Dear Respondent:
The Code Enforcement Board of the City of Atlantic Beach was created pursuant to
Florida Statutes and exists for the purpose of facilitating the enforcement of the Code of
Ordinances. It is comprised of seven citizens of Atlantic Beach who meet regularly to hear
allegations of code violations.
You are hereby notified and ordered to appear at the next public hearing of the Code
Enforcement Board on Tuesday, September 9, 2014, at 6:00 pm at Atlantic Beach City Hall,
Commission Chamber, 800 Seminole Road, to answer and be heard to the following alleged
violations on the property known as Lot S 25FT Lot 2, Lot 3, SEC H Atlantic Beach, Block 235,

International Property Maintenance Code/City Code of Ordinances
Violation Description
Sec. 24-154. Outdoor display, sale and storage of
furniture, household items, merchandise and business
activities outside of enclosed buildings.
(g) Within all residential zoning districts, and also
including any property containing a residential use,
household items, furniture and those items customarily
intended for indoor use shall not be displayed,maintained
or permanently stored outdoors, or in any location on the
lot where such items shall be stored or properly disposed
of to avoid mold, rodent and insect infestations which may
result in health risks and which also create unsightly
appearance that negatively affect neighborhoods. Such
violations shall be corrected immediatly upon written order
from the city.
The Code Enforcement Board may levy fines up to $250.00 per day for the first violation
and $500.00 per day for a repeat violation. If the violation is corrected and then recurs or if the
violation is not corrected by the time specified for correction by the Code Enforcement Officer,
the case could be presented to the Code Enforcement Board even if the violation has been
corrected prior to the Board hearing. Upon completing the corrective action required, it is your
responsibility to contact Atlantic Beach Code Enforcement and arrange for an inspection to
verify compliance at(904) 247-5855.
You have the right to obtain an attorney at your own expense and to present witnesses in
your behalf. If you desire to have witnesses subpoenaed or if you have questions regarding the
procedure,please contact Dayna Williams, Secretary of the Code Enforcement Board within five
days of the receipt of this notice at (904) 247-5810. Please note the presence of a court reporter
for the purpose of insuring a verbatim record in the event an appeal should be secured at your
expense.

In response to your Order Imposing Fine dated January 21, 2614,please be advised that we have
already addressed some of the issues as hand. As you are aware, we recently acquired 132
Belvedere Street along with the other properties referenced above, and immediately went about
taking care of what we could in the short period of time we h ve been in ownership.
Regarding IPMC Sec 302.4,we have cut the grass and shrubs and removed debris; all premises
are compliant. IPMC 304.Secs 10, 12, 3, 6,4, and 7, our intent is to have all these issues
addressed in a timely manner,thus bringing these properties p to code. Within the next few
months we also plan to completely rebuild 131 and 132 Belvedere Street, and to renovate the
others also.
We understand that these properties have been a public nuisa ce and an eyesore to the Atlantic
Beach community; however,we are in the process of making the necessary changes to have them
become an asset to the city. We are requesting that you stop the rolling fines now being
accumulated as we have already shown good i by rectifying the grass, shrubbery, and debris
issues - everything we could do in our short perk -)f ownership. We would also appreciate it if
you would negate any and all fines incurred by th. previous 'wner,Thomas Bennett, as they
would create a hardship and possibly delay us accomplishing our goals for these properties.
We look forward to working in conjunction with you,the City of Atlantic Beach, in
accomplishing everything we have planned for these properties.

ORDER IMPOSING FINE
THIS CAUSE came for public hearing before the Code Enforcement Board on July 8,
2014, and the Board having heard testimony under oath, received evidence, and heard arguments
respective to all appropriate matters, and thereupon issues the Findings of Fact, Conclusions of
Law and Order as follows:
FINDINGS OF FACT
1) That the Respondent Thomas J. Bennett owns the property located at 1365 Rose
Street, Atlantic Beach, Florida.
2) That notice was sent by certified mail and that Respondent was not present at the
hearing.
3) That notification of the violations of the City of Atlantic Beach, were made and
served on the Respondent as evidenced in this hearing.
Sec. 24-154. Outdoor display, sale and storage of
furniture,household items, merchandise and business
activities outside of enclosed buildings.
(g) Within all residential zoning districts, and also
including any property containing a residential use,
household items, furniture and those items customarily
intended for indoor use shall not be displayed,maintained
or permanently stored outdoors, or in any location on the
lot where such items shall be stored or properly disposed
of to avoid mold, rodent and insect infestations which may
result in health risks and which also create unsightly
appearance that negatively affect neighborhoods. Such
violations shall be corrected immediatly upon written order
from the city.
4) The aforementioned property shall be corrected by removal of all outside storage of
items including overflowing trash and recycle containers by July 31, 2014
CONCLUSIONS OF LAW
THAT Thomas J. Bennett is not in compliance and has failed to correct such violation as of this
hearing date.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority
granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic
Beach, Florida it is Ordered:
THAT the Respondent is found in violation for non-compliance and must obtain
compliance on or before July 31, 2014. Failure to comply will result in fines of$100.00 for the
first day and$100.00 for every day thereafter while the violation continues to exist.
THAT the Respondent is responsible for contacting the City of Atlantic Beach Code
Enforcement Officer and obtaining an inspection of compliance.
THAT failure to pay all accumulated fines will result in a lien being placed against the
property at 1365 Rose St or the total assessment plus costs incurred for the filing of the lien. All
lien amounts are to be made payable at an interest rate of ten (10) percent per annum from date
of certification until paid.
DONE AND ORDERED THIS July 8, 2014.

Please be advised, Atlantic Beach Code Enforcement has found your property referenced above
to be in violation of the City of Atlantic Beach, Code of Ordinances, to wit:

Violation Description
Sec. 24-154. Outdoor display, sale and storage of
furniture, household items, merchandise and business
activities outside of enclosed buildings.
(g) Within all residential zoning districts, and also
including any property containing a residential use,
household items, furniture and those items customarily
intended for indoor use shall not be displayed, maintained
or permanently stored outdoors, or in any location on the
lot where such items shall be stored or properly disposed
of to avoid mold, rodent and insect infestations which may
result in health risks and which also create unsightly
appearance that negatively affect neighborhoods. Such
violations shall be corrected immediately upon written order
from the city.
This letter requests that the noted violations be corrected by removing all the outside
storage of junk in the front yard within ten (10) days of the receipt of this notice.

To avoid having this case be referred to the Code Enforcement Board, all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
Enforcement. The Board may impose fines up to two hundred fifty($250.00)per day for
continuing violations.Upon completing the corrective action quired, it is your responsibility to
contact Atlantic Beach Code Enforcement and arrange for an' pection to verify compliance.
It is our goal to keep our neighborhoods looking well maintained while protecting property

Dear Respondent:
The Code Enforcement Board of the City of Atlantic Beach was created pursuant to Florida
Statutes and exists for the purpose of facilitating the enforcc ment of the Code of Ordinances. It is
comprised of seven citizens of Atlantic Beach who meet regularly to hear allegations of code
violations.
You are hereby notified and ordered to appear at the next public hearing of the Code
Enforcement Board on Tuesday, July 8, 2014, at 6:OD pm at Atlantic Beach City Hall,
Commission Chamber, 800 Seminole Road, to answer and be heard to the following alleged
violations on the property known as Lot S 25FT Lot 2, Lot 3, SEC H Atlantic Beach, Block 235,

business activities outside of enclosed buildings.
(g) Within all residential zoning districts, and also including any property containing a residential
use, household items, furniture and those items customarily intended for indoor use shall not be
displayed, maintained or permanently stored outdoors, or in any location on the lot where such
items shall be stored or properly disposed of to avoid mold, rodent and insect infestations which
may result in health risks and which also create unsightly appearance that negatively affect
neighborhoods. Such violations shall be corrected immediat y upon wri tten order from the city.
The Code Enforcement Board may levy fines up to $250.00 per day for the first violation
and $500.00 per day for a repeat violation. If the violatio t is corrected and then recurs or if the
violation is not corrected by the time specified for correction by the Code Enforcement Officer, the
case could be presented to the Code Enforcement Board even if the violation has been corrected
prior to the Board hearing. Upon completing the corrective ction required, it is your responsibility
to contact Atlantic Beach Code Enforcement and arrange for an inspection to verify compliance at
(904) 247-5855.

You have the right to obtain an attorney at your own expense and to present witnesses in
your behalf. If you desire to have witnesses subpoenaed or if you have questions regarding the
procedure, please contact Dayna Williams, Secretary of the Code Enforcement Board within five
days of the receipt of this notice at(904) 247-5810. Please note the presence of a court reporter for
the purpose of insuring a verbatim record in the event an apf eal should be secured at your expense.

RECOMMENDATION: Staff recommends the Board find the property owner in
violation and order that compliance be achieved by removal of all outside
storage of items including overflowing trash/recycle containers by July 31, 2014
or a fine of$ 100.00 will be imposed for the first day and $100.00 for every day
thereafter the violation continues to exists. The property owner is responsible
for contacting the City Code Enforcement Officer and obtaining an inspection of
compliance.
