If you suggest I pay rent, under the law as I understand it, I would be condoning the practices occuring here at Sea Oats, which I do not. The roofs need pictures on file, the police records should all be pulled, the health department should be interviewing people with small children, the elderly, the disabled - like myself and the indigent. That the Respondent Sea Oats Acquisitions, LLC owns the property located at 900 Plaza, Atlantic Beach, Florida. 2. That notice was sent by certified mail and that Jennifer Mathis, with American Management Group, owner of Sea Oats Acquisitions, was present at the hearing. 3. That notification of the violations of the City of Atlantic Beach, were made and served on the Respondent as evidenced in this hearing. IPMC Sec.304.10 Stairways, decks, porches and balconies. Every exterior stairway, deck, porch and balcony, and all appurtenances attached thereto, shall be maintained structurally sound, in good repair, with proper anchorage and capable of supporting the imposed loads. IPMC Sec. 304.12 Handrails and guards. Every handrail and guard shall be firmly fastened and capable of supporting normally imposed loads and shall be maintained in good condition. IPMC Sec. 304.4 Structural members. All structural members shall be maintained free from deterioration, and shall be capable of safely supporting the imposed dead and live loads. 304.7 Roofs and drainage. The roof and flashing shall be sound, tight and not have defects that admit rain. Roof drainage shall be adequate to prevent dampness or deterioration in the walls or interior portion of the structure. Roof drains, gutters and downspouts shall be maintained in good repair and free from obstructions. Roof water shall not be discharged in a manner that creates a public nuisance. 305.4 Stairs and walking surfaces. Every stair, ramp, landing, balcony,porch, deck or other walking surface shall be maintained in sound condition and good repair. 4. The aforementioned property shall be corrected by obtaining permits by a State of Florida licensed contractor to make and complete all required repairs and obtain an approved final inspection. CONCLUSIONS OF LAW THAT Sea Oats Acquisitions, LLC is not in compliance and has failed to correct such violation as of this hearing date. ORDER Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach, Florida it is Ordered: THAT the Respondent is found in violation for non-compliance and must obtain compliance on or before June 30, 2014. Failure to comply will result in fines of$100.00 for the first day and $100.00 for every day thereafter while the violation continues to exist. In addition, any fine shall also include the administrative costs to the City incurred in prosecuting this case. THAT the Respondent is responsible for contacting the City of Atlantic Beach Code Enforcement Officer and obtaining an inspection of compliance. THAT failure to pay all accumulated fines will result in a lien being placed against the property at 900 Plaza for the total assessment plus costs incurred for the filing of the lien. All lien amounts are to be made payable at an interest rate of ten (10) percent per annum from date of certification until paid.
