Please be advised, Atlantic Beach Code Enforcement has found your property referenced above
to be in violation of the City c,s'Atlantic Beach, Code of Ordinances, to wit:
VIOLATION
Violation Description
IPMC 302.4 Weeds.
All premises and exterior property shall be
maintained free from weeds or plant growth in excess of
twelve(12) inches. All noxious weeds shall be prohibited.
Weeds shall be defined as all grasses, annual plants and
vegetation, other than trees or shrubs provided; however,
this term shall not include cultivated flowers and gardens.
Violation Description
Sec. 24-154. Outdcor display, sale and storage of
furniture, househol_a items, merchandise and business
activities outside c` nclosed buildings.
(g) Within all resi��-ntial zoning districts, and also
including any propi°rty containing a residential use,
household items, furniture and those items customarily
intended for indoor use shall not be displayed, maintained
or permanently stored outdoors, or in any location on the
lot where such items shall be stored or properly disposed
of to avoid mold, rodent and insect infestations which may
result in health risks and which also create unsightly
appearance that negatively affect neighborhoods. Such
violations shall be corrected immediately upon writterfi order
from the city.
Violation Description
Sec. 16-3. - Garbage and trash containers.
(b) Set out and storage. No person shall place a
container or yard waste in front of a residential unit i
which he does not reside. Nor shall containers of yar
waste be placed in a city park or right of way adjoining a
park or in a road median. Garbage containers set out 1br
garbage collection shall be placed at the curb of the
street from which garbage service is rendered except as
otherwise provided herein. Garbage containers shall be set
out no earlier than 6:00 pm the day prior to collection and
shall be returned to their regular place of storage no
later than 12:00 midnight on the day of collection. Y rd
waste such as leaves or grass clippings shall be set out in
a yard waste receptacle, no sooner than two (2) days prior
to collection. Bulk(uncontainerized) yard waste such as
tree limbs or palm fronds may be set out when gener ted.
Garbage container blinds, which are in architectural
harmony with the building, or underground containers may be
placed anywhere between the building and the street lbr
which garbage service is rendered,but in no case sh
they be located on public right of way or public property.
If garbage is stored underground or behind a garbage
container blind that is not located at the curb,the
garbage container must be moved to the curb for pick up.
Any residence or commercial unit to which this section
creates a hardship to either the resident of the property or
the franchisee for placement of containers for garbage
service shall apply:to the public works director or his
designee, who shall thereupon determine the location at
which garbage containers shall be placed. Garbage
containers located other than as described in this section
shall not be emptied. In cases where lots run from str et
to street, the provisions of this section applicable to
front yards shall also apply to rear yard.

This letter requests that the noted violations be corrected by removing all unlicensed
vehicles, store garabage and recycle containers out of sight, remove all outside storage in
front, side and rear yards and mow the overgrown yard within ten (10) days of the receipt
of this notice.
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
Enforcement. The Board may impose fines up to two hundred fifty($250.00) per day for
continuing violations. Upon completing the corrective action required, it is your responsibility to
contact Atlantic Beach Code Enforcement and arrange for an inspection to verify compliance.

Good morni :)t received a response to a telephone call I have

Hibiscus St. ig my home due to a job opportunity in another area
of the country. I am writing because the iium� --or to my home, 1065 Hibiscus, is being rented to
people who are in violation of codes on the books for Atlantic Beach. The first thing that I want to point out is
the fact that the garbage cans and recyclable containers stay out by the road 24 hours a day, 7 days a week.
This is a violation of a code currently on the books and in the past is something that has been enforced.
Second, they have a small dog who is always off leash and, at times, has come into my yard barking at me.
He is doing that to potential buyers as well. There are many people living at that property and I am often
unaware of who actually lives there because so many people come and go at all hours. People sometimes
sleep in cars on the property. This home does not have central heat or air, the yard is overgrown in the rear
and there are 10 garbage bags full of beer/soda cans littering the back yard. There is drug use and sale of
drugs taking place on the property. The house is listed as foreclosed by JP Morgan Chase and may be
inhabited illegally. I have had feedback from Realtors that specifically identified the neighbors as a barrier to
the sale. When I bought my home in Atlantic Beach behavior such as this was not tolerated. I have put up with
the behavior for the past 2 years in hopes that the house would be purchased by someone who was not a
slumlord, since it was heading toward foreclosure. I am well aware of the view that those of us who live on
the west side of Mayport road are the "black sheep" of the city (despite several commissioners residing on the
west side) but feel that the Atlantic Beach city council and the code enforcement division in particular is
failing in its responsibility to the citizens of the West Beaches who see the value in the area. As a taxpaying
citizen of the city of Atlantic Beach I would appreciate a response to my complaints.

I met Ms . Kelley ' s daughter at the property this afternoon. I
spoke to the next door neighbor/resident at 1065 and issued a
"courtesy notice" on several items/violations , i . e .
2 unlicensed vehicles , garbage containers stored at the curb,
outside storage of household items , plywood, tables , misc . junk
in the front yard, side and rear yards , pallets in alcove
between units and overgrown yard. I asked him to corrected all
the violations within ten days from today and call me when he
finishes correcting all the violations . I will go by whether he
calls me or not to verify compliance after the 10 days . If
there are any remaining items that have not been corrected I
will send a certified letter to the property owner . (The
property is in foreclosure (lis pendens) according to the clerk
of court property records . If I send the property owner a
certified letter I will send a copy to the mortgage company and
their property maintenance provider.
I called Ms . Kelly when I left the property and gave her all the
above information .
