or acted overly audacious in his behavior. As to whether he entered a closed house uninvited cannot be sustained. Mr. Ford states he talked with a painter first outside the house and asked if he could enter. As we discussed on November 9, 2004, our office represents William H. Parham, Jr., as Trustee of the William H. Parham, Jr., Revocable Trust, and owner of the above referenced property in Atlantic Beach, with regard to an incident involving Mr. Ford. The facts of the incident are summarized as follows. Mr. Parham purchased his Atlantic Beach residence on October 15, 2004. He then hired a plumbing contractor and employees on his payroll to perform minor bathroom repairs, and he hired a painter, Frank Peterson, to paint the kitchen. On November 4, 2004, Mr. Ford drove by the house, saw the trucks of the painter and plumber, and spoke with a plumber. Mr. Ford proceeded to enter the house uninvited. He walked into the kitchen, where Mr. Peterson had removed the cabinet doors solely for the purpose of painting. Mr. Ford incorrectly assumed that the kitchen was being remodeled. He surprised Mr. Peterson by suddenly appearing in the kitchen, and he forcefully and rudely "ordered" Mr. Peterson to stop all work and leave the premises. Mr. Ford then went upstairs and angrily ordered the plumbers to leave the house. He •then posted a stop work order on the outside of the house. l MARKS GRAY November 12, 2004 Page 2 Mr. Peterson notified Mr. Parham, who called me. I called the City Manager, Jim Hanson, and told him about Mr. Ford's unlawful trespass and entry into Mr. Parham's private residence. On November 5, 2004, I received a telephone call from Mr. Ford, who stated that he was invited into the house by the painter, Frank Peterson. Mr. Ford also told me that he did not go upstairs. He admitted that no permit is needed for painting, but that he was unilaterally stopping all work at the house, including the kitchen painting, because he thought that the plumber needed a permit. My subsequent conversations with Mr. Peterson and Mr. Parham confirmed that Mr. Ford was not invited into the house, was an unlawful trespasser, and was seen by two plumbers in the upstairs bathroom, again uninvited. On Monday, November 8, 2004, Mr. Peterson returned to the house to finish painting the kitchen, but was confronted by Mr. Ford, who demanded that Mr. Peterson leave the property. When he did not, Mr. Ford called for the City of Atlantic Beach police officers. Mr. Peterson was threatened with arrest and jail. He was forced to leave the premises. Incidentally, the plumber had already applied for and was issued a permit to complete the plumbing repairs. It is clear from the above facts that Mr. Ford unlawfully entered a private residence without permission or authority. He then issued a stop work order for painting work which did not require a permit. He then called the police to enforce his improper stop work order, costing Mr. Parham the costs for painting labor while Mr. Peterson denied the opportunity to complete his work. Mr. Ford's conduct is nothing less than unlawful trespass, invasion of privacy, unlawful search and seizure, and abuse of his authority, all of which expose himself and the City of Atlantic Beach to liability for losses and damages. On behalf of William H. Parham, Jr., as Trustee and owner of the above residence, demand is hereby made for the following: 1. That the City of Atlantic Beach issue a formal apology to Mr. Parham and Mr. Peterson. 2. That the City of Atlantic Beach issue a formal Letter of Reprimand to Mr. Don Ford. 3. Again from the field of looking at permits posted on jobsites, I find that those companies which do not have QBN's or COA, if you will, also most times do not have a license number printed on the permit. If the permit issuer were required to put the license number on the issued permit, and the issuer paid attention to the name of the entity requesting the permit to verify tha the entiry was properly licensed, the over-whelming majority of these type problems would disappear. You'd be surprised how many contractors have failed to qualify the company they are contracting in the name of. This becomes a sticking point in trials. Contractors are required to put the license number or QBN on any permit application by 489.119(6)(a & b)and the issuer is required to look at it. This is obviously not happening enough. I've caught licensee holders who never qualified any of the names of their contracting companies and who showed an Occupational License in the name of the contracting company as proof of their QBN during depositions. Prior to the change in 489.128, all of their work was done as an unlicensed contractor by statute. Is there a requirement that license numbers be placed on the issued permit? DRAFT December 28, 2004 Nicholas Pulignano 1200 Riverplace Boulevard Suite 800 Jacksonville, FL 32207 RE: Complaint about City of Atlantic Beach Building Official Don Ford Dear Mr. Pulignano; This is to respond to your second letter about Don Ford's actions as the Atlantic Beach Building Official at the home of Mr. Parham at 416"' St. To clarify my previous answer to your allegations you will find both a full copy of Deputy Chief Campbell's report of his findings attached and your allegations will be individually addressed as follows; 1) Mr. Ford entered Mr. Parham's house illegally on November 4th; As the City Building Official, one of Mr. Ford's responsibilities is to keep an eye out for ongoing construction activity that has not been permitted. He saw constriction debris at your client's house at 41 6t' St. and stopped to check it out. From this point on the statements of the three people at the scene differ. Mr. Ford stated he asked the painter, Mr. Peterson, while he was outside the house if he could go in and have a look and Mr. Peterson agreed. Mr. Peterson said that Mr. Ford"appeared"in the house while he was inside and that he was not aware until that time that Mr. Ford was on the premises. Mr. Larue, the plumber,was outside the house when Mr. Ford arrived and said that Mr. Ford spoke with Mr. Peterson before going into the house. The preponderance of evidence on this matter supports Mr. Ford's version of the event. 2) Mr. Ford went upstairs in Mr. Parham's house and ordered two plumbers in the upstairs bathroom to leave on November 4' allegation ofthethree peopled in your st letter,on the site onut repeated in the second. According to the statements November 4t' (Ford, Peterson and Larue),no one else was at the house at that time. 3) Mr.Ford was angry and otherwise unprofessional in his actions; Mr. Larue stated that Mr. Ford polite and"just doing his job". Mr. Peterson said that Ford was not rude, possibly a little"cocky"but just doing and ad to all for a police officercame to tto explain to Mr. time and ordered work to be stopped Peterson that he must stop work, I am pleased that the tone of their discussion did not escalate into anything more dramatic. 4) Mr. Ford subsequently harassed Mr. Parham on November e by issuing another stop work order and calling the police to enforce it: When a stop work order is issued on a job site, all work must stop. This includes work that may not otherwise require a permit. Painting is particularly included because the result of that work is the final step in covering up un-permitted work that must be inspected. It appears to me that the issuance of a Stop Work Order was the correct step to take and perfectly within the parameters of Mr. Ford's authority. Further,the removal of a stop work order is a violation of City Code. It would have been perfectly reasonable to cite Mr. Parham for removing the stop work orders (twice) if Mr. Ford had chosen a less conciliatory path toward resolution of the matter. After reviewing this letter and Chief Campbell's report, I am confident that you will agree that Don Ford's actions concerning Mr., Parham's construction project were legal, appropriate, professional and courteous. No apology to Mr. Parham is warranted and no reprimand of Mr. Ford will be given. If you have any questions or require any further information please let me know. The applicant has stated that he was unaware a Use-by-Exception was required when he relocated to this property approximately a year-and-a-half ago. Staff advised the applicant that approval of a Use-by-Exception was required before an Occupational License could be issued. This block of West Sixth Street, which is immediately west of Mayport Road, contains a mix of predominantly small warehouse buildings and light industrial and wholesale uses. Most of these businesses are long-existing, but under current regulations would be considered more intense than appropriate for the Commercial General District. Staff cannot find that the existing cabinet shop is incompatible with surrounding uses; however, approval of this Use-by-Exception would not seem to be consistent with long-term goals for the redevelopment of the Mayport Road corridor. The applicant has advised staff that the current location on West Sixth Street may be a temporary location, and that he intends to relocate the business to the expansion of the Rockgarden Enterprises property at 248 Levy Road. A Use-by-Exception for a cabinet shop was approved for that property in August of this year. The Community Development Board considered this request at their November 18th meeting, and recommended approval subject to: • this Use-by-Exception shall be granted to this applicant only, at this location only, and for a period not to exceed eighteen (18) months. Mr. Jackie Russell Bennett introduced himself and apologized for the delinquency in this matter. He advised that he had attempted to apply for a Use-by-Exception several times, but had the submitted the wrong information. He further advised that he had been in this community for 18 years, had run Beaches Woodcraft for 15 years, and started his own company about two-and-a-half years ago. Mr. Wolfson asked Mr. Bennett if there was a possibility that he would be relocating his business. Mr. Bennett responded that he plans to move to another location on Levy Road, where a Use-by-Exception has already been approved for a cabinet shop, once that new building is completed. Mr. Wolfson asked Mr. Bennett if the 18-month limitation proposed by staff was acceptable. Mr. Bennett responded that it was acceptable. Mr. Frohwein asked Ms. Doerr if the letter in the agenda packet from her to Mr. Bennett, which is dated March 06, 2002, was dated correctly. Ms. Doerr responded that it was correct. She stated that this matter came to staff's attention with the transfer of the Occupational License to this location. She further stated that Mr. Bennett moved into this location without realizing that a Use-by-Exception was required. Ms. Doerr explained that this was not an unreasonable assumption for Mr. Bennett to make, since this area contains various other light industrial, warehouse and wholesale businesses, but that it is in fact zoned CG, which requires a Use-by-Exception for cabinet shops. Mr. Bennett cannot obtain an Occupational License without approval of a Use-by-Exception. Mr. Frohwein stated that one-and-a-half years seemed to be an exceptionally long time frame to take to apply for the Use-by-Exception. Mr. Bennett explained that he had filled out the information four times and then got frustrated because he was trying to run his business. Mr. Bennett apologized again stating that he realized it took too a long time and that there was no excuse. A motion to recommend approval to the City Commission of the Use-by-Exception to allow a woodworking and cabinet shop to remain within the Commercial General Zoning District on property located at 41 West Sixth Street was made by Mr. Burkhart, seconded by Ms. Drysdale, and unanimously carried, subject: • This Use-by-Exception shall be granted to this applicant only, for this location only, and for a period not to exceed eighteen (18) months. Chairman Wolfson advised Mr. Bennett that, if approved by the City Commission, this Use- by-Exception was only for this business at this location and it did not move with him to any other location.
