Catherine, the 50 % impervious surface limit is a zoning requirement, not stormwater related. Any resident,
regardless of total lot coverage, adding 400 SIF or more new impervious surface has this requirement. The
Public Works Director has the authority to waive this on-site storage requirement if determined to be
unnecessary or unattainable, but this exception was never approved while I was PW Director. Your mother in
law could ask the City Commission for a waiver of the requirement, but they have not approved any requests in
the past, and it would not be able to be approved before January, because there is only one Commission
meeting in December, and it would be very hard to get the request on the agenda for that meeting.

Thank you for the info.This house was purchased in short sale in 2012 with limited info.The pool itself has an underground storage
tank so that it can be emptied in the winter for skateboarding,from the previous Owners. It has been featured in national forums for
having whatever technology it has to store the water. Not sure if that helps for any reason, but I am reachoing, as this is just a small
project turning into a big nightmare for my mother-in-law,who is on a very limited budget.
We are doing the work for free, but it is still a big financial hit that she's been saving up for.To find out the extra requirements on top of
this,that we have never heard of in the 10 years its been in effect in Atlantic Beach, is just a huge let down, as I am sure you can
understand.We are friends with our main competitors and they have never heard of this either, and have done many many permitted
driveways with square footage additions of over 400 sf.
Seems a poor time to decide to enforce this on a senior citizen with a limited budget who just happens to have a larger property.
Shouldn't mean her entire side yard should have to be dug out.when 76% of her property will still be left to absorb the water.What
about the people that have more than 50% lot coverage?There are monstrosities on small lots with variances for coverage that are
WELL over the city standards.They are more of a burden on the storm water system then her property with a driveway would be, and
STILL she is well under the impervious surface requirements. In fact, if she wanted to cover 50%of her property,there wouldn't even
be space left over according to your calculations to have a swale(sp?).What would you do in that case? Let it slide? In the code you
have the authority to allow her permit to pass, it is at your discretion. She is on a corner lot and will not affect any neighbors.This is not
an area known for flooding in the streets. I am asking for any willingness to work with her here. Please take a moment to reflect upon
the situation and see if there is any way to grant an exception, as is allowed per the LDC.
