Mayor Woods called the meeting to order at 6:31 p.m. Mayor Woods began by asking for a moment of
silence for a friend of the City, Pete Rodrigues, and his family. She gave the Invocation, followed by the
Pledge of Allegiance to the Flag.

Approve the minutes ofthe Special Called Workshop of September 29, 2014.
Mayor Woods asked ifthere were any corrections to the above minutes. There were no corrections, so Mayor
Woods stated the minutes will stand as submitted.
2. Courtesy of Floor to Visitors
Mayor Woods opened the Courtesy of the Floor to Visitors. She welcomed the audience and explained the
process for public comments.
Brian Vonn, 1209 W. Plaza, spoke in support of the City purchasing the Bennett property.
Steve Fouraker, 387 6th Street, spoke in support of the City purchasing the Bennett property.
Cheryl Vonn, 1209 W. Plaza, spoke in support of the City purchasing the Bennett property.
John November, 647 Beach Avenue, as the attorney representing the Bennetts, spoke in support of the land
purchase.
No one else from the audience spoke, so Mayor Woods closed the Courtesy ofthe Floor to Visitors.
3. Unfinished Business from Previous Meetings
A. Selection of Architect/Engineer Services for Police Building Expansion and Remodeling.
Public Works Director Doug Layton summarized his staff report stating staffs recommendation, after their
evaluation. was to choose Clemons Rutherford and Associates (CRA) to continue on with the construction
management method the Commission selected.
Motion: Authorize staff to negotiate with the firms in order of their rankings for Architectural and
Engineering Services for design of the expansion and remodeling of the Police Facility and authorize
the City Manager to sign an agreement with the selected vendor to perform these services in an amount
not to exceed $200,000.

A. PLAT-14-00100036 (Atlantic Beach Country Club)
Building and Zoning Director Jeremy Hubsch summarized his staff report stating this is Unit 2 of the Atlantic
Beach Country Club platting, which is for the remaining 161 lots. He showed slides of the plat (which is
attached and made part of this Official Record as Attachment A). He further stated they have been working

with the developer to get an easement for Sherman's Creek to give us long-term access to the creek for
maintenance, dredging, etc. in case it silts up in the future. He stated this will be coming before the
Commission on 1 0/27/14 for a final vote. Mayor Woods requested the charts be attached to the minutes so
they become public record.
Mr. VanLiere stated he spoke with Karen Bowling, City of Jacksonville, who stated they were going to begin
to propose our annexation with the people downtown. Mr. Komando stated they have been working on it,
and he believes we are just waiting on that fmal approval before it is submitted to the City Council.
Discussion ensued.
It was consensus of the Commission to move this forward to the next meeting for a vote.
B. Bennett Property Discussion
Public Works Director Doug Layton summarized his staff report showing a slide of the property and the two
retention ponds. Discussion ensued regarding the two ponds.
It was the consensus of the Commission to continue discussion regarding the City acquiring the property and
to put it on the next agenda under Miscellaneous Business.
C. Tree Protection Report
Mr. Hubsch summarized his staff report and presented slides on the Tree Ordinance providing history on the
Tree Code; when Tree Permits are required and when there are exemptions; the Tree Mitigation Standards;
Tree Protection Results 2013-present; Possible strengthening of the Code; Historic Corridor Designation;
Rebuilding the Tree Canopy and the Tree Canopy Program. Discussion ensued.
Mr. VanLiere stated the plan is to tweak the Code with all the things Mr. Hubsch has discussed, to create a
priority list of locations to put trees, and enforcement related to the mitigation, i.e. survivability of the
plantings and compliance with the Code after the fact. Mr. Hubsch also stated he would like to have an
Atlantic Beach Garden Club established. Mayor Woods stated they need consensus to have staff follow the
plan outlined by the City Manager and get back to us. Mr. Hubsch stated he will talk to the Community
Development Board and come back with something more concrete and formal to present to the Commission
and start talking about actual Code changes. Mayor Woods asked how long the process will take before it
will come back before the Commission. Mr. Hubsch stated he can get it on the November Community
Development Board meeting and could bring this back late November or early December. Further discussion
ensued.
9. City Manager
A. City Manager's Report.
• 90-Day Calendar (August-October 2014)
City Manager Nelson Van Liere reported there will be a workshop for the Community Redevelopment
Agency (CRA), which was not on the calendar. He stated it will be held on 10/27/14 at 4:00p.m. He stated
Steve Lindorfffrom Jacksonville Beach and Carol Westmoreland from Florida League of Cities will present a
CRA 1 01 class.

He reported he met with City of Jacksonville (COJ) regarding the tipping fee and believes they have reached
an agreement. He stated he and Mr. Komando will put it on paper and then send it to COJ so they can agree
it is what they agreed on and will bring it back to the Commission.
He reported the fountain is now installed and working at Mayport and 4th.
He stated the Dog Park at Rose Park now has a scanner at the gate to let people in and out so people now
have to come pay to join the park.
He stated he believes all the staff have met with the grant writer.
He reported Friends of Atlantic Beach Elementary did get the track installed a while back.
He stated they are waiting for the final letter regarding the FIND grant for the Marsh Master Plan's two
overlooks and the kayak launch which will be funded at $150,000.
He stated both the Police and Blue Collar Unions will have an agreement on the wages that were approved in
the budget.
Reported Timmy Johnson will now be on the General Employees Pension Board.
At Mr. VanLiere's request, Mr. Hubsch reported on the Beaches Bike Path Study stating the North Florida
TPO funded the study. He answered questions from the Commission. Discussion ensued.
At Mr. Van Liere's request, Mr. Layton recapped his neighborhood meeting on the Seminole Streetscape
Project, stating they have reduced the proposed on-street parking as a result of comments received from
citizens. Discussion ensued. Mr. Layton answered questions from the Commission. Further discussion
ensued regarding curbs, with Commissioner Hill stating he prefers rounded Miami curbs rather than the 8"
standard curbs. Mr. Layton explained a bioswale. Commissioner Mark suggested planting muhly grass
instead of curbs.
10. Reports and/or requests from City Commissioners and City Attorney
Commissioner Mark
• Reported on her attendance at the FLC Policy Committee, stating the two matters they are going to
bring before the legislation are the developments of regional impact and the enterprise zones.
• Expressed her appreciation for the Citizens Police Academy, stating it is a fabulous course. She stated
it should almost be mandatory that any elected official attend this. She stated besides being fun it is a
great way for the elected officials to get to know our police department and see what they do and how
they do it every day. She stated, as an elected official it has given her a whole new respect and
consideration of what their needs are and what they need to really protect our community and give us
that level of service they provide to us. She stated all the citizens should take this course; it is a way
for them to meet their police officers who are doing an extraordinary job.

• Stated he will not be here for the November lOth meeting nor will he be here on November 11,
Veterans Day. He stated for the last five years he has attend the Veterans Day celebration in

would like to identify some funds to have it looke d at by a professional. Mayor Wo ods stated she
be lieves it is way Ollt of our hands and we sho uld con tac t EPA or w hoeve r to take care of it. Mr. Van
Liere stated he checked out the problem and he co uldn 't be lieve it ; th ey are everywhere. He s tated h e
heard they are pyramid ants. Mayor Woods asked Mr. Van Liere to contact the appropri ate people.

• Stated he wo uld li ke to pursue the Tree City designation and find out what that wou l d e nt ail. Mr.
llubsch read the criteria and stated he would send it to the Commission.

because it has been sent back to the City for re-review. He wou ld s ugges t a time before a
Co mmi ssion meeting in Nov~mber to schedule a specia l meetit1g so they can comp ly with th e court's
ord er and ha ve the follow-up hearin g. I lc stated he would hope they co u ld reso lve this in about an
hou r but after he speaks wit h opposing counci l they may need more time. He stated he would llkc
them to schedu le th e time an d then at th e next meetin g if there is a problem, he will let them know. Jt
was the consensus to sched ul e this meetin g on 11 /24/14 at 5:00p.m.

eva lu ation for the City C le rk City Attorney and the City Manager and in light of the fact that th ey are

eva lu ation too l prepared prior to th ei r las t set o f in terviews. He stated it is ge nera ll y a good idea to
have expecta tio ns se t for the person who is com in g int o th e job as fa r as what th ey are go in g to

the Committee members for their informational purposes. He s tate d everything th at is decided by the
Co mm ittee will come to th e Commission for rev iew and the Comm iss ion wi ll decide wh ich
recomme nda ti ons they want to keep and those t hat are app roved will be put on the ballot. Discussion

• Reminded everyone that on 10/24/14 they are having the City Manager interviews and anyone in the
public is welcome to come. She stated they will be asking each applicant predetermined questions
and listening to their answers at that meeting.
• Reminded everyone that there is a Town Hall meeting this Saturday, 10/18/14 at 10:00 a.m. in the
Chamber and Commissioner Mark will take the minutes.
• Stated, related to the conversation Commissioner Daugherty brought up at the last meeting about the
buy-out of the pension plans, she did a search and it is a complicated subject but is something they
might want to consider. She stated usually not every employee takes the buy-out, it is a very personal
decision depending on their situation, but she would like them to see if it is a good fit and if it would
help the City or some of the employees at all for both police and general employees pension plans.

Pancreatic Cancer Awareness Month in the City of Atlantic Beach
WHEREAS, in 2014, an estimated 46,420 people will be diagnosed with pancreatic cancer in the United States
and 39,590 will die from the disease; and
WHEREAS, pancreatic cancer is one of the deadliest cancers, is currently the fourth leading cause of cancer
death in the United States, and is projected to become the second by 2020; and
WHEREAS, pancreatic cancer is the only major cancer with a five-year relative survival rate in the single digits
at just six percent; and
WHEREAS, when symptoms of pancreatic cancer present themselves, it is generally late stage, and 73 percent of
pancreatic cancer patients die within the first year of their diagnosis while 94 percent of pancreatic cancer patients die
within the first five years; and
WHEREAS, approximately 2,890 deaths will occur in Florida in 2014; and
WHEREAS, the Recalcitrant Cancer Research Act was signed into law in 2013, which calls on the National
Cancer Institute to develop a scientific framework, or strategic plans, for pancreatic cancer and other deadly cancers,
which will help provide the strategic direction and guidance needed to make true progress against these diseases; and
WHEREAS, the Pancreatic Cancer Action Network is the national organization serving the pancreatic cancer
community in the City of Atlantic Beach and nationwide through a comprehensive approach that includes public policy,
research funding, patient services, and public awareness and education related to developing effective treatments and a
cure for pancreatic cancer; and
WHEREAS, the Pancreatic Cancer Action Network and its affiliates in the City of Atlantic Beach support those
patients currently battling pancreatic cancer, as well as to those who have lost their lives to the disease, and are committed
to nothing less than a cure; and
WHEREAS, the good health and well-being of the residents of the City of Atlantic Beach are enhanced as a
direct result of increased awareness about pancreatic cancer and research into early detection, causes, and effective
treatments.
NOW, THEREFORE, I, Carolyn Woods, Mayor of the City of Atlantic Beach, in recognition ofthis important
initiative, do hereby proclaim the month ofNovember 2014 as Pancreatic Cancer Awareness Month in the City of Atlantic
Beach.

Three carriers responded with proposals to provide basic life insurance to our
employees: Standard, Lincoln and United HealthCare. Standard and Lincoln both
proposed a 12% increase in costs over the current year for the same coverage ($1 ,063
annual premium increase), but United proposed a 59% increase, so I recommend
staying with Standard, which has a robust Employee Assistance Program of which
many employees and their family members have taken advantage.
VOLUNTARY BENEFITS:
The benefit package includes voluntary products that are 100% paid by the employee.
Employees may elect dental, vision, short and long term disability and supplemental
life insurance and pay 100% of the premium.
Dental:
There are four major dental carriers in our area: Guardian (incumbent), Lincoln,
United HealthCare and UCCI. Guardian's proposal represents a 9.3% increase in
premiums for the same coverage provided this year, while United HealthCare's
proposal represents an overall savings of 6.5% in premiums over this year's. I
recommend going with United HealthCare.
Vision:
Three carriers responded with proposals to provide voluntary vision insurance:
Humana (incumbent), United HealthCare and Lincoln. Humana proposed a 3%
increase in premiums for the same coverage, while Lincoln's was a 10% increase.
United HealthCare proposed slightly better benefits with a slight decrease in
premiums, but they have a greatly limited network of pmiicipating providers, so I
recommend that we remain with Humana.
Supplemental Life:
Three carriers responded with very similar proposals for voluntary life insurance:
Standard (incumbent), Lincoln and United HealthCare, so I recommend staying with
Standard.
Short Term and Long Term Disability:
Two carriers responded with proposals to provide our employees with voluntary
disability insurance: Lincoln (incumbent) and United HealthCare. Lincoln's proposal
was substantially better, so I recommend staying with Lincoln.
If these recommendations are approved, the total savings to the City for premiums
paid for health insurance, over those paid this year, is $23,893, which is
$181,4 72.12 under the amount budgeted. The cost to the City for basic life
premiums over those paid this year will increase by $1,063.
RECOMMENDATIONS:
1. Approve all employee insurances listed below effective January 1, 2015 through December 31,
2015.

BACKGROUND: In 2002, the City of Atlantic Beach re-wrote its sign code, which reduced the
maximum height for fi·eestanding signs from 25 feet to 8 feet, increased the maximum sign width from 10
feet to 12 feet, and increased the maximum sign area from 80 square feet to 96 square feet. At the time
these changes were enacted in 2002, there were 79 freestanding signs that exceeded the eight-foot height
limit. These signs were then given ten years to come into compliance with the new code changes. In 2011
that ten year amortization period was extended to January 1st 2015 in order to be consistent with Neptune
Beach's amortization. One thing that was not contemplated at the time of that extension is the fact that the
date for Jacksonville's sign amortization for Mayport Road is 2018.
Sign amortization is sometimes described as more of a postponement than a solution. The legal theory
underpinning amortization is that the local government has placed the property owner on notice, and has
provided sufficient time for the property owner to realize a return on his or her investment so as to avoid a
deprivation of due process rights. Ultimately, amortization is a "balancing test" that weighs the private
cost against the public gain. In doing research, it appears that ten years is generally accepted as a
reasonable period to allow owners to realize the return on their initial sign investment. Numerous courts
in Florida and across the country have upheld a municipality's ability to regulate non-conforming signs
through the amortization process.
The code changes enacted in 2002 created situations where a sign would need to be replaced, such as:
abandonment, weather damage, alteration of more than 25% of materials (see Exhibit 1 for full list). Since
2002, the amount of non-confonning signs in Atlantic Beach has been reduced from 79 to 54. In that
same time period, 19 new free standing signs have been constructed that meet the eight foot height limits
and all other sign codes. Twelve of these signs are on Atlantic Boulevard and seven are on Mayport Road.
As you can see on the map in Exhibit 2, the majority of the new confonning signs on Atlantic Boulevard
are between Sailfish Drive and Aquatic Drive. Thirteen of fifteen signs between Seminole Drive and the
Town Center are non-confonning (Exhibit 3). On the Neptune Beach side of Atlantic Boulevard, there are
only five non-confonning signs between Seminole and the Town Center. Given property values in this
area and market demand, asking businesses to come into compliance may not be as difficult as it will be
on Mayport Road.
There are cunently 29 nonconfonning signs in the Atlantic Beach portion of Mayport Road. Staff was not
able to detennine how many non-conforming signs there are in the city of Jacksonville portion of
Mayport Road. Based on visual analysis of the corridor, it is clear that the amount is substantial. The City
of Jacksonville's sign amortization for Mayport Road is not scheduled to occur until20 18.
Staff Recommendations: Staff has several recommendations. The first is to sync amortization up with
both Neptune Beach and Jacksonville. Neptune Beach extended theirs until the fall of 2014, while

Jacksonville's will not occur until 2018. This proposal means keeping the scheduled 2015 amortization
for Atlantic Blvd, while extending Mayport Road's until 2018 to match Jacksonville's portion of the
corridor. If businesses on both corridors are required to come into compliance by January, I st 2015, it will
greatly exhaust staff resources and time. By staggering the amortization, staff can focus on Atlantic
Boulevard and then use that experience to work with businesses on the Mayport Corridor to prepare for
2018. There is also no denying that right now there is a major difference in tenns of aesthetics, rent
prices, and property values between Atlantic Boulevard and Mayport Road. As the gateway to the beach
and Town Center, the commission may decide to hold Atlantic Boulevard to a higher standard than
Mayport Road.
In looking at how other municipalities have handled sign amortization, it was found that the use of
incentive programs has greatly eased the contentiousness of the process and speed their removal up. Staff
would like to ask for money in next year's budget to create an incentive program for owners of non-
confonning signs on Atlantic Boulevard. This program could help offset the costs of removal/alteration.
Generally 50/50 matches are the standard for these types of programs. Staff estimates that roughly 8 of
the 25 non-confonning signs on Atlantic Boulevard can be reduced by cutting the sign pole, 2 can be
corrected by minor alterations, and 8 through major alterations. The remaining seven would likely need
total replacement.
Extending the amortization to 2018 for Mayport, would also give staff time to try to create an incentive
program for non-confonning signs there and to start working proactively with businesses. There is the
possibility of using future CDBG funds for a sign removal program. Additionally, the city may explore
the creation of a CRA along the Mayport Road corridor, which would be another mechanism to fund an
incentive program. Given the current market conditions, and lack of a long tenn redevelopment plan, staff
believes it is in the best interest of all parties to delay amortization to 2018 for Mayport Road.
Staff would also like to use this opportunity to consider making changes to the sign code that relate
specifically to amortization. One of those is to create specific standards that would allow non-conforming
signs to be granted a waiver. Currently, the code states that a waiver can be sought, but does not have
established criteria for when one should be granted. Another possible change is to require that non-
confonning signs come into compliance when a substantial redevelopment happens on a property.
Currently the code only requires a sign come into compliance if there are any changes to the sign itself,
but does not require it when any other improvements occur on a property. If amortization is extended to
2018 along Mayport Road, this provision would ensure more businesses come into compliance with sign
codes prior to the deadline.
BUDGET: None.
RECOMMENDATION: Request that staff draft an ordinance that amends the existing sign code
to extend amortization to 2018 for Maypmt Road; establishes specific standards for the granting of
waivers; and requires non-conforming signs to come into compliance when substantial renovations occur
on a property.

A ll s ign s , which wer e lawfully in existence and constructed or in sta lled with properl y issued sign
perm its as of the effective date of these amended regu lations, a nd which are made non con f orming by the
provision s herein sha l l be allowed to remain in accordance with th e fo ll owing conditions:
(1) Freestan ding signs, permitted pursuan t t o section 17-29, made nonconforming upon the in itia l
effective date of these amended regu la tions, which are not in com pliance only with respect to
the minimum requi red distance of fi ve (5) fee t from a ny property lin es sha ll be allowed to r ema in
in the exi sting lo ca tion provided th a t no portion of the sign is loca ted Within any publicly owned
right-of-way or utility easement an d that no interfer ence Wit h clear sight distance exists, and
further provided th at such sig ns are otherwise in complia nce with the terms of th is chapter.
(2) Freestanding s i gns, permitted pursuant to sectio n 17-29, made n onconformin g upon the initi al
effec ti ve date of these a mend ed re gulation s, which are not in complian ce with respect only to
maximum width, he igh t or size shall be allowed to remain, p rovided that such signs are
otherwise in co mplia nce wi th th e terms of thi s ch apte r.
(3) Nonco nforming s ign s, incl uding th ose as described In preceding paragraphs (1) and (2) s ha ll be
made conformi ng w ith all provisions of this chapter w hen any of th e f ollowing changes a r e
made:
a . A ny change to the stru c tu ral suppo rt s or structura l materials, including te rn porary
re location associated with r outine maint enance of a property.
b. Any change w hic h increases the illuminatio n.
c. Any change w hich in cr eases the height of a sign.
d. Any change, w hich alter s the materia l used f or the d isplay area or face area by more than
twenty-five (25) percent.
e. Any replacement r equired as the result of an accidenta l act or a weath er-relat ed act.
f. Any replacement of an aba nd oned sign.
g. A ny change necessary for compliance with Florid a Building Code requirements.
(4) The provisions o f this section s hall not be co nstru ed to apply to signs th at are abandon ed,
deteriorated, dilapid ated, or in a gener al s ta te of d isrepair, or which are determined to create a
hazard t o public safety. Such signs shall be subj ect to the provisions of sectio n 17-33
(5) Notwithstanding the preceding prov ~s i o ns of paragraphs (1) through (4), all sign s p ermitted
w ithin commerc ial and industri al zoning districts, pursuan t to section 17-6 of thi s cha pter, shall
be made to conform with the provisio ns of this chapter, as m ay be amended on or before
January 1, 2015.

Requests to waive terms of this chapter may be made upon specific application to the city
commission, with proper public notice required, provided that no waiver shall be requested that would
allow a prohibited sign, or any otherwise unlawful sign. The applicant requesting such waiver shall have
the burden of demonstrating the need for the requested waiver, and that the waiver is not in conflict with
the intent of this chapter. The terms of any waiver to the provisions of this chapter shall be established by
order of the city commission.

The City Clerk is "appointed" with the City Commission
establishing the salary each year.

In past years, pay raises for the City Clerk have been consistent
with those given to other non-union general employees.
Based on the approval of the 2014-2015 budget proposed by the
Interim City Manager, general employees will be given a 3% (of
midpoint) increase effective 1011/2014.
The City Clerk position is not included in the Pay Scale, therefore,
no classification, grade or pay range was determined or approved
for the position.
BUDGET: Sufficient funds are included within the budget.
RECOMMENDATION: Approve a salary increase of3% for the City Clerk retroactive to
10/1/14.

BACKGROUND: At a Commi ssion bud get workshop in August, the City received a request
that th e City co ns id er acquiring a portion of th e Bennett property at Ca melia Street and
W. 3'd Stree t (near the Tideviews Preserve). The rationa le proposed by th e resid ents
was con se rvation of marsh front property to avoid potential future development. The
p ro posal soug ht to tie the parce l to Tideviews Preserve by improving access a lon g t he
north end s o f the Jasmin e and Begonia (FOOT) Street ponds.
Recently the Commission asked staff to prepare a possible layout of th e Bennett parce l in
relation to Tideviews Preserve a nd t he p ond s. S taff st arted from an exhibit within the
Marsh Master Pl a n a nd expanded t he exhibit north a nd east to in clude both ponds a nd
the Be nnett prope rty . Thi s expa nd ed layout is includ ed as Atta c hm e nt 1 a nd includes
additional options beyond those shown in th e Tideviews Marsh Master Pl an .
A survey showin g the proposed acq ui sition i s included as Attachment 2 .
Attachment 3 discusses considerations for preparing a n appraisa l va lue of t h e property.
A lso included a re three options for marsh access for differin g co nfi g uratio ns o f Bennett property
purchase.

Comments About Value for Private Purchase of Bennett Property:

• West facing portion of the Bennett property is 70 by 100. It is likely comprised of
wetlands, and therefore very difficult to build on.
• A natural vegetative buffer of 50 feet must be maintained from tributaries, streams, or
other water bodies connected to the Intracoastal. The buffer must start at mean high
water line. The property is adjacent to a water body that is connected to the Intracoastal.
• A 25 foot natural vegetative buffer must be maintained between all jurisdictional wetlands
and development. The rear of this site is likely wetlands.
• Section 24-256 of the COAB code states that all lots shall have satisfactory and
permanent access to a paved public street. The rear of this property currently has no
access to a paved public street.
Because of these limitations, the property has a reduced value for residential
development. It is quite likely that the only use for this property is as a backyard for
current residents, or as conservation/park space for the public. Therefore, in Staff's
opinion all discussion for the acquisition should be in terms of its resale value as
conservation land, not buildable residential property. Additionally, a residential property
on the same block is for sale for $50,000. The lot is 50 by 1 00; however, it does not
have marsh view. So even if the property is buildable for residential, it is likely worth
less than appraised value provided by the residents.

Option 1. This shows the possibilities for the site if COAB doesn't acquire add iti onal
land . The access to the ponds and Tideviews Preserve proposed by the residents
co uld be provided entire ly within the City's West 3rd Stand J asmine Street rights of way
and would not require an easement, but would requ ire a small elevated walkover where
the access point has to cross a small section of wet lands/marsh.

Option 2. The portion in red is th e rear portion of the Bennett property. Acquiring this
portion would allow access to the marsh from Camelia without an elevated walkover. It
would also add additional green space if the City wants to expand Tideviews Prese rve .
