Land Development Regulations. Section 24-17. Definitions. Short term rentals shall mean any residential rental or lease the term of which is less than ninety(90) days. Short term rentals shall similarly be considered to be commercial uses as are Hotel, Motel, Motor Lodge, Resort Rental, Bed and Breakfast or Tourist Court Uses. (Short term rentals are not permitted in a residentally zoned district) Violation Description FBC Section 105 Permit 105.1 Required. Any owner or authorized agent who intends to construct, enlarge, alter, repair, remove, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any required impact resistant coverings, electrical, gas, mechanical or plumbing system, the installation of which is regulated by this code, or to cause any such work to be done, shall first make application to the Building Official and obtain the required permit. The Code Enforcement Board may levy fines up to $250.00 per day for the first violation and $500.00 per day for a repeat violation. If the violation is corrected and then recurs or if the violation is not corrected by the time specified for correction by the Code Enforcement Officer, the case could be presented to the Code Enforcement Board even if the violation has been corrected prior to the Board hearing. Upon completing the corrective action required, it is your responsibility to contact Atlantic Beach Code Enforcement and arrange for an inspection to verify compliance at(904) 247-5855. You have the right to obtain an attorney at your own expense and to present witnesses in your behalf. Mrs. Forsyth said the owner of the property is renting her property out for weddings against city code. Debbie Forsyth said she has talked with you about this issue. Has she and do you have an update? Cmdr Layson I worked a wedding at this address last month, and had a lot of problems between the neighbors and the owner Sarah Bohr(concerning parking on private property). Forsyth said one of her neighbors has a pamphlet about renting the property for a wedding which she believes is against city ordinances. Officer Anderson worked a wedding party on 4/6/14 from 3 pm—7 pm and when I left at 6 pm had not had any issues at that time. Mrs. Forsyth would like a call back from someone concerning this issue. Sarah was handing these out as recently as last weekend. It clearly shows she is offering her property for event rental. It even shows she is renting her condos short term. Even though the last line in the brochure says, "90 day minimum" hopefully the City can read between the lines in the prior paragraph and know that she is being purposefully vague and when someone calls for a short term rental, like a business traveler she explicitly mentions, she tells them short term is ok. She did this twice a few years ago when the City had one of it's police officers call and offer to rent one of the condos short term. She agreed. And while the City did call her before the Code Enforcement Board, it is my understanding she was simply warned not to keep doing it. My tenants are now very aware of this situation with Sarah. My lease with these tenants expires in July. They had expressed an interest in renewing the lease for another year. I am concerned that this situation with Sarah's property could deter them from renewing the lease. They are Mayo doctors with two little girls. Any resident of Atlantic Beach should have peace of mind that their neighbor is not running an "event" business with parties every weekend. Please keep me updated on your investigation.
